Abstract

This study examines the current issue regarding default (customer negligence in sharia financing contracts), particularly in the AkadIjarah Muntahiyah bi al-Tamlik(IMBT), and analyze how the Religious Court (PA) implements sharia principles in its decisions on disputes. IMBT combines rent (lease) and the promise of transfer of ownership (completeness), often giving rise to disputes when customers fail to fulfill their installment payment obligations. The central issue is the harmonization between General Civil Law (especially the concepts of compensation and execution) and Sharia Economic Law (especially the principle of avoidingribaand achieve justiceshulh). The method used in this research is normative legal research which is analytical-descriptive in nature. The approach used in this research is the Legislation approach (Statute Approach). The research results indicate challenges in the application of sanctions due to default. Judges' decisions are required to not only be based on formal legal certainty but also reflect sharia values, such as avoiding fines that areusuryand considering the customer's good faith. This study concludes that the implementation of sharia principles in judicial decisions in IMBT default cases still requires consistency and stricter guidance from the Supreme Court to ensure substantive justice and sharia compliance for all parties.

Abstract

Amidst the proliferation of transnational ideologies and the phenomenon of religious instant-ism in the digital era, the preservation of Ahlussunnah wal Jama’ah (Aswaja) theology requires a pedagogical approach rooted in local wisdom. This research investigates the internalization of Asy'ariyyah creed values at Pondok Pesantren Al-Hikamussalafiyah Cipulus, Purwakarta, specifically through the study of the book ‘Aqaidul Iman by KH. Adang Badruddin (Abah Cipulus). Using a qualitative field research method, data were collected through in-depth interviews, participant observation of sorogan and lalaran activities, and manuscript analysis. The study reveals that ‘Aqaidul Iman serves as a strategic instrument of vernacularization of theology, transforming the classical text Tijan ad-Darari into Sundanese nadham (poetry) written in Pegon script. The internalization process follows a holistic trajectory: the transformation stage via the bandongan method for cognitive understanding; the transaction stage via the lalaran (collective chanting) tradition for affective habituation; and the trans-internalization stage, where theological values manifest as humility (tawadhu) and social tolerance. The research concludes that integrating the author’s charismatic authority (Rabithah) with the mnemonic efficacy of the local language creates a robust theological fortress that effectively shields santri from radicalism and superficial religious understanding.

Abstract

Qardh  financing in Islamic financial institutions in Indonesia faces a dilemma between its social function and the need for financial sustainability. The absence of a mechanism that allows institutions to obtain commercial certainty causes Qardh  to remain a cost center that is not developed institutionally. The study offers a Tiered Financing model that expressly separates the two layers of Qardh  financing as a social portfolio and Mudharabah as a commercial portfolio through contractual and temporal separation. The two are connected by Waʿad Mulzim, which serves as an instrument of bilateral commitment to reduce the risk of customer leakage while maintaining compliance with the prohibition of ta’alluq al-’uqud. A conceptual analysis of the structure of contracts, sharia standards, and regulatory implications shows that this tiered architecture provides a framework that can bridge the social and commercial goals of the institution in a balanced manner. This model also offers a theoretical contribution in the form of the integration of risk-governance mechanisms in the tabarru’ contract to improve institutional sustainability. The findings of this study suggest that Tiered Financing is a viable alternative to strengthen Qardh 's role in modern Islamic finance, while remaining within the corridor of core sharia principles.
