Abstract

Indonesia is known as the largest archipelagic country in the world and is recognized as having a maritime territorial area that is almost equal to its land area. Indonesia's territorial waters contain abundant potential fishery resources and marine diversity, making it known as a maritime country. Illegal fishing is an activity or fishing activity that is contrary to a country's laws or international regulations, where the majority of perpetrators are corporations. Illegal fishing practices have a tremendous impact on marine sustainability, causing huge losses to the country. The occurrence of illegal fishing is caused by weak law enforcement and supervision in Indonesian waters and the authorities' indecisiveness in handling illegal fishing perpetrators. Understanding illegal fishing and crimes committed by corporations should be a strong basis for every legal practitioner to process and impose appropriate and correct sanctions on every perpetrator of illegal fishing or corporate crime perpetrators. The method used in this research is a normative legal research method sourced from primary data, namely the Criminal Code (KUHP), Law Number 45 of 2009 in conjunction with Law Number 31 of 2004 concerning Fisheries, Law of the Republic of Indonesia Number 32 of 2009 concerning Environmental Protection and Management (UUPPLH), secondary data and tertiary data based on regulations relating to fisheries and corporate crimes. The data collection method is qualitative descriptive analysis with literature study using a statute approach. This research aims to determine the factors that cause the crime of illegal fishing in Indonesia, the legal responsibility of corporations related to the crime of illegal fishing in Indonesia and the efforts made to prevent or eradicate the occurrence of criminal acts. illegal fishing in Indonesia.

Abstract

Criminal accountability by perpetrators of criminal acts of corruption committed individually or collectively is very important in eradicating criminal acts of corruption and providing a deterrent effect to perpetrators of criminal acts of corruption. Corruption currently occurring in Indonesia is in a very serious position and is deeply rooted in every aspect of life. The development of corrupt practices from year to year is increasing, both in terms of the quantity or amount of state financial losses and in terms of quality, which is increasingly systematic, sophisticated and its scope has expanded in all aspects of society.The method used in this research is descriptive analysis. Research data sources are generally distinguished between data obtained from library materials (secondary data). Normative legal research methods only recognize secondary data. The secondary data consists of primary legal materials, secondary legal materials and tertiary legal materials. In this research the author used qualitative analysis to analyze the data. Where qualitative analysis is a way of analyzing data sourced from legal materials based on concepts, theories, statutory regulations, doctrine, legal principles and expert opinions as well as the author's own views.This research aims to find and examine more deeply the legal instruments in the context of accountability for perpetrators of criminal acts of corruption committed jointly. The results of this research are influenced by certain factors, and as a result of acts of corruption, responsibility can be imposed on perpetrators of criminal acts of corruption, not only those who commit corruption individually, but also those who do it together.

Abstract

Village funds disbursed by the government sourced from the APBN are still considered as assets that continue to be targeted by certain Village Heads with low morals. The high political costs to get the number one seat in the village cause people to do anything to get it. Because the village funds disbursed are quite tempting. In just one year in mathematical calculations, the capital spent during the process of getting the position of village head can be returned. Therefore, the suboptimal performance of the village head is due to many stumbling blocks of interest. The village head is no longer focused on the promised programs. The village head only focuses on efforts to return the campaign funds spent so far. The high number of corruption cases that hit the village head if it does not become the government's attention, the disbursement of village funds which were originally intended to make the village strong, advanced and independent will be in vain. That is why the role of the Village Consultative Body is needed here, an independent institution whose status is outside the village government. The function of the BPD which is expressly stated in the village law has not been implemented optimally, this results in village fund leaks always occurring every year in almost all regions of Indonesia. This study uses a normative legal research type, namely research that focuses on research on related laws and regulations. The results of this study indicate that Village Fund Supervision in Improving the Performance of the Village Consultative Body has not been guided and based on the principles of Law No. 6 of 2014 concerning Villages. The BPD has not fully carried out its functions. And the obstacles experienced are mainly in the HR aspect besides the absence of regulations that explicitly explain how the technical supervision of the allocation of village funds.

Abstract

This paper describes the dynamics of legal politics in the regulation of Simultaneous Regional Elections in Indonesia with a focus on the effectiveness of implementation and its impact on local democracy. Simultaneous Regional Elections, which began in 2015, are the government's efforts to improve the efficiency of regional head elections while strengthening the democratic system. However, its implementation faces various challenges, such as regulatory complexity, potential political conflict, and impacts on the quality of representation at the local level. This study uses a juridical-normative approach with a qualitative analysis method to evaluate the laws and regulations governing Simultaneous Regional Elections, including Law Number 10 of 2016 and its implementing policies. Data were obtained through literature studies, legal documents, and interviews with relevant stakeholders. The results of the study show that, although Simultaneous Regional Elections bring benefits in the form of budget efficiency and strengthening political stability, this policy also poses a number of challenges. Among them are the gap in local government capacity, strengthening political oligarchy, and decreasing the quality of community participation at the local level. In addition, the implementation of Simultaneous Regional Elections tends to sacrifice regional autonomy in the context of local democracy, given the homogenization of election times that do not always match regional needs. This study recommends the need for a revision of regulations that are more adaptive to local needs, increasing public political education, and strengthening the capacity of election organizers to ensure that Simultaneous Regional Elections can run effectively without sacrificing the principles of local democracy.

Abstract

In order to preserve and uphold the honor, dignity, and the behavior of the judge is required to supervise the attitude of the constitutional judge to fit the code of ethics, so that each judge's ruling will be implemented in order to enforce the law and justice based on Pancasila and the Constitution 1945 asapermanent legal political for supervision of the constitutional judges . Meanwhile legal politics incidental that becomes a choice among others: a) Behavior of Constitutional Judges are supervised by the Board of Ethics established by the Constitutional Court, and for the reported judges or suspected violations of ethic codes of Constitutional Judges formed by Honorary Council of Constitutional Judges who were proposed by Ethics Council, with the task of implementing and serving as judicial ethic; and b) there is no judicial supervision against Constitutional Court's decision as well as supervision of a court decision which was in the Supreme Court through the mechanism of legal remedies ( ordinary and extraordinary).

Abstract

Health law reform in Indonesia is an important agenda in efforts to realize universal health that is fair and equitable for all levels of society. Along with social and economic developments, the Indonesian health system faces various challenges, such as unequal access to health services, unequal quality of services, and high financing burdens. Therefore, reforms in the health legal system are needed to increase the effectiveness and efficiency of health services, as well as ensuring the right of every citizen to receive adequate health services. This article discusses the main challenges in implementing health law reform in Indonesia, including unequal health infrastructure, limited human resources, and regulatory and bureaucratic obstacles. Apart from that, this article also explores existing opportunities, such as the use of digital technology, improving the National Health Insurance (JKN) system, and increasing community participation in decision making regarding health policy. Through analysis of various policies and experiences of other countries, it is hoped that recommendations can be obtained to improve Indonesia's health legal system in realizing universal health goals. With the right reforms, Indonesia can improve the quality of health services that are inclusive and accessible to all its citizens, without exception.

Abstract

Legal politics in the implementation of executive power in Indonesia, which is an integral part of the government system based on the constitution. Legal politics not only determines the direction and content of government policy, but also reflects the power relations between the executive, legislative and judicial institutions. This research aims to analyze how legal politics influences decision making at the executive level, with a focus on the role of the president in the presidential system, regulatory challenges, and political dynamics that influence the implementation of law in Indonesia. A qualitative approach with descriptive-analytical methods was used in this research, through literature review, analysis of legal documents, and evaluation of executive policies. The research results show that legal politics in Indonesia is characterized by challenges such as regulatory disharmony, the dominance of executive power in the presidential system, and political intervention in the legislative process. This situation has the potential to weaken the principles of rule of law and democracy. However, legal politics also functions as a transformation tool to strengthen fair, accountable and transparent governance. Legal political reform through harmonization of regulations, strengthening supervisory mechanisms, and empowering the community in the legislative process is very necessary to create a democratic and just legal system. This paper recommends the need to strengthen checks and balances between state institutions, consistent legal policies that are in line with the constitution, as well as legal education for the public so they can participate actively in the political process.

Abstract

Tindak pidana korupsi adalah kejahatan luar biasa yang sudah mendarah daging dan membudaya di sebagian bangsa Indonesia. Pengaturan hukum terhadap tindak pidana korupsi harus ditegakkan dan diterapkan hakim untuk pelaku korupsi sesuai dengan Pasal 2, 3 Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubahdengan UndangUndang Nomor 20 Tahun 2001. Pertanggungjawaban pidana tindak pidana korupsi. Pelaku harus bertanggung jawab karena telah menyalahgunakan kewenangan, kesempatan atau sarana yang ada padanya karena jabatan atau kedudukan yang dapat merugikan keuangan negara atau perekonomian negara, serta dalam kasus ini tindak pidana korupsi dapat dibuktikan dipersidangan dan telah memenuhi unsur Pasal 3 ayat (1) Undang-Undang Republik Indonesia Nomor 31 Tahun 1999 Tentang Pemberantasan Tindak Pidana Korupsi sebagaimana diubah dengan Undang-Undang Republik Indonesia Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi. Adanya tugas, kewenangan, hak dan kewajiban keterlibatan kepala desa terhadap pengawasan penggunaan anggaran dana desa merupakan faktor yang sangat penting untuk mencegah terjadinya tindak pidana korupsi dana desa,baik dalam pengambilan kebijakan, pengalokasian anggaran dan pelaksanaan kebijakan. Adapun upaya yang dilakukan Kepala Desa terhadap pencegahan tindak pidana korupsi dana desa dengan mengenali modus operandi korupsi dana desa untuk diantisipasi, peningkatan kualitas perangkat desa, pengawasan pengelolaan dana desa dan penguatan kerjasama dengan pendamping desa. Hambatan yang ditemui dan solusi yang dilakukan Kepala Desa dalam mencegah tindak pidana korupsi dana desa adalah rendahnya kualitas sumber daya manusia dalam mengelola dana desa dengan solusi dilakukannya bimbinganteknis, rendahnya integritas perangkat desa dalam mengelola dana desa dengan solusi melakukan penyuluhan budaya integritas sehingga terwujudlah pemerintahan desa yang berintegritas dalam menjalankan tugasnya dan rendahnya partisipasi masyarakat terhadap pengawasan pengelolaan dana desa dengan solusi menyediakan informasi kepada masyarakat desa melalui pemasangan spanduk di depan kantor desa, di lokasi pembangunan, pemasangan prasasti ketika pembangunan selesai dan disampaikan secara lisan melalui sosialisasi di berbagai acara kemasyarakatan.

Abstract

Reformasi hukum kesehatan di Indonesia menjadi agenda penting dalam upaya mewujudkan kesehatan universal yang adil dan merata bagi seluruh lapisan masyarakat. Seiring dengan perkembangan sosial dan ekonomi, sistem kesehatan Indonesia menghadapi berbagai tantangan, seperti ketimpangan akses layanan kesehatan, kualitas pelayanan yang tidak merata, serta beban pembiayaan yang tinggi. Oleh karena itu, reformasi dalam sistem hukum kesehatan diperlukan untuk meningkatkan efektivitas dan efisiensi pelayanan kesehatan, serta memastikan hak setiap warga negara untuk mendapatkan pelayanan kesehatan yang layak. Artikel ini membahas tantangan utama dalam implementasi reformasi hukum kesehatan di Indonesia, termasuk ketidakmerataan infrastruktur kesehatan, terbatasnya sumber daya manusia, serta hambatan regulasi dan birokrasi. Selain itu, artikel ini juga mengeksplorasi peluang yang ada, seperti pemanfaatan teknologi digital, perbaikan sistem Jaminan Kesehatan Nasional (JKN), dan peningkatan partisipasi masyarakat dalam pengambilan keputusan terkait kebijakan kesehatan. Melalui analisis terhadap berbagai kebijakan dan pengalaman negara lain, diharapkan dapat diperoleh rekomendasi untuk memperbaiki sistem hukum kesehatan Indonesia dalam mewujudkan tujuan kesehatan universal. Dengan reformasi yang tepat, Indonesia dapat meningkatkan kualitas layanan kesehatan yang inklusif dan dapat diakses oleh seluruh warganya, tanpa terkecuali.

Abstract

Tanjung Pinang City, with its natural resource potential in the form of bauxite ore, has experienced problems related to illegal mining activities (PETI) involving CV. Tri Karya Abadi. This case began with a report by PT Kemayan Bintan regarding theft and land grabbing in 2009. Investigations showed that CV. Tri Karya Abadi, despite having a limited permit, carried out exploitation outside the permitted area, utilizing heavy equipment and manipulative methods to obtain maximum profit. These activities resulted in the export of large amounts of bauxite to foreign countries. The investigation by the Criminal Investigation Unit of the Tanjung Pinang Police faced procedural obstacles, but succeeded in determining the main suspect and documenting the violations through the Investigation Report (BAP). In its resolution, this case dragged various parties with the application of sanctions based on Law No. 4 of 2009. An important lesson from this case is the need for synergy between the community, the police, and related agencies to prevent and take firm action against illegal mining activities. Consistent law enforcement with a multi-door system approach is key to protecting the environment and ensuring legal compliance.
