Abstract

This article aims to critically analyse the application of force majeure in sharia contracts, particularly in the context of economic disputes resulting from public policies. By exploring the court decisions in this case, this study seeks to identify weaknesses in the sharia legal protection system and offer solutions to strengthen justice for the parties involved. The research method used is a qualitative approach with normative juridical research design and case-based analysis. This study aims to analyse in depth the application of force majeure clauses in sharia contracts, particularly in the dispute between PT Lissa Sejahtera Mandiri and Bank Nagari Syariah, by linking it to the legal protection of customers in the context of public policy changes. This case underscores the need for better synergy between sharia principles, contract implementation, and public policies that often become external obstacles. Courts are expected to not only focus on the formality of the agreement, but also consider the substance of justice in accordance with sharia principles.

Abstract

Islamic financial institutions have evolved very rapidly since the 1990s when Muamarat Bank launched LKS in the form of Islamic banks, but there were no restrictions on Islamic banks that year. The current concept of Islamic banking is an extension of the concept of Byturmar from the time of the Prophet, who later evolved into Islamic banking. During its development, the Islamic banking system changed in terms of standards applied in Indonesia. The standards mentioned are the laws, regulations and regulations of the National Shariah Council of the Indonesian Ulama Council. The purpose of this article is to examine the evolution of LKS-led funding standards (Islamic banks). The research methods used are normative / legal and legal research using the Fatwa DSN MUI approach. This type of study is a historical study in which data is extracted from literary studies. The survey results focus on current developments from 1992 to 2008 and Islamic banks' funding standards are independent of both regulation and institutions. At DSMNUI Fatwa, the Wadia-Mudarabah contract is the basic loan agreement for Islamic banks. The deal changed its use at Islamic banks, initially targeting the community, and later expanded its name to interbank and banking products. Indonesia (BI). Starting in 2020, the two contracts could turn into a variety of products between Islamic banks and even between BIs. Abstrak Lembaga Keuangan Syariah telah mengalami perkembangan yang sangat pesat, dimulai pada tahun 90-an LKS berupa perbankan syariah diawali oleh bank muamalat, sekalipun pada tahun tersebut belum ada regulasi yang berkaitan dengan perbankan syariah. konsep perbankan syariah yang saat ini merupakan kepanjangan dari konsep Baitul Maal pada masa Rasulullah yang kemudian bertransformasi menjadi perbankan syariah. Dalam perkembangannya, perbankaan syariah mengalami perubahan dari sisi norma yang berlaku di Indonesia. Norma yang dimaksud ialah peraturan perundang-undangan dan fatwa Dewan Syariah Nasional Majelis Ulama Indonesia. Tujuan dari penulisan ini ialah meniliti perkembangan norma perhimpunan dana yang dilakukan oleh LKS (perbankan syariah). Metode penelitian yang digunakan, penelitian yuridis normatif dengan pendekatan norma/perundang-undangan dan fatwa DSN-MUI. Jenis penelitiannya merupakan penelitian historis yang diambil datanya melalui studi pustaka. Temuan hasil penelitain melihat perkembangan saat ini sejak 1992 hingga 2008 norma penghimpunan dana perbankan syariah secara regulasi dan kelembagaan sudah mandiri. Dalam fatwa DSN-MUI akad Wadi’ah dan Mudharabah menjadi akad dasar dalam penghimpunan dana di bank syariah. Akad tersebut mengalami perubahan dalam penggunaannya di perbankan syariah, semula diperuntukan masyarakat, kemudian berkembang peruntukannya menjadi antar bank bahkan prodak Bank Indonesia (BI). Ditahun 2020 ke atas kedua akad tersebut dapat saja berkembang menjadi keragaman prodak antar bank syariah bahkan BI.

Abstract

The existence of the DSN-MUI Fatwa cannot be separated from the political situation of Indonesia and the legal politics of the formation of Islamic economic regulations. At the end of Soeharto's presidency, the government began to listen to the aspirations of Muslims to incorporate sharia values into legislation. This research aims to examine the background of the issuance of Fatwa DSN-MUI through a legal political approach, and examine the legal position of Fatwa DSN-MUI in Islamic financial institutions. The type of normative research whose object of study is Fatwa DSN-MUI using statute approach, conceptual approach, and historical approach. Sources of legal and non-legal materials were obtained from literature and documentation studies. The existence of Fatwa DSN-MUI is caused by two factors, namely: First, the existence of regulations that require every Islamic financial institution to carry out its business activities in accordance with the Fatwa DSN-MUI; and Second, the development of product innovation in every Islamic financial institution that requires Fatwa DSN-MUI as norms and operational guidelines that govern it. Therefore, the position of Fatwa DSN-MUI in legal substance is morally and legally binding for all Islamic financial service business actors. The binding of the DSN-MUI Fatwa is due to the existence of orders from the legislation. This is differentiates the Fatwa of DSN-MUI from other religious fatwas.

Abstract

This qualitative study aims to identify the sociological construction of the implementation of legal principles in the inheritance system in Indonesia and its relevance to the Islamic inheritance system. The theory of receptio a contrario and the theory of structural functionalism as a legal sociology perspective are used to see how social construction is related to the implementation of the principle of justice, the principle of freedom of will, and the individual principle in the implementation of the inheritance system in a plural Indonesian society. This study finds the construction of social relations related to legal principles in the implementation of the national inheritance system with Islamic inheritance in Indonesia. The relational construction of these principles leads to the implementation of harmony between the implementation of the national inheritance legal system and the Islamic inheritance system so that both can run in an orderly and well-integrated manner. This study confirms that in sociological construction, the relationship between the principle of law enforcement and the social and cultural values of society cannot be dichotomized.

Abstract

Penelitian ini bertujuan untuk menguraikan mengenai putusnya perkawinan dalam hukum keluarga Islam di Indonesia. Penelitian ini dilatarbelakangi oleh data tahun 2022, kasus perceraian di Indonesia 516.334. Dalam enam tahun terakhir, kasus perceraian ini menjadi yang tertinggi. Mayoritas kasus perceraian terjadi karena cerai gugat, dengan jumlah 338.358 kasus atau 75,21% dari total kasus. Sedangkan 127.986 kasus atau 24,79% terjadi karena cerai talak.. Hasil penelitian menunjukkan bahwa putusnya perkawinan dominan dikarenakan perceraian atau putusan pengadilan jika dibandingkan dengan kematian. Mengenai putusnya perkawinan dalam perkembangannya terjadi menyesuaikan dengan konteks dan situasi yang ada di masyarakat. Akan tetapi dalam literature fiqh mengenai bentuk putusnya perkawinan atau perceraian dikenal dengan talaq, khulu’, khiyar/fasakh, syiqaq, nusyuz, ila’, dan zihar. Abstract

Kafaah, sebagai konsep kesetaraan dalam hukum perkawinan Islam, menjadi topik penting dalam kajian sosiologi hukum. Penelitian ini menganalisis pandangan empat imam mazhab utama (Hanafi, Maliki, Syafi’i, Hanbali) terkait kafaah dan penerapannya di masyarakat Indonesia. Dengan pendekatan kualitatif deskriptif, penelitian ini menggabungkan data primer dari kitab klasik fiqih dan data sekunder dari studi empiris. Hasil menunjukkan bahwa praktik kafaah di Indonesia dipengaruhi oleh norma adat, status sosial, serta modernisasi yang menekankan pendidikan dan ekonomi. Perspektif sosiologi hukum Islam menyoroti adaptasi kafaah dalam masyarakat plural. Studi ini menegaskan bahwa hukum Islam fleksibel dalam menyesuaikan dengan konteks sosial budaya.

Abstract

The phenomenon of pregnant marriage, which is a marriage that takes place because of pregnancy outside of marriage, is an important issue that involves various legal and social perspectives. KHI article 53 supports the legality of pregnant marriage by establishing specific rules to protect the rights of women and children. The main factors that trigger pregnant marriages include a lack of religious education, the influence of the social environment, and weak family supervision. Adulterous children in KHI Article 186 and MUI only have a nasab relationship with the mother and her family. The Constitutional Court in Decision No. 46/PUU-VIII/2010 stated that adulterous children have a legal relationship with biological fathers if proven through valid evidence. The sociological perspective of Islamic law emphasises the importance of legal responses to social realities, especially pregnant marriages, to maintain social stability and reduce the stigma experienced by women and children. Meanwhile, maqashid sharia emphasises sharia objectives, such as the protection of honour (hifz al-ird), offspring (hifz an-nasl) and soul (hifz al-nafs) as the basis for the permissibility of pregnant marriage to prevent wider negative impacts.

Abstract

This research analyzes the decision of the Sumber Religious Court of Cirebon Regency in the procedure for executing the confiscation of sharia mortgage rights in the murabahah case Number 2008/Pdt.G/2020/PA.Sbr. This research pays attention to the role and actions of religious courts in handling execution cases, assessing debt collateral, and protecting the rights of debtors and creditors in sharia economic cases. The author uses a qualitative method with a normative approach. The analyzes primary data such as the judge's decision and related documents and analyzes secondary data as a source of information which includes literature study. This execution process involves the State Property and Auction Services Office and may face challenges from debtors or third parties. The case study of case Number 2008/Pdt.G/2020/PA.Sbr shows that the execution mechanism for the auction of mortgage rights was carried out outside the Sumber Religious Court, Cirebon Regency, without a court execution order. The judge considers it according to the applicable legal basis. As a result, the Plaintiff's lawsuit was rejected because of the implementation of the auction by Bank BRI Syariah.Tbk Cirebon Branch Office was deemed to be in accordance with the law. Default by the Customer is the main reason for this decision.

Abstract

Disputes can be resolved through litigation (in court) or non-litigation (out of court). Dispute resolution through litigation involves examining disputes before a judge in court. Whether it's public or private disputes, litigation, or court, are the most common dispute resolution methods. As time goes by, people's needs for justice and welfare increase. As a result, dispute resolution through litigation has become less effective. This is considered too long and costs quite a lot. In situations like this, people who seek justice begin to look for other options, namely dispute resolution outside the judicial process, which is called dispute resolution that does not involve litigation, i.e. non-litigation is carried out and the role of mediators. In the aspect of settlement using non-litigation methods for a quick and cheap settlement through the role of mediators in non-litigation dispute resolution through the negotiation stages, mediation, conciliation, and arbitration are some of the methods of resolving disputes outside of court. The discussion of the Musyarakah Contract is a form of financing that is commonly used in Islamic financial institutions. This research uses a normative approach to research to reveal the truth systematically, methodologically, and consistently. This approach has been collected and processed, analyzed and used for constructive purposes during the research process, how effective the role of mediators is in non-litigation dispute resolution
