Abstract

Unilateral termination of employment constitutes a fundamental issue in industrial relations, reflecting the imbalance of bargaining power between employers and workers. The state intervenes through labor regulations, particularly Law Number 6 of 2023 on the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 on Job Creation as Law and Government Regulation Number 35 of 2021 concerning Fixed-Term Employment Agreements, Outsourcing, Working Time and Rest Time, and Termination of Employment, to ensure legal protection for workers. This study examines how termination of employment is regulated under Government Regulation Number 35 of 2021 and how the panel of judges considered unilateral termination cases in Decision Number 16/Pdt.Sus-PHI/2025/PN Bdg. The research employs a qualitative method with a normative legal approach through literature study of statutory regulations and court decisions. Government Regulation Number 35 of 2021 regulates termination of employment comprehensively as a last resort with strict procedures. In Decision Number 16/Pdt.Sus-PHI/2025/PN Bdg, the panel of judges declared that the fixed-term employment agreement had transformed into an indefinite-term employment agreement and that the termination was null and void. However, a contradiction arises as the employment relationship was ultimately terminated on grounds of efficiency solely based on Article 100 of Law Number 2 of 2004 without considering Constitutional Court Decision Number 19/PUU-IX/2011, whereas the efficiency provisions within that Constitutional Court Decision cannot justify the termination of employment of the Plaintiffs whose status had been established as indefinite-term, thus the legal basis employed was inaccurate and entirely without juridical foundation, ultimately failing to provide optimal legal protection for workers.

Abstract

This study is based on the vulnerability of children as victims of sexual abuse, requiring strong juridical and procedural protection from the investigation stage to prevent revictimization and prolonged trauma. The research aims to evaluate the effectiveness of legal protections for child victims in Indonesia and assess how the principle of equality before the law ensures balanced justice for both victims and suspects. The method used is normative juridical research through library studies of primary, secondary, and tertiary legal sources, supported by interviews at the Women and Children Protection Unit (Unit PPA) of the Karawang Police Resort. Findings indicate that, normatively, Indonesia has a solid foundation through the 2025 Criminal Procedure Code, the Law on Witness and Victim Protection, the Child Protection Law, and Law No. 12 of 2022 on Sexual Violence Crimes, guaranteeing rights such as identity protection, expert accompaniment, and restitution. Practically, however, protection depends on adherence to cross-sectoral standard operating procedures, the involvement of certified female investigators, and coordination with institutions like the Regional PPA Unit, Social Services, and Correctional Guidance Office. The study concludes that restorative justice cannot be applied in child sexual abuse cases to protect the substantive rights of victims. Investigators face challenges in collecting psychologically affected testimony, limited eyewitnesses, and scarce evidence, resulting in incomplete protection. Therefore, strengthening formal judicial proceedings is essential to ensure justice for child victims.

Abstract

AbstrakHubungan Industrial Pancasila mengacu pada konsep hukum ketenagakerjaan Indonesia yang sarat dengan nilai-nilai Pancasila. Redundansi berarti PHK antara pegawai atau karyawan dengan perusahaan atau kontraktor. Uraian singkat kasus yang penulis lakukan yaitu pemecatan karyawan Garden Palace Hotel Surabaya karena perusahaan dinyatakan pailit oleh Pengadilan Niaga Surabaya, karena buruknya keadaan keuangan perusahaan sehingga tercapai efisiensi. Karyawan yang terkena PHK berhak mendapatkan uang pesangon secara mencicil. Disepakati pada 29 Maret 2021. Namun hasilnya tidak sesuai dengan kesepakatan berdasarkan asas Pancasila bahwa pelaksanaan hak-hak agregat diatur dengan undang-undang. peraturan pemerintah dan kontrak kerja. Dalam putusan tersebut, penulis berkesimpulan bahwa dalam hal ini majelis hakim telah mematuhi Pasal 165 UU No 13/2003 , dimana hak pemberhentian pegawai apabila perusahaan bangkrut adalah: 2x PHK + 1x panjang. biaya layanan + hak pesangon.AbstractPancasila Industrial Relations refers to the concept of Indonesian labor law which is full of Pancasila values. Redundancy means termination of employment between an employee or employees and the company or contractor. A brief description of the case that the author did, namely the dismissal of Garden Palace Hotel Surabaya employees because the company was declared bankrupt by the Surabaya Commercial Court, due to the poor financial condition of the company so that efficiency was achieved. Employees who are dismissed are entitled to severance pay in installments. It was agreed on March 29, 2021. However, the result is not in accordance with the agreement based on the principle of Pancasila that the implementation of aggregate rights is regulated by law. government regulations and employment contracts. In this decision, the author concludes that in this case the panel of judges has complied with Article 165 of Law Number 13 Year 2003, where the right to dismiss employees if the company goes bankrupt is: 2x layoff + 1x long. service fee + severance pay rights.

Abstract

Unilateral This research is motivated by the high number of cybercrimes in the form of fraud in e-commerce in Karawang Regency, with the increasing digital lifestyle of the community. The main objective of this study is to explore this phenomenon using a victimology perspective, where the Lifestyle Exposure theory of Hindelang and his colleagues and the concept of functional responsibility of Stephen Schafer are the foundation. The methodology applied in this study is empirical juridical, with primary data obtained through in-depth interviews with the Tipidter Unit of the Karawang Police and individuals who have become victims of online fraud. The findings of the study indicate that the key factors causing victimization in Karawang are caused by less vigilant consumer behavior, including transactions outside official platforms (85%) and being influenced by unreasonable prices (78%), which theoretically indicates exposure to risks due to digital lifestyles. The Karawang Police's countermeasures utilize a preventative approach, providing digital literacy education to strengthen social resilience, and a repressive approach through law enforcement based on digital forensics and inter-agency collaboration (Kominfo, BSSN, and OJK) to create a deterrent effect on perpetrators. This study concludes that preventing online fraud requires collaboration between legal enforcement and increased awareness among victims to break the cycle of opportunity for crime.

Abstract

The allocation of joint assets in polygamous unions involves distinct complexities that necessitate well-defined legal provisions to avert potential conflicts within the family. This research analyzes how legal rules governing joint property in polygamous marriages are implemented, as illustrated in Decision No. 555/Pdt.G/2024/PA.Krw. Utilizing a normative juridical approach combined with a case study method, the study incorporates qualitative analysis of judicial decisions, statutory law, and pertinent legal doctrines. The results reveal that the panel of judges relied on Article 35 of Law No. 1 of 1974 and Article 94 of the Compilation of Islamic Law, both of which mandate that joint property be divided separately for each marital relationship. This measure is intended to ensure legal certainty, safeguard the ownership rights of the first wife, and prevent future disputes. Judicial considerations also included the explicit consent of the first wife and sufficient financial capability of the applicant as prerequisites for granting polygamy. The study concludes that separating joint property in polygamous marriages serves as a preventive legal protection for wives while embodying the principles of justice and legal certainty within the religious court system. Abstract

The increasing incidence of drug abuse among street children in Karawang Regency has become a serious social and legal concern. As a vulnerable group, street children often fall victim to drug exploitation due to the absence of family supervision and their exposure to high-risk environments. This study aims to analyze the victimological factors that make street children vulnerable to drug abuse and to interpret this phenomenon through the Lifestyle Exposure theory. Using an empirical juridical method, this research combines normative analysis of legal regulations with field studies through interviews with street children, law enforcement officials, the National Narcotics Agency of Karawang Regency, and social institutions. The findings reveal that economic hardship, social pressure, and a lack of legal awareness significantly contribute to children’s exposure to drugs. In the context of Lifestyle Exposure theory, their street-based lifestyle increases the likelihood of contact with perpetrators and risky situations. Legally, these children qualify as potential victims requiring special protection. Therefore, integrated efforts between government institutions, law enforcement, and the community are urgently needed to strengthen prevention, protection, and rehabilitation mechanisms for street children affected by drug abuse.

Abstract

The responsibility of a judge is not only to the State but also to God Almighty. The panel of judges in deciding a case always carries a message with the sentence “Justice is based on the one and only God.” The Surabaya District Court Judge acquitted the defendant in a murder case because he was not proven to have committed the crime charged by the public prosecutor, namely “Article 338 of the Criminal Code or both Articles 351 paragraph (3) of the Criminal Code or the first three Articles 359 of the Criminal Code and both Articles 351 paragraph (1) of the Criminal Code.” The public prosecutor filed an appeal to the Supreme Court. This study aims to analyze how the public prosecutor will file an appeal in a murder case that was acquitted by the Court and how the cassation judge considered it in decision Number 1446 K / Pid / 2024? This research was conducted normatively by examining library materials and applicable regulations. The stages or process of submitting a cassation by the public prosecutor to the Supreme Court are stated in “Article 244, Article 245, Article 246, Article 247 and Article 248 of the Criminal Procedure Code concerning cassation examination”. The main finding in the description of the judge's considerations, the actions carried out by the Defendant clearly fulfill the elements of a criminal act as stated in the alternative charge of the second combination of Article 351 paragraph (3) of the Criminal Code. Thus, the Defendant was found guilty legally and convincingly, and was sentenced to five years imprisonment.

Abstract

Adoption functions as a formal legal process aimed at protecting children’s rights and welfare, especially for those without parental care from their birth parents. It aims to provide legal security, familial stability, and social protection for adopted children within a legitimate family structure. This study presents a normative legal analysis of the procedural aspects of child adoption and critically examines the judicial considerations outlined in the Decision of the Karawang District Court Number 175/Pdt.P/2024/PN.Kwg. Employing a normative juridical approach combined with a case study and conceptual analysis, the research finds that the adoption application submitted by Silwanus Betti and Maria Agustina Kono complies with both formal and material legal requirements. The judge took into account the child’s background, born to a single mother facing economic hardship, and emphasized the best-interests of the child principle. The petition was supported by authentic documents and credible witness testimonies. The court’s ruling not only provides legal legitimacy and protection for the adopted child but also establishes legal certainty for all parties involved in the adoptive family relationship.

Abstract

The state holds constitutional responsibility in the field of labor by providing legal protection to ensure legal certainty for individuals involved, particularly in the context of employing foreign labor. However, such protection applies only to foreign workers who meet the legal standing requirements in Indonesia. This research addresses the case of unilateral termination of employment against Stephane Baudoin by PT Origin Resort Lombok. Utilizing a normative juridical method, the findings indicate Baudoin's entitlement to legal recourse due to fulfilling the criteria of legal standing in labor matters. The appellate decision of the Supreme Court confirms PT Origin Resort Lombok's violation of the Job Creation Law. Abstract

This research investigates the implementation of smart contracts in the Indonesian property sector, examining the legal opportunities and challenges involved. Blockchain technology offers high transparency, efficiency, and security in property transactions, but faces regulatory and infrastructural hurdles. The aim of this research is to explore the related legal dynamics, identify socio-economic impacts, and offer sustainable solutions. The research method employed is a qualitative legal approach to gather and analyze data. The findings indicate that although blockchain can expedite transaction processes and enhance transparency, the legal validity of smart contracts and consumer protection remain major issues.
