Abstract

Piutang merupakan hal yang umum dilakukan oleh pihak-pihak yang saling membutuhkan dalam jual beli baik barang maupun jasa. Hal ini dibutuhkan untuk kemudahan pelayanan dan pengadministrasian keuangan. Namun piutang harus dikelola sesuai dengan peraturan perundangan yang berlaku agar tidak ada pihak yang dirugikan dalam pelaksanaannya. Penelitian ini mengambil lokasi di UPTD Laboratorium Kesehatan Daerah Kota Balikpapan dengan metode deskriptif kualitatif. Pengumpulan data dilakukan melalui wawancara dan observasi terhadap pejabat pengelola piutang serta studi dokumen. Hasilnya, pengelolaan piutang di UPTD Laboratorium Kesehatan Daerah Kota Balikpapan telah sesuai dengan peraturan perundangan yang berlaku, baik di tahap perencanaan, pelaksanaan maupun solusi terhadap hambatan yang ditemukan. Hambatan yang ditemukan pun kurang berarti dan dapat diselesaikan dengan musyawarah mufakat tanpa harus melalui sengketa di pengadilan. Namun perlu dilakukan evaluasi kembali mengenai rincian pasal-pasal yang dituangkan dalam surat Perjanjian Kerja Sama, agar semua maksud dari kedua belah pihak dapat dijabarkan dengan lebih lengkap.

Abstract

In the era of financial technology, e-wallets have become a popular payment tool among e-commerce users aged 19-45. However, e-wallets face security issues, such as breach cases that harm users. Regulations such as PBI Number 20/6/PBI/2018 and POJK No. 6/POJK.07/2022 require organizers to ensure security and consumer protection, but their implementation is still in doubt. The purpose of this study is to analyze the legal protection of consumers from the risk of personal data security, the threat of fraud, and circumvention (cybercrime) in the e-wallet payment system. The method used in this research is normative research. Based on the principle of legality, cybercrimes such as data theft have violated the ITE Law, therefore a person's personal data must be protected according to the Ministry of Communication and Information and Bank Indonesia Regulations. According to Philipus M. Hadjon's theory of legal protection to overcome legal problems such as data theft on e-wallets, preventive and repressive measures are needed.

Abstract

The purpose of this study is to understand the impact of the implementation of the Personal Data Protection Law (PDP Law) on the management of consumer health data in Indonesia, with a focus on enhancing secure and confidential handling. In the midst of the rapidly evolving digitalisation era, the management of personal data, especially those related to health information, requires strict and effective legal regulation. This is becoming increasingly urgent given the increasing incidents of data leaks and privacy violations, one of which occurred in the leak of the Indonesian Ministry of Health's server which collected 6 million patient medical record data. The research method used is normative juridical with a conceptual approach and a statutory approach, where secondary data is broken down into three different types of legal materials, namely primary, secondary, and tertiary legal materials. The PDP Law and Consumer Protection Law are the primary legal sources, accompanied by the use of relevant literature as secondary legal sources as well as dictionaries and encyclopedias as tertiary legal materials to further explain. The novelty of this research lies in the comprehensive analysis of the existing regulations and their applicability in the health context, as well as considering the increasing public awareness of their rights to personal data. The results show that although challenges such as uneven technological infrastructure and lack of awareness among health staff still exist, the measures taken through the PDP Law have created a strong foundation for better health data protection in the future, improving security and confidentiality in health data management.

Abstract

Beauty clinics have become an integral part of modern lifestyles, offering aesthetic solutions to enhance self-confidence. However, alongside their popularity, several challenges have emerged, including health risks stemming from hazardous chemicals, malpractice, and inadequate professional competence. Widespread consumerism often overlooks safety aspects, driven by media-induced unrealistic beauty standards. In this context, legal protection for consumers utilizing beauty clinic services is of paramount importance. This study aims to analyze the legal liability of beauty clinics in safeguarding consumer rights, focusing on the application of justice principles. These principles encompass distributive justice, which demands equitable access to services without discrimination, and procedural justice, which ensures transparency and active consumer participation in medical decision-making. Employing a normative juridical method. The findings reveal that, despite existing regulations outlining the obligations of service providers, numerous beauty clinics fail to adhere to established standards. Consumers often suffer harm due to unsafe procedures or the use of unregulated beauty products. In such instances, the BPSK offers an effective mechanism for dispute resolution, providing mediation, conciliation, and arbitration services characterized by low costs and simplified procedures. From the perspective of justice, ensuring that all consumers have equal rights to clear information and safe services is imperative. Furthermore, strengthening consumer involvement in medical decision-making processes is critical to avoiding the dominance of paternalistic relationships between healthcare providers and patients. By enforcing robust legal protections and adopting a holistic approach to justice, consumer protection in beauty clinic services can be significantly enhanced. This would not only mitigate potential harm but also foster a more balanced relationship between consumers and service providers.

Abstract

Online loans are financial institutions that provide loans and borrowing of funds through digital technology. This study aims to examine the impact of using online loan services and the legal protection applied to online loan consumers. This study uses a normative legal method with a qualitative approach. The data used are secondary data obtained from laws and regulations, legal doctrine, related literature, and jurisprudence. Data collection techniques are carried out through document studies, while data analysis is carried out qualitatively by interpreting and connecting relevant legal data to examine legal protection for online loan consumers. The results of this study indicate that the use of online loans by consumers has positive and negative impacts. One of the positive impacts is providing significant economic development for the community and the negative impact is high interest rates. Legal protection for online loan consumers is regulated in the Financial Services Authority Regulation (POJK) Number 2 of 2023 which includes protection of assets, privacy, and consumer data; obligations and prohibitions for consumers and online loan actors; collection mechanisms carried out by online loan actors to consumers; and so on.

Abstract

It becomes a real polemic when a drug intended for health development to support national development actually becomes a serious threat to health itself. The purpose of this study is to answer the issue of responsibility for drugs that cause adverse effects on consumers. This research uses normative juridical method. In this research, it is found that the constitution has massively regulated the relationship that implies responsibility in terms of drugs that cause adverse effects to consumers. Based on the theory of causality, in addition to pharmaceutical companies that can be charged with absolute liability in accordance with the provisions of Article 19 of the Consumer Protection Law, the Food and Drug Supervisory Agency (BPOM) can also be blamed, especially if the elements of abuse of duty and negligence are met based on Presidential Regulation No. 80 of 2017 concerning BPOM.

Abstract

The current position of patients, which can be said to be equal to healthcare professionals, makes healthcare providers unable to ignore regulations that may conflict with criminal, civil, and administrative law. In cases of malpractice, patients can directly report and demand accountability. The problem in this research is that healthcare providers, healthcare professionals, and medical personnel can face legal consequences if proven to have provided healthcare services that do not comply with existing Professional Standards and Standard Operating Procedures. This research uses a normative juridical research method, relying on primary data sources in the form of laws and regulations related to the problem, namely Law No. 17 of 2023 concerning Health, Law No. 36 of 2014 concerning Health Workers, and Law No. 44 of 2009 concerning Hospitals. Secondary data sources include books, professional codes of ethics, law journals, theses, and dissertations that provide guidance and explanations regarding primary data sources. In Law Number 17 of 2023 concerning Health, Article 273 provides legal protection for healthcare professionals and medical personnel who perform medical actions in healthcare services as long as they comply with professional standards, professional service standards, Standards operational procedure, and professional ethics. It also seeks to resolve disputes resulting from negligence outside of court. This research is limited to a normative legal analysis, focusing on laws and regulations without empirical validation from case studies or direct interviews with affected professionals and patients. The study also does not explore international comparative law, which may provide broader insights into malpractice accountability.

Abstract

This paper analyzes the proposed policy of requiring vasectomy as a condition for receiving social assistance in Bandung from the perspective of health law as a human right. Using a normative juridical and philosophical approach, this study demonstrates that such a policy contradicts the principles of bodily autonomy and freedom guaranteed under both national and international law. The recent revision of the Health Law, namely Law No. 17 of 2023, strengthens the position of the right to health as part of human rights, which demands that any health intervention be based on consent rather than coercion.

Abstract

The development of law in the modern and post-modern era has brought significant epistemological consequences to the philosophical foundations that support it. In the midst of global disruption, the crisis of legitimacy of legal institutions, and the growing awareness of the importance of moral values and substantive justice, the philosophy of law is required to not only answer questions about “what the law is”, but also “why the law applies” and “how the law should be lived ethically”. This research aims to reconstruct the new direction of legal philosophy through a descriptive qualitative approach with a systematic literature review method. This study examines classic and contemporary works in legal philosophy, including the thoughts of Plato, Aristotle, Aquinas, Austin, Hart, Fuller, Dworkin, Habermas, to postmodern criticism in Critical Legal Studies and feminist legal theory. The findings show that the reduction of law to a mere normative system without an ethical-moral basis has created an acute normative crisis in contemporary legal praxis. This article proposes a transformative legal philosophy paradigm that not only emphasizes formal legality, but also integrates communicative rationality, public morality, and deliberative participation as the basis for the reconstruction of just and humane law. The implications of this approach provide a theoretical contribution to the development of a more holistic legal discourse, as well as presenting practical and managerial recommendations for policy makers in designing value-based regulations.

Abstract

Kasus dugaan malpraktik medis yang terjadi di Puskesmas Bolo, Kabupaten Bima, Nusa Tenggara Barat, pada tahun 2025, menarik perhatian publik setelah seorang balita bernama Aruni umur 1,5 Tahun mengalami pembengkakan hebat dan infeksi pada tangan kirinya pasca tindakan pemasangan infus. Menurut laporan keluarga, tindakan medis tersebut dilakukan tanpa persetujuan dan tidak sesuai dengan prosedur medis yang seharusnya. Kondisi korban yang memburuk ditandai dengan perubahan warna kulit dan pembengkakan, tidak ditindaklanjuti secara profesional oleh tenaga medis yang bertugas. Hal ini memicu laporan resmi ke pihak kepolisian dan audit internal oleh Dinas Kesehatan setempat. Sehingga memunculkan permasalahan yuridis terkait apakah tindakan tenaga medis tersebut dapat dikategorikan sebagai kelalaian dalam konteks hukum perdata. Penelitian ini bertujuan untuk menganalisis aspek pertanggungjawaban hukum, baik secara perdata maupun administratif, Pendekatan yang digunakan adalah yuridis normatif dan studi kasus. Dari analisis yang dilakukan, ditemukan bahwa apabila terbukti terjadi pelanggaran terhadap Standar Operasional Prosedur dan tidak terpenuhinya prinsip informed consent, maka tindakan tersebut dapat dikategorikan sebagai perbuatan melawan hukum, sehingga tenaga medis maupun pihak puskesmas dapat dimintai pertanggung jawaban atas dasar wanprestasi atau tort (delik) perdata, serta dikenai sanksi administratif dari instansi pembina. Studi ini menegaskan pentingnya penguatan sistem kontrol internal, peningkatan kompetensi tenaga medis.
