Tujuan artikel ini untuk mengetahui reformasi kebijakan pengaturan perkawinan dan perubahan batasan minimal umur perkawinan di Indonesia. Penelitian ini merupakan doktrinal, metode penelitian yang digunakan adalah metode penelitian hukum normatif yaitu metode penelitian hukum yang mendasarkan pada pendekatan perundang-undangan dengan menggunakan analisis deskritif analitis. Hasil penelitian ini menunjukan adanya reformasi atau perubahan terkait pengaturan perkawinan di Indonesia, melalui perubahan UU Perkawinan tahun 1974 menjadi UU Perkawinan tahunn 2019. Subtansi perubahan UU Perkawinan ini berfokus pada perubahan batasan minimal umur perkawinan umur untuk perempuan menjadi 19 tahun. Karena pengaturan batasan umur sebelumnya (16 tahun) tidak sejalan dengan ketentuan yang ada dalam UU Perlindungan Anak yang menyatakan anak adalah seseorang yang berusia belum 18 tahun. Selain itu adanya fakta bahwa perempuan yang menikah diusia 16 tahun lebih rentan mengalamin gaguan kesehatan serta mental. Perubahan ini juga merupakan uapaya pemenuhan hak dasar anak atas perlindungan dari kekerasan dan diskriminasi, hak sipil, haka kesehatan, hak pendidikan dan hak sosial anak yang sulit terpenuhi akibat pernikahan di usia dini.

In Indonesia, the spread of Coronavirus Disease 2019 (COVID-19) affects economic stability. The problem faced by Indonesia today is that the performance and capacity of debtors in carrying out their credit obligations have been disrupted by the spread of COVID-19, which has the potential to disrupt banking performance in credit management. Encouraging the optimization of the banking intermediary function a policy is needed in tackling the impact of the spread of COVID-19. The research method used is a normative legal research method using secondary data. The results of this study indicate that policy settings in overcoming economic instability due to the spread of COVID-19 are the issuance of policies to provide national economic stimulus through the application of Financial Services Authority Regulation No. 11/POJK.03/2020. This policy regulates the existence of credit restructuring, namely the quality of restructured loans can be determined smoothly if given to debtors identified as being affected by the spread of COVID-19. The implementation of the restructuring scheme can vary and is determined by the policies of each bank depending on the assessment of the debtor's profile and capacity to pay. We emphasize that amid uncertainty, such as the current policy will be truly useful if each party takes the process carefully and responsibly.

The development and progress of electronic transactions has resulted in changes in the activities of human life in various fields which have directly given rise to new forms of legal action that require Indonesia to form arrangements regarding electronic transaction management. The purpose of this study is to find out the background of the birth of criminal law policies regarding electronic transactions and to find out the formulation of criminal acts regarding electronic transactions in Law Number 19 of 2019 concerning Information and Electronic Transactions. The results of this study indicate that the background of the birth of the criminal law policy in the field of electronic transactions is the development of crime through electronic systems in society. Although crime through an electronic system is virtual, it can be categorized as a real legal act or action. Juridically, legal actions in this cyber space are regulated in the ITE Law. This ITE Law is an absolute legal approach to safeguard security in cyberspace and produce legal certainty on technology utilization issues.

Globalization era requires Indonesia to always use technology and information in improving economy. This also applies to insurance companies that have implemented technology and information. Conventional insurance has developed into online one that attracts Indonesian citizen. However, today new issue is about protecting the spiritual rights of consumers as well as the halal or haram of online insurance. Answering this problem, this research will use normative juridical (doctrinal) method that prioritizes primary legal material i.e. insurance laws, consumer protection laws, and other legal materials. This research shows the existence of online insurance in Indonesia which rapidly develops because it offers more conveniences compared to conventional one. In Islamic law, online insurance is allowed as long as it is in line with Islamic law principles in protecting consumers’ spiritual rights. The example of sharia principle is cooperation by paying tabarru’ funds, using tabarru’ and tijarah agreement, and sharing similar responsibility between one participant and others (ta’awun). The legal basis for insurance in Indonesia is contained in the 2014 Law Number 40 and MUI Fatwa Number 21/DSN-MUI/X/2001.Era globalisasi mengharuskan Indonesia untuk selalu memanfaatkan teknologi dan informasi dalam meningkatkan perekonomian. Ini berlaku pula pada perusahaan asuransi yang telah menerapkan teknologi dan informasi. Asuransi konvensional telah berkembang menjadi asuransi online yang banyak diminati masyarakat Indonesia. Namun, persoalan yang hangat dibicarakan saat ini mengenai perlindungan hak spiritual konsumen serta halal atau haramnya asuransi online. Untuk menjawab persoalan tersebut, penelitian ini menggunakan metode yuridis normatif (doktrinal) yang mengedepankan bahan hukum primer yaitu undang-undang perasuransian, undang-undang perlindungan konsumen, serta bahan hukum lain. Penelitian ini menunjukan eksistensi asuransi online di Indonesia telah mengalami perkembangan pesat karena memberikan kemudahan dibanding asuransi konvensional. Dalam hukum Islam, asuransi online pada dasarnya diperbolehkan dengan syarat tidak bertentangan dengan prinsip-prinsip hukum Islam dalam melindungi hak spiritual konsumen. Contohnya prinsip syariah tersebut seperti bekerja sama dengan cara masing-masing mengeluarkan dana tabarru’, menggunakan akad tabarru’ dan akad tijarah, dan saling menanggung risiko antara satu peserta dengan peserta lainnya (ta’awun). Dasar hukum mengenai asuransi di Indonesia terdapat dalam UU Nomor 40 Tahun 2014 dan Fatwa MUI Nomor: 21/DSN-MUI/X/2001.

The presence of types of financial institutions in Indonesia makes it easy for people to choose which financial services they need. Micro Waqf Bank is one of the Microfinance Institutions that applies sharia principles that are currently growing and developing. However, there are legal issues related to arrangements for organizing a Micro Waqf Bank with a cooperative legal entity, namely, there are two overlapping regulations, namely the Microfinance Institution legislation, and Cooperative regulations. The purpose of this study is necessary to find out whether the legal consequences arising in the process of establishment, implementation, or if there are problems encountered by Mikro Waqf Banks as a Sharia Microfinance Institution incorporated as a cooperative. This study uses a normative legal research method with a statutory approach and conceptual approach. This study shows that the dualism of Micro Waqf Bank arrangements gives rise to contradictions in the arrangements for the establishment, guidance, and supervision. The existence of this dualism of regulation also gives rise to legal consequences in the establishment of a Micro Waqf Bank incorporated as a cooperative. The legal consequences are related to the broader aspects of business activities based on MFI regulations compared to cooperative regulations. Legal consequences related to capital aspects that require Micro Waqf Banks have a certain amount of capital by MFI regulations. Then from the aspect of coaching and supervision in which there are an examination and evaluation, there is also a dualism which in the regulation of the function of the cooperative is carried out by the Ministry of Cooperatives but the existence of the MFI regulation of the fostering and supervision function is under the authority of the Financial Services Authority.

The problem for all countries in the world, including Indonesia, is the presence of a virus originating from Wuhan City, China. This virus is known as COVID-19. The Government of Indonesia has established COVID-19 as a type of disease that causes a Public Health Emergency. Therefore, prevention efforts must be made in accordance with existing provisions. The research method used is a socio-legal research method with a normative legal approach and a sociological approach conducted in Klaten-Central Java. The results of this study indicate that the policy currently being taken is health quarantine. The policy is the issuance of health protocols for the community. This protocol is known as the COVID-19 hygiene protocol, one of which is related to the obligation to wear masks by everyone when outside the home and the Hand Washing with Soap (CPTS) movement with running water either/both the use of antiseptic hand sanitizers as stipulated in the Ministry of Health Circular Number HK.02.02/I/385/2020. The level of awareness and compliance in Klaten Regency on the policy is exceptionally well, indicated by the dominant number of people in the use of masks when they are outside of the house and washing their hands with soap with running water either/both using antiseptic hand sanitizers. Therefore, the existence of a health protocol as a government policy in accelerating COVID-19 countermeasures is expected by parties, such as the Regional Government and the community in playing an active role referring to those who are feverish to the nearest hospital. Then, the Regional Government can socialize or urge people to use masks. For emergencies, if you sneeze or cough in a public area, cover your mouth with your inner elbows or upper sleeve. People who are sick are also advised not to use public transportation to minimize the possible risk of spreading the disease.

Perspektif hukum kepailitan, jika debitur jatuh pailit dan hartanya tidak lebih banyak daripada utangnya maka kreditur konkurenlah yang paling dirugikan bahkan terancam tidak memperoleh pelunasan utang sama sekali dari debitur. Untuk itu sarana kepailitan tidak boleh sampai digunakan untuk itikad yang tidak baik yang dimanfaatkan debitur maupun salah satu kreditur. Dalam Pasal 2 ayat 1 Undang-Undang Nomor 37 Tahun 2004 menegaskan syarat kepailitan hanya terdiri dari dua kreditur atau lebih dan minimal satu utang yang telah jatuh tempo sangatlah riskan dan berpotensi diggunakan untuk kepetingan debitur maupun kreditur yang melenceng dari hakikat kepailitan itu sendiri dan dapat merugikan pihak-pihak lain. Penelitian ini dilakukan dengan metode hukum yang bersifat normatif, dimana menggunakan bahan hukum primer, sekunder dan juga tersier. Hasil penelitian ini menunjukan, banyaknya aturan dari undang-undang kepailitan saat ini yang bertolak belakang dengan norma dan prinsip kepailitan tentu bisa menjadi cela bagi pihak-pihak yang ingin memanfaatkan sarana kepailitan dengan maksud tidak baik. Apabila hal ini sampai terjadi maka sangat berpotensi kreditur konkurenlah yang paling besar menerima imbasnya. Maka dari itu, dengan membahas dan menggali hakikat kepailitan dari asas dan prinsip-prinsipnya yang kemudian dibandingan dengan undang-undang positif yang berlaku akan mengingatkan kita pada hakikat sejati dari kepailitan itu sendiri, sehingga diharapkan dapat mengetahui bagaimana bentuk perlindungan hukum yang semestinya didapat oleh kreditur konkuren yang sering menjadi pihak paling dirugikan dari sebuah kasus kepailitan.

In Indonesia, the development of the mode of commercial sexual exploitation of children has been carried out through the practice of siri marriage. Children who are vulnerable to sexual exploitation due to lack of literacy in children, economic conditions of the family, and because of the environment and social status. The study aims to examine the protection of children against commercial sexual exploitation through the siri marriage mode from the Maqashid Al-Shariah perspective. This research uses normative juridical research methods with the statutory approach and conceptual approach. This research shows that siri marriage based on Islamic law is permissible if it meets the requirements of marriage, but based on Indonesian national law, siri marriage is prohibited if the purpose is to obtain material benefits for parents or the party to marry off children at an early age. Siri marriage can be used as a criminal offense if done against a child. Whereas in the Maqashid Al-Shariah perspective, marriage with children through siri marriage is legal or permissible. However, the marriage will only produce part of the purpose of marriage, while other objectives in perspective Maqashid Al-Sharia tend to be ignored because early marriage is prone to psychological problems and lack of skills in the family. As a result, marriage is considered to have the risk of giving birth to a bad thing in the family which can reduce the noble values which are the main mission of Islam.

The use of information technology in Indonesia has increased significantly and has affected the aspects of human life. One of them is the presence of e-commerce platform money lending rather than financial technology in the form of peer to peer lending (P2P Lending). P2P Lending is the practice or method of giving money to individuals or businesses and vice versa, applying for loans to lenders, which connects lenders with borrowers or investors online. However, the problem currently faced is the protection of P2P Lending consumers' data. Therefore, this normative legal research aims to find out and examine the protection of personal data of P2P Lending consumers as part of the e-commerce business in Indonesia. This research shows that the implementation of P2P Lending is regulated in POJK No. 77/POJK.01/2016 and PBI No.19/12/PBI/2017. These two rules were formed aiming to ensure the implementation of P2P Lending and be able to keep abreast of financial technology very quickly. Then the protection of P2P Lending consumer private data has been set in the ITE Law. The presence of the ITE Law aims to protect private data in P2P Lending activities as part of an e-commerce business. But the ITE Law does not yet contain specific data protection rules.

Tujuan: Penelitian ini bertujuan untuk mengkaji dan menganalisis perlindungan hukum terhadap keputusan bisnis Direksi BUMN yang dikriminalisasi akibat keputusan bisnis tersebut merugikan keuangan negara. Metodologi: Penelitian yang bersifat deskriptif ini menggunakan metode penelitian hukum normatif yang mengedepankan pada data sekunder. Pendekatan yang digunakan pada penelitian ini adalah pendekatan perundang-undangan dan pendekatan konseptual.Temuan: Hasil penelitian ini menunjukkan perlindungan hukum yang diberikan kepada Direksi BUMN dalam mengambil keputusan bisnisnya dapat berupa hak imunitas, yang mana dengan hak ini seorang Direksi BUMN dapat terlepas dari pertanggungjawaban pidana apabila Direksi tersebut dapat membuktikan bahwa keputusan bisnis yang telah diambil dan dijalankan telah sesuai dengan prinsip-prinsip bisnis yang layak (business judgement rule) sesuai ketentuan yang termuat dalam Undang-Undang Perseroan Terbatas.Kegunaan: Hasil penelitian ini dimaksudkan agar dapat berkontribusi dalam literatur mengenai perlindungan hukum bagi keputusan bisnis Direksi BUMN yang telah dikriminalisasi.Kebaruan/Orisinalitas: Berbeda dengan penelitian terdahulu, pada penelitian ini menunjukkan business judgment rule doctrine dapat dipergunakan untuk menlindungi keputusan bisnis Direksi BUMN yang merugikan negara dan penelitian ini berfokus pada perlindungan hukum keputusan bisnis Direksi BUMN setelah adanya Putusan Mahkamah Konstitusi Nomor No. 48/PUU-XI/2013 dan 62/PUU-XI/2013. Â
