Abstract

Applying Islamic law, there needs to be a deep understanding of the theory of the enactment of Islamic law by the principles of national law, justice, and national values, this paper dissects the analysis of the theory of the enactment of Islamic law, How is the conceptual framework of the theory of the enactment of Islamic law in Indonesia, and What is the purpose of understanding the theory of the enactment of Islamic law in Indonesia, using the library research method is a study whose data is in the form of theories, concepts of thoughts and ideas, examining data and events that have occurred among Muslims in Indonesia in previous research, writing books and articles then continued research using relevant legal reasoning methodologies whose results found a condition that we can realize the complexity and challenges in integrating aspects of Islamic law into a country's national legal system,  including in the Indonesian context.

Abstract

The aim of this research is to explain, analyze and understand the theoretical construct of the philosophy of science paradigm. The type of research used is data collection techniques, library research, which examines, searches for and collects information from various sources. Basically, a theory is formulated to explain existing phenomena. Building a theory which is an abstract of a number of concepts agreed upon in definitions will experience development, and this development occurs when the theory is no longer relevant and no longer functions to solve problems. Acceptance of a theory in the scientific community does not mean that the theory has absolute truth. Every theory is always influenced by the assumptions and methods of the scientist who formulated it. The ability of a theory to predict what will happen is a criterion for the validity of the theory. Therefore, it is necessary to understand theoretical constructs as a basis for scientific research.

Abstract

This research aims to explain the epistemology of empiricism and the figures who support this school. To obtain relevant research results, this research uses data collection techniques or literature studies. The results of this research are that epistemology examines what science really is, where the source of knowledge comes from, and how the process occurs. Epistemology requires scientific methods in obtaining knowledge, one of these methods is empiricism, which emerged as a reaction to the weaknesses of rationalism. Empiricism is a doctrine where the source of knowledge must be sought in experience or the sensory. The supporting figures for this flow are:

Abstract

The aim of this research is to understand the meaning of the structure and hierarchy of science, the structure and hierarchy of science according to al-Ghazali, and the structure and hierarchy of science according to al-Farabi. The results of this research show: 1) The structure of science is a systematic collection of knowledge consisting of components that are interrelated or coordinated so that they can become a theoretical basis or provide an explanation. The hierarchy of knowledge is a sequence or level of knowledge; 2) Regarding scientific terminology, Al-Ghazali tries to map it into three global categories based on the level of obligation, source, and social function. In an ontological perspective, Al-Ghazali divides science into Fardhu 'Ain and Fardhu Kifayah. In the epistemological framework, science, according to Al-Ghazali, can be mapped into two, namely Sharia Science and Sharia Ghairu. In Al-Ghazali's reading, all knowledge that is included in the framework of sharia science is commendable. However, this is not the case with knowledge that falls within the domain of sharia-ghiru science. This knowledge is mapped into three domains, namely: praiseworthy, disgraceful, and neutral (mubah); 3) Al-Farabi classified science into two large groups, namely 'Aqliyyah (intellectual) sciences, which were then called Philosophical Sciences, and Naqliyyah (doctrinal) sciences, which were then called Religious Sciences.

Abstract

The central issue of this study was the concept of restorative justice for children in confrontation with the law from an Islamic legal standpoint. This was a qualitative study employing a normative (syar'i) methodology. This study utilized primary data sources, including information from the Police, Prosecutors, Judges, and Social Institutions. And secondary sources such as books, journals, and articles. This study utilized observation, interviews, documentation, and reference tracking to acquire its data. Data processing and analysis procedures were implemented in a series of processes, including data selection, data examination, data classification, and data compilation. Based on the findings of this study, the fundamental elements of restorative justice in resolving criminal cases involving children in confrontation with the law are child protection, the best interests of the child, and kinship. In criminal cases involving children in dispute with the law, the concepts of restorative justice were implemented through mediation, deliberation, consensus, direction, and supervision of children. In criminal cases involving children in dispute with the law, the practice of restorative justice has the social effects of eradicating the stigma or labeling of children as mischievous, as well as promoting child growth and child development.

Abstract

The Covid-19 pandemic that hit Indonesia became an opportunity to enrich themselves through corruption of social assistance funds. However, existing regulations do not provide a deterrent effect on the perpetrators. This research is a normative legal research (library research) using a case approach and presented in the form of descriptive analysis. The results of this study indicate that the existence of legal regulations related to corruption during the pandemic has not been fully implemented by Indonesia considering that the Corruption Law, especially Article 2 paragraph (2), is still open to multiple interpretations regarding "certain circumstances". Then the relevance of the Corruption Law to corruption during the pandemic is certainly related to its eradication to provide a deterrent effect even though the sanctions have not been applied. The government then prioritized the data management improvement program.

Abstract

Causality is one of the most important topics in the history of philosophy, this is because the principle of causality is one of the main issues in the tradition of Islamic philosophy where the principle of causality is a fundamental issue in philosophy. In the Middle Ages, Muslim philosophers were busy with productive debates about causality that were seen solely from Islamic philosophy and Islamic theology, thus giving rise to debates among philosophers where each philosopher had his own opinion. In fact, it can be said that awareness of the world and representation in the world always depend on causal relationships. Finding all the relationships between cause and effect also provides insight into the causal structure of nature and forms the ability to learn to act intelligently in the world. Finding what actually causes the possibility of building causal patterns, and this allows for rational or logical predictions, decisions, and actions in the world. Causality forms a chain that begins in the past, exists in the present, and disappears in the future. The views of philosophers on the principle of causality have evolved from Plato, who emphasized the importance of causes in change, to Aristotle who distinguished four types of causes. The Stoics asserted that every event has a cause, while medieval philosophers distinguished between primary and secondary causes. In modern times, Hume emphasized the need for experience to understand causal relationships, while Kant argued that causality is based on the structure of reason. Mill added that causes are combinations of conditions. Overall, these developments reflect the complexity of views on causality in philosophy.

Abstract

This paper discusses the meaning, concept, position, and role of philosophy in Islam which is divided into two main views: the group that rejects philosophy and the group that accepts it. The group that rejects philosophy views it as a threat to the purity of Islamic teachings, while the group that accepts philosophy sees it as a tool to deepen the understanding of Islamic teachings through the use of reason and rationality. Philosophy has an important position in Islam, as evidenced by the history of Muslim philosophers such as Al-Farabi, Ibn Sina, and Ibn Rushd, who not only developed Islamic thought but also bridged the traditions of Greek and Western philosophy. In the context of Islam, philosophy helps answer contemporary challenges, understand the wisdom of religious teachings, and encourage a critical and rational approach to sacred texts. The philosophical approach in Islam also has a significant impact on the formation of science, such as ushul fiqh and tasawuf, and provides a framework for thinking to face modern challenges. Thus, philosophy and Islam complement each other in forming a deep and relevant understanding of religious teachings in everyday life.

Abstract

Speaking of the birth and development of philosophy, at the beginning of its birth it cannot be separated from the development of (science) knowledge that emerged during the Ancient civilization (Greek era). In 2000 BC, the Babylonians who lived in the Nile Valley (Egypt) and the Euphrates River had known weight measuring instruments, power number tables, multiplication tables using ten fingers. In this study, the author uses a qualitative descriptive approach with the main data source from library data. The results of the study show that the advantages of positivism are: Objectivity in positivism can be measured and tested empirically. Positivism recognizes the relativism of science. The implication is that it is more tolerant of differences in research results. Research using positivism can be applied to understand the past, present and predict the future. These advantages are related to the basic assumptions of positivism which aim to find general laws. Furthermore, these laws are able to describe the development of the history of the culture of a society. By using positivism, a researcher is only limited to the study of empirical socio-cultural phenomena. That means, they are only fixated on empirical reality and deny imaginary reality (discourse) when conducting research. Whereas a society has both realities in its daily life.

Abstract

Perkembangan tekhnologi digital telah membawa banyak kemajuan dalam industri perbankan, meskipun masih terdapat tantangan dalam memastikan bahwa layanan tersebut dapat diakses dengan mudah oleh penyandang disabilitas. Hal ini menyebabkan belum meratanya akses terhadap layanan keuangan bagi penyandang disabilitas. Penelitian ini merupakan penelitian deskriptif kulitatif dengan pendekatan hukum Islam dan yuridis. Dalam penelitian ini menggunakan kajian studi pustaka (library research) dengan mencari informasi melalui buku, jurnal ilmiah, berita dan literature lainnya yang bersinggungan dengan penelitian. Hasil penelitian ini bahwa transformasi digital dalam perbankan syariah dapat meningkatkan akesesibilitas bagi penyandang disabilitas melalui langkah-langkah seperti pengembangan aplikasi mobile yang rama disabilitas, pelatihan serta peningkatan keterampilan staf bank dalam melayani kebutuhan khusus serta penggunakan tekhnologi yang efektif dalam memperluas akses bagi penyandang disabilitas. Dengan demikian, perbankan syariah dapat terus berinovasi dalam layanan digital serta memperhatikan kebutuhan dan tantangan yang dihadapi oleh penyandang disabilitas.
