Abstract

Transformasi digital telah mengubah lanskap ketenagakerjaan Indonesia, khususnya bagi Generasi Z (lahir 1997-2012) yang mendominasi sektor ekonomi digital dan industri kreatif, namun menghadapi persoalan mendasar berupa ketiadaan perlindungan hukum memadai dan ketidakjelasan status kepegawaian. Penelitian ini menggunakan pendekatan mixed method yang menggabungkan penelitian hukum normatif dengan penelitian hukum empiris melalui survei terhadap 20 responden pekerja digital berusia 21-26 tahun untuk menganalisis implementasi perlindungan hukum berdasarkan UU No. 13 Tahun 2003 jo. UU No. 6 Tahun 2023 tentang Cipta Kerja. Hasil penelitian menunjukkan bahwa meskipun 85% responden telah terdaftar BPJS dan sebagian menilai perlindungan hukum cukup efektif, terdapat kesenjangan signifikan antara pekerja tetap yang mendapat perlindungan lengkap dengan pekerja freelance atau mitra platform yang rentan eksploitasi akibat rendahnya literasi hukum (mayoritas hanya memahami sebagian kecil UU Ketenagakerjaan dan UU Cipta Kerja), minimnya sosialisasi regulasi, ketiadaan kontrak tertulis jelas, ketidakpastian upah, dan ambiguitas status kepegawaian yang memungkinkan platform menghindari kewajiban perlindungan tenaga kerja. Konsensus kuat dari Generasi Z menunjukkan perlunya regulasi khusus untuk pekerja platform digital, peran aktif pemerintah, dan perlindungan komprehensif yang mencakup kejelasan status hubungan kerja, jaminan sosial, standar upah layak, dan perlindungan data pribadi. Penelitian ini merekomendasikan reformasi kebijakan menyeluruh meliputi sosialisasi hukum masif berbasis digital, klarifikasi status kepegawaian dengan kategori "pekerja platform" yang mendapat perlindungan dasar namun tetap fleksibel, transparansi algoritma platform, perluasan akses jaminan sosial adaptif, sistem penyelesaian sengketa cepat dan murah, penguatan kapasitas penegak hukum, serta dialog multi-stakeholder berkelanjutan untuk memastikan ekosistem kerja digital Indonesia tumbuh inovatif tanpa mengorbankan kesejahteraan dan hak-hak fundamental pekerja muda. Generation Z (born 1997–2012), who dominate the digital economy and creative industries but face fundamental issues such as inadequate legal protection and unclear employment status. This study employs a mixed-method approach combining normative and empirical legal research through a survey of 20 digital workers aged 21–26 to analyze the implementation of legal protection based on Law No. 13 of 2003 in conjunction with Law No. 6 of 2023 on Job Creation. The findings reveal that although 85% of respondents are registered with BPJS (Social Security), and some perceive legal protection as fairly effective, a significant gap remains between permanent employees who receive comprehensive protection and freelancers or platform partners, who are vulnerable to exploitation due to low legal literacy (most understand only a small portion of the Manpower Law and the Job Creation Law), limited regulatory outreach, lack of clear written contracts, wage uncertainty, and ambiguous employment status that allows platforms to evade labor protection obligations. A strong consensus among Generation Z highlights the urgent need for specific regulations for digital platform workers, active government involvement, and comprehensive protection encompassing clear employment status, social security, fair wage standards, and personal data protection. This study recommends comprehensive policy reforms, including large-scale digital legal education, clarification of employment status through a “platform worker” category ensuring basic yet flexible protection, platform algorithm transparency, expanded access to adaptive social security, fast and affordable dispute resolution systems, capacity building for law enforcers, and continuous multi-stakeholder dialogue to ensure Indonesia’s digital work ecosystem grows innovatively without compromising the welfare and fundamental rights of young workers.

Abstract

Overclaim occurs when business actors convey excessive or factual information in product promotions, thus misleading consumers and violating the principles of transparency and honesty in trade. In the skincare industry on e-commerce platforms, this practice is increasingly widespread along with high market competition. Consumers are often disadvantaged because they do not have adequate ability to verify the truth of product claims. This study aims to examine the form of legal protection provided to consumers, as well as to examine the responsibilities of business actors based on the provisions of Law Number 8 of 1999 concerning Consumer Protection. The method used is qualitative with a normative legal approach, which focuses on literature studies and analysis of relevant laws and regulations. The findings in this study indicate the need to strengthen the legal protection system, both preventively through advertising monitoring mechanisms, and repressively through the application of strict legal sanctions. The active involvement of e-commerce platforms is also key to creating effective consumer protection in the digital space.

Abstract

This study aims to analyze the considerations employed by the Panel of Judges in Decision Number 30/Pid.Sus/2023/PN.Cbi and to examine the obstacles encountered in combating the crime of child trafficking through illegal adoption schemes. The research employs a normative juridical method using statutory, case, and conceptual approaches. The findings indicate that the judges’ legal considerations were consistent with the provisions of Article 83 in conjunction with Article 76F of Law Number 35 of 2014 concerning Child Protection, as they were based on the fulfillment of the elements of the criminal offense and supported by valid evidence. The judges also took into account philosophical and sociological considerations in determining the sentence. However, the sentence imposed on the defendant, namely four (4) years of imprisonment and a fine of IDR 100,000,000, was considered relatively lenient because it was lower than the sentence sought by the Public Prosecutor, namely five (5) years of imprisonment. Consequently, the punishment imposed has not fully reflected substantive justice for the victim. Furthermore, efforts to combat this form of crime continue to face various challenges, including ambiguities in legal norms, weak supervision of child adoption practices, low levels of public legal awareness, and the use of social media as a medium for digitally facilitated criminal activities. Protection for victims also remains suboptimal, particularly with regard to psychological recovery, rehabilitation, and restitution.

Abstract

Law Number 20 of 2025 concerning the Criminal Procedure Code (KUHAP) introduces restorative justice as part of the reform of Indonesia’s criminal justice system. However, the implementation of restorative justice at the inquiry stage continues to raise legal concerns because the status of the alleged offender and the victim has not yet been definitively established, while the case may already be resolved through a reconciliation mechanism. This study aims to analyze the regulation of restorative justice under Articles 79 to 84 of the 2025 Criminal Procedure Code and to identify the challenges arising from its implementation during the inquiry stage. The research employs a normative legal method using statutory and conceptual approaches through qualitative analysis of primary and secondary legal materials. The findings indicate that the restorative justice provisions contained in the 2025 Criminal Procedure Code have accommodated victim-oriented recovery and dialogic dispute resolution. Nevertheless, their implementation at the inquiry stage still presents several challenges, including the unclear legal status of the parties involved, inadequate fact verification, limited supervisory mechanisms, and the potential abuse of authority that may weaken victim protection. Therefore, more comprehensive regulations concerning case eligibility standards, supervisory mechanisms, and victim protection are required to ensure that the implementation of restorative justice remains consistent with the objectives of criminal justice system reform.

Abstract

The circulation of cosmetics containing hazardous dyes remains a serious problem in Indonesia despite being regulated under Law No. 8 of 1999 on Consumer Protection. Based on findings by the Indonesian Food and Drug Administration (BPOM) in 2025, cosmetic products containing hazardous substances that pose potential health risks to consumers are still being found. This study aims to analyze the government’s role through the BPOM in overseeing the circulation of cosmetics containing hazardous dyes, as well as to analyze the form of liability of business operators for consumer losses based on Articles 4, 7, 8, 19, 29, and 30 of Law No. 8 of 1999 on Consumer Protection. The research method used is a normative legal approach with a legislative and conceptual framework, utilizing secondary data comprising primary, secondary, and tertiary legal sources through a literature review. The research findings indicate several issues in the oversight of hazardous cosmetics, namely the suboptimal post-market supervision of products circulating in digital media, weak oversight of product distribution in regional areas, and the persistent discrepancy between the registered product composition and the products actually circulating in the market. Furthermore, business operators continue to violate regulations by selling products containing hazardous dyes despite existing prohibitions in the law. Businesses fulfill their responsibilities through product recalls, suspension of distribution, revocation of marketing authorizations, and compensation for consumers. Therefore, it is necessary to strengthen BPOM oversight, enhance monitoring of digital distribution, and enforce the law more rigorously to ensure optimal consumer protection.

Abstract

This study examines Supreme Court Decision No. 560 K/Pdt.Sus-PHI/2023 regarding the arbitrary dismissal of a fixed-term contract (PKWT) worker due to COVID-19. Using normative judicial methods, it highlights violations of human rights and legal protection. Findings show that under Article 62 of the Labor Law, employers must pay the remaining contract wages for early termination. The Supreme Court granted the worker’s appeal, citing the lower court's legal errors. Consequently, the company was ordered to pay IDR 33,400,000 in compensation to ensure substantive justice and protect the worker’s normative rights.

Abstract

Legal protection for female workers regarding working hours is regulated by Law No. 13 of 2003 concerning Manpower, but remains Vulnerable to violations such as excessive working hourse and inadequate nighttime facilities. A case study at PT. TMI revealed obstacles stemming from workers’ lack of understanding, minimal company attention and suboptimal union support. The conclusion emphasizes the synergy between the three parties and the need for specific Regional Reglations to close regulatory gaps, through efforts to socialize the Collective Labor Agreement (PKB) and proactively respond to complaints.

Abstract

This study examines legal protection for abortion actors in medical emergency cases under the Health Law, the 2023 Criminal Code and Government Regulation 28/2024. The main issue lies in the gap between the normative recognition of lawful abortion exceptions and the risk of criminalization when procedure, gestational limits, or medical proof are not fulfilled. Using normative juridical method, this study finds that patients and medical personnel are protected when the abortion is based on lawful indications, performed in authorized facilities and supported by consent and medical assessment. Operational guidelines remain necessary to prevent criminal interpretation.

Abstract

Legal guarantees for workers include the right to overtime pay, which employers must pay if workers work beyond the specified working hours. However, violations of this right still frequently occur, as seen in case No. 39/Pdt.SusPHI/2025/PN Sby. This study examines the legal guarantees for overtime pay based on the Manpower Law Regulations in conjunction with the Job Creation Law and the judge's considerations in the decision. The results of the study indicate that legal protection for overtime pay has been comprehensively regulated in legislation. The judge's considerations are deemed appropriate because they are based on valid facts and evidence. The Labor Inspectorate determined the company's liability at Rp18,643,500.00.

Abstract

Climate change has become a global challenge that needs to be addressed together. Indonesia is one of the countries that is vulnerable to climate change. The decline in environmental quality that has an impact on natural disasters can be detrimental to various parties. In Indonesia, Law Number 32 of 2009 concerning Protection and Management of the Environment has been enacted, which contains systematic and integrated efforts to preserve the environment and as an effort to prevent pollution and/or environmental damage. In addition, regulations have also been issued on carbon taxes in Article 13 of Law Number 7 of 2021 concerning Harmonization of Tax Regulations. The main objective of the carbon tax is to change the behavior of economic actors to switch to low-carbon economic activities, but the implementation of the carbon tax is currently still being postponed. The research methodology is a literature review, in the form of normative legal, qualitative. The data presented are secondary data obtained from various literature sources. This study concludes that in order to reduce the worsening environmental damage and also increase revenue from the Tax sector, it is necessary to implement a Carbon Tax, but the Law that has been issued has been postponed, with various considerations, so that the carbon tax can be implemented and run effectively, there is a need for improved regulations that not only function as economic tools, but also as drivers of behavioral change and technological development to achieve sustainability goals.
