Abstract

Perkembangan dan pemanfaatan teknologi Era Society 5.0 memberikan dampak positif dan negatif di berbagai aspek kehidupan manusia. Salah satu dampak negatifnya adalah adanya bentuk-bentuk pelanggaran hukum yang memanfaatkan teknologi seperti penyebaran hoaks di media sosial, cyber bullying, pelanggaran atas data pribadi dan pelanggaran hukum lainnya. Selain itu, berdasarkan data yang diperoleh di Panti Asuhan Sinar Batam, ditemukan banyak remaja yang tidak mengetahui bahwa komentar buruk di media sosial merupakan pelanggaran hukum. Selain itu, remaja tanpa sadar memberikan informasi pribadi, menandatangani situs yang tidak jelas, serta masuk ke situs ilegal. Atas permasalahan ini, pelaksana akan memberikan peningkatan pemahaman hukum dengan metode penyuluhan. Berdasarkan hasil evaluasi dari seluruh rangkaian pelaksanaan kegiatan ini, dapat disimpulkan berhasil. Sejumlah 71% peserta telah mengetahui pentingnya pendidikan hukum sejak dini untuk meminimalisir pelanggaran hukum.

Abstract

Although Indonesia has Law No. 28 of 2014 on Copyright, the legal problems of copyright infringement in transactions on e-commerce platforms are legal regulations regarding the enforcement of copyright infringement and the awareness of e-commerce platform users. There is a gap between the current law and the reality on the ground, and piracy is still widespread. The purpose of this study is to analyze legal certainty in the enforcement of copyright infringement on e-commerce platforms based on the current law and to identify challenges in its enforcement. The method used in this research is a normative legal research method that involves analyzing laws and regulations, legal theories, and literature related to copyright and e-commerce issues. The findings of this study recommend the reconstruction of copyright enforcement on e-commerce platforms in Indonesia through the integration of advanced technologies such as Artificial Intelligence (AI) and automated algorithms to effectively detect and monitor violations, accompanied by the simplification of administrative processes. Additionally, it emphasizes the importance of defining specific responsibilities for e-commerce platforms, strengthening sanctions for royalty payment violations, and increasing legal awareness among users through educational campaigns and transaction agreements that include copyright protection to ensure legal certainty in the digital era.

Abstract

The lack of specific legal provisions addressing the misuse of genetic information in Indonesia raises critical concerns regarding potential violations of the right to privacy and genetic-based discrimination. This study aims to examine the extent to which Indonesia’s legal framework protects human rights in the era of genetic technology. Employing a normative legal research method, the study utilizes statutory and conceptual approaches to analyze relevant laws, including the 1945 Constitution, the Human Rights Law, and the Personal Data Protection Law. The findings reveal that while Indonesia’s existing legal framework provides foundational human rights protections, it fails to explicitly regulate genetic data as a distinct category requiring heightened safeguards. Key issues include the absence of mechanisms for informed consent, vague data governance, and a lack of explicit prohibitions on genetic discrimination. As genetic testing expands—particularly in health, research, and insurance sectors—the risk of rights violations becomes more imminent. The study recommends comprehensive reform through the creation of dedicated legislation, establishment of an independent oversight body, and adoption of progressive legal principles such as autonomy, non-discrimination, and precaution. Without such reforms, Indonesia risks falling behind in ethically and legally navigating genetic innovation while compromising constitutional human rights guarantees. [Kurangnya ketentuan hukum yang secara spesifik mengatur penyalahgunaan informasi genetik di Indonesia menimbulkan kekhawatiran serius terkait potensi pelanggaran hak atas privasi serta diskriminasi berbasis karakteristik genetik. Penelitian ini bertujuan untuk mengkaji sejauh mana kerangka hukum Indonesia melindungi HAM dalam era perkembangan teknologi genetik. Dengan menggunakan metode penelitian hukum normatif, studi ini menerapkan pendekatan perundang-undangan dan konseptual untuk menganalisis berbagai regulasi yang relevan, termasuk UUD NRI 1945, UU Hak Asasi Manusia, serta UU Pelindungan Data Pribadi. Temuan penelitian menunjukkan bahwa meskipun kerangka hukum Indonesia saat ini telah menyediakan perlindungan dasar terhadap hak asasi manusia, regulasi tersebut belum secara tegas mengatur data genetik sebagai kategori khusus yang memerlukan perlindungan lebih kuat. Beberapa isu utama yang ditemukan antara lain ketiadaan mekanisme persetujuan berdasarkan informasi (informed consent), ketidakjelasan tata kelola data, serta belum adanya larangan eksplisit terhadap diskriminasi genetik. Seiring dengan meluasnya penggunaan tes genetik- terutama dalam sektor kesehatan, penelitian, dan asuransi-risiko terjadinya pelanggaran hak semakin meningkat. Penelitian ini merekomendasikan dilakukannya reformasi hukum secara komprehensif melalui pembentukan regulasi khusus, pendirian lembaga pengawas independen, serta penerapan prinsip-prinsip hukum progresif seperti otonomi, non-diskriminasi, dan prinsip kehati-hatian. Tanpa adanya reformasi tersebut, Indonesia berisiko tertinggal dalam menghadapi inovasi genetik secara etis dan legal, sekaligus berpotensi mengorbankan jaminan hak konstitusional warga negara.

Abstract

The implementation of the right to be forgotten in digital banking transactions in Indonesia faces complex legal challenges. Legal disharmony among regulations on personal data protection, electronic information and transactions, and banking law creates uncertainty in applying this right. This study aims to evaluate the legal framework of the right to be forgotten in Indonesia and compare it with the European Union's General Data Protection Regulation (GDPR) to identify an ideal normative solution. The research employs a normative legal method with statutory and comparative approaches. The findings indicate that the GDPR provides a more flexible data deletion mechanism, including the existence of an independent supervisory authority and simpler procedures for individuals to request data erasure. To enhance legal certainty in regulating the right to be forgotten in Indonesia, legal reform is necessary. This includes harmonizing existing regulations, formulating technical guidelines for Electronic System Providers (ESPs), and establishing an independent Personal Data Protection Authority similar to the European Data Protection Board (EDPB).

Abstract

The rapid growth of digital advertising as a key component of the digital economy has intensified concerns over the protection of personal data and privacy rights. The primary legal problem addressed in this research is the inability of Indonesia’s current data protection framework to adequately regulate data-driven digital advertising practices and prevent unlawful identification of individuals, particularly when compared to South Korea’s more advanced regulatory regime. This study aims to comparatively analyze the legal frameworks governing personal data and privacy protection in digital advertising in Indonesia and South Korea and to propose a legal development model for Indonesia. This research employs a normative legal research method using a comparative statutory approach, focusing on Indonesia’s Law on Personal Data Protection and South Korea’s Personal Information Protection Act, along with its enforcement regulations. Legal norms are examined through statutory provisions and supported by relevant legal and academic literature. The findings demonstrate substantial regulatory disparities between the two countries. South Korea has established a comprehensive and technologically responsive legal framework, incorporating detailed data classification, recognition of pseudonymized data, strict profiling limitations, and strong institutional enforcement. In contrast, Indonesia’s legal framework remains structurally limited, relies heavily on undelivered implementing regulations, and insufficiently addresses indirect identification and advanced data-processing practices in digital advertising. This study proposes targeted legal reforms for Indonesia, including the integration of pseudonymization, enhanced data classification, criminalization of unlawful identification, and mandatory tracking notifications to strengthen privacy protection in the digital advertising ecosystem.

Abstract

Genetic engineering raises complex ethical and legal challenges, particularly in Indonesia, where intellectual property rights intersect with religious values. This research identifies the regulatory gap within Indonesian patent law, which lacks clear provisions for managing ethical concerns related to genetic engineering, including antitrust measures and scientific scrutiny. The study aims to explore whether the concept of Hisbah within Sharia can offer a normative framework to address these challenges while fostering scientific progress. Utilizing a normative legal research method, this study critically analyzes Law No. 13 of 2016 on Patents alongside Islamic legal doctrines. The findings reveal that, contrary to ultraconservative views, Hisbah encourages scientific advancements such as genetic engineering when aligned with societal welfare and ethical considerations, emphasizing that knowledge should contribute to the public good without enabling monopolistic practices. This research concludes that integrating Hisbah into Indonesia’s patent regulation can guide the ethical development of genetic engineering while respecting both the need for innovation and the values embedded in Indonesian society. It offers a significant perspective for policymakers to harmonize intellectual property law with Islamic principles, ensuring a balanced legal framework that safeguards public interest while promoting scientific progress.

Abstract

This article discusses the potential of IPR-based sustainable tourism in Indonesia, Malaysia, and Thailand, three Southeast Asian countries with immense cultural resources that can further develop the tourism industry. This analysis primarily assesses the adequacy of the relevant regulatory frameworks in bridging sustainability and tourism, particularly by utilising the relevant IPR regimes. Employing the normative legal research method, this study finds that all three countries are for the most part, normatively inadequate to adopt an IPR-based sustainable tourism system, due to the lack of emphasis on ‘social interests’ with regards to community development and its connection with the bigger and more urgent objective of environmental sustainability. However, the study also notes that Indonesia stands out as the country with the most comprehensive and locally sensitive IPR frameworks. These frameworks potentially facilitate a harmonious connection between the three domains through the perspective of Roscoe Pound’s Sociological Jurisprudence, specifically how law is viewed as an instrument for social engineering, which serves the objective of moving the tourism sector and its stakeholders towards a more sustainable approach.

Abstract

Syndicated credit refers to the provision of credit extended by more than one rural bank (BPR) for a single debtor loan. In Batam City, this type of credit is commonly practiced by BPRs to meet the needs of debtors requiring large loans. In this mechanism, one bank acts as the lead bank, serving as the principal institution leading the syndicated credit provision. This study provides an overview of the implementation of dispute resolution in syndicated credit in the event of default by the debtor, as well as the legal protection afforded to the lead bank during the dispute resolution process. The findings indicate that the resolution of syndicated credit disputes resulting from debtor defaults is effectively conducted through negotiation. The lead bank plays an active role in openly assisting the debtor to find the best solution to fulfill their obligations. Moreover, the lead bank is granted legal protection in resolving syndicated credit disputes, as stipulated in the syndicated credit agreement signed before the credit is extended to the debtor. This legal protection is highly effective in addressing default disputes, thereby safeguarding the lead bank from potential losses

Abstract

This study examines the legal gaps in regulating data proportionality in ASEAN digital banking, particularly in Indonesia, the Philippines, and Malaysia. The main legal issue lies in the absence of clear standards governing the limitation, justification, and classification of personal data, which leads to excessive and potentially invasive data processing practices in digital banking systems. This research aims to examine the concept of data proportionality in digital banking and to assess the adequacy of legal frameworks governing data proportionality in Indonesia, the Philippines, and Malaysia in order to identify existing regulatory gaps. This study employs a normative legal research method with a comparative approach. The findings reveal that although all three countries have established data protection frameworks, none comprehensively integrate data proportionality into digital banking regulations, resulting in fragmented and ineffective legal protection. Indonesia lacks detailed standards and risk-based mechanisms, while the Philippines and Malaysia show regulatory gaps in governing conventional digital banking services. These weaknesses contribute to increased risks of privacy violations and legal uncertainty. Therefore, this study suggests the need for regulatory reform, including clearer data classification, proportionality standards, and mandatory risk assessments, to ensure a balance between digital banking innovation and the protection of consumer privacy rights.
