Abstract

Inheritance law is an important aspect of legal systems in various African countries. This research aims to analyze the differences and similarities in the system of inheritance law in three African countries, namely Somalia, Nigeria, and Ghana. Through a comparative law approach, this study describes various aspects of inheritance law, such as fundamental principles, inheritance of property, and inheritance rights in these three countries. This research employs a descriptive research method by analyzing relevant legal documents, including constitutions, laws, and court judgments related to inheritance law. Additionally, the study also includes a literature review on cultural, religious, and customary views that influence the system of inheritance law in Somalia, Nigeria, and Ghana. The findings of this research indicate significant differences in inheritance law among the three countries. Somalia implements an inheritance law system based on Islamic Sharia, with principles governed by Islamic law that involve a balance between male and female family members. On the other hand, Nigeria has an inheritance law system influenced by Islamic, Christian, and customary laws. Meanwhile, Ghana adopts an inheritance law system based on principles of customary law and local customs

Abstract

The dissolution of marriage has legal consequences on marital property, namely the termination of joint assets. However, in its development, cases related to the division of joint assets often give rise to various perceptions in classifying disputed objects as joint assets or not, such as disputed objects in the form of insurance coverage, funeral expenses, and pension funds. This paper focuses on the theme of the legal status of insurance coverage, funeral expenses, and pension funds in relation to joint assets. The conclusion of this research is that there are differences in the status of insurance coverage, funeral expenses, and pension funds in relation to joint assets. If the premiums are paid during the marriage, the assets will become joint assets, as stated in Article 35 paragraph (1) of Law Number 1 of 1974 concerning Marriage. On the other hand, if the premiums are paid before the marriage, even if the person concerned enters into a marriage, the insurance coverage, funeral expenses, and pension funds, as stated in Article 35 paragraph (2) of Law Number 1 of 1974 concerning Marriage, will remain as the individual's separate property.

Abstract

This study aims to know the development of Islamic inheritance law in Indonesia. Inheritance law is a crucial part of the legal system that governs the transfer of property and rights owned by individuals who have passed away to their heirs. This research employs a document analysis method to investigate the legal regulations and legislations related to inheritance in Indonesia, such as Law No. 5 of 1960 on Basic Agrarian Principles and Law No. 16 of 2019 on Evidence. Additionally, this study involves relevant literature review and case studies to understand the application of inheritance law in Indonesia. The results of this research reveal that the inheritance law system in Indonesia is based on customary, religious, and national law principles. The development of Islamic inheritance law in Indonesia has changed along with changes in the socio-cultural and legal context in this country. Initially, Islamic inheritance law in Indonesia was based on classical fiqh principles based on the texts of the Qur’an and hadith, but overtime there has been an update in Islamic inheritance law. One of the important development in Islamic inheritance law in Indonesia is through the application of a compilation of Islamic law that has been in force sin 1991. The compilation of Islamic law regulates various aspects of Islamic inheritance law which includes the separation of assets, distibution of inheritance, wills and grants.

Abstract

The purpose of this study is to comprehensively analyze the construction and legal certainty of replacement heirs in the compilation of Islamic law and its application in the religious courts of the DKI Jakarta region. This research uses a qualitative method with a normative legal approach, legislation, decision analysis, and Islamic law literature. Primary sources are obtained from the decisions of the religious courts of the DKI Jakarta high religious court region numbered: 131/pdt.p/2022/pa.jp, 339/pdt.p/2021/pa.jp, 166/pdt.p/2021/pa-jb, 3950/pdt.g/2020/pa-js, the compilation of Islamic law, and other legal materials related to inheritance. Meanwhile, secondary sources are obtained from literature searches such as books, documents, and journals that have the same relevance as this research. After the data is obtained and collected, data will be filtered and grouped according to its type, then the data is analyzed using descriptive analysis to be able to provide an overview of the existing problems. The results showed that, the legal construction of the concept of substitute heirs in the Compilation of Islamic Law in the Religious Courts in the DKI Jakarta PTA region by placing the position of substitute heirs by applying justice to the inheritance of his parents who had died before the heir. The research confirms the legal construction and rationale behind substitute heirs in Islamic inheritance law, highlighting their significance in inheritance disputes. Recognized under KHI Article 185, substitute heirs play a crucial role in ensuring fairness and equity in inheritance distribution. However, obstacles such as public awareness, evidentiary challenges, and conflicts with local customs impede the effective implementation of the substitute heir rule.

Abstract

AbstractThis study aims to analyze the discourse of Daniel S. Lev's thoughts on the existence of religious courts in Indonesia, this is done by descriptive-interpretive methods to socio-historically describe the position of religious courts since colonial times until today. the context in which the balance in the political constellation regarding the 'religious-socio-political cleavage' between supporters and opponents of the Religious courts has been reversed, the question of which system is conquering, and which system is being conquered becomes problematic. In Indonesia today, a dual legal system in which civil law and Islamic legal traditions coexist is no longer politically disputed. By extension, the convergence of civil and Islamic legal systems no longer implies the conquest of religious courts by civil law systems. It may also be the other way around.AbstrakPenelitian ini bertujuan menganalisis diskursus pemikiran Daniel S. Lev terhadap eksistensi pengadilan Agama di Indonesia, hal ini dilakukan dengan metode deskriptif-interpretatif mengurai secara sosio-historis posisi Pengadilan Agama sejak zaman kolonial hingga saat ini. konteks di mana keseimbangan dalam konstelasi politik mengenai 'pembelahan agama-sosial-politik' antara pendukung dan penentang pengadilan Agama telah terbalik, pertanyaan tentang sistem mana yang menaklukkan, dan sistem mana yang sedang ditaklukkan menjadi bermasalah. Di Indonesia saat ini, sistem hukum ganda di mana hukum perdata dan tradisi hukum Islam hidup berdampingan tidak lagi dipermasalahkan secara politis. Dengan perluasan, konvergensi sistem hukum sipil dan Islam tidak lagi menyiratkan penaklukan pengadilan Agama oleh sistem hukum sipil. Mungkin juga sebaliknya.

Abstract

Family law primarily refers to the legal rules that regulate relationships within the family, which can derive from either blood relations or the act of marriage. The purpose of this article is to analyze the concept and the norm of altering Islamic family law in Indonesia. To examine the subject of altering Islamic family law in Indonesia, a qualitative methodology backed by literature can be used. A combination with descriptive normative approach entails researching legal documents related to Islamic families in Indonesia, selecting some contentious family law cases and analyzing their impact on the legal system, and interviewing Islamic legal experts, human rights activists, or family members involved in specific legal cases. The results of the study underline the significance of family bonds in influencing problems such as parental and filial rights, inheritance laws, along with custody and guardianship. Essentially, family law has its foundation on two sources: written and unwritten regulations. Written sources include a wide range of legal topics, including law, jurisprudence, and treaties. Unwritten sources, on the other hand, refer to legal ideas that emerge and shape themselves within the context of cultural life.

Abstract

This research analyzes the authority of the Commercial Court in resolving bankruptcy cases of Sharia business institutions with a focus on Supreme Court Decision No. 1016 K/Pdt.Sus-Pailit/2016 highlights legal protection for policyholders and considers Sharia principles in handling these cases. This research uses normative research methods with qualitative analysis. The result of this research is that the Sharia Economic Bankruptcy Settlement Law regulates financial issues in the Sharia economy using Islamic law principles. The process includes handling debts, religious courts, debt restructuring, and protecting creditor rights. This law ensures bankruptcy resolution per Sharia principles, protects creditors' rights, and fulfills financial obligations. Religious courts have jurisdiction, but more explicit regulations regarding handling sharia insurance bankruptcy are still needed. Commercial Court decision regarding the PT case. Mubarakah Sharia Insurance is based on the law, and the bankruptcy requirements are met. Policyholders and legal protection for them are also essential concerns, requiring better supervision, considering the principles of sharia law and justice.

Abstract

Morocco and Algeria are part of Muslim countries that use family law as a reference in dealing with the affairs of their people. Morocco is a kingdom located in the northwestern part of Africa; the northern part is bordered by the Mediterranean, the eastern part is bordered by Algeria, and the southeast and southern regions are bound by the French Sahara and Spain. In contrast, the Atlantic Ocean borders the western part. As for Algeria as a Muslim-majority country, it is not surprising that all forms of law regulation are based on Islam, which is also recognized as the official religion. The development of Islamic law in Algeria revolves more around Family Law. Regarding Islamic family law towards the two countries, namely Morocco and Algeria, the author needs to describe the Islamic family law model towards the countries of Morocco and Algeria. The goal is to provide an understanding of Islamic family law in the country. The approach used by the author is a comparative approach); in this study, it can be interpreted as an activity to compare the law of a country with the law of another country or the law of one time with a certain law of another time, in this case, Morocco and Algeria. The type of research the author uses for this discussion is qualitative, using the descriptive analysis method.

Abstract

Family law in various Muslim countries of the world in its application and implementation is adjusted to the region or country of origin and depends on the policy of the government itself. Muslim countries have different legal provisions for their implementation, as do Jordan and South Yemen, both Muslim countries are very interesting to examine and analyze. The development of Islamic family law (al-Ahwal al-Shakhshiyah) in the modern Islamic state can be said to be a new format that accommodates the ideas of renewal of Islamic Legal thought. This research uses library research methods. In this study, the author used a qualitative research approach using a descriptive method of analysis. The results of this study that family law carried out in Jordan are among others related to the issue of marriage age, marriage vows, interfaith marriage, marriage registration, divorce and polygamy. Family law reform in Jordan has implemented various universal provisions of basic values in Islam by considering aspects of maslahah. Family law in South Yemen belongs to a group of countries that follow (enforce) traditional Islamic family law, where classical Islamic family law is applied according to various schools of thought as inheritance that is hereditary, unchanged and not codified until today. The state of Yemen applies the Shafi'i sect and the Hanafi sect in addition to the Zaydi Shi'a sect.
