Abstract

Abstract

This research discusses women's rights after divorce by comparing Islamic family law in Indonesia and Egypt. The main focus of this research is to answer three questions: 1) how are women's rights post-divorce regulated in Indonesia, 2) how are the same arrangements in Egypt, and 3) comparative analysis between the two countries. The research uses a library method (research library) with a normative juridical approach and data collection techniques through document study. The research results show that in Indonesia, Islamic family law aims to protect women's rights through iddah, mut'ah and madhiyah livelihoods. However, enforcing these rights often faces challenges. In Egypt, Law no. 100 of 1985 provides similar protection, including the right to divorce and maintenance during the iddah period, although its implementation is hampered by social and cultural factors. A comparison between the two countries reveals similarities and differences in the arrangement of these rights. The husband's obligation to provide maintenance during the iddah period in Indonesia is flexible and determined by the court, whereas in Egypt it is more strict. Mut'ah in Indonesia is considered a respect that is not always required, while in Egypt it is the wife's right. In terms of joint assets, Indonesia considers all assets during a marriage to be jointly owned with division based on agreement, while Egypt considers the contribution of each party. This difference is influenced by economic factors, local culture, as well as regulations on interfaith marriages which are prohibited in Indonesia but exist in Egypt.

Abstract

Zakat distribution in Indonesia has generally been limited to material measurements, which often results in an imbalanced impact on mustahik , especially in the context of productive zakat. To address this gap, the CIBEST (Center for Islamic Business and Economic Studies) model is recognized as an effective tool for measuring both material and spiritual dimensions of welfare. This study focuses on productive zakat recipients ( mustahik ) under the auspices of BAZNAS in the Ajatappareng region, specifically in Parepare City and Sidenreng Rappang Regency. The research adopts a mixed-methods approach, combining quantitative and descriptive qualitative analysis, while using the CIBEST model to evaluate the impact of zakat distribution. Findings reveal that BAZNAS distributes both productive and consumptive zakat—including cash assistance, business equipment, and staple food—alongside training, mentoring, and empowerment programs. Based on the CIBEST quadrant analysis, significant shifts occurred in the material and spiritual poverty classifications of mustahik . Before receiving zakat, households were distributed as follows: Quadrant I (10 households), Quadrant II (22), Quadrant III (0), and Quadrant IV (3). After receiving productive zakat, the distribution changed markedly to: Quadrant I (29 households), Quadrant II (6), Quadrant III (0), and Quadrant IV (0). A paired-sample statistical test showed a significant difference in household income before and after zakat assistance, with a p-value (Sig. 2-tailed) of 0.000 ( 0.05). These findings confirm that productive zakat distribution by BAZNAS has a positive and statistically significant impact on improving the economic welfare of mustahik in the Ajatappareng region.

Abstract

This research examines social facts related to marriage dispensation before and after the enactment of Law No. 16/2019 at the Sidenreng Rappang Religious Court. The focus of the research is on the factors causing the increase in marriage dispensation applications and the response of law enforcers in the religious courts. The method used is field research with a qualitative descriptive approach and case study method. The results showed that after the enactment of Law No. 16/2019, which raised the minimum age of marriage to 19 years, there was a significant increase in marriage dispensation applications at the Sidenreng Rappang Religious Court. The main factors influencing the high number of applications include family economic conditions, low levels of education, strong local social and cultural norms, pregnancy outside marriage, and lack of supervision and education from parents. In addition, fear of violating religious norms and a desire to maintain the family's reputation are also important reasons for marriage dispensation applications. Despite various education and socialization efforts by the Sidenreng Rappang Religious Court, the effective implementation of the minimum age of marriage still faces challenges due to deep-rooted social and cultural factors in the community. This study recommends the need for increased legal education, strengthening the role of parents, and synergy between agencies to reduce marriage dispensation.

Abstract

This study investigates the phenomenon of unregistered marriage and efforts to prevent underage marriage in Wajo Regency. The research aims to examine the motivations behind unregistered underage marriages through the lens of Maq??id Mukallaf and evaluate the effectiveness of local legal interventions. Wajo Regent Regulation No. 64 of 2022 serves as a key policy instrument aimed at curbing underage marriage and promoting legally recognized unions. Using a qualitative juridical approach, data were collected through in-depth interviews with marriage officials, parents, community leaders, and underage couples, supported by observation and document analysis. The study integrates Maq??id Mukallaf theory to assess the legality and ethical validity of marriage motives, alongside Ibn Qayyim al-Jawziyyah’s theory of legal change and Weber’s bureaucratic management theory to evaluate policy responsiveness and implementation. Findings indicate that although unregistered marriages involving underage couples may fulfill internal aspects such as personal capability and social support from parents and family, they are often driven by defensive motives such as avoiding complex legal procedures or social stigma which ultimately fail to meet the criteria of valid Maq??id Mukallaf.  Such acts are legally and morally untenable when they cause harm to others, particularly to children. This study highlights the importance of aligning legal frameworks with religious principles and community engagement to protect children’s rights and foster sustainable social change.

Abstract

The welfare of children is one of the key concerns in matters of marriage and divorce. Issues related to child welfare typically arise in custody disputes following divorce. Almost all Islamic family laws in Muslim countries have legal provisions to ensure child welfare. However, these welfare provisions are often considered unclear due to their general nature. This article aims to highlight the elements of child welfare care that are sought to be manifested through Islamic family law provisions in Southeast Asian Muslim countries. A document analysis method, including case judgments, was used to identify the aspects of welfare that are of concern. The analysis found that some Islamic family law provisions in Southeast Asian countries regarding child welfare remain general in nature. Legal practitioners have attempted to outline the elements of child care through interpretations of existing provisions or through the rationale provided in court judgments. Among the identified welfare elements are priority for the mother, the status quo of the current custodian, the child's age, the child's right to choose, the custodian’s religion, the custodian's lifestyle, economic status of the custodian, health status of the custodian, the custodian’s age, the custodian’s behavior, the custodian's place of residence, and access to the child's education. These elements are typically emphasized by disputing parties when presenting evidence to the court.
