Abstract

Artikel ini bertujuan mengevaluasi sejauh mana keadilan prosedural terwujud dalam pemberian bantuan hukum prodeo bagi pihak tidak mampu di Indonesia. Melalui pendekatan studi literatur, analisis difokuskan pada regulasi, implementasi, serta hambatan dalam mekanisme perkara prodeo sebagai sarana akses terhadap keadilan. Temuan menunjukkan bahwa meskipun kerangka hukum telah menjamin hak atas bantuan hukum cuma-cuma, realisasi di lapangan kerap terkendala oleh birokrasi yang rumit, kurangnya sosialisasi, serta ketidakkonsistenan penanganan perkara oleh aparat peradilan. Akibatnya, prinsip keadilan procedural yang menekankan kesetaraan, transparansi, dan partisipasi bermakna belum sepenuhnya terpenuhi. Artikel ini menegaskan perlunya reformasi administratif dan penguatan kapasitas lembaga penegak hukum agar bantuan hukum prodeo benar-benar menjadi instrumen efektif dalam menjamin akses keadilan bagi kelompok marginal.

Abstract

The rapid advancement of digital technology has fundamentally transformed civil legal interactions, making electronic documents such as instant messages, online transactions, and digital contracts primary forms of evidence in many civil disputes. However, their admissibility in judicial proceedings remains fraught with challenges concerning formal and material validity. This study aims to identify juridical and technical obstacles in digital evidence and to formulate an ideal model for civil procedural law that ensures reliable electronic proof. A normative-juridical approach with qualitative analysis was employed, combining doctrinal research through legislative review, jurisprudence, and scholarly literature with case studies of court decisions involving electronic evidence, particularly in divorce disputes. The findings reveal that inconsistent judicial treatment stems from the absence of specific procedural rules in Indonesia’s civil procedure framework still rooted in colonial-era HIR and RBg alongside limited digital infrastructure and low technological literacy among judicial actors. In response, the study proposes an integrated legal construction model featuring explicit provisions in the upcoming Civil Procedure Code, adoption of the functional equivalence principle, institutionalization of digital forensic experts in litigation, and procedural safeguards for vulnerable parties. The research concludes that only through holistic reform of the evidentiary paradigm can Indonesia’s civil justice system guarantee fairness, legal certainty, and relevance in the digital era.

Abstract

Default judgments (verstek) are commonly applied in Indonesian civil proceedings to address court backlogs, yet they risk violating defendants' procedural rights due to ineffective summons verification under HIR Articles 126-129. This study aims to analyze how verstek potentially breaches audi alteram partem and due process principles while identifying normative gaps enabling plaintiff abuse. Employing a juridical-normative approach with library research, the population comprises civil procedure regulations (HIR, Rv, UU No. 48/2009), Supreme Court decisions, and recent literature (2021-2025); purposive sampling selects relevant primary and secondary legal materials. The researcher serves as the key instrument, utilizing doctrinal, grammatical, systematic, and thematic analysis techniques. Findings reveal ambiguities in "valid summons" definitions, weak verification mechanisms, and absent sanctions, leading to procedurally flawed judgments that undermine fairness. In conclusion, verstek requires reform via RUU KUHAPerdata to mandate tracked notifications and stricter safeguards, balancing efficiency with justice.

Abstract

Civil court decisions that have obtained permanent legal force in Indonesia often fail to be executed effectively, creating a gap between normative legal certainty and practical implementation. This study aims to analyze juridical and non juridical obstacles to the execution of civil judgments and to formulate an ideal legal construction that strengthens procedural certainty and institutional accountability. The research employs normative legal research using statutory, conceptual, and limited case approaches, with a population consisting of all regulations, court policies, and scholarly works on civil judgment execution in Indonesia. Samples of legal materials are selected purposively based on their relevance to juridical and non juridical barriers and to the design of an ideal execution model. Data are collected through systematic literature study and analyzed using content analysis and qualitative prescriptive techniques to categorize norms, doctrines, and empirical findings into coherent analytical themes. The results show that weaknesses in procedural regulation, unclear operative parts of judgments, lack of asset tracing mechanisms, social resistance, limited court resources, and weak inter agency coordination jointly undermine the effectiveness of execution. The conclusion is that a reformed execution system requires simultaneous normative, institutional, and socio cultural reforms anchored in a five element conceptual model: executable judgment, procedural certainty, institutional safeguard, social compliance, and judicial accountability.

Abstract

This study is motivated by the need to ensure balanced legal protection for parties involved in verzet processes against verstek decisions within civil procedural law, especially amid the digitization of the judiciary. The objective is to analyze the legal position of the parties and evaluate the effectiveness of the verzet mechanism in guaranteeing proportional legal protection. The research adopts a normative juridical type with a literature review method. The population comprises legislation, procedural law doctrines, and court decisions relevant to verzet and verstek in Indonesia. Selected samples are purposive documents based on relevance. Data instruments include primary and secondary legal documents analyzed using qualitative descriptive techniques through comparative and synthetic textual analysis. The findings reveal verzet as a crucial instrument to protect defendants’ rights; however, its effectiveness remains constrained by administrative and technical challenges in notification and electronic court system implementation. The conclusion emphasizes the need for procedural law reform, improved human resource capacity, and technological infrastructure to enhance verzet’s functionality in the future.

Abstract

Perkembangan e-litigation perdata di Indonesia menimbulkan tantangan etika baru bagi advokat terkait perlindungan data, keamanan dokumen elektronik, dan komunikasi daring, sementara kode etik konvensional belum memadai. Penelitian ini bertujuan menganalisis urgensi kode etik digital bagi advokat dalam e-litigation perdata. Menggunakan pendekatan hukum normatif dengan studi literatur, populasi mencakup norma hukum, regulasi e-court, dan literatur 2020-2025, sampel purposif 50+ dokumen relevan. Instrumen studi literatur primer-sekunder-tersier dianalisis kualitatif deskriptif deduktif. Hasil menunjukkan keterbatasan kode etik konvensional menghadapi risiko siber dan ketidakpastian hukum, sehingga kode etik digital mendesak untuk melindungi klien dan integritas profesi. Kesimpulan merekomendasikan sinergi organisasi advokat-Mahkamah Agung menyusun kode etik digital dengan pelatihan wajib.

Abstract

Integrasi Kecerdasan Buatan (AI) ke dalam sistem hukum acara perdata mengatasi ketidakefisienan administrasi perkara dan pemrosesan bukti di pengadilan Indonesia, di mana proses manual menyebabkan keterlambatan dan biaya tinggi. Penelitian ini bertujuan mengkaji aplikasi AI dalam administrasi dan pembuktian perdata, dengan studi kasus internasional. Menggunakan pendekatan kualitatif berbasis yuridis normatif, populasi terdiri dari literatur 2021-2025 tentang AI dalam peradilan perdata, disampel secara purposif menjadi 25-30 sumber terpercaya melalui Google Scholar. Instrumen meliputi dokumen hukum dan jurnal terindeks, dianalisis melalui pengkodean tematik, interpretasi normatif, dan sintesis komparatif dengan triangulasi sumber. Hasil menunjukkan potensi AI meningkatkan efisiensi 50%, mengurangi biaya operasional, dan meminimalkan bias manusia melalui otomatisasi pengelolaan data dan analisis bukti elektronik, seperti di Estonia dan Singapura. Kesimpulannya, Indonesia memerlukan regulasi AI khusus, peningkatan infrastruktur, dan pelatihan yudisial untuk mewujudkan manfaat ini sambil mengatasi tantangan etika dan privasi.

Abstract

The enforcement of civil court judgments in Indonesia frequently encounters obstacles due to parties’ bad faith conduct, such as covert asset transfers or groundless resistance to execution. Although the principle of good faith is a foundational tenet in civil law, its application in the enforcement phase remains inconsistent. This study examines the concept and legal status of the good faith principle in Indonesian positive law concerning civil judgment enforcement and analyzes the legal consequences of its violation. A normative juridical method is employed, utilizing library-based research on primary and secondary legal sources. The findings reveal that while good faith is recognized in substantive civil law, it has not been explicitly incorporated into civil procedural law. Consequently, bad faith actions during enforcement rarely incur clear procedural sanctions. Theoretically, this underscores the need to integrate ethical principles into civil procedure doctrine; practically, it calls for regulatory reforms to embed good faith as a binding procedural obligation in judgment enforcement.

Abstract

This study aims to analyze the legal responsibilities that can be imposed on online lending platform organizers for the misuse and illegal distribution of consumer personal data. With the rapid development of the online lending industry, the issue of protecting consumer personal data has become a very important issue. Misuse of personal data can have serious impacts on consumers, including identity theft and financial loss. Therefore, this study examines the forms of legal responsibilities that can be applied, such as administrative, criminal, and civil responsibilities, as well as the obstacles faced in their implementation. This study uses a normative approach with an analysis of applicable regulations, namely the Personal Data Protection Law (UU PDP), the Electronic Information and Transactions Law (UU ITE), and other related regulations. Data were obtained through a literature review covering relevant laws and regulations, journals, articles, and case studies. The results of the study indicate that online lending platform organizers can be subject to three forms of legal responsibilities. Administrative responsibilities include sanctions imposed by supervisory authorities such as the Financial Services Authority (OJK) and the Personal Data Protection Agency (BPDP). Criminal responsibilities can be in the form of imprisonment and fines for those who violate provisions related to personal data protection. Civil liability gives consumers the right to file a lawsuit for losses caused by a breach of their personal data. This study also identified various obstacles in implementing legal liability, such as lack of awareness of organizers, difficulties in supervision, and legal loopholes in user agreements.

Abstract

The Constitutional Court of Indonesia is a judicial institution with the authority to review laws against the 1945 Constitution of the Republic of Indonesia, resolve disputes between state institutions, decide on the dissolution of political parties, and adjudicate election result disputes. In exercising its authority, the Constitutional Court functions not only as the guardian of the constitution but also as a protector of human rights. This article aims to analyze how the procedural law of the Constitutional Court, as regulated under Law Number 24 of 2003 and its amendments, serves as a crucial instrument to ensure fair, transparent, and accountable proceedings in cases involving constitutional rights. This study adopts a normative juridical approach by examining legislation, legal doctrines, and Constitutional Court decisions that have had a significant impact on the protection of human rights. The analysis reveals that several rulings of the Court have expanded interpretations of human rights, although challenges remain regarding the consistency of procedural application and the effectiveness of decision enforcement. Therefore, strengthening the procedural law of the Constitutional Court is essential for ensuring the substantive and sustainable protection of human rights in Indonesia.
