Abstract

Community based correction merupakan bentuk program dalam pembinaan bagi setiap narapidana sewaktu mereka menjalani sisa pidandanya di dalam lembaga permasyarakatan, kemudian mereka diberi kesempatam untuk kembali atau bersosialisi kembali ke lingkungan masyarakat dengan pengawasan atau supervise tertentu. Dengan bertujuan untuk melaksanakan program opresional lapas terbuka dipelukan 5 (lima) prinsip dasar, yang diantaranya sebagai berikut: prinsip pertama narapidana harus memilki kesempatan untuk memperbolehkan kerjaan, prinsip yang kedua narapidana harus diseleksi terlebih dahulu sebelum turun langsung ke tengah masyarakat, prinsip ketiga narapidana tidak boleh di eksploitasi, prinisip keempat system pengamanan harus minimum, kemudian yang terakhir tanggung jawab pemindahan terhadap narapidana.

Abstract

The importance of education for children in life, it needs to be given to all children but what about children in conflict with the law who are serving their criminal period at the Special Children's Institution, education carried out by means of Packages A, B, and C is one solution but is it in the solution? Therefore, sports education is given and how the education is given. In this study, it is explained that sports education has been implemented with its programs in formal, non-formal and informal education. To obtain the results of research on the fulfillment of the right to Sports Education, this research uses qualitative research methods by means of observation and also conducts case studies of applicable laws. This study has a purpose, namely to find out and obtain data about the implementation of the fulfillment of the right to education for children in conflict with the law at the Special Child Development Institute, especially in Sports Education. Children who are in conflict with the law have the right to education. Sports Education is education that focuses on physical and sports which is carried out as part of a regular and continuous educational process and has the aim of obtaining physical fitness, personality, skills, health, and knowledge. Sports Education is one form of an implementation of coaching at the Special Child Development Institute. The limited facilities and infrastructure at the Child Special Guidance Institute do not become an obstacle to fulfilling the right to education for children, especially sports education. The results of this study indicate that the implementation of the fulfillment of the right to education, especially Sports Education, is carried out well even though in its implementation it is still not optimal in fulfilling the Right to Education for Children in the Special Guidance for Children Institutions because there are several factors from internal and external factors.

Abstract

In providing protection and guaranteeing the rights of persons with disabilities, the Government makes laws and regulations, namely Law Number 8 of 2016. As a human being, of course, persons with disabilities are not free from mistakes, they can also be subject to imprisonment like other citizens. Prisons as a forum for fostering inmates who have been convicted of committing a crime are not entitled to take away the rights they should have. Inmates only lose their freedom of movement and still get human rights. Prisoners with disabilities have different special needs, where this right must be fulfilled by prisons as stated in Law Number 8 of 2016 concerning Persons with Disabilities. The rights they should get can be in the form of special residential rooms, special toilets for disabilities, special disabled lanes, and wheelchairs/canes to facilitate mobility. In its implementation, there are still some obstacles in fulfilling the rights of prisoners with disabilities, therefore this study uses a normative method aimed at examining library materials and secondary materials such as related laws and regulations. The results of the study indicate that the fulfillment of the rights of prisoners with disabilities in prisons is still not optimal, so there is a need for evaluation and quality improvement carried out by prisons and related institutions, besides that further regulations are needed that focus on guaranteeing the rights of prisoners with disabilities. Abstract

There are provisions concerning criminal sanctions in the implementation of criminal law. where there is a purpose of imposing criminal sanctions for convicted offenders. The purpose of the imposition of criminal sanctions should not be solely to encourage the existence of a retaliation. In this case the Correctional institution is one of the executors of the purpose of the penal system in the improvement system As stated in the legislation, a number of law enforcement efforts to ensure that inmates are punished to be aware of their mistakes, in order to correct themselves and will not repeat crimes as well as then they are acceptable to be returned by the community, actively participate in the development and live a fair living as a good citizen and responsible criminal law, accordingly on law regulations act No. 12 Of 1995 about correctional regulations to regulate all rights of inmates. In the first letter k section 14 of the Act (Act No. 12 of 1995) it says "Prisoners are entitled to parole". Likewise the rights of well-behaved inmates of narcotics justice. Following the current development of narcotic crimes is a complex crime, because narcotic crimes do perpetrators can become victims at once. Best coaching for inmates returning/integrating into society and not being electrically isolated with iron rods.

Abstract

A citizen who commits a criminal crime and is proven guilty until he has legal force will continue to serve the crime of missing independence in prison. Broadly speaking, this is a criminal justice system in Indonesia where because the system does not adapt to the development of the times and conditions in the field, this is making prisons as a post-final punishment for being overcrowded (excess occupants) and coaching does not run optimally based on the reasons above, this underlies the existence of the CBC concept, which is a type or alternative punishment program that is coaching in Indonesia, the concept is carried out when prisoners will serve the rest of their crimes with the concept of blending them into the community with certain conditions and supervision. This study aims to determine the extent to which the effectiveness of the role of CBC on coaching and overcrowded in prisons. This research method uses descriptive qualitative research by means of library research, namely by taking data from journal literature, documents, news and books that are relevant to the research core. The results of this study are that the CBC concept is very effective in helping overcrowded prisons and the coaching model is quite good even though there are obstacles in its implementation, such as not optimal infrastructure for inmates and obstacles in collaborating with 3rd parties as a place for the CBC implementation process. But this is worth the positive impact that is better with the application of this concept

Abstract

Overcrowding in correctionaI institutions in Indonesia is one institution that stiII has unresoIved probIems untiI now. The government has made efforts to give rights to every inmate, one of which is a conditionaI exemption. A conditionaI exemption is one of the targets in the prisoner deveIopment system, which is carried out based on a correctionaI system that aims to prepare prisoners to bIend in heaIthiIy into society. He has a roIe again as a member of society and has a sense of responsibiIity. In the execution, not aII prisoners who have served 2/3 of the criminaI period receive conditionaI exemption because various conditions need to be fuIfiIIed and speciaI requirements from the inmates themseIves. They need to show awareness and regret of their mistakes and have shown good character, which can be shown by taking coaching seriousIy. It is important to remember that they shouId not get punishment during discipIinary. After the consideration has been carried out regarding the approvaI of the paroIe proposaI for the convicts invoIved, a Decision Ietter (SK) on conditionaI exemption is issued. Then guidance is given to prisoners who get conditionaI exemption by the (Bapas). The impIementation of the granting of conditionaI reIease, in fact, stiII finds severaI internaI and externaI obstacIes.

Abstract

An inmate who is sentenced to a correctional facility is certainly faced with a pressure to deal with the problems he is currently facing, whether it is very high stress that will endanger the individual's physical and mental condition or the worst possibility, namely ending his life. The status of changing into a prisoner is the hardest thing to be separated from the family. The house assimilation policy is one of the goals in bringing prisoners closer to society, the family is one of the keys in implementing this program. Changing someone into a prisoner is not an easy thing, so it takes the support of a family who is willing to accept it again. This support is very meaningful in minimizing psychological disorders because being far from the closest people makes prisoners vulnerable to this. This situation is exacerbated by the existence of negative stigma from the community regarding the existence of prisoners, namely people who are considered to have a negative influence and can harm the community. With such circumstances, it is necessary to have an encouragement that plays a role in preventing, overcoming, and avoiding negative impacts that can harm themselves or others where prisoners feel that they have someone who loves, cares, and respects themselves so that they can reduce anxiety or stress that is more intense. . The house assimilation policy is one of the goals in bringing prisoners closer to society, the family is one of the keys in implementing this program.

Abstract

Correctional facilities which have the aim of forming Correctional Inmates to become fully human, realize mistakes, improve themselves and do not repeat criminal acts so that they can be re-accepted in society, in the view of the general public there are more negative stigmas, especially in terms of the icons of correctional facilities. , namely the Correctional Institution or Prison. A lot of news that is known by the public about prisons is negative news such as fires, riots, escapes and even overcrowding or overcapacity. This article will explain the factors, effects of alternative punishment in overcoming prison problems and their implementation in Indonesia. The research uses a normative juridical method which will seek the truth based on logic and actual circumstances.

Abstract

Hukuman adalah suatu bentuk hukuman yang berusaha memberikan perlakuan untuk memperbaiki perilaku narapidana. Program pemasyarakatan bertujuan untuk mempersiapkan dan memulihkan keutuhan hubungan antar narapidana dan menjadi warga negara yang aktif dalam masyarakat. Hubungan berbasis masyarakat antara pemasyarakatan dan rehabilitasi didasarkan pada alasan utama reuni narapidana dan masyarakat. Metode penelitian dalam penelitian ini menggunakan metode deskriptif dengan pendekatan kualitatif untuk menganalisis masalah dan memberikan gambaran untuk menemukan solusi yang paling efektif dan efisien. Sebagaimana telah dijelaskan pada sub bab sebelumnya, pentingnya posisi Lapas dalam mendukung konsep putusan Lapas berbasis masyarakat merupakan langkah yang baik untuk mencapai tujuan Lapas. Paradigma pembalasan tidak selalu menjadi cara terpenting untuk mencapai tujuan pemidanaan, namun perubahan paradigma penegakan hukum berbasis masyarakat adalah cara yang baik untuk menyadarkan narapidana dari jalan yang hilang. Untuk kejahatan yang dilakukan, Anda dapat membiarkan dan menyembuhkan goncangan sosial.

Abstract

Sistem Pemasyarakatan adalah sebuah proses pembinaan narapidana dengan berlandaskan falsafah bangsa Indonesia yang menilai narapidana adalah makhluk Tuhan, sebagai bagian dari masyarakat. pada pelaksanaan pembinaan narapidana, dikembangkan hidup kejiwaan, jasmaninya, pribadinya serta kemasyarakatan yang langsung dan tanpa melupakan hubungannya dalam masyarakat. Oleh karna itu Narapidana pada saat di lepaskan ke dalam masyarakat benar-benar mampu dan siap hidup bermasyarakat sebagai warga yang taat pada hukum dan norma-norma yang berkembang di mana mereka berada. Penelitian ini bertujuan untuk mengetahui pelaksanaan Asimilasi pada Narapidana khusus Tipikor di Lembaga Pemasyarakatan Perempuan Kelas IIA Medan. Dalam penelitian ini digunakan metode penelitian kualitatif, dan jenis penelitian mendeskripsikan yang mendetail tentang suatu penomenal yang terjadi, dan untuk mendapatkan informasi. Sebagai hasil penelitian menyatakan setiap Narapidana memiliki hak yang sama yaitu memperoleh Asimilasi termasuk Narapidana khusus Tipikor, namun untuk hal ini syarat-syarat yang diberikan berbeda dengan Narapidana umum. Pada pelaksanaannya di Lembaga Pemasyarakatan Perempuan Kelas IIA Medan di temukan kendala-kendala yaitu 1) Perbandingan Jumlah petugas pemasyarakatan dengan jumlah Narapidana yang kecil. 2) Hanya sedikit pihak ketiga yang dapat menyetujui program Asimilasi di luar Lembaga Pemasyarakatan tersebut. 3) Minimnya pengetahuan Narapidana tentang program Asimilasi. 4) Minimnya pengetahuan masyarakat sekitar Yayasan tentang sistem pemasyarakatan dan program Asimilasi. 5) Masih kurang efektif dan efisien peraturan perundangan-undangan yang ada.
