Abstract

In everyday life, economic activities often involve legal agreements between parties regarding an agreed-upon object. In Indonesia's Civil Law system, various types of contracts are regulated, including employment relationships. This study aims to identify the factors leading to termination of employment (PHK) based on the Job Creation Law and to explore legal protection for workers who experience unilateral termination. The focus of this research includes the analysis of employment termination mechanisms under the Job Creation Law, and the legal efforts available to workers against unilateral termination carried out by companies. This research is normative in nature, employing a qualitative method and a normative juridical approach. This approach involves examining rules, norms, and regulations relevant to unilateral termination through a literature study, which includes reading, quoting, copying, and analyzing related theories. The primary data used are secondary data, while primary data serve as supporting data. The findings indicate that there are cases of unilateral termination that violate the Job Creation Law. The ambiguity of sanctions in the law creates loopholes for companies to carry out unilateral terminations. Workers affected by unilateral termination are entitled to legal protection as stipulated in the Job Creation Law, which is part of the commitment to improving economic quality. Companies that conduct unilateral termination must also face sanctions in accordance with violations of the law and the uncertainty of citizens' constitutional rights.

Abstract

In Indonesia, drug abuse and distribution are still serious problems. The absence of a threshold for drug possession for abusers causes ambiguity in law enforcement. This study analyzes the regulation of the threshold for drug possession for drug abusers as seen from two Karawang District Court Decisions used as comparative references so that there is a disparity in decisions reviewed from evidence that exceeds its abuse. Evidence can be used as a reference to determine whether the goods exceed the personal consumption limit. This study uses a normative legal approach by analyzing qualitatively, the results show that there is a lack of guidelines on the threshold for possession. Judges' interpretations often affect evidence, and inconsistent guidelines lead to differences in sentences.

Abstract

The discovery of nine children's food products containing pork (porcine) by BPJPH and BPOM in April 2025 raised public concern, especially since seven of them had halal certification. This study examines the role of BPJPH in protecting consumer rights under Law Number 8 of 1999, focusing on cases of ingredient falsification. Using a normative juridical approach and case study method, the findings reveal weak post-market surveillance by related agencies, resulting in significant spiritual and material losses for Muslim consumers. The study highlights the urgent need for more effective preventive, repressive, and coordinative measures to uphold consumer protection and halal assurance.

Abstract

The allocation of joint assets in polygamous unions involves distinct complexities that necessitate well-defined legal provisions to avert potential conflicts within the family. This research analyzes how legal rules governing joint property in polygamous marriages are implemented, as illustrated in Decision No. 555/Pdt.G/2024/PA.Krw. Utilizing a normative juridical approach combined with a case study method, the study incorporates qualitative analysis of judicial decisions, statutory law, and pertinent legal doctrines. The results reveal that the panel of judges relied on Article 35 of Law No. 1 of 1974 and Article 94 of the Compilation of Islamic Law, both of which mandate that joint property be divided separately for each marital relationship. This measure is intended to ensure legal certainty, safeguard the ownership rights of the first wife, and prevent future disputes. Judicial considerations also included the explicit consent of the first wife and sufficient financial capability of the applicant as prerequisites for granting polygamy. The study concludes that separating joint property in polygamous marriages serves as a preventive legal protection for wives while embodying the principles of justice and legal certainty within the religious court system. Abstract

The purpose of a marriage bond is to form a household that is sakinah mawadah warrahmah that lasts until the end of life. However, often this goal cannot be realized due to various kinds of conflicts in a marriage bond that eventually results in divorce. The end of the marital relationship due to divorce does not necessarily solve problems between divorced husband and wife, sometimes new conflicts arise after the occurrence of divorce, including regarding common property that is contested through a Joint Property Lawsuit. One way to anticipate the emergence of such conflicts is to make a Prenuptial Agreement that is carried out before marriage. The problem is what if the agreement is made before the divorce and how the strength of the joint property division agreement made before the divorce is reviewed from the Civil Code against the joint property lawsuit. Qualitative Research Method Using the Normative Juridical Approach Method. The result of his research is the evidentiary power of the agreement on the division of common property carried out under the hands before the divorce reviewed from article 1338 of the Civil Code and article 1320 of the Civil Code which guarantees the legal force of the agreement made before the divorce in the joint property lawsuit and also whether the agreement under the hands can be said to have perfect evidentiary power as per the principle of pacta sunt servanda.

Abstract

Public housing credit is a program aimed at addressing the housing backlog in Indonesia, yet its implementation faces various challenges. This research focuses on two main issues: (1) What happens to public housing loans when banks go bankrupt? (2) How can consumer issues be resolved when housing loans default? The study uses a normative judicial method. The findings reveal that while the People's Housing Credit (KPR) helps people acquire homes, significant risks arise if credit institutions go bankrupt or debtors default. In cases of default or bank bankruptcy, debtors must still fulfill their credit obligations. Consumer protection is outlined in the 1999 Consumer Law, which includes exit clauses in credit agreements. The government, through the Deposit Insurance Corporation (LPS), can rescue or liquidate banks according to Law No. 24 of 2004. Moreover, drafting fair contracts, offering credit restructuring, and providing insurance options can better protect debtors than asset auctions. Additionally, applying the principle of prudence in credit assessments, as per the Banking Law, is crucial to minimizing default risks. Stricter regulations and robust legal protections are essential for mortgages to effectively help people own homes while ensuring financial and legal stability.

Abstract

Early marriage in Indonesia has entered an alarming stage with the number of early marriages continuing to climb as poverty in Indonesia increases. For the poor, early marriage is a pragmatic effort to reduce the economic burden born from the obligation to take care of their children. However, this actually worsens the condition because children who marry early find it difficult to get out of structural poverty. With a normative juridical method, this research is intended to understand the legal dynamics in the context of preventing early marriage in society. From this study, it was found that there was a legal gap in the revision of the Marriage Law and the absence of legal products that function to prevent early marriage so that the number of early marriages continues to increase and responsible actors can avoid their responsibilities by taking advantage of existing legal loopholes

Abstract

Law number 1 of 2023 was prepared as an update of the old product, namely the Netherlands Heritage Fund. Various new paradigms of legal protection are part of the preparation of the draft of Law number 1 of 2023. However, at the same time, the protection of commercial sex workers (PSK) is still limited to efforts to provide a deterrent effect on those who allow prostitution to occur. In fact, the solution to the problem of prostitution should be solved systematically with lex specialis who raises issues involving prostitution. Meanwhile, the weakness of Law number 1 of 2023 is that it has not solved the core problem of brutal and inhumane social justice in prostitution. However, Law number 1 of 2023 has at least stopped the criminalization of prostitution. This research is prepared by normative juridical methods and reviews the law in depth based on the editorial and context of legal products of Law number 1 of 2023 on the basis of research to find.
