Abstract

Penelitian ini bertujuan untuk menganalisa permasalahan terkait masalah pembajakan novel di marketplace melalui perlindungan hukum atas Hak Cipta di Indonesia. Adapun metode penelitian yang digunakan adalah metode yuridis normatif dengan mengkaji data-data kepustakaan yang berkaitan dengan peraturan hukum atau perundang-undangan terkait Hak Cipta. Hasil penelitian menunjukan bahwa pembajakan di Indonesia sebetulnya telah diatur melalui dua cara yang didasari oleh teori perlindungan hukum. Pertama, perlindungan hukum preventif guna mencegah atau menghindari terjadinya kasus pembajakan. Kedua, perlindungan hukum represif yang bertindak sebagai penegak hukum dalam mengadili pelaku pembajakan dengan pemberian denda maupun sanksi, di mana kedua upaya tersebut secara substansi merujuk pada pemberlakuan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta.

Abstract

Kualitas informasi yang diberikan oleh penyedia Kredit Pemilikan Rumah (KPR) erat kaitannya dalam pemenuhan hak konsumen, serta berakibat dampaknya terhadap pemahaman dan keputusan konsumen KPR. Masalah ketidakjelasan informasi terkait suku bunga, biaya tambahan, dan syarat kredit, yang sering menyebabkan kesalahpahaman dan konflik antara Bank dengan Konsumen KPR. Penelitian bertujuan untuk mengidentifikasi kualitas informasi KPR yang disampaikan dan menganalisis pengaruhnya terhadap pemahaman dan keputusan konsumen KPR di Kota Batam. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan analisis bahan hukum sekunder, seperti peraturan perundang-undangan, didukung pendekatan empiris dari data primer yang langsung diperoleh dari sebaran kuesioner kepada 59 Responden (konsumen KPR di Kota Batam). Hasil penelitian menunjukkan bahwa meskipun sebagian besar konsumen merasa informasi cukup jelas, namun aspek transparansi terkait biaya tambahan dan risiko masih memerlukan perbaikan. Transparansi informasi berkontribusi positif terhadap kepercayaan dan keputusan konsumen, dengan diperlukan edukasi lebih lanjut dan pengawasan regulator untuk meningkatkan perlindungan konsumen. Penelitian ini menegaskan pentingnya penyampaian informasi yang akurat dan transparan sebagai bentuk tanggung jawab hukum penyedia KPR, sesuai dengan Undang-Undang Perlindungan Konsumen.

Abstract

This study aims to analyze the principles of legal justice embodied in Decision Number 31/Pdt.Sus-Hak Cipta/2020/PN.Niaga.Jkt.Pst., concerning the copyright dispute between the artwork “Urban Light” by Chris Burden and the “Love Light” installation at Rabbit Town. The research employs a normative juridical method, utilizing statutory and case approaches to examine the relevance of Law Number 28 of 2014 on Copyright and its application in the court’s judgment. The data used are secondary, comprising legislation, court decisions, and related legal literature, analyzed descriptively and qualitatively. The findings reveal that the panel of judges has duly considered distributive, commutative, and procedural justice by providing comprehensive protection of the moral and economic rights of the creator. The decision affirms that unauthorized reproduction and adaptation of copyrighted works constitute infringement, ensuring a balanced consideration of the rights of creators and users. Furthermore, this ruling is expected to serve as a significant precedent for copyright protection in Indonesia and to enhance public legal awareness regarding the importance of respecting intellectual property rights.

Abstract

Commercial property disputes are one of the significant challenges in business practice in Indonesia, especially in the legal relationship between creditors and debtors. This study aims to analyze legal protection for creditors in commercial property disputes through a case study of the Batam District Court Decision No. 158/Pdt.G/Plw/GS/2022/PN Btm. The methodology used is normative legal research with an analytical-descriptive approach, which examines laws and regulations and related court decisions. The results of the study show that in this case it includes three dimensions of legal protection according to Philipus M. Hadjon's theory, namely preventive, repressive, and curative. In the preventive dimension, protection is provided through the binding of dependent rights and the use of the cession mechanism as an anticipatory measure. The repressive dimension, lawsuits and cession recognition by the courts ensure that creditors' rights remain protected after a dispute has occurred. The curative dimension, guarantee execution and litigation process play a role in the recovery of creditor rights due to debtor default. However, the study also found weaknesses in the implementation of legal protection, especially related to the long legal process and bureaucracy in the execution of bail. This study concludes that legal protection for creditors in Indonesia has been well regulated normatively, but its implementation needs to be strengthened, especially in the efficiency of guarantee execution and dispute management. Recommendations are given to creditors, debtors, and governments to improve dispute management and legal protection within the commercial property sector

Abstract

The growing incidence of cyber theft has exposed critical deficiencies in trade secret protection regimes, particularly in jurisdictions lacking integrated cybersecurity measures. This study analyses the legal frameworks of Indonesia, India, and Australia, using the United States' Defend Trade Secrets Act (DTSA) as a benchmark to evaluate their capacity to address digital trade secret misappropriation. Employing a comparative legal methodology, it examines statutory provisions, judicial interpretations, and enforcement mechanisms relevant to cybersecurity threats. The findings reveal that while Indonesia has enacted a trade secret statute, it lacks procedural safeguards specifically designed to address cyber theft. India and Australia, by contrast, depend on disjointed protections rooted in contract law, breach of confidence, and general cybercrime statutes. None of the jurisdictions provide a robust legal framework incorporating vital cybersecurity components such as ex-parte seizure, digital evidence management, or encryption standards. These shortcomings highlight a critical vulnerability in safeguarding proprietary information amidst escalating cyber threats. The study underscores the urgent need for legislative reform to align trade secret protection with contemporary cybersecurity challenges. Its insights contribute to the ongoing academic and legal discourse on the adequacy of current laws in mitigating cyber-enabled intellectual property violations. Meningkatnya insiden pencurian siber telah mengungkap kelemahan mendasar dalam rezim perlindungan rahasia dagang, terutama di yurisdiksi yang belum mengintegrasikan langkah-langkah keamanan siber dalam kerangka hukumnya. Studi ini menganalisis sistem hukum Indonesia, India, dan Australia, dengan membandingkannya terhadap Defend Trade Secrets Act (DTSA) dari Amerika Serikat untuk menilai efektivitasnya dalam menangani penyalahgunaan rahasia dagang secara digital. Dengan pendekatan hukum komparatif, kajian ini mengevaluasi ketentuan undang-undang, doktrin yurisprudensi, dan mekanisme penegakan yang relevan terhadap ancaman siber. Hasilnya menunjukkan bahwa meskipun Indonesia memiliki undang-undang khusus, perlindungan prosedural terhadap pencurian siber belum memadai. India dan Australia justru mengandalkan perlindungan yang terfragmentasi melalui hukum kontrak, asas kepercayaan, dan regulasi kejahatan siber umum. Tidak satu pun dari ketiga negara menyediakan kerangka hukum menyeluruh yang mencakup unsur penting seperti penyitaan ex-parte, pengelolaan bukti digital, atau standar enkripsi. Kekosongan ini menunjukkan lemahnya perlindungan terhadap informasi bisnis sensitif di tengah meningkatnya ancaman digital. Studi ini menekankan urgensi reformasi legislatif untuk menyelaraskan perlindungan rahasia dagang dengan tantangan keamanan siber modern. Temuan ini memberi kontribusi penting bagi wacana akademik dan hukum terkait perlindungan kekayaan intelektual di era digital.

Abstract

Dalam beberapa tahun terakhir, pelanggaran data pribadi oleh korporasi di Indonesia meningkat secara signifikan, menunjukkan perlunya kepastian hukum dalam pertanggungjawaban pidana terhadap pelaku. Penelitian ini bertujuan untuk menganalisis kepastian hukum dalam pertanggungjawaban pidana korporasi atas penyalahgunaan data pribadi di Indonesia. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Hasil penelitian menunjukkan bahwa Indonesia telah memiliki kerangka hukum yang jelas dan tegas dalam pertanggungjawaban pidana korporasi atas penyalahgunaan data pribadi. UU PDP menetapkan mekanisme strict liability, yang memastikan korporasi tetap bertanggung jawab meskipun pelanggaran dilakukan oleh individu dalam perusahaan. Sanksi tegas berupa denda hingga 2% dari pendapatan tahunan, pencabutan izin usaha, serta hukuman pidana bagi pengurus korporasi memperkuat aspek kepastian hukum.

Abstract

The integration of Artificial Intelligence (AI) into scientific advancements has become a crucial part of daily life for many people. In the creative industry, AI has the potential to not only enhance the level of creativity, but also productivity. The legal implications of this development must be carefully analyzed for the development of the creative industry, to establish a legal position on where AI stands in the increasingly competitive market, especially when Intellectual Property Right (IPR) as a key factor is taken into account. This research examines the need for a legal framework for AI. It was conducted through the lens of intellectual property law, to determine its place within existing IPR regimes using the comparative legal method. The results conceptually justify the urgency to regulate AI, and highlights the taxonomy dilemma of AI-generated works within the current dynamics of the creative industry, indicating a taxonomy dilemma. Further analysis also indicates that while there’s a decent urgency to address all of the normative issues that exist within Indonesia’s IPR legal framework, it’s imperative that Indonesia prioritizes the development of the copyright and patent regimes, which are closely related to the nature of AI-generated works.

Abstract

Local cultural heritage is a Traditional Cultural Expression, which is an important asset and needs to be protected to ensure the continuity and diversity of human cultural heritage. However, this practice is considered to face serious threats due to the rapid development of the modern tourism industry and minimal attention to the preservation of traditional culture. This research will clearly illustrate the urgency of legal protection and preservation of the Ngarong Fishing Culture as an inseparable part of the local cultural heritage which is rich in traditional values. This research uses empirical juridical research with statutory, conceptual and ethnographic approaches. The research stages consist of problem formulation, data collection, data analysis, correlation discovery, preparation of recommendations and preparation of research outputs. The data sources used are primary and secondary data with qualitative descriptive analysis techniques. The research results show that the Ngarong Fishing Culture is not just an ordinary fishing activity, but rather a ritual passed down from generation to generation by the local community. One of the main obstacles in efforts to preserve the Ngarong Fishing Culture in Teluk Mata Ikan Village is that there is no recognition as a Communal Intellectual Property Right at the Directorate General of Intellectual Property (DJKI), so there is a large potential for loss due to intellectual property violations. Therefore, legal protection is needed, interpreted as an effort to protect legal subjects by using positive law which is enforced by its implementers and given sanctions for violators. In traditional expression, this can be done with preventive protection efforts or prevention efforts by registering communal intellectual property rights with the Directorate General of Intellectual Property (DJKI) by the Regional Government with local traditional stakeholders.

Abstract

Geographical Indications play a crucial role as an intellectual property regime that protects unique products originating from specific regions, shaped by both human and natural factors. The presence of natural factors makes Geographical Indications a potential tool for strengthening local economies while simultaneously protecting the environment. This study aims to analyze the potential utilization of the Geographical Indications regime in Indonesia to support sustainable development, particularly in relation to environmental protection. Employing a normative legal research method supported by a statutory approach, this study examines the connection between Geographical Indications and environmental protection. The analysis reveals that despite the conceptual link between Geographical Indications and environmental sustainability, there is no normative legal support within the existing regulatory framework governing Geographical Indications. A normative construction model is proposed to facilitate the integration of environmental protection into the Geographical Indications regime, emphasizing aspects of planning, utilization, supervision, maintenance, control, and law enforcement.

Abstract

Supervision of market activities and competition in Islam has existed since the time of Prophet Muhammad PBUH and, at the same time, became a duty of an official called a muhtasib (supervisor). Al-Hisbah, as a controller institution for economic activities and market competition, aims to uphold the amar ma'ruf nahi munkar (commanding the good and forbidding the evil). Meanwhile, KPPU, as an independent institution, functions as a controller of the practice of monopolies and unfair business competition in Indonesia under the principle of economic democracy to support national economic development. This research uses the juridical-normative method with a historical and conceptual approach. Having compared the role of KPPU in supervising business competition to al-hisbah institution in Islam, this study finds out that KPPU, in general, is similar to al-hisbah on account that the substance and the values contained in al-hisbah have been embedded in KPPU especially in upholding amar ma'ruf nahi munkar in economic activities and business competition.
