Abstract

The aim of this research is to describe the understanding of health care for the enforcement of the Law (Law) No. 17 Year 2023 in Indonesia. This law is a major health regulation that has a major impact on health care practices, health care systems, and health care in the country. This research uses qualitative research with literary studies. The results of this study reveal that the healthcare authorities' understanding of Act No. 17 of 2023 varies, with some very well aware of the regulation, while others may still need further clarification. There were also varied reactions to the changes produced by this law, including a sense of challenge in adapting to the new regulations.

Abstract

The competitiveness of micro, small and medium enterprises through the process of registering a brand can be defined as their ability to improve their competitive position in the market by utilizing the strength of an officially registered brand identity. A registered brand provides legal protection, increases the added value of the product, builds consumer trust, and opens up opportunities to expand a larger market. By having a registered brand, micro, small and medium enterprises can differentiate themselves from competitors, build customer loyalty, and increase bargaining power in business negotiations, which ultimately contributes to increasing overall competitiveness in an increasingly competitive business environment. The research method used in this study uses a literature study. The research findings show that registering a brand has a positive effect on the competitiveness of micro, small and medium enterprises. Some of the benefits obtained include: Increased product added value, Legal protection of intellectual property rights, Increased consumer trust, Ease of expanding the market and Increased bargaining power in business negotiations. Meanwhile, the obstacles faced by micro, small and medium enterprises in the process of registering a brand, such as: Lack of understanding of the importance of brands, Limited access to information and registration procedures, Costs that are considered quite high by some micro, small and medium enterprises and Relatively long processing time. Thus, registering a brand is an important step to increase the competitiveness of micro, small and medium enterprises in Pantai Sederhana Village and has the potential to be implemented in other areas. With the right support from various stakeholders, micro, small and medium enterprises can leverage the power of brands to strengthen their position in an increasingly competitive market.

Abstract

The COVID-19 pandemic has changed the paradigm of education systems globally, forcing educational institutions to adapt to distance learning. The role of digital technology in this transition has become key to maintaining educational continuity. With schools and universities closing down, online learning and educational technology (EdTech) are gaining mainstream attention as the primary solution in overcoming physical barriers. Management learning platforms, web conferencing applications and online educational resources are rapidly growing and being used extensively. The results show that while technology has enabled the continuity of learning, there is still a significant digital divide that affects equity in education. Implications of this technology adoption include the need for more adaptive and inclusive education policies and improved infrastructure to support equitable learning. This study concludes that digital technologies are critical in facilitating distance learning during crises and have the potential to improve the quality and affordability of education in the future, provided challenges in access and skills are addressed.

Abstract

We carried out this study to analyze several scientific pieces of evidence on the sustainability of the use of technology in the context of post-pandemic higher education learning. We got several kinds of literature in the form of scientific evidence from several publications released between 2010 and 2020, which we obtained electronically with keyword-based searches such as “technology uses," "sustainability Education," higher education" post-Covid-19," and technology in learning." To get answers to the questions of this study, we analyzed the data under another phenomenon approach which involved data coding techniques, data evaluation, data interpretation, and valid and reliable conclusions. Based on existing data and discussion of the results, we can conclude that the analysis of scientific evidence shows that the continued use of technology in teaching in higher education is an effort made to harmonize learning in the 21st century, which prioritizes technology adoption to accelerate learning outcomes in tertiary institutions. This result will be a helpful insight into the following studies

Abstract

This study discusses the role of jurisprudence as a source of legal reform in Indonesia's civil law system by examining the function of judicial discovery through a literature review. In practice, the limitations of written regulations often encourage judges to interpret and form new norms to fill gaps and adapt the law to societal developments. The process of legal discovery (rechtsvinding) produces decisions that not only resolve individual cases but also form jurisprudence that serves as a guideline for resolving similar cases in the future. This study emphasises that jurisprudence plays a significant role as a driver of national legal reform, although it remains within the framework and supremacy of legislation. Therefore, synergy between judicial discovery and formal legislation is essential to achieve an adaptive, responsive, and just legal system in Indonesia.

Abstract

This study discusses the important role of Supreme Court jurisprudence in establishing legal certainty and consistency of decisions in the Indonesian judicial system. Although the Indonesian legal system emphasises written sources of law, the emergence and application of jurisprudence has become increasingly significant, especially in overcoming legal ambiguities and gaps resulting from inadequate regulations in legislation. By providing interpretative guidelines and practical standards, Supreme Court decisions serve as persuasive references for lower courts, thereby minimising disparity in rulings and enhancing the predictability of case outcomes. This study highlights how the utilisation of jurisprudence not only strengthens public trust in the judicial system but also contributes to the integrity and legitimacy of court decisions. However, challenges remain, such as limited access to relevant decisions and uneven understanding among judges. Therefore, sustained efforts—including the digitisation of decisions and regular training—are needed to optimise the function of jurisprudence in achieving legal certainty and consistency in Indonesia.

Abstract

This study examines the dynamics of the existence of multilateral and bilateral treaties in the context of economic rights protection in Indonesia through a literature review approach. The main focus of the study is how these two types of free trade agreements play a role in guaranteeing and regulating the protection of economic rights of the community and domestic business actors amid the flow of global trade liberalisation. The findings indicate that multilateral treaties provide important global legitimacy and standards, while bilateral treaties allow for flexibility and protection of specific national issues. Synergy between the two is key to strengthening the sustainable protection of economic rights in Indonesia. This study provides recommendations for strengthening institutional capacity and stakeholder involvement in the implementation of agreements to achieve national economic justice and prosperity.

Abstract

This study discusses the harmonisation of international agreement implementation in Indonesia by highlighting the influence of global treaty ratification on the national legal system. Through a literature review, this study examines the ratification process, challenges faced, and implications for regulatory reform and national legal practice. The findings reveal that the ratification of global treaties encourages the updating and adaptation of legislation to align with international standards; however, this process often faces obstacles such as differences in legal systems, local cultural values, and domestic political dynamics. The harmonisation process requires close collaboration between state institutions, strong political will, and public involvement to ensure that ratification has a positive impact on justice, development, and national legal sovereignty. It is concluded that the success of harmonisation goes beyond legislative changes and lies in its actual implementation and substantive benefits for society.

Abstract

The recognition and protection of customary law in Indonesia is an issue that continues to evolve amid regulatory dynamics and implementation challenges. This study aims to analyse the dynamics of recognition and protection of customary law from the perspective of the younger generation through a literature review of derivative regulations and practical challenges in the field. The research method used is a literature review, examining legislation, official documents, and previous research findings related to customary law. The review findings indicate that although derivative regulations such as national laws, government regulations, and local regulations have provided a formal framework for the recognition of customary law, implementation in the field often faces obstacles in the form of complex bureaucracy, regulatory disharmony, and pressure from modernisation and commercialisation. The role of the younger generation is significant in addressing these challenges through active involvement in advocacy, education, and digital innovation. Their involvement not only preserves the sustainability of customary law but also encourages regulatory reforms that are more responsive to the future needs of indigenous communities. This study recommends synergy between policymakers, legal structures, and the empowerment of the younger generation to strengthen inclusive and equitable protection of customary law.

Abstract

This study discusses the interaction between Baduy customary law and the national legal system in the post-Reform era, using a literature review approach. Baduy customary law has maintained its existence as a legal system amid modernisation and changes in national regulations. This study highlights the internal mechanisms, community leadership, and commitment of the Baduy people in preserving their ancestral norms. On the other hand, formal recognition through the constitution and national laws provides legal legitimacy to Baduy customary law; however, its implementation still faces challenges such as overlapping regulations and potential normative conflicts. This study emphasizes the importance of dialogue, negotiation, and harmonisation between customary communities and the state to ensure that customary law can coexist and synergise with the national legal system without sacrificing cultural values. This study concludes that Baduy customary law can serve as an inclusive model for the development of national legal policies that respect local wisdom as a source of legal and cultural strength for the nation.
