Abstract

The purpose of this study is to comprehensively analyze the construction and legal certainty of replacement heirs in the compilation of Islamic law and its application in the religious courts of the DKI Jakarta region. This research uses a qualitative method with a normative legal approach, legislation, decision analysis, and Islamic law literature. Primary sources are obtained from the decisions of the religious courts of the DKI Jakarta high religious court region numbered: 131/pdt.p/2022/pa.jp, 339/pdt.p/2021/pa.jp, 166/pdt.p/2021/pa-jb, 3950/pdt.g/2020/pa-js, the compilation of Islamic law, and other legal materials related to inheritance. Meanwhile, secondary sources are obtained from literature searches such as books, documents, and journals that have the same relevance as this research. After the data is obtained and collected, data will be filtered and grouped according to its type, then the data is analyzed using descriptive analysis to be able to provide an overview of the existing problems. The results showed that, the legal construction of the concept of substitute heirs in the Compilation of Islamic Law in the Religious Courts in the DKI Jakarta PTA region by placing the position of substitute heirs by applying justice to the inheritance of his parents who had died before the heir. The research confirms the legal construction and rationale behind substitute heirs in Islamic inheritance law, highlighting their significance in inheritance disputes. Recognized under KHI Article 185, substitute heirs play a crucial role in ensuring fairness and equity in inheritance distribution. However, obstacles such as public awareness, evidentiary challenges, and conflicts with local customs impede the effective implementation of the substitute heir rule.

Abstract

Setiap manusia sering kali bersedekah dengan memberikan uang atau bentuk dukungan lainnya. Setiap manusia sering kali menukarkan uang atau bentuk dukungan lainnya untuk sumbangan amal. Bersedekah adalah salah satu cara umat Islam membantu mereka yang membutuhkan kebutuhan pokok. Selain mengalokasikan harta, hal ini bertujuan untuk membersihkan harta yang dimiliki agar Tuhan dapat mempercayakan hak orang lain. Memberi adalah definisi awal dari sedekah, dan dianggap sebagai sunnah pada masa awal Islam. Sedekah memiliki banyak keuntungan selain membersihkan harta ada juga pahala diampuni dosanya, sedekah bisa menjadi suatu ibadah untuk membantu orang lain. Dalam Al-Qur’an sendiri disebutkan sebanyak 7 kali dengan berbagai arti. Adapun menurut Surat Al-Baqarah ayat ke 271 disebutkan sebaik-baiknya sedekah secara sembunyi-sembunyi, biar tidak ada rasa dengki dari yang memberikan sedekah dan juga tidak menjatuhkan harga diri seseorang yang diberikan sedekah tersebut.

Abstract

The obligatory will regulated in Article 209 of the Compilation of Islamic Law is only for adoptive parents and adopted children, there is no obligatory will for heirs of different religions. On the other hand, there is a need for legal provisions that present a solution to provide part of the inheritance to heirs who do not receive inheritance due to religious differences. The purpose of this research is to analyze the important obligatory will in terms of its necessity, as well as a study of the obligatory will in terms of the procedure or implementation of the obligatory will itself in resolving disputes in court with legal considerations that are certain, fair and beneficial. The research method uses a qualitative method with a normative juridical approach. Primary data was obtained from regulations, laws, verdict numbers: 368 K/AG/1995, 51 K/AG/1999, 16 K/AG/2010, 721 K/AG/2015, 218 K/AG/2016 and 331 K/AG/2018. Supreme Court Decision No. 331 K/AG/2018 as well as the Compilation of Islamic Law (KHI) article 209 and regulations governing mandatory wills, secondary, tertiary data obtained from library studies, books, documents, journals and so on that have the same relevance to this research. The analysis process uses a legal logic approach, which analyzes the norms and laws or regulations that apply in depth, radically, systematically, and logically. The results of this study concluded that the dynamics of religious court decisions regarding compulsory bequests for heirs of different religions vary greatly, some are granted and some are rejected, the consideration depends on the sitting of the case that is disputed in the religious court, while the granting of compulsory bequests for heirs of different religions refers to the opinion who allows it as long as it is a will and the different religion in question is not kafir dzimmi. The effect of this decision becomes jurisprudence as part of the source of law for judges at levels below the Supreme Court. The contribution of the religious court's decision on this matter is that it can become a permanent jurisprudence so that it is proposed as a new article in KHI to fill in the missing article regarding mandatory wills for heirs of different religions.

Abstract

Progressive law is based on the emergence of a sense of dissatisfaction with the theory that has been developed and used as a guide in legal practice in Indonesia, legal theories that have been developed so far, are unable to respond to problems that occur in the reality of society. This has resulted in a sense of public dissatisfaction with the performance of the law and the courts. The value of justice is the main goal to be achieved in law enforcement efforts. Meanwhile, in the case of marriage annulment, there are parties who are dissatisfied with the decision of the first level judge, so they take legal action to a higher level court to answer their dissatisfaction. This research uses a qualitative method with an empirical juridical approach. Primary data obtained from marriage annulment decisions Number 185/Pdt.G/2023/PTA.Bdg, 84/Pdt.G/2023/PTA.Bdg and 106/Pdt.G/2023/PTA.bdg, secondary data obtained from laws, journals and other legal books that have the same relevance as this research. After the data is collected, data analysis is carried out to get answers to the problems raised. This research resulted in several findings. First, the application of progressive law in polygamy licensing cases uses the hermeneutic method, namely the school of philosophy that studies the nature of something to understand something into a clearer object of interpretation, in the case of forced marriage using the legal interpretation method, namely a conclusion in providing an explanation or understanding of a term that is unclear in meaning. Second, the door for judges to apply progressive law will never be closed, in fact it is a necessity by judges, legal problems will continue to exist and continue to develop.

Abstract

Digital technology is reshaping marketing by transforming how businesses engage with customers and deliver value. This study explores how digital platforms—such as CRM systems, AI tools, mobile applications, and social media—enhance customer engagement and satisfaction. Drawing on theories like Service-Dominant Logic and Omnichannel Marketing, it provides a conceptual analysis of digital value creation. Using qualitative methods and data from scholarly publications, the research identifies personalization, responsiveness, and seamless multichannel integration as key drivers of value. Findings suggest that firms must align digital strategies with evolving customer expectations through agile structures and cultural sensitivity. The study contributes theoretically by integrating global and local perspectives, and offers practical implications for businesses seeking to innovate through digital transformation. It concludes that strategic digital integration is essential for sustained competitiveness and long-term customer loyalty in dynamic environments.

Abstract

This research starts from the fact that shows the high divorce rate in Indonesia, this is evidence of the absence of household harmony that is not sufficient before entering into marriage, so the State is responsible as ordered by law, for the welfare of its people, making their households happy and eternal, that is where the State must be present and act to realize the households of its people happy and prosperous, one of which is by establishing premarital education early on as a concrete step to reduce the high divorce rate in Indonesia. The purpose of this study is to determine and analyze the optimal function of BP4 in tackling the divorce rate, the divorce rate in the PTA Bandung area 2017 to 2022, the function of BP4 in relation to the competence of judges, and BP4's efforts to reduce the divorce rate in the PTA Bandung area. The results of this study indicate that, First, Optimizing the Function of the Marriage Counseling, Guidance, Preservation Agency in relation to the high divorce rate in the Bandung PTA area, including: enhancing and improving the quality of marriage and happy families, preventing underage marriage, preventing unhealthy polygamy, and providing information advice in guidance to those concerned about Nikah, Talak and Rujuk (NTR) issues, especially for broken home households.

Abstract

This paper explores the concept of sustainable development from an Islamic perspective based on the QThis paper explores the concept of sustainable development from an Islamic perspective based on the Quran and Hadith. Sustainable development aims to meet the current generation's needs without compromising the future generation's capacity through economic growth, social justice, and environmental protection. However, academic discourse integrating these three pillars from an Islamic viewpoint is limited. Therefore, this paper analyses relevant Quranic verses and Hadiths to formulate a comprehensive sustainable development concept in Islam encompassing those key pillars. Content analysis finds Islamic sustainable development contains four main complementary dimensions: (1) comprehensive social development considering individual and societal wellbeing, (2) economic development focused on financing sources and economic potential mobilization, (3) legal and policy development to facilitate and protect development processes, and (4) stability and security as prerequisites for development. These dimensions align with the human role on Earth to prosper while safeguarding sustainability. Development must promote justice through balancing current and future generation interests. Hence, Islamic sustainable development integrates spiritual, social, economic, and environmental aspects. This concept can enrich contemporary Islamic scholarship on the issue and serve as an alternative framework for Muslim-majority countries to formulate policies towards welfare and sustainability.ran and Hadith. Abstract

The meaning of tijarah in the Qur'an is often interpreted as trade, commerce, business or buying and selling. The term tijarah in the Qur'an is often expressed to provide understanding or guidance for conducting commerce or business in Islam. So the aim of this research is to understand the meaning of tijarah in the Al-Qur'an, which then applies this interpretation to Islamic business practices. The method used in this research is a qualitative method with a literature study approach. The results of this research show that the word tijarah in the Al-Qur'an, along with all its derivatives, is repeated eight times, found in Surah Al-Baqarah/2: 16 and 282, An-Nisa/4: 29, At-Taubah/9 : 24, An-Nur/24: 37, Fathir/35: 29, Ash-Shaf/61: 10, and Al-Jumu'ah/62: 11, which shows the meaning of commerce or business in material and immaterial forms. The meaning of tijarah in the Al-Quran provides understanding and guidance that business or commerce practices should be carried out in accordance with the Shari'a by avoiding anything that justifies any means just to gain profit. However, the most important thing is to pursue pleasure to get blessings from the sustenance given by Allah SWT.

Abstract

The purpose of writing this paper is to find out whether there is falsehood in the sukuk transaction. This paper aims to see based on sharia principles as well as seen from QS. An-Nisa verse 29. The research method used in this paper is a qualitative method in the form of a literature study. Classical commentary books as primary sources and supporting theory books as secondary sources. The results of this study are ordered by Allah SWT that it forbids His believing servants to eat the wealth of some of them over others in a false way, namely through businesses that do not have the Shari'a, such as doing it by means of usury, gambling and various other ways. which fall into the category of using various tricks and deception. The author concludes that in the sukuk transaction it is clearly stated in the Qur'an and hadith that the management carried out must be based on sharia principles, it is not allowed to contain elements of maysir (gambling), gharar (obscurity), and usury (usury).

Abstract

This study explains Maqâshidî Interpretation and its application in interpretation Of Ahkam Verses, and aims to discussion on Maqâshid asy-Syarî’ah and the significance and urgency of Maqâshidî. Maqâshidî's inter-pretation is expected to provide an alternative interpretation in providing solutions for contemporary problematics and reinterpretation of the interpretation formulations that have been out of date. The research method used in this research is qualitative method and analytical descriptive method. This study concludes that The character of Syarî'ah is permanent and governs the whole af'âl al-Mukallaf in every place and time, then the approach or method of maqâshidî interpretation in interpreting Âyât al-ahkâm is a necessity and very imfortant. The discourse of Âyât al-AhKâm interpretation discusses on the place of law formulation against a problem (Fi'l al-Mukallaf). he necessity of interpretation of the approach or method of Maqâshidî interpretation is not only effective in responding to new issues that have never appeared before but also empowered to reinterpret the formulation of interpretations that have not been relevant anymore in the context of the present and the contemporary.Keywords: Maqâshidî Interpretation, Maqâshid asy-Syarî’ah, Âyât al-AhKâm,
