Abstract

The Muslim community in Jayapura faces significant challenges in implementing Sharia-based economics, chiefly due to persistent social stigma surrounding halal products and limited public understanding of Islamic economic principles. This study explores how Fiqh al-Aqalliyyat a flexible jurisprudential framework can address these challenges within a multicultural society. Adopting a qualitative case study methodology, the research draws on interviews with 14 key local stakeholders, including government officials, religious leaders, and business owners. Data were gathered through purposive sampling and analyzed thematically to identify key barriers and viable solutions. The findings indicate that social stigma and inadequate infrastructure impede halal product promotion. Nevertheless, significant opportunities exist, including a growing demand for halal goods, government support for Sharia-compliant capital markets, and the active engagement of religious institutions. Abstract

Abstrak: Penelitian ini bertujuan untuk menganalisis Eksistensi Fintech Alami Sharia pada pembiayaan Crowdfunding, di mana kehadiran Financial Technologi merupakan efek positif dari perkembangan teknologi di bidang keuangan, fintech yang berlandaskan syariat Islam menjadi inovasi besar pada keuangan syariah khususnya di Indonesia. Penelitian termasuk jenis penelitian kualitatif dengan fokus pada sumber data, terutama data-data yang ditemukan melalui analisis kepustakaan (library research). Metode ini masuk dalam kategori penelitian kepustakaan, yang dalam konteks penelitian hukum dapat diklasifikasikan sebagai penelitian yuridis normatif atau penelitian hukum kepustakaan. Hasil dari penelitian ini menunjukkan bahwa kehadiran Fintech Alami sharia dengan segala inovasi dan eksistensinya terutama dalam pembiayaan crowdfunding yang sudah terbukti membantu banyak UMKM membuat keuangan syariah Indonesia diakui ruang internasional pada penghargaan GIFA 2022, hal ini menjadi motivasi sekaligus gerbang kesuksesan keuangan syariah bisa melaju dengan cepat. Abstract: This study aims to analyze the existence of Natural Sharia Fintech in Crowdfunding financing, where the presence of Financial Technology is a positive effect of technological developments in finance, fintech based on Islamic law is a major innovation in Islamic finance, especially in Indonesia. Research is a type of qualitative research with a focus on data sources, especially data found through library research. This method is included in the category of literature research, which in the context of legal research can be classified as normative juridical research or literature law research. The results of this study show that the presence of Fintech Alami sharia with all its innovations and existence, especially in crowdfunding financing which has been proven to help many MSMEs make Indonesian sharia finance recognized internationally at the 2022 GIFA awards, this is a motivation as well as a gateway to the success of Islamic finance can go quickly.

Abstract

Penelitian ini bertujuan untuk menyelidiki pemindahan kepemilikan dalam konteks kewirausahaan Islam, dengan penekanan khusus pada perspektif moral dan etika bisnis. Melibatkan analisis literatur, studi kasus, dan wawancara dengan pelaku bisnis Islam dan ahli hukum Islam, penelitian ini menyelidiki nilai-nilai moral yang mendasari transaksi seperti jual beli, warisan, hibah, dan akuisisi perusahaan. Dengan mendalamnya analisis terhadap prinsip-prinsip etika bisnis Islam, penelitian ini bertujuan untuk memberikan pandangan holistik terhadap bagaimana pemindahan kepemilikan dapat dijalankan dengan integritas, keadilan, dan tanggung jawab sosial. Harapannya, hasil penelitian ini dapat memberikan kontribusi signifikan dalam membentuk pemahaman praktik bisnis Islam yang beretika serta memberikan pedoman praktis bagi para pelaku bisnis untuk menghadapi dilema moral dalam keputusan pemindahan kepemilikan.

Abstract

Strengthening the Economic Independence of Islamic boarding schools is a strategic agenda in developing a community-based sharia economy. Although many institutions possess superior business units, their management remains partial, unstructured, and unintegrated within a systematic framework. This condition prevents the Silsilat al-Qīmah (value chain) of pesantren businesses—from production and quality control to distribution—from achieving optimal economic and social value. Therefore, this article aims to formulate an Islamic Boarding School Business Model based on Maqāṣid al-Sharī'ah through a combined approach of Silsilat al-Qīmah and Khalq al-Qīmah al-Musytarakah (Creating Shared Value). Using a qualitative field study method across several schools, data was gathered via in-depth interviews, observations, and documentation, then analyzed thematically by integrating sharia principles as a normative foundation alongside business management instruments. The results show that strengthening the pesantren business model requires institutional consolidation, managerial capacity building, and value chain integration oriented toward distribution fairness, product quality, and sustainability. The Khalq al-Qīmah al-Musytarakah approach emphasizes that economic activities must not only increase institutional income but also empower students and the surrounding community to achieve collective benefits. Ultimately, this article contributes theoretically by offering a conceptual framework for an Islamic Boarding School Business Model based on Maqāṣid al-Sharī'ah that contextually connects Islamic normative values with practical business management. Practically, it serves as a strategic reference for building a just, resilient, and sustainable pesantren economy.

Abstract

Microeconomics is an economic science study that reviews individual behavior in conducting economic transactions. In the Islamic concept, microeconomics is characterized by the existence of norms that are applied within the limits of the Qur'an and Sunnah. The scholars of the classical period discussed many of these microeconomic issues, including Imam Abu Ubaid in his book al-Amwal and Imam al-Syaibani in his book al-kasb. This article explores the perspectives of these two influential men when examining microeconomic research through the use of descriptive qualitative methods and a review of relevant book and journal references. A Muslim scholar who specializes in Islamic economics is Imam Abu Ubaid whose ideas are contained in Kitab al-Amwal, one of the most influential scholarly references, containing many principles and concepts of public financial management. In addition to him, Iman As-Syaibani with his book Al-Kasb provides a view that work is human productivity that can make a person feel part of the world and has the value of worship for the pleasure of Allah SWT.
