Abstract

The rapid growth of influencer marketing has revolutionized the way brands connect with their target audiences. However, this novel marketing strategy has also brought forth new legal challenges, particularly in consumer trust and intellectual property rights (IPRs). This study aims to bridge the gap in the current understanding of the interplay between consumer trust and IPR risks in the context of influencer marketing. Through a normative legal research method with a statutory approach, this study seeks to comprehensively examine the wider implications of influencer marketing. The research aims to contribute to developing a more robust legal framework that can effectively address the unique challenges posed by influencer marketing while fostering consumer trust and protecting intellectual property rights. The findings reveal inadequacies in the existing Indonesian legal frameworks, particularly the Consumer Protection Law, Copyright Law, and Trademark and GI Law, in addressing the unique challenges of influencer marketing. The study proposes targeted amendments to these laws, including mandatory disclosure requirements, clear guidelines on fair use and trademark usage, and stronger enforcement mechanisms to mitigate consumer trust and IPR risks. Pertumbuhan pesat pemasaran melalui influencer telah merevolusi cara mengenalkan merek berhubungan dengan audiens target mereka. Namun, strategi pemasaran baru ini juga memunculkan tantangan hukum baru, terutama di bidang kepercayaan konsumen dan hak kekayaan intelektual (HKI). Penelitian ini bertujuan untuk menjembatani kesenjangan dalam pemahaman saat ini mengenai keterkaitan antara kepercayaan konsumen dan risiko HKI dalam konteks pemasaran influencer. Melalui metode penelitian hukum normatif dengan pendekatan perundang-undangan, penelitian ini berupaya memberikan pemeriksaan menyeluruh terhadap implikasi luas pemasaran influencer. Penelitian ini bertujuan untuk berkontribusi pada pengembangan kerangka hukum yang lebih kuat yang dapat secara efektif menangani tantangan unik yang ditimbulkan oleh pemasaran influencer sambil mendorong kepercayaan konsumen dan melindungi hak kekayaan intelektual. Temuan mengungkapkan ketidakcukupan dalam kerangka hukum Indonesia yang ada, terutama Undang-Undang Perlindungan Konsumen, Undang-Undang Hak Cipta, dan Undang-Undang Merek dan Indikasi Geografis, dalam menangani tantangan unik pemasaran influencer. Penelitian ini mengusulkan amandemen khusus terhadap undang-undang ini, termasuk persyaratan pengungkapan wajib, pedoman yang jelas tentang penggunaan wajar dan penggunaan merek dagang, serta mekanisme penegakan yang lebih kuat, untuk mengurangi risiko kepercayaan konsumen dan HKI.

Abstract

The integrality of the criminal justice system must be realized in every aspect of sub-systems, in substance, structure, and legal culture. In this respect, in the process of criminal justice, the three sub-systems’ integrality are required so that the criminal justice system is capable to produce fair legal decisions in the process of law enforcement in Indonesia. Until such a policy is undertaken, the law will always be harsh against the poor and weak against the rich. This paper discusses criminal objectives integrality in Indonesian criminal justice system and its influence in the integrated criminal justice system. Using a normative juridical method, this paper demonstrates that each sub-system of criminal justice (the Police, Prosecutors, Courts, and the prison) is in line with the main objectives of criminal law enforcement as found in various laws that govern the institutions.

Abstract

As a country blessed with abundant cultural elements, Indonesia holds the potential to harness traditional knowledge for the betterment of its people's lives. Unfortunately, this concept is often forgotten within Indonesian society and faces various challenges that jeopardize cultural heritage. Hence, the objective of this study is to analyze the significance of traditional knowledge and the legal hurdles that arise in regulating this concept within Indonesia's intellectual property rights framework. The findings of this normative legal research demonstrate that traditional knowledge holds great importance for Indonesian society, particularly amidst the accelerating impacts of globalization, which pose a threat to cultural heritage. Taking a legislative approach, there is an urgent need for a normative framework to protect traditional knowledge as a communal intellectual asset in order to realize the implicit recognition reflected in the constitution, the 1945 Constitution.

Abstract

In today’s rapidly modernizing world, traditional architecture often faces threats from swift development and urbanization. Protecting traditional architecture is not merely about preserving physical structures; it is about understanding and maintaining the cultural values embedded within them. By employing an empirical juridical method that combines juridical, conceptual, and ethnographic approaches, this research seeks to explore the philosophical, historical, and cultural values inherent in the traditional Malay architecture of Kampung Tua in Batam City. Additionally, it aims to analyze the relevance and applicability of intellectual property concepts within the context of local communal identity. The findings reveal that while traditional Malay architecture has been recognized as part of communal intellectual property, its legal protection remains inadequate. Proper inventory, documentation, and official recognition are necessary to strengthen legal protection, with collaboration between the government, indigenous communities, and academics being crucial to keeping this cultural heritage alive.

Abstract

In Indonesia, many cases that occur related to contempt of court and law enforcement have occurred. The issue of Contempt of Court in Indonesia is a problem that is both interesting and complicated in its conception and regulation. Until now, in Indonesia, no provisions specifically regulating the Contempt of Court institutions. This completed study uses a normative juridical research method that prioritizes secondary data. This research addressing the legislation governing the Contempt of Court specifically until now still does not yet exist. However, the general arrangement has happened in the Criminal Code. Contempt of Court can occur both in the courtroom and outside the trial both in criminal, civil and industrial relations cases. Increasingly expanding various actions, which can be categorizing as contempt of court in Indonesia, it is necessary to arrange Contempt of Court in the form of separate rules

Abstract

In Indonesia, the development of the mode of commercial sexual exploitation of children has been carried out through the practice of siri marriage. Children who are vulnerable to sexual exploitation due to lack of literacy in children, economic conditions of the family, and because of the environment and social status. The study aims to examine the protection of children against commercial sexual exploitation through the siri marriage mode from the Maqashid Al-Shariah perspective. This research uses normative juridical research methods with the statutory approach and conceptual approach. This research shows that siri marriage based on Islamic law is permissible if it meets the requirements of marriage, but based on Indonesian national law, siri marriage is prohibited if the purpose is to obtain material benefits for parents or the party to marry off children at an early age. Siri marriage can be used as a criminal offense if done against a child. Whereas in the Maqashid Al-Shariah perspective, marriage with children through siri marriage is legal or permissible. However, the marriage will only produce part of the purpose of marriage, while other objectives in perspective Maqashid Al-Sharia tend to be ignored because early marriage is prone to psychological problems and lack of skills in the family. As a result, marriage is considered to have the risk of giving birth to a bad thing in the family which can reduce the noble values which are the main mission of Islam.

Abstract

Trademark protection is important because of its role in representing a brand’s integrity. The effort to protect trademark rights is therefore essential in ensuring that the brand’s integrity does not suffer any erosion, even if it means going for a lawsuit. This research is conducted to analyze the challenges in pursuing a lawsuit to protect trademark rights, particularly in proving what constitutes a well-known trademark. This research utilized the normative legal research method to analyze the existing positive law in Indonesia, particularly regarding the protection of trademarks. The conceptual analysis supported by the normative research method used in this research found that most of the literature favors the effort to protect trademarks, as it covers a significant portion of a brand’s strategy and perception in the public eye. However, the case study found that the reality of this pathway can be difficult, where there is a possibility that a decision can be made not based on a sound ratio decidendi, or even the lack thereof.

Abstract

: This study aims to identify and analyze Islamic banking policies in maintaining and even improving the image/reputation of Islamic banking and to contribute scientifically to CSR in Islamic banking based on national law and Islamic law. This study uses a qualitative normative legal research method with a conceptual, statutory, and sociological approach. The results of this study indicate that the image or reputation of Islamic banking is the beliefs or feelings of consumers or stakeholders about Islamic banking itself. The reputation of Islamic banking is respect, assessment, and even appreciation from consumers or stakeholders. Islamic banking in improving its image or reputation can be done through CSR. This study provides a descriptive picture of Islamic banking, in general, to provide quality programs through CSR. CSR activities by several examples of Islamic banking in Indonesia refer to the company's obligation to protect and contribute to the community and stakeholders where the company is located. The concept of CSR in Islam is implemented in 3 (three) models of responsibility, namely the relationship of responsibility to Allah SWT; responsibility to humans; and responsibility to the natural environment. The concept of CSR in Islamic banking is a necessity that needs to be implemented as a form of responsibility towards fellow humans and the environment.

Abstract

Abstract The digital economy era has driven the use of technology that relies on data utilization to support various economic activities, such as the use of data analytics. The use of data analytics to provide more relevant features and ads to users of various online platforms has legal implications that must be supported by a legal framework for personal data protection in Indonesia. This study is done to analyze the gap in the development of legal framework in Indonesia in regards to the use of data analytics. Using normative legal research, this study explains the legal implications and outlines the legal issues related to the use of data analytics and the risks faced by online platform users as data owners. The analysis using the statutory approach in this research found that there are several legal issues and normative limitations that make it difficult to implement the concept of transparency and consent in efforts to protect personal data of online platform users, which is the main target of the use of data analytics. The findings of this study also indicate that the use of more complex technical terms is not found in regulations governing the protection of personal data, and hinders further normative exploration related to the use of data analytics that distinguish the types of data used into more complex terms and classifications.

Abstract

Bezitter merupakan seseorang yang menguasai suatu kebendaan seolah-olah benda itu adalah kepunyaannya sendiri. Penguasaan benda oleh bezitter untuk mendapatkan hak milik itu disebut dengan acquisitive verjaring. Asas ini memungkinkan terjadinya peralihan hak milik terhadap benda yang telah dinyatakan daluwarsa. Syaratnya adalah bezitter tersebut harus memiliki itikad yang baik. Ia dapat dikatakan memiliki itikad baik apabila tidak ada keberatan dari pihak manapun terhadap penguasaan benda tersebut. Selain itu, benda tersebut harus dikuasai secara terus menerus selama 20 dan/atau 30 tahun. Di samping itu, prinsip ini juga menimbulkan kontroversi dan sengketa yang tidak sedikit. Hal ini terjadi karena kelalaian pemilik tanah untuk memelihara dan memanfaatkan tanah tersebut. Sehingga bertentangan dengan tujuan tanah sebagai nikmat Tuhan yang keberadaannya diperuntukkan untuk kesejahteraan masyarakat. Tulisan ini bermaksud untuk memberikan analisa hukum terhadap bezitter yang beritikad baik sebagai syarat yang harus dipenuhi untuk memperoleh suatu hak milik kebendaan. Metode penelitian yang digunakan adalah dengan pendekatan yuridis-normatif yang mengkaji beberapa peraturan perundang-undangan terkait dengan judul penelitian ini. Sehingga, dapat diketahui bahwa seorang bezitter dikatakan beritikad baik dalam penguasaan tanah apabila ia memenuhi beberapa unsur. Unsur tersebut diantaranya adalah tanah tersebut harus diduduki secara terus menerus, tidak terjadi sengketa atas tanah tersebut, bezitter tidak mengetahui asal usul tanah tersebut, dan tanah harus dikuasai di muka umum.
