Abstract

This study formulates three problems which include: (1) The principles of the social protest movement from the perspective of Islamic law; (2) Methods and techniques for conducting demonstrations from the perspective of Islamic law; (3) The social impact of demonstrations in Indonesia from the perspective of Islamic law. This study uses a qualitative method (descriptive-analytic). Based on the data source is library research (library research). The approach used is the sociological approach of Islamic law and the siyasah fiqh approach. In the perspective of scientific studies, these two approaches are used to understand the phenomenon of demonstrations in Indonesia based on legal arguments contained in the Qur'an and Hadith, the opinions of fuqaha' and opinions that develop (ijitahad) at a time in life. Muslims. Meanwhile, from a methodological perspective, these two approaches are used to provide an interpretation of the methodology of Islamic law on the concept and practice of demonstrations based on social movement theory and Islamic political theory. The results of this study found that: The principles of the Islamic social protest movement are built on the doctrine of rights and obligations between the people and the rulers in an Islamic state which include: the principle of hisbah; The principle of freedom of expression; The principle of deliberation; and constitutional principles. Based on the method of carrying out the demonstration, there are 2 methods, namely the exclusive method and the inclusive method. Based on the technique of holding demonstrations, there are 3 levels, namely: (1) demonstrations with the ability and strength of the masses; (2) demonstration with verbal ability and strength; (3) protest with the ability of the heart. Through the istislahi approach, that Islamic law strongly condemns all demonstration activities that cause harm to religion, soul, mind, descendants and property. On the other hand, he strongly supports all demonstration activities that uphold the five maintenances (Maqasid al-khamsah). That demonstrations are not at all motivated by passion or personal tendencies, let alone to cause damage to the earth. It is an obligation not just an appeal for those who can afford it. The law is fardu kifayah. Abstract

This paper elaborates on implementing Indonesian employment law in protecting the welfare rights of Indonesian Migrant Workers according to Islamic law. This type of research was field research of descriptive qualitative with a case study design. The primary data sources of this study were the Ministry of Employment and The National Agency of Placement and Protection of Indonesian Migrant Workers. The data collection techniques include observation, purposive interview, snowball sampling, documentation, and literature review. The approaches used were juridical, sociological, and normative theological approaches. The data obtained were then analyzed by data reduction techniques, presentation, concluding, and data verification. The study results indicate the implementation of Indonesia’s employment law through the instruments of Constitution Number 13 of 2003 about Employment and Constitution Number 39 of 2004 concerning the Placement and Protection of Indonesian Migrant Workers Abroad (PPIMWA). The revision of Constitution Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers (PIMW) has empowered and employed Indonesian migrant workers optimally and humanely. The theory of Maqasid al-Syar’i‘ah takes the employment into the category of the essential five human elements (al-Daruriyyat al-Khamsu). It refers to religion, soul, lineage, property, and mind at the primary level (al-D{aruriyyat), then the legal protection of Indonesian migrant worker who is komprador in maintaining and preserving human rights must also be embodied.

Abstract

The main problem in this study is how the requirements for digital signatures can be recognized as valid evidence, and how the legal strength of digital signature evidence is reviewed from Law concerning information and electronic transactions. Research type is library research with a juridical-normative approach. The results of this research obtained by the author are the digital signature requirements so that they can be recognized as valid evidence, in article 11 of the ITE Law which stipulates that. The legal strength of proof inherent in digital signatures in terms of civil evidence has the legal power of evidence at the same level as private certificates, therefore the legal strength of evidence inherent in signatures on electronic letters is only formal and material proof.

Abstract

Urgensi pemilihan pendekatan penelitian dalam kajian hukum dan hukum Islam di tengah kompleksitas persoalan sosial dan tuntutan penillustrasian keadilan yang komprehensif. Penelitian ini bertujuan menguraikan karakteristik, perbedaan, serta titik temu antara pendekatan normatif (yuridis-doktrinal), empiris (yuridis-sosiologis), dan pendekatan hukum Islam, sekaligus menjelaskan faktor-faktor yang memengaruhi pemilihannya. Penelitian menggunakan desain deskriptif-analitis dengan kombinasi pendekatan yuridis-normatif dan pendekatan hukum Islam melalui studi pustaka, dengan menelaah peraturan perundang-undangan, doktrin/teori hukum, karya ilmiah, serta literatur fikih klasik dan kontemporer. Hasil kajian menunjukkan bahwa pendekatan normatif memusatkan perhatian pada hukum sebagai norma tertulis (law in books) dan efektif untuk mengkaji asas, sistematika, serta konsistensi antar norma. Pendekatan empiris menelaah hukum dalam praktik (law in action) sehingga relevan untuk menilai efektivitas, kepatuhan, serta hambatan implementasi ketika diperlukan dukungan data lapangan. Sementara itu, pendekatan hukum Islam bertumpu pada Al-Qur’an, Hadis, ijma’, qiyas dan metode istinbath untuk menilai kemaslahatan serta relevansi norma berdasarkan maqāṣid al-syarī‘ah. Pemilihan pendekatan dipengaruhi jenis masalah, tujuan penelitian, ketersediaan data, konteks riset, dan kompetensi peneliti, dengan tambahan pada studi hukum Islam berupa relevansi dalil dan konteks sosial. Implikasinya, integrasi multi-pendekatan (mixed legal research) dapat memperkuat ketajaman analisis sekaligus meningkatkan kebermanfaatan hasil penelitian
