Abstract

This study is to examine in depth the polemic of law enforcement of corruption crimes (a case study of sugar imports by the Minister of Trade Thomas Lembong) and comprehensively discuss the legal and political framework for the eradication of corruption in Indonesia. The type of research is normative juridical with a descriptive-analytical approach, discussing existing legal symptoms and problems and testing them based on laws regulations, and legal norms. The results of this study show that the analysis of the handling of the case of alleged corruption in Thomas Lembong's sugar imports has many problems, including the requirement for political interests, not following the procedure and the time for determining the suspect is very long, the amount of state losses is uncertain, there is not enough evidence and only focuses on one individual. Corruption as an extraordinary crime requires extraordinary handling, including penal policies regulated in several regulations such as the law on the eradication of corruption crimes, the law on the corruption eradication commission, the Criminal Code, to the Presidential Regulation on the national strategy for corruption prevention, as well as non-penal policies including: public awareness education, administrative reform and strengthening of supervisory institutions

Abstract

This study aims to discuss in depth the juridical study and the role of members of the House of Representatives in a democratic country, as well as comprehensively discuss the urgency of reconstructing the law on the educational qualifications of members of the House of Representatives in election law. The type of research is normative juridical with a descriptive-analytical approach, discussing existing legal symptoms and problems and testing them based on laws regulations, and legal norms. The results of this study show that the legislative institution has a strategic position because it plays a role in carrying out the functions of legislation, budgeting, and supervision, as stipulated in Article 20 of the Constitution of the Republic of Indonesia of 1945. The requirements to become a legislative member are regulated in Article 240 Paragraph (1) of Law Number: 7 of 2017 concerning Elections, namely: being over 21 years old, fearing God Almighty, being loyal to Pancasilan and the 1945 Constitution, and having at least a high school, madrasah aliyah, vocational high school, or other equivalent school. The urgency of reconstructing the law on the educational competence of legislative members in Law Number: 7 of 2017 concerning Elections, namely the provisions of Article 240 to improve the educational qualifications of legislative members. Higher educational qualifications can affect the ability to make decisions, absorb aspirations, increase public credibility and trust, and adapt to the needs of the times

Abstract

The development of digital technology has brought significant transformations in the health sector, including in the implementation of telemedicine. Telemedicine allows interaction between doctors and patients through electronic media, which offers convenience in health services, especially in remote areas. However, the practice of telemedicine also poses various challenges, especially related to legal protection for patients. This study aims to examine the legal protection provided to patients in the digital era, especially in the context of telemedicine in Indonesia. In addition, this study also evaluates the telemedicine regulations that apply in Indonesia. Government Regulation No. 28 of 2024 is an implementing regulation of Law Number 17 of 2023 concerning Health. Regulation of the Minister of Health Number 20 of 2019 regulates the Implementation of Telemedicine Services Between Health Service Facilities. Through a normative juridical approach, this study highlights various legal issues related to patient data privacy, health service standards, legal responsibilities of medical personnel, and guarantees of legal protection for patients in telemedicine services. The results of this research are expected to contribute to the development of more comprehensive regulations and ensure that patients' rights are protected in the digital era

Abstract

The issue of land ownership disputes is a complex issue and often triggers prolonged conflicts in Indonesia. Land disputes can be caused by various factors, such as overlapping certificates, illegal land control, and weak law enforcement. In this context, legal politics becomes an important instrument in formulating policies to resolve land disputes fairly and efficiently. This paper aims to analyze the role of legal politics in resolving land ownership disputes, identify obstacles in policy implementation, and offer solutions to increase the effectiveness of dispute resolution. The research uses a normative approach with analysis of statutory regulations, official documents and academic literature. The research results show that existing regulations, such as the Basic Agrarian Law no. 5 of 1960, requires harmonization with other policies to overcome overlapping regulations. In addition, the role of mediation and arbitration institutions is considered crucial in reducing the burden on courts. However, weak legal dissemination to the community is a significant obstacle in policy implementation. This paper recommends strengthening regulations, increasing the capacity of mediation institutions, and legal education to the community as strategic steps to create a more effective land dispute resolution system.

Abstract

The dynamics of legal politics in resolving conflicts through mediation in Indonesia. The mediation process is an alternative dispute resolution that is increasingly popular in Indonesia, both in the context of civil and socio-political conflicts. This research aims to analyze the role of mediation in resolving conflicts as well as the impact of legal politics involved in this process. Mediation in Indonesia often involves political factors that influence the course of the process, both from the government, judicial institutions and other related parties. In this study, the author examines various cases of successful and failed mediation, and explores how political intervention can strengthen or hinder the effectiveness of mediation. The research results show that although mediation offers a peaceful solution, political dynamics are often an obstacle that needs to be considered in optimizing this route as a means of resolving disputes. This paper is expected to provide a deeper understanding of the challenges and opportunities of mediation in the Indonesian legal system.

Abstract

Legal politics is a strategic instrument in the formulation and enforcement of laws that reflects the vision, mission, and goals of a state. This article examines how legal politics influences the drafting of legislation and its implementation in law enforcement in Indonesia. Using a descriptive qualitative approach, this study reveals that legal politics in Indonesia is shaped by various political, economic, social, and cultural dynamics. The findings highlight challenges in maintaining the integrity and independence of the legislative process and law enforcement due to political interference. This article recommends strengthening oversight mechanisms and increasing public participation in legal politics to establish a more just and accountable legal system.

Abstract

ABSTRAKArtikel ini mengkaji hubungan antara politik hukum dan kesehatanmasyarakat di Indonesia, dengan fokus pada dampak kebijakan hukum terhadapsistem kesehatan nasional. Penelitian ini menggunakan pendekatan yuridis normatifdan empiris untuk menganalisis berbagai kebijakan kesehatan dan implementasinyadalam konteks Indonesia.Hasil penelitian menunjukkan bahwa politik hukum memiliki pengaruhsignifikan terhadap kesehatan masyarakat Indonesia. Berbagai produk hukum telahdihasilkan untuk mengatur sistem kesehatan nasional, namun implementasinyamasih menghadapi berbagai tantangan, seperti kesenjangan infrastruktur kesehatan,keterbatasan anggaran, dan koordinasi antar lembaga yang belum optimal.Upaya reformasi kebijakan kesehatan yang disarankan mencakup penguatansistem kesehatan primer, peningkatan anggaran kesehatan, pemerataan fasilitaskesehatan, dan pengembangan sumber daya manusia kesehatan. Keberhasilanimplementasi kebijakan kesehatan juga bergantung pada koordinasi antarpemangku kepentingan, konsistensi implementasi, dukungan anggaran yangmemadai, serta monitoring dan evaluasi berkelanjutan.Kata Kunci: Politik hukum, kesehatan masyarakat, kebijakan kesehatan,Indonesia, sistem kesehatan nasional

Abstract

Law is a set of rules and principles that regulate social interaction in society, aim to maintain order, and include various institutions and processes for implementing rules as a reality in society. The research was conducted in Binjai City at the Class II A Binjai Correctional Institution (Prison) Office. This research uses an empirical legal approach method, and data obtained in the field are presented descriptively using an empirical normative approach method. This study aims to determine the criminal law policy on granting Remission to inmates at Class II A Binjai Penitentiary and the obstacles faced in granting Remission to inmates at Class II A Binjai Penitentiary. Based on the results of the study, the author obtained that the fulfilment of the right to reduce the sentence (Remission) is based on existing laws and regulations, but to provide the fulfilment of rights (Remission) still requires improvements such as explaining to inmates (prisoners) about the requirements for obtaining Remission, as well as the obstacles faced by inmates (prisoners) in obtaining Remission, one of the factors is from the inmates themselves because the requirements for obtaining Remission are to behave well and be able to create a conducive environment.

Abstract

Forest fires are an environmental problem that occurs so often that it has become a local and global concerns. The phenomenon of forest and land fires that occurred in various regions of Indonesia several years ago is a legal fact that the implementation of Law Number 32 of 2009 concerning Environmental Protection and Management, Law Numbers 19 of 2004 concerning Forestry and various other statutory regulations does note in understand with predetermined expectations and rules. It cannot be denied that the phenomenon.phenomenon of forests fires is a serious and urgent threat that must be addressed by all parties. The method used in this research is normative legal research whichcomes from primary data, secondary data and tertiary data to support the arguments in this article. The data collection technique is qualitative descriptive analysis, namely by taking a conceptual and statutory approach. Using literature studies by collecting data through books, articles, statutory regulations, journals or other legal literature as well as online sites that are relevant to the problem being written about. This research aims to determine the impact of forest fires which cause environmental damage, the application of criminal sanctions against corporations as legal subjects for criminal acts of forest burning which . Based on the description above, it can be concluded that in accordance with the development of Indonesian criminal law regulations, a corporation that is declared obstacles faced when applying criminal sanctions against corporations as legal subjects for criminal acts of forest burning which cause environmental damage legal subject can also be burdened with criminal liability.
