Abstract

This study discusses the legal legitimacy of public whipping in Aceh as part of the legal specificity regulated through Law Number 11 of 2006 concerning the Government of Aceh. This specificity provides a constitutional basis for Aceh to implement Islamic law-based law through Qanun Jinayat, especially Qanun Number 6 of 2014 concerning the Jinayat Law which regulates the punishment for certain criminal acts, including adultery. Although normatively legitimate because it is underpinned by asymmetric decentralization mechanisms, the practice of public caning is controversial from a human rights perspective. Indonesia has ratified the ICCPR through Law Number 12 of 2005, so it is bound by the prohibition of cruel, inhuman, and degrading treatment. This condition creates a normative tension between Islamic sharia principles that emphasize social morality and international human rights principles that emphasize individual dignity. The research uses normative juridical methods with a legislative and conceptual approach, and analyzes the relationship between Islamic law, national law, and international law. The results of the study show the need for a more contextual reconstruction of punishment, emphasizing maqāṣid al-syarī'ah as a meeting point between religious values and human rights principles. Alternatives such as closed executions or rehabilitative punishment can be a solution so that the application of jinayat law remains relevant without causing serious contradictions. Thus, this study emphasizes the importance of humanistic, transformative, and substantive justice regulatory innovation

Abstract

The increasing reliance on screenshots, chats, and voice notes in Indonesian criminal proceedings reflects a significant shift in evidentiary practices driven by digital communication technologies. However, this development has not been followed by adequate normative adaptation within criminal procedural law. Article 184 of the Criminal Procedure Code does not explicitly accommodate micro-digital evidence, while the Electronic Information and Transactions Law merely provides general recognition without specifying procedural standards for authentication and evidentiary weight. This condition creates normative ambiguity regarding the legal status, admissibility, and probative value of screenshots, chats, and voice notes, resulting in inconsistent judicial practices and potential violations of fair trial principles. This study employs normative legal research using statute, conceptual, and case approaches to analyze the position of micro-digital evidence in Indonesian criminal trials. The findings demonstrate that unverified digital evidence risks eroding the presumption of innocence, shifting the burden of proof to defendants, and undermining legal certainty. This article argues that criminal procedural law must be reformed to explicitly regulate the classification, authentication, and corroboration of micro-digital evidence in order to ensure technological adaptation without compromising due process of law and fair trial guarantees.

Abstract

This article examines the utilization of customary law in resolving land and natural resource disputes through a restorative justice approach within Indonesia’s plural legal system. Although customary institutions remain actively used by indigenous communities to resolve disputes based on consensus and social harmony, their normative status within the formal legal system remains uncertain. This study identifies three core legal issues: normative ambiguity concerning the legal force of customary dispute resolution, a legal vacuum in the formal recognition of restorative mechanisms outside judicial processes, and conflicts of norms between customary law and positive state law governing land and natural resources.Using a normative juridical method with statute, conceptual, and case approaches, this article analyzes constitutional provisions, land and natural resource regulations, and legal doctrines on restorative justice and legal pluralism. The analysis demonstrates that customary dispute resolution inherently reflects restorative justice principles, including harm repair, communal participation, and restoration of social relations. However, these mechanisms lack formal legal recognition as binding and enforceable outcomes. Judicial and administrative practices tend to prioritize procedural legality and formal documentation, thereby marginalizing customary restorative settlements and perpetuating legal uncertainty for indigenous communities. This article argues that the persistence of land and natural resource disputes reflects structural deficiencies in Indonesia’s legal framework rather than isolated implementation failures. It proposes a prescriptive framework for institutionalizing customary restorative mechanisms through statutory recognition, administrative integration, and pluralistic judicial interpretation to ensure legal certainty, substantive justice, and constitutional compliance

Abstract

This study aims to analyze the role of political parties in the consolidation of democracy in Indonesia through a qualitative approach with a literature study method. The political transition after the 1998 reform has opened up a more open democratic space, but has not yet fully produced substantive democracy. Political parties as the main pillars of democracy should carry out the functions of interest aggregation, political education, cadre formation, and supervision of the government. However, various literatures show that political parties in Indonesia still face various challenges, such as oligarchic dominance, weak internal democracy, low quality of cadre recruitment, and a tendency towards political pragmatism. This study uses secondary data from journal articles, academic books, and reports from credible institutions which are systematically analyzed using content analysis techniques. The results of the study show that political parties have not been able to become effective agents of democratic consolidation due to the lack of party institutionalization and low political literacy of the community. Therefore, a comprehensive reform of the party system is needed through institutional strengthening, internal transparency, and encouragement of more inclusive political participation. Abstract

This study aims to examine the relationship between decentralization and the effectiveness of regional government in Indonesia through a qualitative approach with a literature study method. Decentralization implemented after the reform through regional autonomy policies has given broad authority to regional governments to regulate their own household affairs. Although it is expected to improve the quality of public services and locally-based development, its implementation shows mixed results. This study analyzes various scientific sources in the form of journals, academic books, policy reports, and regulations to identify patterns of success and challenges in the implementation of regional autonomy. The results of the study show that the effectiveness of regional government is greatly influenced by institutional capacity, human resource competence, regional head leadership, community participation, and the ongoing monitoring system. Some regions are able to utilize autonomy to innovate governance, but most still face structural and cultural obstacles. In addition, fiscal dependence on the central government and weak coordination between institutions are obstacles to achieving effectiveness. Therefore, strengthening regional capacity and implementing an asymmetric decentralization model are important to realize effective, accountable, and participatory governance in the era of regional autonomy.

Abstract

This study examines how the politics of fear is shaped and exploited through threat narratives in state security policy. Using a qualitative approach and literature study methods, this study analyzes the dynamics of discourse used by the state to legitimize repressive security measures. Threat narratives, discursively constructed by state actors and amplified by the media, play a central role in shaping public perceptions of imminent danger. The resulting collective fear allows the state to justify enacting extraordinary policies, even when there is no real, proportionate threat. Within the framework of securitization and state of exception theories, security policy is interpreted as a response to politically defined, rather than objective, threats. As a result, the space for public participation is narrowed, civil rights are diminished, and the rule of law is threatened. This study emphasizes that security cannot be built on manipulative constructs of fear but must be grounded in transparency, justice, and respect for democratic principles. Critique of the politics of fear is crucial to ensure that security policy does not deviate from the framework of a democratic and civilized state based on the rule of law.

Abstract

This study aims to examine the development of democracy in developing countries through a qualitative approach based on literature. Democracy in developing countries exhibits diverse dynamics, ranging from institutional progress to decline due to covert authoritarian practices. By reviewing various scientific sources such as academic journals, international agency reports, and reference books, this study presents a thematic synthesis of factors influencing the democratization process. The results indicate that the weakness of political institutions, elite dominance, and socio-economic inequality are the main obstacles to democratic consolidation. However, there is also a significant role for non-state actors such as civil society organizations and the media in promoting political openness and accountability. Furthermore, this study emphasizes the importance of a contextual, non-universal theoretical approach in understanding democratic practices in developing countries. These findings reinforce the urgency of developing a more inclusive, adaptive, and local-reality-based democratic framework. Thus, this literature study not only provides theoretical contributions to the realm of political science and governance but can also serve as a reference for formulating more sustainable policies to strengthen democracy in developing countries.

Abstract

Public places have the potential to become places for disease transmission and environmental pollution, for example, tourist spots. Muaro Jambi Temple is one of the cultural heritage complexes of the largest Hindu-Buddhist temple complex in Southeast Asia. It is also the most visited tourist spot in Muaro Jambi Regency. This study aims to evaluate the implementation of sanitation at the Muaro Jambi Temple tourist area. The method used in this research is qualitative research with an evaluation approach. There were 8 informants in this study who were taken by purposive sampling. Data collection was carried out by means of in-depth interviews, observation, and document review. Data analysis with content analysis method. The validity test of the research was carried out using the triangulation method. The results showed that the human resources of the Jambi Kecil health center had not met the standards, the cleaning staff or caretakers at the temple were sufficient in quantity but had not been assigned specifically to implement standardization of sanitation for tourist attractions. Funds for the implementation of the program from the Public health center come from BOK, while the tourism management has not prepared funds for implementing sanitation. The facilities and infrastructure of the Public health center are adequate, but the sanitation facilities in the temples are not up to standard. There is no policy that regulates STTU. Examination and assessment of sanitation in the temple had never been done before. When a sanitary inspection was carried out, it was found that the Muaro Jambi temple did not meet health requirements, namely 42.63%. It is hoped that the regional government will make regional regulations regarding the application of STTU and tourism managers will start implementing standardization of sanitation as a necessity. Abstract

Background: Evaluation of cross-sectoral control of refillable drinking water depot is a strategic role in protecting consumers to obtain standardized drinking water quality. Objective: The purpose of this study was to evaluate the factors in the control and management of refillable drinking water depot in the working area of the Muaro Jambi District Health Center. Methods: The method used was a descriptive qualitative approach, which is to understand the phenomenon of the research subject holistically. Results: The results showed that the evaluation conducted by the health office was not optimal, most of the refillable drinking water depots in the Puskesmas working area had not been inspected. This is influenced by limited human resources in monitoring and evaluating each refillable drinking water depot, lack of socialization and education to refillable drinking water depot businesses and the community regarding the importance of consuming quality-assured drinking water, and especially the lack of awareness of refillable drinking water depot businesses to pro-actively meet drinking water quality standards. Conclusion: The lack of optimal cross-sectoral control of refillable drinking water depots is influenced by human resources and socialization and education programs, along with community awareness. It is expected that there will be more intensive integration between the health center, health office, and village officials who play a role in monitoring and evaluating the management of refillable drinking water depot.

Abstract

Program pengabdian masyarakat ini dilaksanakan melalui kegiatan Kuliah Kerja Nyata (KKN) di Desa Alue Kuyun, Kecamatan Woyla Timur, Kabupaten Aceh Barat dengan fokus pada pemanfaatan tanaman herbal sebagai obat tradisional. Tujuan utama kegiatan ini adalah meningkatkan pengetahuan dan keterampilan masyarakat mengenai budidaya serta pemanfaatan tanaman herbal sebagai alternatif pengobatan alami dan mandiri. Metode pengabdian yang digunakan meliputi observasi, pendidikan masyarakat, pelatihan, dan difusi ipteks. Tahapan kegiatan mencakup survei lokasi, pembersihan dan pengolahan lahan, pembuatan rak serta pagar sederhana, penanaman berbagai jenis tanaman herbal (jahe, kunyit, kencur, serai, daun sirih, dan lainnya), serta sosialisasi tentang khasiat dan pemanfaatannya. Hasil kegiatan menunjukkan bahwa masyarakat antusias terlibat dalam setiap proses, pengetahuan mereka tentang manfaat tanaman herbal meningkat, dan terbentuk sebuah taman herbal sebagai sarana edukasi sekaligus sumber obat keluarga. Program ini berhasil memberikan dampak positif bagi kesehatan, lingkungan, serta membuka peluang ekonomi kreatif melalui pengembangan produk herbal. Dengan dukungan masyarakat dan perangkat desa, kegiatan ini berpotensi untuk dilanjutkan secara berkelanjutan dan direplikasi di wilayah lain.
