Abstract

Persons with mental disorders, legally recognized as persons with psychosocial disabilities, are entitled to fundamental constitutional rights, including equal treatment, freedom from discrimination, and a dignified life. However, despite guarantees under Indonesian law and the Convention on the Rights of Persons with Disabilities, the protection mechanism for individuals leaving psychiatric institutional care remains structurally inadequate, resulting in persistent social rejection and family abandonment. This study aims to evaluate the effectiveness of existing legal protections and identify the structural barriers that hinder full social reintegration. Using normative legal research with statutory, conceptual, and case-based approaches, the analysis focuses on Law Number 18 of 2014, Law Number 8 of 2016, and the Convention on the Rights of Persons with Disabilities. Findings indicate that the absence of firm penal sanctions for discriminatory acts, combined with deep-rooted social stigma and insufficient community-based reintegration support, renders current legal safeguards ineffective. The study concludes that comprehensive regulatory reform is needed, emphasizing the inclusion of strict sanctions and mandatory community support systems to ensure the realization of the right to full and dignified reintegration for persons with psychosocial disabilities.

Abstract

This study analyzes the BPJS Health referral procedure at the Kimia Farma Sumber Cirebon Clinic through an empirical qualitative approach. Data were collected through interviews, observations, and documentation studies to evaluate legal compliance, identify driving and inhibiting factors, and formulate recommendations for improvement. Findings indicate that, normatively, the clinic has complied with BPJS regulations, as demonstrated by staff’s good understanding of doctors’ authority and the use of the P-Care system. However, implementation in the field faces technical obstacles, such as the instability of the P-Care system, which triggers the use of temporary referral letters, as well as information gaps that cause patient confusion. It was concluded that legal compliance depends not only on normative compliance, but also on infrastructure support and effective communication. Strategic recommendations focused on three pillars: strengthening technological infrastructure, increasing human resource capacity through continuous training, and improving transparency and patient education on procedures to create synergy between legal compliance, service efficiency, and public accountability within the JKN framework.

Abstract

The promulgation of this law marks a paradigm shift in Indonesia’s health law system, emphasizing accountability, transparency, and patient safety as the core principles of healthcare service delivery. This study aims to analyze the legal implications of the enactment of Law Number 17 of 2023 on Health for the formulation of standard operating procedures and the implementation of risk management in hospitals. The method used in this research is library research with a normative juridical approach. The findings indicate that the changes in legal norms under Law Number 17 of 2023 have led to the necessity of adjusting hospital SOPs to be oriented toward risk analysis and patient safety. The implementation of risk management is now viewed as a legal obligation inherent in healthcare institutions rather than merely a managerial instrument. This research also reveals an urgent need for hospitals to establish legal risk management units to anticipate potential legal disputes and strengthen legal protection for medical personnel. The conclusion of this study emphasizes that the enforcement of the new Health Law brings positive implications in strengthening a legally grounded, professional, and equitable hospital governance system.

Abstract

Kasus dugaan malpraktik medis yang terjadi di Puskesmas Bolo, Kabupaten Bima, Nusa Tenggara Barat, pada tahun 2025, menarik perhatian publik setelah seorang balita bernama Aruni umur 1,5 Tahun mengalami pembengkakan hebat dan infeksi pada tangan kirinya pasca tindakan pemasangan infus. Menurut laporan keluarga, tindakan medis tersebut dilakukan tanpa persetujuan dan tidak sesuai dengan prosedur medis yang seharusnya. Kondisi korban yang memburuk ditandai dengan perubahan warna kulit dan pembengkakan, tidak ditindaklanjuti secara profesional oleh tenaga medis yang bertugas. Hal ini memicu laporan resmi ke pihak kepolisian dan audit internal oleh Dinas Kesehatan setempat. Sehingga memunculkan permasalahan yuridis terkait apakah tindakan tenaga medis tersebut dapat dikategorikan sebagai kelalaian dalam konteks hukum perdata. Penelitian ini bertujuan untuk menganalisis aspek pertanggungjawaban hukum, baik secara perdata maupun administratif, Pendekatan yang digunakan adalah yuridis normatif dan studi kasus. Dari analisis yang dilakukan, ditemukan bahwa apabila terbukti terjadi pelanggaran terhadap Standar Operasional Prosedur dan tidak terpenuhinya prinsip informed consent, maka tindakan tersebut dapat dikategorikan sebagai perbuatan melawan hukum, sehingga tenaga medis maupun pihak puskesmas dapat dimintai pertanggung jawaban atas dasar wanprestasi atau tort (delik) perdata, serta dikenai sanksi administratif dari instansi pembina. Studi ini menegaskan pentingnya penguatan sistem kontrol internal, peningkatan kompetensi tenaga medis.

Abstract

Kegiatan ini berangkat dari kebutuhan Fakultas Hukum Universitas Islam Nusantara untuk memperkuat capaian prestasi mahasiswa yang masih menghadapi kendala motivasi belajar, keterbatasan literasi digital dalam penyusunan karya ilmiah, serta kurangnya pemahaman terhadap prosedur kompetisi dan rekognisi prestasi. Permasalahan tersebut berdampak pada belum optimalnya konversi potensi mahasiswa menjadi capaian prestasi yang terstruktur. Kegiatan ini menawarkan penguatan sinergi antara peran dosen dan dukungan institusional melalui pendekatan Participatory Action Research (PAR) yang diintegrasikan dengan mentoring intensif, coaching clinic penulisan proposal, dan service learning. Pelaksanaan dilakukan melalui tahapan identifikasi kebutuhan, pendampingan teknis, serta monitoring capaian prestasi mahasiswa. Hasil kegiatan menunjukkan peningkatan kesiapan mahasiswa dalam mengikuti kompetisi, perbaikan kualitas karya ilmiah, serta meningkatnya partisipasi mahasiswa dalam kegiatan akademik dan non-akademik. Dampak konkret tercermin dari keterlibatan mahasiswa dalam Program Kreativitas Mahasiswa (PKM), perolehan penghargaan pada konferensi ilmiah mahasiswa, serta capaian prestasi olahraga tingkat regional dan nasional. Temuan ini menunjukkan bahwa integrasi pendampingan dosen dan kebijakan institusi yang suportif efektif dalam memperkuat ekosistem prestasi mahasiswa yang berkelanjutan di era Society 5.0.

Abstract

The post-truth era creates uncertainty in the search for absolute truth, where objective facts are less influential in shaping public opinion than emotions and personal beliefs. This phenomenon has a negative impact on the democratic process, public perception of democratic institutions, and legal justice. The challenge of distinguishing facts from fabricated opinions affects law enforcement and the integrity of the democratic process. The research method used in this article is normative legal research that examines law as norms or rules that apply in society, focusing on document analysis and the use of legal sources. This research aims to find legal norms that are relevant in answering certain legal challenges or problems, as well as to produce arguments and theories as guidelines in resolving legal cases using secondary data (library research or document studies). In the post-truth era, law remains an important foundation in maintaining justice and order. Although challenges to political correctness can shake public confidence, the roots of law remain strong. The post-truth phenomenon is an irrational phenomenon, while legal truth (ontologically, epistemologically, and axiologically) is related to rational things, so it is quite difficult to debate and bring these two things together. Therefore, it is important to position the two different things in a position where we can find the most basic thing, both philosophically and legally.

Abstract

Desa Cibunar, Kecamatan Rancakalong, Kabupaten Sumedang memiliki potensi lokal yang besar berupa keanekaragaman budaya, usaha mikro, kecil, dan menengah (UMKM), serta hasil pangan lokal. Namun, potensi tersebut belum sepenuhnya dipahami dan dimanfaatkan secara optimal oleh masyarakat, terutama dalam aspek pengelolaan, promosi, dan keberlanjutan. Kegiatan pengabdian kepada masyarakat ini bertujuan untuk meningkatkan pengetahuan dan kesadaran masyarakat melalui kegiatan sosialisasi dan edukasi terkait potensi budaya, UMKM, dan pangan lokal Desa Cibunar. Metode pelaksanaan kegiatan dilakukan melalui pendekatan partisipatif berupa sosialisasi, edukasi, pendampingan, serta keterlibatan langsung dalam aktivitas masyarakat, termasuk kegiatan pendidikan, UMKM, kesehatan, dan pelestarian budaya. Sasaran kegiatan meliputi masyarakat desa, pelaku UMKM, anak-anak usia sekolah, serta kader masyarakat. Hasil kegiatan menunjukkan adanya peningkatan pemahaman masyarakat terhadap pentingnya pelestarian budaya lokal, pengembangan UMKM berbasis potensi desa, serta diversifikasi dan pemanfaatan hasil pangan lokal. Kegiatan sosialisasi juga mendorong partisipasi aktif masyarakat dalam kegiatan pendidikan, kesehatan, dan ekonomi kreatif, serta memperkuat sinergi antara mahasiswa dan masyarakat desa. Simpulan dari kegiatan ini adalah bahwa sosialisasi dan edukasi yang dilakukan secara partisipatif mampu menjadi strategi efektif dalam mendukung pemberdayaan masyarakat desa berbasis potensi lokal. Kegiatan ini diharapkan dapat menjadi model pengabdian masyarakat yang berkelanjutan dan direplikasi di desa lain dengan karakteristik serupa.

Abstract

Online information exchange has become commonplace in today's digital era, especially in the health sector. However, this also raises concerns regarding personal data privacy, especially health data. This study analyses consumers' perceptions and practices of health data privacy protection. The empirical method is used in this research. The data collection techniques used were literature studies, direct observation, and interviews. After the data is obtained, it is analysed through the stages of reduction, presentation of data, and conclusion. The results showed that consumers in Jakarta have a high level of perception of the importance of health data privacy; consumers understand that health data is sensitive information that needs to be protected. The law regarding the protection of consumer health data privacy in Indonesia is Law No. 27 of 2022 concerning Personal Data Protection. Practices in carrying out the personal data protection function by officers involve providing information and consultation to those in control of personal data to ensure compliance with the Personal Data Protection Law, monitoring to ensure that the rules applied by those in control of individual data are by the provisions of the applicable requirements, providing advice regarding the impact of personal data protection as well as monitoring the performance of individual data controllers and coordinating and taking action on issues related to activities in processing personal data.

Abstract

This research analyzes the effectiveness of legal protection for consumers in digital business transactions in Indonesia through the principle of data portability, focusing on the financial technology and electronic commerce sectors. Indonesia ranks thirteenth globally in data breaches, with around 156.8 million personal data records leaked from 2004 to April 2024. Since 2017, the Financial Services Authority has closed more than eleven thousand illegal financial entities, many of which misused consumer data. These problems show the urgent need for stronger rules to give consumers better control over their personal information. The study aims to examine how the principle of data portability is applied in practice and how the Consumer Protection Law and the Personal Data Protection Law can work together to create a safer digital environment. It uses a normative juridical method with statutory, comparative, and case study approaches. The findings reveal that most businesses lack proper systems for data transfer and have not reached international standards. The main obstacles are the absence of clear technical guidelines, limited supervision resources, and low awareness among companies. In conclusion, stronger government regulations, better infrastructure, multi-stakeholder support, and public education are needed to make data portability a real tool for protecting digital consumers and building trust in Indonesia’s growing digital economy.
