Abstract

Era Covid-19 kemarin semakin membuka dan membawa kita pada sistem kesehatan yang baru, reformasi system kesehatan yang ditunjang dengan kemajuan teknologi kini sudah tidak terelakan, pengenalan pelayanan Kesehatan berbasis digital jarak jauh (telemedicine) semakin menjamur dimasyarakat. Pemanfaatan teknologi informasi saat ini juga sangat luas, namun aspek keamanan data serta perlindungan pasien dalam hal ini juga sangat rentan. Perlindungan konsumen dari kejadian tidak diinginkan dalam praktik konsultasi Kesehatan ini sangat perlu diawasi oleh hukum yang jelas, bagaimana alur pelaporan serta pengaduan pasien jika mengalami kerugian dalam layanan ini. Keamanan data yang dipakai pada digitalisasi ini juga rentan dengan kejahatan cyber. Penulisan jurnal hukum perdata ini bertujuan untuk melakukan analisis terhadap hukum perdata yang berlaku mengenai perlindungan konsumen dalam pelayanan kesehatan berbasis digital jarakjauh (telemedicine) Hasil analisis pada penulisan jurnal ini menunjukkan perlindungan hukum terhadap praktik kedokteran ini perlu adanya kejelasan yang tertuju langsung pada pelaksanaan praktik telemedicine sehingga keamanan dari penggunan baik dalam hal data maupun kemungkinan kelalaian medis bisa dihindari.

Abstract

In an effort to tackle corruption that impedes Indonesia's social and economic progress, this service project focuses on the effectiveness of anti-corruption counseling to increase integrity and transparency among students, education personnel, and the community. Using Service Learning methodology, this activity involves counseling integrated in the learning process and community service delivery, with the cooperation of the West Java High Prosecutor's Office to ensure the relevance of the material. Results showed an increase in participants' awareness and competence in identifying and countering corruption, with 85% reporting increased capacity. The outreach also successfully promoted a culture of integrity and triggered local initiatives for greater transparency in resource management, strengthening the legal and institutional framework through policy advocacy. The findings support the need for expansion of similar programs and increased collaboration between sectors to strengthen corruption eradication efforts in Indonesia.

Abstract

The prepaid card industry in Indonesia, particularly gift cards, has exhibited significant growth in recent years. In 2023, the industry is projected to grow by 10.6% annually, reaching an estimated value of approximately US$1,958.4 million. The Indonesian gift card market recorded a Compound Annual Growth Rate (CAGR) of 11.4% from 2018 to 2022. The susceptibility of gift cards to fraud is a significant concern due to several intrinsic characteristics. This study aims to identify the various challenges in gift card payment fraud and analyze preventative strategies that could prove effective in addressing this issue. The research method used is normative juridical with a statute approach, case approach, analytical approach, and comparative approach. The conclusion of this paper emphasizes the importance of a holistic approach to addressing payment fraud using gift cards. The significant growth of the gift card industry in Indonesia must be accompanied by improved security and consumer education. This comprehensive approach is expected to close the loopholes exploited by fraudsters and result in effective consumer protection.

Abstract

Islamic boarding schools must be a safe and friendly place for students and female students. Pesantren educational institutions must be perpendicular to the objectives of the establishment of the pesantren, among others, teaching the values ​​of Islamic teachings in order to improve and make society much better. However, on the other hand, there are several Islamic boarding schools that are suspected of having committed a sexual crime against their students. What is more worrying is that the sexual crime was committed by the teacher or instructor of the pesantren. There needs to be preventive efforts to respond to the number of sexual crimes in Islamic boarding schools so that these incidents do not happen again. In addition to carrying out legal protection for victims which is one form of protection, prevention efforts are also part of the concept of protecting students and female students in Islamic boarding schools. The purpose of this study was to find out how the urgency of regulating efforts to prevent sexual violence in Islamic Boarding Schools and the second to realize the sexual crime prevention model at Islamic Boarding Schools in protecting santri and female students. This research was conducted using descriptive analysis method, namely providing researched data about the condition of the object under study, namely victims and the concept of preventing sexual crimes in Islamic Boarding Schools associated with laws and regulations, and normative juridical methods. The data obtained from library research is supported by field research and then analyzed qualitatively. Based on the results of the study, it was concluded that efforts to prevent sexual violence from Islamic boarding schools could be carried out by strengthening state, government and government supervision of Islamic boarding schools, conducting legal counseling on the dangers of sexual crimes so that students and female students could act when receiving sexual crimes, making a sexual crime complaint post at the Institute. Islamic boarding school education and supervision of Islamic boarding schools by the Ministry of Religion.

Abstract

This article describes the application of the principle of informed consent in civil law, focusing on case studies of internal reduction and fixation operations (ORIF). The research method uses a normative legal approach by analyzing related laws and regulations, related court decisions, and relevant legal literature. Interviews with medical legal practitioners and experienced physicians were conducted to gain practical insight into doctor-patient agreements in ORIF actions. The importance of a holistic and adaptive approach in implementing the principle of informed consent in Indonesia not only covers legal aspects, but also considers cultural, social, and economic factors. This requires active involvement from all relevant parties, as well as increased awareness of patient rights and physician responsibilities. By understanding these challenges, we can improve informed consent systems in the context of ORIF, create a more transparent healthcare environment, and safeguard the principles of patient well-being in medical practice. The results of this study are expected to contribute to a further understanding of the complexities of civil law in the context of informed consent, strengthen ethical principles in medical practice, and provide guidance for stakeholders, including physicians and medical law practitioners with a focus on ORIF actions.

Abstract

In realizing Universal Health Coverage (UHC), Indonesian government has launched a national health insurance program (JKN) organized by the Health Social Security Administering Agency (BPJS) starting from January 01, 2014. The policy of determining outpatient episodes for patients in the emergency department (ED) who receive treatment for less than 6 hours raises problems related to claims for services provided by service providers. Hospitals are required to provide health services in emergency situations to save lives and prevent disabilities, while also having profit objectives. This research aims to describe the output and impact in relation to the regulations. The research uses normative legal research methods with statute approach, conceptual approach and a non-judicial case study approach, presenting several cases related to discrepancies between ER services provided and claims paid, especially for patients who die in the ER within 6 hours, which is suspected to cause hospitals to be selective in handling emergency patients. The Minister of Health Regulation No. 27 of 2014 regarding INA-CBG creates dilemmas and challenges for hospitals in providing optimal services for emergency cases in the ER.

Abstract

AbstrakPenelitian ini mengevaluasi perlindungan hukum yang dapat diakses oleh konsumen dalam transaksi perdagangan elektronik dan metode penyelesaian sengketa yang diterapkan dalam kasus pelanggaran kontrak. Metode yang digunakan adalah pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analitis, menggunakan data sekunder yang mencakup hukum primer, sekunder, dan tersier sebagai sumber informasi. Analisis data dilakukan secara kualitatif. Temuan penelitian menunjukkan bahwa regulasi hukum terkait perlindungan konsumen E-commerce diatur dalam Undang-Undang No. 8/1999 tentang Perlindungan Konsumen, khususnya pada pasal 19, 20, 21, 24, dan 26. Pelaksanaan perlindungan ini melibatkan kerja sama antara pemerintah, Badan Perlindungan Konsumen Nasional, dan Lembaga Perlindungan Konsumen Swadaya Masyarakat. Untuk menyelesaikan sengketa terkait wanprestasi, hukum menyediakan dua jalur, yaitu litigasi dan non-litigasi, sebagai solusi yang dapat ditempuh. AbstractThis research evaluates the legal protection accessible to consumers in electronic commerce transactions and the dispute resolution methods applied in cases of breach of contract. The method used is a normative juridical approach with analytical descriptive research specifications, using secondary data that includes primary, secondary, and tertiary laws as sources of information. Data analysis was conducted qualitatively. The research findings show that legal regulations related to E-commerce consumer protection are regulated in Law No. 8/1999 on Consumer Protection, specifically in articles 19, 20, 21, 24, and 26. The implementation of this protection involves cooperation between the government, the National Consumer Protection Agency, and the Non-Governmental Consumer Protection Agency. To resolve disputes related to default, the law provides two paths, namely litigation and non-litigation, as solutions that can be pursued.

Abstract

This study aims to explore the application of consumer protection law to health access services from the perspective of society. The research method used is qualitative with a descriptive approach. Primary data were obtained through interviews and observations, while secondary data were obtained from relevant literature reviews. The results showed that healthcare users in community health centers experienced variations in satisfaction, selection factors, quality of service, problems faced, and consumer protection. The main factors influencing the selection of a health center are location, quality of service, and reputation. Although most respondents were satisfied with the friendly and efficient service, they also complained of a lack of information and slow administrative processes. Variations in assessments of service quality include medical staff competence, waiting times, and levels of coordination. Problems include excessively long waiting times, lack of clear information, and lack of communication between medical staff and administration. Consumer protection is also a concern, especially related to access to patient rights information and the fulfillment of these rights.

Abstract

Legal protection for tumor surgeons in facing chemotherapy side effects in breast cancer patients is essential in contemporary medical practice. This study employed a narrative method and legal approach to explore the legal protection available to tumor surgeons in addressing risks and side effects during chemotherapy services. The narrative method was used to explore the role of the law in protecting tumor surgeons and providing a clear framework for addressing side effects in chemotherapy services. Literature analysis regarding medical practice standards, professional responsibilities, and relevant legal cases were used to formulate a comprehensive perspective of this legal protection. The research highlights the need for meticulous documentation of procedures, risks, and patient consent before undergoing chemotherapy. Additionally, legal protection also depends on adherence to applicable medical practice standards and effective communication between tumor surgeons and patients. In conclusion, the understanding of tumor surgeons is needed for the legal implications of their medical practices, including in the context of chemotherapy services. Thus, the use of narrative methods in this study provides valuable insights for tumor surgeons to protect themselves and provide safe and quality services to breast cancer patients.

Abstract

Pelayanan kesehatan adalah aspek penting dalam kehidupan masyarakat, dan kontrak pelayanan kesehatan menjadi instrumen hukum yang memainkan peran kunci dalam pengaturan hubungan antara pasien dan penyedia layanan kesehatan. Studi ini bertujuan untuk menginvestigasi aspek hukum dalam kontrak pelayanan kesehatan dengan fokus pada kewajiban dan hak pasien. Penelitian ini menggunakan metode analisis kasus dengan mengambil beberapa studi kasus sebagai sampel untuk mencapai pemahaman yang komprehensif tentang perjanjian pelayanan kesehatan. Hasil analisis menunjukkan bahwa kontrak pelayanan kesehatan memiliki peran signifikan dalam menjaga keseimbangan hak dan kewajiban antara pasien dan penyedia layanan. Kewajiban dan hak pasien dalam kontrak pelayanan kesehatan mencakup hak untuk mendapatkan perawatan yang berkualitas, hak untuk informasi yang jujur dan transparan, dan hak untuk mengajukan keluhan serta tuntutan jika terjadi ketidakpatuhan. Selain itu, studi ini juga mengidentifikasi tantangan dalam penerapan aspek hukum dalam kontrak pelayanan kesehatan, seperti masalah kepatuhan, perlindungan data pasien, serta penyelesaian sengketa. Oleh karena itu, diperlukan perbaikan regulasi dan kerangka hukum yang lebih kuat untuk memastikan pemenuhan hak pasien dan kewajiban penyedia layanan kesehatan. Penelitian ini memberikan wawasan yang mendalam tentang pentingnya kontrak pelayanan kesehatan sebagai alat hukum yang melindungi pasien, serta menggarisbawahi peran hukum dalam menjaga integritas sistem pelayanan kesehatan. Hasil penelitian ini dapat digunakan sebagai landasan untuk perbaikan dan perubahan kebijakan dalam bidang hukum perdata kesehatan, dengan tujuan akhir untuk memastikan pasien mendapatkan pelayanan yang layak dan bermutu sesuai dengan hak-hak mereka.
