Abstract

Tujuan dari penelitian ini adalah untuk mempelajari dan meninjau kehidupan masyarakat Indonesia dalam transaksi yang berkaitan dengan Undang-undang No. 8 tahun 1999, yang juga dilihat dari sudut pandang hukum dagang. Dalam penelitian ini, metode penelitian normatif digunakan. Yang dimana bahan dasar penelitian adalah bahan pustaka atau data sekunder, dengan menelusuri literatur dan peraturan yang berkaitan dengan Undang-Undang Perlindungan Konsumen No. 8 tahun 1999.  Hasil penelitian menunjukkan bahwa perubahan besar dalam hukum transaksi diperlukan untuk mengimbangi perkembangan kehidupan masyarakat Indonesia yang pesat. Terutama di era modern, di mana internet memudah kan masyarakat dalam mengakses segala hal.

Abstract

International trade or export-import is one of the important elements in the era of globalization in supporting a country's economy. In carrying out international trade activities, especially export activities, legal protection is needed for exporters as sellers in carrying out their business activities because of the many risks that will be accepted by them. Exporters if they carry out international trade activities using a consignment payment system. Normatively, international trade activities, especially exports, have rules that are in line with the Civil Code that applies in Indonesia, but there are also other legal provisions, both national and international legal provisions that can be used as a reference by exporters as sellers in carrying out their business in order to obtain guaranteed legal protection. which is further regulated in Law Number 7 of 2014 concerning Trade and the Convention on the Law Applicable to International Sale of Goods 1955, but this international law convention states in article 1 that this convention only applies to the international sale and purchase of goods, and This convention also only applies to sales and purchases that are stated in written documents or written contracts. This means that in relation to this matter, in order for exporters to obtain legal protection, they are required to carry out their business activities in international trade by making written agreement documents or sales contracts as detailed and perfect as possible starting from the quantity of goods being bought and sold, payment times and deadlines as well as methods for resolving disputes. which will be chosen to be taken if there is a default from the importer as the buyer.

Abstract

The phenomenon of film piracy is a detrimental thing, especially for film arts activists, where piracy is an act that is detrimental both materialistically and to their creations. In order to protect the rights of art, intellectual property rights are also being read, which also reads Law No. 28 of 2014 concerning Intellectual Property Rights, this paper will discuss how the effectiveness of the use of the UU Hakijakaan against the phenomenon of filmmakers, writing using normative juridical methods.

Abstract

Lumpur kolam ikan merupakan salah satu limbah dari aktivitas akuakultur dan dapat menjadi masalah apabila tidak dikelola dengan baik. Berdasarkan observasi yang dilakukan, lumpur kolam ini dibuang begitu saja ke perairan umum, sehingga menyebabkan pencemaran lingkungan. Akan tetapi lumpur limbah kolam memiliki dampak yang baik bagi tanaman. Kegiatan ini merupakan salah satu program unggulan dari Kukerta MBKM Desa Sipungguk, bertujuan untuk meningkatkan pengetahuan dan keterampilan masyarakat pada pengolahan lumpur limbah kolam menjadi media tanam dan pupuk organik cair, sehingga menciptakan Integrated Farming System antara perikanan dan pertanian. Kegiatan telah dilaksanakan pada tanggal 19 Juli s/d 1 Agustus 2024, pada kelompok tani UPJA (Usaha Pelayanan Jasa Alsintan) Desa Sipungguk. Kegiatan terdiri dari penyuluhan dan praktik bersama kelompok tani dalam pengolahan lumpur limbah kolam menjadi media tanam dan pupuk organik cair untuk tanaman hortikultura. Hasil kegiatan ini menunjukkan kelompok tani sangat antusias dengan kegiatan ini, ditunjukkan dengan diskusi yang terjadi serta mampu memahami dan mengolah lumpur limbah kolam menjadi media tanam dan pupuk organik cair dengan antusias dalam mengikuti praktik pengolahan lumpur kolam menjadi media tanam dan pupuk organik cair.

Abstract

The research explores the impact of predatory pricing practices by foreign businesses on e-commerce platforms, which pose significant challenges to Micro, Small, and Medium Enterprises (MSMEs) in Karawang, Indonesia. Using a normative legal research approach, the study evaluates the adequacy of regulations such as Law Number 5 of 1999 on Prohibition of Monopolistic Practices and Unfair Business Competition and Ministry of Trade Regulation Number 50 of 2020 in providing legal protection to MSMEs. The study highlights the role of the Business Competition Supervisory Commission (KPPU) in monitoring and enforcing fair competition laws within the digital marketplace. The findings reveal that imported products sold at significantly low prices undermine local MSMEs’ competitiveness, exacerbating the challenges they face in the digital economy. Although government initiatives such as prioritizing domestic products, implementing stricter regulations, and launching campaigns like the "Proud to be Made in Indonesia" movement aim to support MSMEs, more robust enforcement and consistent implementation are required. This research emphasizes the necessity for comprehensive strategies to safeguard MSMEs' interests amidst the evolving dynamics of digital trade.

Abstract

This research aims to understand the form of legal protection distributed by the state to brands in the MSME business sector. The author uses a normative legal research type research method that observes several legal norms, legal theories, which are synchronized with several sources of legal material, both from statutory regulations and other sources. The legal phenomenon that attracted the attention of the author until conducting this research was due to the mushrooming of the MSME sector, but business actors still put aside the interests of brand rights. Thus, based on research, if there are MSMEs that do not register their brand rights with the Director General of Intellectual Property (DJKI), their brand will not receive legal protection, and can be misused by other business actors in a detrimental manner.

Abstract

The increase in share ownership by foreign nationals was triggered by the existence of regulations in the form of laws which provided an opportunity for foreigners to own shares of up to 99%. This provision aims to facilitate banks in improving their capital structure. Using normative juridical research methods, it is concluded that the legal regulation of foreign ownership of shares in national banks has positive implications, namely the creation of good bank corporate governance and an increase in bank performance. However, it also has a negative implication, namely when banks can ultimately be controlled by foreigners who tend to be more profit-oriented than efforts to increase people's welfare, as well as the risk of capital flight abroad during a crisis.

Abstract

In economic activities in society, rental activities are an alternative for some people to get the benefits of goods and/or services at affordable costs. However, the actions of business actors that cause losses to consumers cannot be avoided, thereby causing consumer losses. Through the case of a photographer rental service which causes photo files to become corrupted, this research aims to find out how the Consumer Protection Law provides protection for consumers against defaults caused by negligence of photographer services which causes files to become corrupted. This research uses normative juridical research methods with library study data collection techniques. Based on the research results, the Consumer Protection Law provides full protection for consumers who suffer losses due to defaults committed by business actors and the resulting consequences, namely legal consequences in the form of administrative sanctions and non-legal consequences in the form of social sanctions.

Abstract

Education is essential for human development, enabling individuals to cultivate their potential through formal learning processes and other socially recognized means. It serves as a transformative tool that shapes human character and broadens knowledge. This study aims to analyze the implementation of policies related to the fulfillment of children's right to education within the compulsory education program in Dongkal Village, Pedes District, Karawang Regency. The research employs a normative juridical approach, examining the application of legal provisions in practice and their role in addressing legal issues within society. A qualitative research method with a prescriptive analysis approach is utilized to critically evaluate the effectiveness of these policies. This study not only assesses the fulfillment of children's educational rights but also contributes to a broader discourse on sustainable development by integrating legal and socio-economic perspectives. The findings of this research provide valuable insights into the effectiveness of compulsory education policies and their implementation at the local level. Furthermore, this study offers recommendations for policymakers to enhance the legal framework governing compulsory education, ensuring equitable access to quality education for all children. By addressing gaps in policy enforcement and aligning educational initiatives with human rights principles, this research contributes to the development of more inclusive and sustainable education policies in Indonesia.

Abstract

Kuliah Kerja Nyata (KKN) is a form of community service activity carried out by tertiary institutions. This service activity was carried out by a group of students and lecturers from the University of Mataram with the theme Healthy Village. In the KKN activities carried out in Pengadangan Village, Pringgasela District, East Lombok Regency, the KKN team carried out various activities with the main target being the health problems of the Pengadangan Village community. The purpose of this KKN activity is to provide assistance and education to the Pengadangan Village community about the dangers of cancer and sexually transmitted diseases and help the community to minimize the stunting rate in Pengadangan Village. There are four methods of activities carried out, namely (1) Stunting counseling with posyandu cadres in Pengadangan Village, (2) Participating in Posyandu activities in each hamlet, (3) Holding a quiz competition between posyandu cadres with the theme of Stunting, (4) Counseling as well as free examinations of cancer and sexually transmitted diseases. The results of this activity are first, the community knows the causes and ways to prevent stunting. Second, posyandu cadres are helped in carrying out their activities. Third, increased knowledge among cadres about stunting. And finally, the community gained knowledge about cancer and sexually transmitted diseases ranging from indications, characteristics and how to prevent them and the community can also conduct free examinations to find out whether there is an indication of a disease or not. In addition, the KKN team was also involved in various other activities such as providing counseling and literacy on the importance of waste selection and processing, making RT signs, and holding a healthy walk as a form of our farewell event. The results of the above activities show that this KKN activity is able to provide assistance to the Pengadangan Village community in an effort to realize a Healthy Village.
