Abstract

Islam views the marriage contract as a miitsaqan ghalidha with the main goal of forming a sakinah mawaddah wa rahmah. Even though the marriage bond is so strong, the reality shows that many marriages have broken up due to divorce, for example in 2021 there will be approximately 459,630 couples, including divorces carried out by PNS, which are also not small. In certain cases of divorce, Islam obliges the husband to provide mut'ah along with maintenance, dowry and kiswa during the iddah period according to the husband's ability and propriety. Specifically for male civil servants, in certain divorce cases, they are also obliged to hand over part of their salary to their ex-wife and children or children, as stipulated in Article 8 PP No. 10 of 1983 jo PP No. 45 of 1990. These provisions need to be examined from the perspective of Islamic law. In researching used normative juridical research. The results of the study according to the authors of the deduction/delivery of part of the male PNS to his ex-wife as stipulated in the Government Regulation are not in accordance with the provisions of Islamic law, for the reasons that, among other things, Islam has determined the obligation for divorced men in certain cases to give to his ex-wife in the form of mut'ah and nafkah iddah, the deduction/delivery of part of the PNS has the potential to violate the objectives of Islamic law to achieve benefits with the aim of, among others, hifdz al maal.

Abstract

The reform of the age limit of marriage in various countries through the codification of family law in the marriage legislation seems to be a relevant and urgent solution. This article will analyze first: how is the age limit of marriage in the legal system of India and Pakistan? second: how does the age limit of marriage affect the people of India and Pakistan? using a qualitative descriptive method. The data is collected through the study of various relevant references. The results of this study provide conclusions, first, in the Indian legal system regulates the age of marriage through the Child Marriage Restraint Act of 1929 revised by The Prohibition of Child Marriage Act of 2006 which sets the legal age for marriage at 18 years for women and 21 years for men, while in Pakistan through Law Number 29 of 1929 which has been amended through Ordinance Number 8 of 1961 sets the age limit for men at 18 years for men and 16 years for women. The age of marriage is different in the two countries because the determination of the standard age of marriage depends on the view of Islamic law adopted and used as a guide by the State. Both the Indian and Pakistani Marriage Acts specifically prohibit underage marriages, but there are still obstacles that prevent the full implementation of these regulations because the sanctions imposed are only considered as an additional cost of getting married and there are strong cultural or customary factors. Therefore, it takes a firm policy from law enforcement and awareness from the community itself to maintain the smooth implementation of this law.

Abstract

Islam brings a set of legal rules, namely shari'a on inheritance, zakat, infaq, shadaqah, grants, waqf and wasiat. Wasiat is the transfer of ownership of something to someone after the owner dies. Wasiat in the Compilation of Islamic Law (KHI) is defined as the giving of an object from the testator to another person or institution that will take effect after the testator dies. With the approach of normative or doctrinal legal studies, it has been concluded that the original will as a gift of a person to another person either in the form of an object, or just a benefit that will belong to the person who will be given a will without expecting a reward (tabarru') whose implementation takes effect after the person who testifies has passed away.   In the development of contemporary Islamic law has been known with the existence of a mandatory will, which is known as Egypt, Syria, Morocco and Tunisia is to address the issue of grandchildren whose parents died before his grandparents. While in Indonesia, the mandatory will is enacted to overcome the relationship between adopted children and adoptive parents who cannot receive inheritance by being given a mandatory will as much as 1/3 of the testamentary property or inheritance property. In the further development of wills wajibah is recontructed to provide parts to non-Muslim heirs, through several court decisions into jurisprudence.

Abstract

The legal system in Iran plays a pivotal role in governing marriage and inheritance, with a particular emphasis on inheritance law. The initial segment of this research provides a comprehensive understanding of inheritance law in Iran. It encompasses an explanation of the fundamental principles underlying the distribution of assets following an individual's demise, as well as the significant influence of Islamic principles within this context. The aim of this research is to offer a thorough insight into the legal framework governing inheritance law in Iran. To achieve this objective, the research employs a literature-based methodology, involving the analysis of legal documents, a review of relevant literature, and an exploration of secondary data sources. The outcomes of this research guide us through critical aspects of inheritance law in Iran, such as how assets are apportioned among heirs in accordance with Islamic principles, changes in inheritance law over time, and significant developments in the interpretation and implementation of these laws. The findings provide profound insights into the role of inheritance law within Iranian society and its complex impact on the individuals and families involved. This understanding is also crucial for the broader social and cultural context in Iran and may serve as a foundation for further consideration of how the law reflects societal values and norms.

Abstract

This paper discusses the embodiment of Zakat, Infaq, and Sadaqah (ZIS) norms and their implementation at the National Amil Zakat Agency (BAZNAS). ZIS norms are the principles governing the collection, management and distribution of zakat, infaq and sadaqah in Muslim society. Implementing ZIS norms is important to ensure effectiveness and transparency in managing zakat funds. The method used in this study is a qualitative descriptive method using a descriptive analysis approach which aims to provide an overview of the structure of the data obtained. In conclusion, the embodiment of ZIS norms and their implementation at BAZNAS is very important to ensure effective, transparent and accountable zakat management. By complying with these norms, BAZNAS can carry out its duties properly and meet the community's expectations in channeling zakat funds to those entitled to receive them.

Abstract

This study aims to investigate the implementation of musyarakah mutanaqishah financing in sharia banking in Indonesia, specifically by considering three issues related to contract implementation: sharia issues, legal issues and operational issues. This research was conducted through a combination of descriptive qualitative methods and inductive analysis. The results of the analysis are based on Law of the Republic of Indonesia Number 21 of 2008 concerning Sharia Banking, DSN-MUI Fatwa Number 73/2008 concerning Musyarakah Mutanaqishah, and AAOIFI sharia standards. From a legal and operational analysis perspective based on BI regulations regarding banking laws, it is indicated that there is a discrepancy between the basic regulations and implementation in the field. Regarding operations, there is a delegation of all payment obligations for costs that arise in deviation from AAOIFI standards and DSN fatwas and there are no specific accounting standards related to MMQ.

Abstract

The primary challenge facing the global banking system is how conventional and Islamic banking systems can operate simultaneously and synergistically within the context of Islamic economic globalization. This study aims to analyze the future prospects of the Dual Banking System, which integrates conventional and Islamic banking, in supporting global economic stability and growth. The methodology employs a qualitative approach with descriptive analysis, incorporating literature review and secondary data analysis from research reports of international institutions focused on the Islamic finance industry. The findings indicate that the Dual Banking System has significant potential to enhance financial inclusion and offer ethical and stable investment alternatives. However, substantial challenges, such as non-uniform regulations and disparate business cultures, remain to be addressed. The implications of this research suggest that with more comprehensive regulatory support and improved financial literacy, the Dual Banking System can become a crucial pillar in fostering a more inclusive and sustainable global economy

Abstract

The beauty of the human body shape still has various phenomena since he was born, there are those who are physically perfect and genetically perfect. On the other hand, there are also humans who are born with imperfect physical and genetic forms. In today's modern era, the existence of genital surgery has positive implications for people who are born with abnormal genitalia, such as men or women who have imperfect or double sex or are performed by men or women with genital organs. perfect sex but has a physical form similar to that of a man or a woman and it is this type that is often misused to perform genital change operations from male to female and female to male. Referring to the factors that have been stated above, the phenomenon of reassignment surgery or sex change is caused by physical factors and the sex itself. Therefore, the focus of the discussion in this article is on the implementation of transsexuals in the legality of reassignment surgery or sex change in Shari'ah in terms of the perspective of Islamic law based on the maqashid al-shari'ah paradigm. Abstract

Tujuan dari penelitian ini adalah untuk mengetahui bagaimana hukum mengatur penyelesaian sengketa ekonomi syariah. Dalam penelitian ini, metode kualitatif yang dikombinasikan dengan pendekatan deskriptif digunakan oleh peneliti. dengan menerapkan proses penelitian kepustakaan, atau studi literatur. Berdasarkan hasil penelitian, sengketa ekonomi syariah didefinisikan sebagai perselisihan mengenai hak atau kepentingan antara dua atau lebih entitas ekonomi yang operasionalnya dijalankan sesuai dengan hukum ekonomi syariah. Sengketa ini dapat berdampak negatif pada kemampuan kedua belah pihak untuk melakukan bisnis dan bahkan mengakibatkan hukuman bagi salah satu pihak. Berikut ini adalah peraturan-peraturan yang mengatur tentang sengketa ekonomi syariah: UU No. 30 tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa mengatur kewenangan lembaga arbitrase untuk menyelesaikan sengketa. Pengadilan Agama memiliki kewenangan untuk menyelesaikan sengketa ekonomi syariah dengan disahkannya UU No. 3 tahun 2006. Ada dua pendekatan untuk menyelesaikan sengketa ekonomi syariah: opsi non-litigasi melibatkan penyelesaian sengketa alternatif (ADR), atau penyelesaian konflik di luar pengadilan. Di sisi lain, penyelesaian sengketa berbasis litigasi menunjukkan bahwa perselisihan diselesaikan melalui sistem hukum. Masalah hukum yang berkaitan dengan ekonomi Syariah yang diselesaikan melalui pengadilan dapat diajukan sebagai gugatan biasa atau gugatan pokok.

Abstract

This study aims to analyze the legal system adopted in Indonesia. Mix Law System is one of the applicable legal systems, in addition to the enactment of the national legal system applies also Islamic law. The existence of Islamic Law is manifested in the constitution of the State of Indonesia which is commonly known as the 1945 Constitution of the Republic of Indonesia. Where the 1945 Constitution is a basic law that regulates the life of the nation and state in order to realize a just government and a prosperous people. This research uses an empirical sociological approach method that is descriptive analysis with the use of qualitative data as the type of research and library research as one of the data collection techniques. This research concludes that, first: The principles of Islamic Law that are used as the ideal foundation of fiqh are the principle of tauhidullah, the principle of insaniyah, the principle of tasamuh, the principle of ta'awun, the principle of silaturahim bain annas, the principle of justice, and the principle of benefit. As for knowing the theories of Islamic law enforcement in the apostolic period of Muhammad SAW are the theory of confession, the theory of accession, the theory of proof, the theory of verdicts, the theory of oaths, the theory of forgiveness. Second: Dispute resolution based on classical Islamic law namely, Al Sulh (Peace), Tahkim (Arbitration), Wilayat al Qadha (Judicial power). Third: The principles of judicial administration according to fiqh qadha and Indonesian law there is a strong correlation between the state and Islam, including Islamic law which has become a living law in the life of the nation and state. Fourth: The principles in the constitution also have relevance to the principles in Islamic Law which are regulated in the Quran and the Al-Hadith including the principles of justice, equality, and welfare. Based on this, Indonesia, which is based on Pancasila and the 1945 Constitution, can be reviewed from the perspective of Islamic law as an effort to realize the laws regulated in the Quran and Al-Hadith.
