Abstract

This study presents a systematic literature review on the use of artificial intelligence (AI) in human resource management (HRM) practices, ranging from recruitment to redundancy, with a focus on algorithmic bias and the urgency of labour regulation in Indonesia. Through a thematic analysis of various literature, this article identifies how AI is transforming recruitment procedures, selection, development, performance appraisal, and decision-making regarding termination of employment, whilst highlighting the potential for efficiency and improved organisational performance, which is offset by risks of discrimination, lack of transparency, and dehumanisation in employment relationships. The study also emphasises that labour regulations in Indonesia have yet to accommodate the characteristics of AI; consequently, an adaptive, worker-friendly legal framework is required, grounded in the principles of justice, non-discrimination, transparency, and algorithmic accountability.

Abstract

Artificial intelligence, particularly generative AI, has transformed the role of brands as human creative products by enabling the automatic creation of names, logos and visual identities. This article examines AI as both a creator and an infringer of brands, focusing on three key aspects: ownership, registration, and legal protection of brands in the era of generative AI. It is analysed that the regulatory framework for brands based on human authorship faces serious challenges when AI output is not fully controlled by humans, thereby raising uncertainties regarding the subject of rights, uniqueness, and the validity of registration. On the other hand, AI also has the potential to be a source of trademark infringement when its outputs resemble or incorporate elements of registered trademarks, whether through data learning processes or irresponsible use, thus requiring a re-evaluation of legal liability and protection mechanisms. This article argues that trademark law needs to evolve towards a more adaptive, responsive, and risk-based approach, so as to accommodate the dynamics of AI without compromising the principles of legal certainty, justice, and the protection of exclusive rights for businesses.

Abstract

The rapid development of artificial intelligence (AI) has transformed the landscape of automated decision-making across various sectors, yet it also poses serious risks to human rights through algorithmic bias, privacy violations, and the erosion of individual autonomy. This article examines the multidimensional impact of AI on human rights. The research findings underscore the need for regulations that integrate algorithmic transparency, human oversight, and developer accountability to protect vulnerable groups. Policy recommendations include the establishment of an independent AI oversight body, national digital literacy training, and the harmonisation of global standards to position Indonesia as a responsible AI leader in ASEAN. This study contributes to the discourse on digital human rights by offering a conceptual framework for the transition from a technology-centric to a human rights-centric paradigm in Indonesia’s AI governance.

Abstract

This article discusses the decolonisation of global trade tariffs as a conceptual and practical strategy for Indonesia in response to the WTO’s projection of a 1.8% slowdown in global trade by 2026. This study highlights that the global tariff system is not entirely neutral, but rather still reflects historical inequalities that favour developed nations and place developing nations in a subordinate position within the international value chain. Using a literature review approach, this article outlines two main focuses: the deconstruction of tariff inequalities in the global economy and Indonesia’s response strategies through export market diversification, industrial downstreaming, domestic market protection, and economic diplomacy. The findings indicate that tariff decolonisation is not merely a normative agenda, but also a strategic instrument for strengthening economic sovereignty, enhancing national competitiveness, and expanding Indonesia’s development policy space amidst global trade uncertainty.

Abstract

One of the company's responsibilities is to provide accurate, transparent and honest information about its products. However, in reality, there are many misleading advertisements that can have many detrimental effects on consumers. One strategy that is considered useful to provide consumers with protection from business actors is the principle of responsibility without fault (absolute responsibility). The problems in this research are: 1) How is the application of the principle of strict liability for losses due to misleading advertising 2) How is the form of legal settlement in the event of losses due to misleading advertising. The method used in the research is normative legal research. Data processing is done with a qualitative juridical approach. The results of the research show: 1) If it is related to the principle of strict liability, the business actor must be directly responsible for the company's actions that cause harm to consumers 2) Legal settlement in the event of losses due to misleading advertising can be done in 2 ways, namely Non- litigation and Litigation.

Abstract

Cases of theft of company assets by unscrupulous employees are a criminal offense. Theft of company assets with entry permit facilities causes losses for the company, not only loss of assets, but also other legal consequences in the form of administrative sanctions from the government for the loss of goods with entry permit facilities. This research aims to understand the legal consequences for companies that are victims of criminal acts committed by unscrupulous employees considering that the goods stolen are imported goods with import duties exemption facilities which are the company's responsibility to the government authority that provides these facilities (for example: the Investment Coordinating Board and Directorate General of Customs and Excise). Next, examine whether administrative sanctions for the loss of company assets with import duty facilities fulfill the principles of justice for companies that are victims of theft by unscrupulous employees. This research is a Normative Juridical research with a legal approach and the concept of examining laws, research results and books to find legal theories, principles and views in the process of obtaining answers which are the main subject of this research.

Abstract

The use of big data from a Islamic economic perspective is certainly an important issue and cannot be postponed any longer, because the disparity in big data between the real sector and the financial sector, which has so far resulted in a lack of completeness in assessments, can be overcome by the limited data provided through big data. It is also possible that various matrices and cluster variants will emerge for various business sectors in an ecosystem. So it will make it easier to determine supply and demand in an ecosystem system. In this way, a closed loop economy based on a sharia ecosystem will be built automatically when big data is formed. This research uses an exploratory descriptive approach by analyzing the role of big data analysis in financial decision making: the case of Islamic banking. This scientific work was also developed using a literature review or library study approach. This research discusses the basic concepts of big data analysis consisting of the definition and characteristics of big data, financial decision making in sharia banking, and the potential application of big data analysis in Islamic banking.

Abstract

Digitalisation in the healthcare sector is bringing about a major transformation in the way healthcare communication is conducted, especially regarding the management of patient data and the protection of medical rights. This study uses the literature method. The research findings found that current legal regulations are still not fully responsive to the rapid development of technology, so a more comprehensive policy update is needed. Emphasis is placed on the need for harmonisation between health technology innovation and ethical and legal principles to maintain the security of medical information. Abstract

This study explores the ethical and legal dilemmas in the delivery of health information on digital platforms, focusing on three main aspects: transparency, misinformation, and legal liability. In the digital age, quick and easy access to health information should help people make better decisions. However, a lack of transparency and the spread of misinformation can be detrimental to public health. This study emphasises the importance of transparency in information delivery to build public trust, while identifying misinformation as a serious threat to public health. The study also discusses the legal responsibility that information providers and digital platforms have to ensure the information provided is valid, accurate and based on scientific evidence. With a combination of strict regulations and strict law enforcement, it is hoped that a safer and more reliable information environment can be created for the public

Abstract

This research discusses health communication law within the framework of the pandemic crisis with a focus on public information policy, government accountability, and implications for the protection of public rights. Transparent and accurate communication is a key element in delivering health information to the public to prevent misinformation and increase public awareness of pandemic mitigation measures. Government accountability in managing health communication policies also plays a major role in building public trust and ensuring effective policy implementation. In addition, this study highlights the importance of protecting people's rights, especially access to correct information and guaranteeing individual privacy, especially regarding health data. This study emphasises that health communication law should be a strategic instrument to balance crisis management with the protection of human rights and public communication ethics
