Abstract

This research explores the regulation of child custody for minors under Indonesian law following divorce, based on Decision Number 3208/pdt.G/2020/PA.Krw. Divorce entails the allocation of custody to one of the separating partners, either the mother or the father. Additionally, parents are obliged to educate their children until they reach the age of 18 or marry. The study adopts a normative juridical method, finding that the regulation of child custody for minors is outlined in Article 105 of the Compilation of Islamic Law, granting a mother the right to raise a child who is not yet mature (mumayyiz) or under 12 years old, while a mature child is returned to them. However, in divorce cases, these rules may not apply, and judges have the discretion to consider the child's interests under Law Number 1, Article 41, with custody potentially revoked under Law Number 1 of 1975, Article 45(1). Custody of minors under Islamic Law is governed by Law Number 23 of 2002 concerning Child Protection, amended by Law Number 35 of 2014, Article 105, which assigns custody of children under 12 to their mothers, yet court rulings may favor fathers.

Abstract

AbstrakHubungan Industrial Pancasila mengacu pada konsep hukum ketenagakerjaan Indonesia yang sarat dengan nilai-nilai Pancasila. Redundansi berarti PHK antara pegawai atau karyawan dengan perusahaan atau kontraktor. Uraian singkat kasus yang penulis lakukan yaitu pemecatan karyawan Garden Palace Hotel Surabaya karena perusahaan dinyatakan pailit oleh Pengadilan Niaga Surabaya, karena buruknya keadaan keuangan perusahaan sehingga tercapai efisiensi. Karyawan yang terkena PHK berhak mendapatkan uang pesangon secara mencicil. Disepakati pada 29 Maret 2021. Namun hasilnya tidak sesuai dengan kesepakatan berdasarkan asas Pancasila bahwa pelaksanaan hak-hak agregat diatur dengan undang-undang. peraturan pemerintah dan kontrak kerja. Dalam putusan tersebut, penulis berkesimpulan bahwa dalam hal ini majelis hakim telah mematuhi Pasal 165 UU No 13/2003 , dimana hak pemberhentian pegawai apabila perusahaan bangkrut adalah: 2x PHK + 1x panjang. biaya layanan + hak pesangon.AbstractPancasila Industrial Relations refers to the concept of Indonesian labor law which is full of Pancasila values. Redundancy means termination of employment between an employee or employees and the company or contractor. A brief description of the case that the author did, namely the dismissal of Garden Palace Hotel Surabaya employees because the company was declared bankrupt by the Surabaya Commercial Court, due to the poor financial condition of the company so that efficiency was achieved. Employees who are dismissed are entitled to severance pay in installments. It was agreed on March 29, 2021. However, the result is not in accordance with the agreement based on the principle of Pancasila that the implementation of aggregate rights is regulated by law. government regulations and employment contracts. In this decision, the author concludes that in this case the panel of judges has complied with Article 165 of Law Number 13 Year 2003, where the right to dismiss employees if the company goes bankrupt is: 2x layoff + 1x long. service fee + severance pay rights.

Abstract

Public housing credit is a program aimed at addressing the housing backlog in Indonesia, yet its implementation faces various challenges. This research focuses on two main issues: (1) What happens to public housing loans when banks go bankrupt? (2) How can consumer issues be resolved when housing loans default? The study uses a normative judicial method. The findings reveal that while the People's Housing Credit (KPR) helps people acquire homes, significant risks arise if credit institutions go bankrupt or debtors default. In cases of default or bank bankruptcy, debtors must still fulfill their credit obligations. Consumer protection is outlined in the 1999 Consumer Law, which includes exit clauses in credit agreements. The government, through the Deposit Insurance Corporation (LPS), can rescue or liquidate banks according to Law No. 24 of 2004. Moreover, drafting fair contracts, offering credit restructuring, and providing insurance options can better protect debtors than asset auctions. Additionally, applying the principle of prudence in credit assessments, as per the Banking Law, is crucial to minimizing default risks. Stricter regulations and robust legal protections are essential for mortgages to effectively help people own homes while ensuring financial and legal stability.

Abstract

Introduction: Illegal logging is a critical issue that harms the environment, economy, and society. This activity results in forest degradation, increases the risk of natural disasters, and undermines the economic potential of sustainable natural resource management.Purposes of the Research: This study aims to analyze the environmental impacts of illegal logging and the penalties imposed on offenders under applicable laws.Methods of the Research: The study employs a normative juridical method, focusing on the legal framework surrounding illegal logging. The analysis highlights the environmental and economic consequences of illegal logging and evaluates the effectiveness of law enforcement measures.Results of the Research: Illegal logging leads to environmental degradation, including heightened risks of flooding and landslides due to soil instability and reduced water absorption. Economically, it diminishes potential revenue from sustainably managed natural resources. Offenders may face sanctions such as fines, compensation, and rehabilitation costs. Strong law enforcement and collaboration between the government, NGOs, communities, and the private sector are essential for effective forest protection.

Abstract

Restorative justice is an alternative approach to resolving legal conflicts, including defamation cases, which emphasizes peaceful settlement outside the court. This process involves cooperation among the perpetrator, victim, families, and the community to find a fair solution. This research highlights the importance of implementing restorative justice in handling defamation cases, which often cause psychological harm to victims, especially in the digital era where the internet and information technology facilitate the unlimited dissemination of information. Currently, the enforcement of laws, particularly regarding defamation offenses, is frequently criticized for failing to provide full justice, especially when imprisonment is imposed. Authorities often use articles related to defamation and insults in the Indonesian Criminal Code (KUHP), such as Articles 310 and 311, along with Law No. 11 of 2008 on Electronic Information and Transactions (ITE), as the basis for legal action. However, this approach neglects the aspects of recovery for victims and rehabilitation for offenders. This study aims to understand how restorative justice can be applied to defamation cases via social media, focusing on mediation aimed at achieving peace among the involved parties. The methodology employed is normative juridical research, with an analysis of relevant legislation. The findings indicate that a restorative approach can offer a fairer and more humane solution to defamation, particularly in the digital era. The implications of this research highlight the need to integrate restorative justice within the criminal justice framework, especially regarding cybercrimes.

Abstract

Local governments are required to build public facilities and spaces for the benefit of the community. The success of a government is measured by its ability to construct safe and comfortable facilities. Public facilities must be maintained to ensure community comfort. The Civil Service Police Unit (Satpol PP) of Karawang Regency deploys its members in public spaces to maintain order. This qualitative research uses an empirical juridical approach to understand the roles and challenges of Satpol PP. The findings aim to improve the effectiveness of Satpol PP in maintaining public order in open spaces.

Abstract

The delivery pf 3 kg LPG fuel has a great effect on the survival of the community, but the distribution is not in accordance with the standards, it can cause problems such as misuse of distribution, triggering criminal acts and can cause a scarcity of 3 kg LPG gas supply. The problem is how effective is the distribution of 3kg cylinder liquified petroleum gas (LPG) on target based on Presidential Regulation Number 38 of 2019 concerning the Supply, Distribution, and Pricing of Liquefied Petroleum Gas for Fishing Vessels for Target Fishermen and Water Pump Machines for Target Farmers and How the Challenges in Distributing 3kg Cylinder Liquified Petroleum Gas (LPG) Cylinders Are Right on Target. Qualitative Research Method using the Normative Juridical approach method. The results of the research are based on the Presidential Regulation of the Republic of Indonesia Number 38 of 2019 concerning the Supply, Allocation, and the rates for Liquefied Petroleum Gas for fishing boats aimed at fisherman and water pump machinery designed for farmers, it’s  stated that the provision and distribution of  LPG for target fishermen’s fishing boats and target farmers water pumping equipment use 3 Kg LPG Cylinders for households and micro businesses. The challenge in distributing 3kg LPG Cylinders on Target is that the Government of Indonesia continues to strive to transform LPG subsidy policies that are more targeted. One of the steps is to change the LPG subsidy scheme from originally commodity-based to individual-based. Abstract

This research investigates the implementation of smart contracts in the Indonesian property sector, examining the legal opportunities and challenges involved. Blockchain technology offers high transparency, efficiency, and security in property transactions, but faces regulatory and infrastructural hurdles. The aim of this research is to explore the related legal dynamics, identify socio-economic impacts, and offer sustainable solutions. The research method employed is a qualitative legal approach to gather and analyze data. The findings indicate that although blockchain can expedite transaction processes and enhance transparency, the legal validity of smart contracts and consumer protection remain major issues. Regulatory updates and increased awareness of data security are necessary to optimize the adoption of this technology in Indonesia.Keywords: Blockchain., Property law., Regulation., Smart contracts., Transparency

Abstract

The state holds constitutional responsibility in the field of labor by providing legal protection to ensure legal certainty for individuals involved, particularly in the context of employing foreign labor. However, such protection applies only to foreign workers who meet the legal standing requirements in Indonesia. This research addresses the case of unilateral termination of employment against Stephane Baudoin by PT Origin Resort Lombok. Utilizing a normative juridical method, the findings indicate Baudoin's entitlement to legal recourse due to fulfilling the criteria of legal standing in labor matters. The appellate decision of the Supreme Court confirms PT Origin Resort Lombok's violation of the Job Creation Law. This study aims to contribute to the literature on the protection of foreign workers, focusing on industrial relations disputes and legal safeguards. Keywords: Foreign Workers, Industrial Relations Disputes, Legal Protection

Abstract

ABSTRACTThe environment is a place for humans to live, actively and have an important role to achieve and improve their prosperity. However, the main challenges for the environment come from two main sources: unsustainable use of natural resources and environmental pollution, especially by pollution. Air pollution caused by Steam Power Plant (PLTU) in Jakarta is a serious problem affecting air quality and public health. The role of the government is very important in addressing the negative impact of PLTU on the environment and public health. Strict supervision and regulations of the Power Plant are governed under various regulations, such as Law No. 32 of 2009 on Environmental Protection and Management and Government Regulation No. 41 of 1999 on Air Pollution Control. In addition, the Governor Regulation of Jakarta No. 66 Year 2019 also provides a framework of supervision of air pollution in Jakarta. The impact of air pollution produced by the PLTU includes environmental pollution and a wide range of public health problems. Greenhouse gas emissions and harmful particulates from PLTU can disrupt ecosystems, cause extreme climate change, and cause respiratory disorders and other diseases in humans. Therefore, resolute and sustainable actions are required, including increased use of clean technology and effective enforcement, to reduce the negative impact of air pollution by the PLTU in Jakarta. Keywords: Air Pollution, Government Role, PLTU ImpactABSTRAK Lingkungan adalah suatu tempat untuk manusia tinggal, beraktifitas dan mempunyai peranan yang penting untuk mencapai dan meningkatkan kemakmurannya. Namun, tantangan utama bagi lingkungan berasal dari dua sumber utama yaitu penggunaan sumber daya alam secara tidak berkelanjutan dan pencemaran lingkungan, khususnya oleh polusi. Polusi udara yang disebabkan oleh Pembangkit Listrik Tenaga Uap (PLTU) di Jakarta menjadi masalah serius yang mempengaruhi kualitas udara dan kesehatan masyarakat. peran pemerintah sangatlah penting dalam mengatasi dampak negatif dari PLTU terhadap lingkungan dan kesehatan Masyarakat. Pengawasan dan regulasi yang ketat terhadap PLTU diatur dalam berbagai peraturan, seperti Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup serta Peraturan Pemerintah Nomor 41 Tahun 1999 tentang Pengendalian Pencemaran Udara. Selain itu, Peraturan Gubernur DKI Jakarta Nomor 66 Tahun 2019 juga memberikan kerangka pengawasan terhadap polusi udara di Jakarta. Dampak dari polusi udara yang dihasilkan oleh PLTU mencakup pencemaran lingkungan dan berbagai masalah kesehatan masyarakat. Emisi gas rumah kaca dan partikulat berbahaya dari PLTU dapat mengganggu ekosistem, menyebabkan perubahan iklim ekstrem, dan menyebabkan gangguan pernapasan serta penyakit lainnya pada manusia. Oleh karena itu, tindakan tegas dan berkelanjutan diperlukan, termasuk peningkatan penggunaan teknologi bersih dan penegakan hukum yang efektif, untuk mengurangi dampak negatif polusi udara oleh PLTU di Jakarta Kata kunci: Polusi Udara, Peran Pemerintah, Dampak PLTU
