Abstract

The protection of workers' rights, particularly concerning minimum wage (UM), has become a central issue in the evolving landscape of Indonesian labor law. This study is motivated by the elimination of sectoral minimum wages through Government Regulation No. 36/2021 and the enactment of the Omnibus Law (UU Ciptaker), which sparked widespread controversy, especially regarding the protection of workers' rights and the transparency of the legislative process. Grounded in the theories of the rule of law, human rights protection, and the principles of good governance, this research employs normative legal methods using a statute approach and literature study. Data collection was conducted through the examination of primary legal materials such as laws and Constitutional Court decisions, as well as secondary legal sources including academic journals, legal books, and relevant scholarly articles. The data was analyzed qualitatively using a descriptive-analytical technique to interpret the legal implications of Constitutional Court Decision No. 168/PUU-XXI/2023. The findings reveal a misalignment between the objectives of the Omnibus Law and the implementation of workers' rights protections. Meanwhile, the Constitutional Court's decision offers a new perspective on the limitations of legislative authority, encouraging the separation of labor regulations from the Omnibus Law, and reinforcing constitutional guarantees for workers' rights. This decision has had a significant impact on wage policy, particularly in Karawang Regency, where the determination of minimum wage must now adhere to the principles of social justice, transparency, and respect for fundamental workers' rights, as subsequently implemented through the issuance of Minister of Manpower Regulation No. 16/2024 on the Determination of Minimum Wage for 2025. Overall, the Constitutional Court's decision strengthens the legal structure of Indonesian labor law, underscores the importance of the rule of law in protecting workers' rights, and marks a pivotal moment in the reform of labor regulations in line with social justice and human rights values.

Abstract

Arbitration as an alternative to resolving business disputes offers a fast, confidential, and final process, but this finality is limited by the provisions of Law Number 30 of 1999 which allows for cancellation under certain conditions. This normative legal research analyzes the legal basis for the cancellation of an arbitration award through a case study of the West Jakarta District Court Decision Number 861/Pdt.Sus-Arbt/2023/PN.Jkt.Brt. The results of the study show that cancellation is only permitted based on three limiting reasons in Article 70 of the Arbitration Law. In the case of PT Talkindo Selaksa Anugrah, the judge annulled the BANI decision based on the discovery of important hidden documents and the existence of trickery. The judge's considerations reflect the balance between maintaining the principle of finality of arbitration and upholding substantive justice, although the standard of proof applied is more flexible than international standards. The annulment of an arbitration award must still be seen as an extraordinary corrective mechanism that is applied strictly, without sacrificing the integrity of the arbitration process, because finality should not protect dishonest practices in dispute resolution.

Abstract

Corruption is a serious issue that has a broad impact on economic stability, social structures, and public trust. Karawang Regency, as a region with rapid economic growth, also faces a high risk of corruption. The Karawang District Prosecutor’s Office holds a strategic role in preventive efforts through various educational and supervisory programs. The research problem or main discussion in this study is how the Karawang District Prosecutor’s Office plays a role in preventing corruption crimes and whether the relationship between the legal structure, legal substance, and legal culture can support efforts to prevent corruption by the prosecutor's office. This research is normative legal research with a juridical-normative approach, encompassing statutory and conceptual approaches. The data used are secondary data obtained through literature studies of legislation, prosecutorial policies, and relevant legal literature. Data analysis is carried out descriptively-analytically using legal interpretation techniques and comparative analysis. The research results show that the Karawang District Prosecutor’s Office has implemented various preventive strategies, such as the "Prosecutors Enter Schools" (Jaksa Masuk Sekolah/JMS) Program, the "Prosecutors Guard Villages" (Jaksa Jaga Desa) Program, and the "Prosecutors as Fishermen's Friends" (Jaksa Sahabat Nelayan) Program. In addition, supervision of regional strategic projects is carried out to prevent abuse of authority. However, there are challenges such as limited human resources, lack of coordination between institutions, and low public legal awareness. By strengthening regulations, transparency, and accountability, it is expected that corrupt practices can be minimized and the integrity of government governance can be enhanced

Abstract

Defamation through electronic media has become an increasingly complex issue amid the rapid development of information technology. Social media facilitates information dissemination but also opens opportunities for the misuse of freedom of expression that may harm others. Article 27A of Law Number 1 of 2024 on Electronic Information and Transactions (EIT Law) has sparked debate due to its ambiguous wording and potential misuse to suppress legitimate criticism. This research employs a normative juridical method by analyzing relevant legislation, legal doctrines, and court decisions. Secondary data were obtained through literature studies and qualitatively analyzed to assess the legal certainty and compatibility of Article 27A with human rights principles, particularly freedom of expression. The findings indicate that Article 27A of the EIT Law remains weak both in its drafting and implementation, especially regarding the phrase "another person," which creates ambiguity and may criminalize public criticism. Such provisions risk being used as a tool of criminalization, contradicting the principle of legal certainty and democratic values guaranteed by the 1945 Constitution. Therefore, a more precise interpretation and revision of Article 27A are necessary to ensure consistency with the principles of legality, legal certainty, and the protection of freedom of expression. .

Abstract

This study examines law enforcement mechanisms against the illegal distribution of drug solvents without medical prescription under Law No. 17 of 2023 concerning Health, analyzing the legal framework, enforcement challenges, and policy implications through Decision No. 302/Pid.Sus/2023/PN Cjr. The proliferation of illegal drug sales without medical prescription remains a persistent challenge in Indonesia, driven by factors including public demand for convenient access, cost considerations, and systemic weaknesses in pharmaceutical oversight, creating a critical gap between regulatory provisions and effective law enforcement implementation. Employing a normative legal research approach, this study analyzes positive law provisions, particularly Law No. 17 of 2023 concerning Health and relevant criminal law provisions, to evaluate the legal basis and enforcement mechanisms against unauthorized pharmaceutical distribution. Article 435 of Law No. 17 of 2023 provides a robust legal foundation for prosecuting both individual perpetrators and corporate entities involved in producing or distributing drug solvents without compliance with regulatory requirements. This study finds that Decision No. 302/Pid.Sus/2023/PN Cjr demonstrates the application of the ne bis in idem principle, ensuring defendants are not tried twice for the same criminal act. However, the case reveals significant structural weaknesses in the pharmaceutical regulatory and supervisory systems that continue to undermine effective enforcement. While law enforcement efforts against unauthorized drug distribution have commenced, current mechanisms remain insufficient without comprehensive systemic reform. The judiciary has correctly applied fundamental criminal law principles, yet enforcement success depends on strengthening digital oversight systems, harmonizing cross-sector regulations, and enhancing law enforcement capacity and digital forensics capabilities. This study contributes to legal scholarship by demonstrating the need for an integrated approach combining criminal prosecution, regulatory reform, and institutional capacity building, recommending that policymakers and law enforcement agencies prioritize modernizing pharmaceutical surveillance through digital systems, harmonizing regulations across relevant agencies, and developing specialized law enforcement units equipped with advanced forensic capabilities to effectively combat pharmaceutical crimes.

Abstract

Ada peluang bagi produsen yang tidak jujur ​​untuk memanfaatkan merek-merek terkenal karena meningkatnya permintaan barang-barang bermerek internasional di Indonesia. Berdasarkan ketentuan Undang-Undang Nomor 20 Tahun 2016 tentang Merek Dagang dan Indikasi Geografis, penelitian ini mengkaji perlindungan merek terkenal dan hak-hak konsumen terkait pencabutan merek karena itikad buruk. Berdasarkan Putusan 557 K/Pdt.Sus-HKI/2016 dan Undang-Undang Nomor 20 Tahun 2016 tentang Merek Dagang dan Indikasi Geografis, penelitian ini mempertanyakan bagaimana pengadilan menilai perlindungan merek dan hak-hak konsumen terhadap pencabutan merek dagang. Studi kasus berpusat pada sengketa merek dagang yang melibatkan Irawan Gunawan dan Laverana GmbH & Co.KG. Penelitian ini menggunakan pendekatan yudisial kualitatif dan normatif.untuk mengevaluasi konsekuensi hukum dari pendaftaran merek dengan itikad buruk dan dampaknya terhadap konsumen serta pemilik merek. Hasil Kesimpulan menunjukkan bahwa perlindungan hukum terhadap merek terkenal esensial untuk mencegah kerugian yang diakibatkan oleh praktik bisnis yang tidak etis. Putusan Nomor 557 K/Pdt.Sus-HKI/2016 menegaskan pentingnya pertimbangan hakim dalam menegakkan keadilan serta melindungi hak kekayaan intelektual, dengan memutuskan pembatalan merek tergugat yang terbukti mendaftarkan merek secara curang. Penelitian ini menggaris bawahi pentingnya tanggung jawab sosial dan etika dalam dunia usaha untuk menciptakan persaingan yang sehat dan berkeadilan.

Abstract

Pelaksanaan Kredit Pemilikan Rumah (KPR) sering melibatkan pengalihan hak melalui perjanjian take over kredit di bawah tangan, tanpa sepengetahuan bank dan tidak mengikuti prosedur resmi. Studi ini mengkaji kepastian hukum atas pelaksanaan take over kredit di bawah tangan dan pertimbangan hakim dalam Putusan No. 107/Pdt.G/2021/PN.Kwg. Dengan pendekatan Yuridis Normatif, penelitian menunjukkan bahwa Pengadilan Negeri Karawang memberikan kepastian hukum kepada penggugat sebagai pembeli beritikad baik. Hakim menyatakan tergugat wanprestasi berdasarkan Pasal 1238 KUHPerdata karena tidak memenuhi kewajiban yang dijanjikan.

Abstract

In everyday life, economic activities often involve legal agreements between parties regarding an agreed-upon object. In Indonesia's Civil Law system, various types of contracts are regulated, including employment relationships. This study aims to identify the factors leading to termination of employment (PHK) based on the Job Creation Law and to explore legal protection for workers who experience unilateral termination. The focus of this research includes the analysis of employment termination mechanisms under the Job Creation Law, and the legal efforts available to workers against unilateral termination carried out by companies. This research is normative in nature, employing a qualitative method and a normative juridical approach. This approach involves examining rules, norms, and regulations relevant to unilateral termination through a literature study, which includes reading, quoting, copying, and analyzing related theories. The primary data used are secondary data, while primary data serve as supporting data. The findings indicate that there are cases of unilateral termination that violate the Job Creation Law. The ambiguity of sanctions in the law creates loopholes for companies to carry out unilateral terminations. Workers affected by unilateral termination are entitled to legal protection as stipulated in the Job Creation Law, which is part of the commitment to improving economic quality. Companies that conduct unilateral termination must also face sanctions in accordance with violations of the law and the uncertainty of citizens' constitutional rights.

Abstract

In Indonesia, drug abuse and distribution are still serious problems. The absence of a threshold for drug possession for abusers causes ambiguity in law enforcement. This study analyzes the regulation of the threshold for drug possession for drug abusers as seen from two Karawang District Court Decisions used as comparative references so that there is a disparity in decisions reviewed from evidence that exceeds its abuse. Evidence can be used as a reference to determine whether the goods exceed the personal consumption limit. This study uses a normative legal approach by analyzing qualitatively, the results show that there is a lack of guidelines on the threshold for possession. Judges' interpretations often affect evidence, and inconsistent guidelines lead to differences in sentences.

Abstract

The discovery of nine children's food products containing pork (porcine) by BPJPH and BPOM in April 2025 raised public concern, especially since seven of them had halal certification. This study examines the role of BPJPH in protecting consumer rights under Law Number 8 of 1999, focusing on cases of ingredient falsification. Using a normative juridical approach and case study method, the findings reveal weak post-market surveillance by related agencies, resulting in significant spiritual and material losses for Muslim consumers. The study highlights the urgent need for more effective preventive, repressive, and coordinative measures to uphold consumer protection and halal assurance.
