Abstract

Medical disputes are one of the most important issues in the world of healthcare, often giving rise to legal, ethical, and social implications for both medical personnel and patients. The implementation of Law No. 17 of 2023 on Health has brought significant changes to the resolution of medical disputes by mandating non-litigation resolution through mediation or arbitration mechanisms before bringing the matter to court. This study aims to analyse the effectiveness of mediation and arbitration as alternative dispute resolution mechanisms following the implementation of the aforementioned law, as well as to identify the challenges and supporting factors for their implementation. The research method employed is a normative-empirical legal approach using a qualitative literature review. The results of the study indicate that non-litigation dispute resolution mechanisms have several advantages, including a faster process, cost-effectiveness, and a focus on restorative justice principles. However, their implementation still faces various challenges, such as low public awareness, a limited number of competent mediators and arbitrators in the medical field, and insufficient infrastructure and technical regulations for implementation. Therefore, collaborative efforts between the government, medical institutions, professional organisations, and the public are needed to strengthen the out-of-court medical dispute resolution system optimally.

Abstract

The implementation of mediation and arbitration as alternative dispute resolution in Indonesia faces various complex challenges, ranging from low compliance with arbitration awards, lack of public understanding, to limited human resources and supporting infrastructure. These obstacles have resulted in the effectiveness of mediation and arbitration being less than optimal and still less popular than dispute resolution through the courts. This article examines these challenges and offers solutions in the form of improved education, strengthened regulations, development of mediator and arbitrator competencies, and effective use of technology. With these strategic steps, it is hoped that mediation and arbitration can become the primary choice for resolving disputes quickly, cheaply, and fairly in Indonesia.

Abstract

The Professional Disciplinary Council (MDP) plays a key role as the primum remedium institution in handling allegations of medical malpractice in Indonesia. This study aims to analyse the role, mechanisms, and effectiveness of the MDP in resolving cases of alleged violations of medical professional standards, using a normative juridical approach through a literature review. The results of the study indicate that the MDP is capable of serving as a swift and proportionate internal resolution forum, offering education and graduated sanctions for medical personnel, thereby preventing all violations from immediately leading to criminalisation or litigation in the general courts. However, the effectiveness and fairness of the MDP still face a number of challenges, such as harmonisation of decisions with other legal systems, transparency, and the independence of the council. This study recommends strengthening regulations and institutional synergy to optimise the protection of patients' and medical personnel's rights within the framework of the national health law system.

Abstract

The transformation of medical professional discipline enforcement in Indonesia from the Indonesian Medical Disciplinary Council (MKDKI) to the Professional Disciplinary Council (MDP) marks a fundamental change in the system of supervision and resolution of alleged medical malpractice. This study aims to analyse these institutional changes and assess their implications for the effectiveness of the screening process for alleged malpractice. The research was conducted using a literature review method, drawing on legal literature, regulations, and the latest academic research related to the disciplinary enforcement system for healthcare professionals. The review findings indicate that the MDP expands the scope of oversight beyond doctors to include other healthcare professionals and strengthens the case screening mechanism before legal proceedings begin. This new system protects medical personnel from disproportionate criminalisation while ensuring patients' rights to adequate legal protection. Although it still faces implementation challenges such as institutional adaptation and the formulation of technical regulations, this transformation is considered capable of strengthening public trust in the national medical professional discipline system through more transparent, inclusive, and accountable governance.

Abstract

This study discusses the role of literature review in improving the effectiveness of administrative, civil, and criminal law enforcement in Indonesia. Using a literature review method, this study analyses various primary and secondary literature related to the theory, principles, and practice of law enforcement in these three areas. The results of the study indicate that literature review is capable of identifying and evaluating weaknesses and inconsistencies in regulations, strengthening conceptual foundations, and providing evidence-based recommendations for legal system reform. Additionally, literature review enriches understanding of jurisprudence and international practices, provides more robust legal arguments, and supports the professionalism of law enforcement officials. Thus, the use of literature review has proven to be essential in efforts to achieve more effective, fair, and sustainable law enforcement in Indonesia.

Abstract

Law enforcement is an important aspect in maintaining justice and order in Indonesia, particularly in the administrative, civil, and criminal law domains. This study aims to analyse the characteristics, challenges, and effectiveness of law enforcement in these three domains through a literature review approach from various sources such as books, journals, and legislation. The analysis shows that administrative law enforcement is preventive and efficient, although it still faces obstacles in terms of supervision and the integrity of officials. Civil law enforcement focuses on dispute resolution based on the principle of procedural justice, but is often hampered by lengthy processes and suboptimal enforcement of decisions. On the other hand, criminal law enforcement plays a role in maintaining social order through complex formal mechanisms and the protection of human rights, although there are still obstacles related to bureaucracy and the professionalism of officials. This study recommends regulatory reforms, capacity building for law enforcement officials, and the promotion of a culture of law among the public to support the effectiveness of law enforcement in Indonesia. Thus, it is hoped that the national legal system can function more fairly, transparently, and responsively to social dynamics.

Abstract

Maternal and child health is a crucial aspect of quality human resource development. This study aims to analyse improvements in health facilities and medical personnel training as key factors in supporting the success of maternal and child health programmes in Indonesia. The method used is a literature review, examining various scientific literature, policy reports, and relevant documents. The findings indicate that adequate improvements in healthcare facilities and continuous training for medical personnel significantly contribute to reducing maternal and infant mortality rates. However, challenges such as uneven distribution of facilities and limited human resources still need to be addressed. This study recommends strengthening programmes through service innovation, equitable distribution of facilities, and competency-based training that is responsive to field needs. Policy support and community participation are supporting factors for the sustainability of improvements in maternal and child health.
