Abstract

The role of the Regional People's Representative Council (DPRD) Secretariat is crucial in supporting the effective supervision function of the DPRD as a pillar of good governance. However, at the Cilegon City DPRD Secretariat, this role faces significant constraints due to a policy of assigning staff to assist in work visits that is not competency-based, which risks weakening local government accountability. This research aims to analyze the facilitation role of the Cilegon City DPRD Secretariat, identify the constraints arising from the removal of expert supervision staff, and formulate optimization strategies to strengthen the institution's role. This study uses a qualitative descriptive method, with data collected through in-depth interviews with key informants within the Secretariat, observation, and document analysis. The research findings indicate that (1) the Secretariat's role has been degraded to be administrative rather than substantive; (2) the main constraint stems from a staff assignment system that ignores competence, which leads to a decline in the quality of supervision reports; and (3) there is an urgent need to reform the human resource management (HRM) system. It is concluded that the optimization of the Secretariat's role can only be achieved by reforming the staff assignment policy and implementing structured competency development programs to restore professionalism and effective support for the DPRD's supervision function. Therefore, this research recommends three strategic steps: in the short term, revising the staff assignment policy to prioritize competence; in the medium term, developing and implementing clear Competency-Based HRM Guidelines; and in the long term, organizing continuous functional training programs to enhance staff capacity in professionally and effectively supporting the DPRD's supervision function.

Abstract

The Nanga Sira Mangrove Forest Tourism Area is an ecotourism destination with significant natural potential that has not been utilized optimally. The managing community faces constraints in aspects of digital marketing, educational content development, governance, and supporting facilities. This community service program aims to implement strategic collaboration between higher education institutions and the community to increase tourist visits through a participatory action research approach. The implementation method includes four main stages: observation, participatory planning, activity implementation, and monitoring and evaluation. Core activities conducted include digital marketing training and creative content creation, development of environmental conservation education materials, improvement of tourism governance systems, and physical infrastructure enhancement. Evaluation results show a significant increase in community capacity with a 75% rise in social media interactions and 40% growth in tourist visits over a two-month period. This program successfully proves that the higher education-community collaboration model is effective as a strategy for sustainable tourism development. Recommendations include the importance of continuous mentoring and the development of more innovative tourism packages.

Abstract

This study analyzes legal justice for workers in the application of non-competition clauses in employment contracts, particularly in the context of unequal bargaining positions between employers and employees. Although non-competition clauses are commonly used to protect trade secrets and business interests, Indonesian labor law does not explicitly regulate their scope and limitations, resulting in legal uncertainty and inconsistent judicial decisions. This research employs a normative juridical method with statutory, conceptual, comparative, and case approaches, focusing on court decisions concerning non-competition clauses and comparing Indonesian practice with regulatory models in the United States. The findings reveal that the application of non-competition clauses may restrict workers’ constitutional right to work and hinder career mobility, especially when such clauses are imposed without proportional compensation and clear limitations. The study further demonstrates that excessive reliance on the principle of freedom of contract often undermines substantive justice for workers. Hasil penelitian menunjukkan bahwa rumusan Pasal 157A masih bersifat umum dan belum memiliki daya sanksi yang efektif jika dibandingkan dengan ketentuan lain dalam klaster ketenagakerjaan, khususnya Pasal 185–189 yang secara tegas mengatur sanksi administratif dan pidana. Kondisi tersebut menyebabkan norma Pasal 157A cenderung tidak efektif dalam mencegah praktik PHK yang sewenang-wenang. Abstract

This study aims to examine the legal liability of business actors and the Halal Product Supervisory Agency (BPJPH) for halal-certified products proven to contain non-halal elements, as well as to analyze legal protection for consumers who are harmed. The background of the study is based on the discovery of seven halal-certified products containing porcine elements, which demonstrates the urgency of evaluating the effectiveness of the implementation of three main regulatory pillars (the Consumer Protection Law, the Halal Product Guarantee Law, and Government Regulation No. 42 of 2024) in ensuring legal protection for Muslim consumers. This study uses a normative legal method with a statute approach and a case study approach to the findings of seven halal-certified products proven to be non-halal, with primary and secondary legal data sources. The novelty of the study is reflected in a comprehensive analysis of post-certification systemic failures as a gap between the law on the books and the law in action. The results of the study indicate dual legal liability, namely the liability of business actors (based on strict liability and liability based on fault) and the public accountability of BPJPH for negligence in carrying out its supervisory mandate. It was found that consumer legal protection, while strong normatively, proved weak in implementation due to the failure of its preventive (supervisory) function. This study recommends fundamental strengthening of the BPJPH's post-market surveillance function to restore the system's integrity and ensure effective legal protection for Muslim consumers.   Penelitian ini bertujuan mengkaji bentuk pertanggungjawaban hukum pelaku usaha dan BPJPH terhadap produk bersertifikat halal yang terbukti mengandung unsur tidak halal, serta menganalisis perlindungan hukum bagi konsumen yang dirugikan. Latar belakang penelitian didasarkan pada temuan tujuh produk bersertifikat halal yang mengandung unsur babi (porcine), yang menunjukkan urgensi evaluasi efektivitas implementasi tiga pilar regulasi utama (UU Perlindungan Konsumen, UU Jaminan Produk Halal, dan PP No. 42 Tahun 2024) dalam menjamin proteksi yuridis bagi konsumen Muslim. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan studi kasus (case approach) terhadap temuan tujuh produk bersertifikat halal yang terbukti tidak halal, dengan sumber data hukum primer dan sekunder. Unsur kebaruan penelitian tercermin pada analisis menyeluruh terhadap kegagalan sistemik pasca-sertifikasi sebagai kesenjangan antara law in the book dan law in action. Hasil penelitian menunjukkan adanya pertanggungjawaban hukum ganda yaitu pertanggungjawaban pelaku usaha (berbasis strict liability dan liability based on fault) dan pertanggungjawaban publik BPJPH atas kelalaian (negligence) dalam menjalankan mandat pengawasan. Ditemukan bahwa perlindungan hukum konsumen, meski kuat secara normatif, terbukti lemah secara implementatif akibat kegagalan fungsi preventif (pengawasan). Penelitian ini merekomendasikan penguatan fundamental pada fungsi pengawasan pasca-pasar (post-market surveillance) oleh BPJPH guna memulihkan integritas sistem dan menjamin perlindungan hukum yang efektif bagi konsumen Muslim.

Abstract

Art Education is an educational program that uses art as a medium or a tool in the process of education and learning. Art in the context of education is used as object or focus study to achieve educational objectives that humanize human beings. This article analyzes conceptually about local wisdom discourse in the era of the Industrial Revolution 4.0 in the context of art education. The results indicated that local wisdom-based art education has an important and strategic role in cultural conservation and development projects, as well as a crucial agent in shaping human characters as that have an reciprocatively, creative, and productive attitude. Through an appreciation and creative creation activities in the implementation of art education, local wisdom in the era of the industrial revolution 4.0 can be saved and developed.

Abstract

The purpose of this study is to describe the integration of ethnomathematics in the culture of the Mandar tribal community in Polewali Mandar Regency and Majene Regency in elementary mathematics teaching material supplements. This qualitative research uses research with an ethnographic approach. The ethnomathematics obtained relates to elementary mathematics materials, among others, namely, Addition and Subtraction of numerical numbers up to 99, Simple Flat Buildings and Simple Spaces, Simple Fractions, Length of Time of an Event (unit of time), Multiples of a Number and Multiples of Communal Numbers, Folding Symmetry and Rotary Symmetry, Nonstandard Measurements (units of length, units of content, units of weight), Perimeter of Flat Buildings (Square, Long Square, and Triangle), Presentation of Data, Position of Objects Against the Wind.

Abstract

Penelitian ini bertujuan untuk mendeskripsikan proses pembelajaran menggunakan media ajar benda konkret yang dapat meningkatkan hasil belajar Matematika konsep pecahan siswa kelas III UPT SDN 59 Kab. Pinrang. Jenis penelitian ini adalah Penelitian Tindakan Kelas (PTK). Subjek pada penelitian ini adalah siswa kelas III UPT SDN 59 Kab. Pinrang tahun ajaran 2023/2024 yang berjumlah 25 siswa. Desain penelitian ini meliputi (1) tahapan perencanaan, (2) pelaksanaan, (3) pengamatan dan (4) refleksi. Metode pengumpulan data yang digunakan dalam penelitian ini adalah (1) tes, (2) observasi dan (3) dokumentasi. Instrumen penelitian yang digunakan adalah lembar observasi dan tes. Berdasarkan hasil penelitian menunjukkan bahwa penggunaan media ajar benda konkret dapat meningkatkan hasil belajar Matematika konsep pecahan pada siswa kelas III UPT SDN 59 Kab. Pinrang. Rata-rata hasil belajar pra siklus sebesar 57,4 dan sedikit mengalami peningkatan pada siswa secara keseluruhan pada siklus I sebesar 68,2, setelah dilakukan perbaikan dengan membagi kelompok sesuai hasil belajar siklus I, membagi tugas pada setiap anggota kelompok, memberikan waktu kepada siswa untuk melakukan proses pemahaman konsep pecahan menggunakan media ajar benda konkret dapat meningkatkan hasil belajar Matematika konsep pecahan pada siswa menjadi 81,8 pada siklus II.

Abstract

This classroom action research (CAR) consisted of two cycles, aiming to improve forward roll ability through game- based learning in grade 5 students of SDN 78 Birea, Bantaeng Regency. The study involved 20 students using a total sampling technique. Data were collected through treatment with game-based learning and observation of forward roll performance in floor gymnastics. Data analysis used descriptive statistics with percentages.Results showed an improvement in forward roll ability from cycle I to cycle II. In cycle I, the completeness rate was 75%, increasing to 95% in cycle II. The average score also rose from 74 in cycle I to 82 in cycle II. These findings indicate that game-based learning effectively enhances forward roll ability in grade 5 students of SDN 78 Birea, Bantaeng Regency.
