Abstract

This study aims to examine the influence of patient culture on their understanding of disease and treatment, as well as the implications of hospital health law in accommodating cultural differences to improve the quality of health services. Patient culture includes beliefs, values, language, and traditional practices that significantly shape perceptions and responses to treatment received. This study uses a literature review method with a descriptive-analytical approach to health law, patient culture, and hospital service literature. The results show that a lack of cultural sensitivity in healthcare services has the potential to cause misunderstandings, treatment refusal, and the risk of treatment failure, while also increasing the risk of legal litigation for hospitals. Therefore, hospitals are required to apply the principle of non-discrimination, provide easily understandable information, and develop cultural competence policies and training for medical personnel. Clear legal implications and integrative cultural-legal strategic steps are key to creating inclusive, dignified, and effective healthcare services. This study provides conceptual and practical contributions to the development of culturally responsive healthcare systems in Indonesia and other multicultural countries.

Abstract

The rapid development of digital technology requires harmonisation of regulations between national and international legal frameworks so that Indonesia can keep pace with global dynamics while maintaining domestic regulatory sovereignty. This study examines the challenges of digital regulatory harmonisation in Indonesia, focusing on the differences in substance and legal mechanisms between national regulations and international standards, as well as the limitations of resources in terms of human resources, technological infrastructure, and institutions that hinder the acceleration of regulatory synchronisation. The research method used is a legal-normative literature review. The results reveal that legal framework disparities remain significant, particularly in personal data protection, fintech, and cybersecurity, compounded by limited resource capacity, which slows down regulatory harmonisation. This study recommends regulatory reform through increased human resource capacity, digital infrastructure development, and improved institutional coordination as key strategies for accelerating digital regulatory harmonisation in Indonesia. With these steps, Indonesia can increase its competitiveness and trust in the global digital ecosystem without sacrificing national legal sovereignty.

Abstract

This study discusses the role of jurisprudence as a dynamic source of law in establishing new legal rules in Indonesia. The focus of the study is directed at analysing contemporary decisions related to administrative disputes, interfaith inheritance, and innovations in digital and gender rights protection in criminal and civil cases. Through a literature review method, this study describes how judges, through their critical decisions, contribute to the formation of legal norms that are responsive to social, cultural, and technological developments and the need for substantive justice. The results of the study show that jurisprudence is capable of filling regulatory gaps and encouraging more inclusive and progressive legal transformation, both in the context of strengthening good governance, respecting religious plurality, protecting digital rights, and promoting gender equality. This study emphasises the importance of jurisprudence as a vital instrument of legal reform to respond to the dynamics of modern society and build an adaptive and just national legal system

Abstract

Cross-border cybercrime is on the rise and poses a serious threat to national and global security. In 2024, the United Nations adopted the Anti-Cybercrime Convention as an international legal instrument to regulate the criminalisation of cybercrime, cooperation mechanisms, and the protection of human rights in the handling of cybercrime. Indonesia, as a country with a high level of internet penetration, faces the challenge of adjusting its national laws to be in line with the provisions of the convention. This study uses a normative legal method with a legislative and comparative law approach to analyse the harmonisation of the Electronic Information and Transaction Law (EIT Law) and the Criminal Code (KUHP) with the 2024 UN Convention on Cybercrime. The results of the study show that adjustments to substantive and procedural rules, strengthening international cooperation mechanisms, and protecting human rights in the ITE Law and the Criminal Code are essential to improve the effectiveness of handling complex cross-border cybercrime. This harmonisation of national laws is key for Indonesia to strengthen its legal framework in facing the threat of cybercrime while playing an active role as part of the international legal order.

Abstract

This study examines culturally sensitive approaches to health law in building trust between patients and medical personnel as a means of improving service effectiveness and reducing conflict in Indonesia. Given Indonesia's highly diverse cultural background, a purely normative approach to law that does not take cultural values into account often presents obstacles to health services. This literature review examines various health regulations, legal principles, and literature related to cultural sensitivity and how its application can strengthen communication, trust, and cooperation between patients and medical personnel. The results of the study show that the integration of culture into health law policies and practices is essential to creating inclusive, humane, and equitable services. This approach also plays a role in reducing disputes and conflicts that arise due to differences in cultural values in healthcare services.

Abstract

This study analyses the role of the principles of fairness and responsibility in Good Corporate Governance (GCG) of state-owned enterprises through a systematic literature review, focusing on their contribution to stakeholder fairness and increased corporate competitiveness. The results show that the principle of fairness ensures proportional distribution of benefits and protection of minority rights through inclusive decision-making mechanisms, while responsibility strengthens social legitimacy through transparent reporting and regulatory compliance with KNKG and OECD standards. Simultaneously, these two principles reduce the risk premium by 20-30%, facilitate access to global capital markets via IFRS, and enhance the operational efficiency and competitive reputation of SOEs in the international arena. The main findings confirm the synergy between fairness and responsibility, creating a virtuous cycle between stakeholder fairness (distributive, procedural, interactional) and competitive advantage through dynamic capabilities, corporate reputation, and managerial meritocracy. Implementation gaps have been identified in political intervention and the lack of an ethical organisational culture, which hinders the transformation of SOEs into world-class corporations.

Abstract

This study analyses the implementation of integrated risk management in State-Owned Enterprises (SOEs) through a theoretical and regulatory review of risk policies, planning, implementation, and monitoring based on PER-05/MBU/09/2022 and PER-2/MBU/03/2023 in order to achieve effective and sustainable governance. Using a qualitative-descriptive approach with content analysis of regulations, COSO ERM literature, ISO 31000, and SOE practice studies such as Pertamina, PLN, and Bank Mandiri, the study found that both regulations have created synergy between risk governance -Good Corporate Governance (GCG) synergy through Risk Appetite Statements, Risk Registers, and three lines of defence, which increased risk-adjusted ROE by up to 15% in mature entities. However, the main challenges include maturity level gaps (levels 2-5), risk aversion culture, human resource skill gaps, and Excel-based data fragmentation, which hinder universal implementation, despite the potential for a 20-30% reduction in material risk incidents through ERMIS and stress testing. The conclusion emphasises the need for a Risk Management Academy, Risk Maturity Scorecard, and progressive regulatory enforcement to transform SOEs into resilient ESG-based corporations that contribute to national economic stability.

Abstract

This study examines the implementation of risk management policies and strategies in State-Owned Enterprises (SOEs) through the optimisation of the Plan-Do-Check-Act (PDCA) cycle, Risk Appetite Framework (RAF), and Key Risk Indicators (KRI) based on a literature review approach. The study found that the integration of these three elements strengthens organisational capabilities through a continuous learning process, improves regulatory compliance in accordance with PER-1/MBU/2011 and ISO 31000, and ensures operational sustainability amid economic and ESG disruptions. The impact includes reduced performance volatility, increased ROE, and post-crisis resilience, with the main challenges being cultural resistance and technological limitations. Strategic recommendations include the formation of a Risk Committee, an AI-based KRI dashboard, and policy standardisation by the Ministry of State-Owned Enterprises for the transformation of state-owned enterprises towards agile and accountable governance.

Abstract

This study aims to examine the obligations of health workers in providing informed consent from an ethical and legal perspective through a literature review. Informed consent is an essential communication process between health workers and patients prior to medical procedures, which affirms the patient's right to obtain complete information and to give conscious and voluntary consent. Legally, this obligation is regulated in various regulations in Indonesia, such as Law No. 29 of 2004, Law No. 36 of 2009, and Law No. 17 of 2023, and reinforced by medical professional ethical standards. The results of the study indicate that optimal implementation of informed consent can protect patients' rights while providing legal protection for healthcare providers; however, challenges remain in its implementation, such as time constraints, the use of medical terminology that is difficult to understand, and insufficient education for both patients and healthcare providers. Therefore, efforts to enhance understanding, training, and continuous supervision are needed to ensure that ethical and legal principles in the provision of informed consent are truly realised in healthcare practice in Indonesia.

Abstract

Patients' rights to privacy and confidentiality of medical data are fundamental aspects of the healthcare system, especially in the era of digitalisation and information technology utilisation. This study aims to examine the protection of patients' privacy rights regarding medical data through a literature review and policy evaluation in Indonesia. The method used is literature research by analysing national regulations, such as the Personal Data Protection Law, the Health Law, and the Minister of Health Regulation on Medical Records, and comparing them with international standards. The results of the study indicate that although the legal framework in Indonesia has explicitly recognised and regulated patient privacy rights, implementation in the field still faces challenges such as weak data security infrastructure, low privacy literacy among health workers and patients, and suboptimal supervision and law enforcement. This study recommends the need to strengthen policies, enhance human resource capacity, and update information technology infrastructure to ensure effective protection of patient privacy rights and support public trust in healthcare services.
