Abstract

In Indonesia, the Commission for the Supervision of Business Competition or Komisi Pengawas Persaingan Usaha (KPPU) is granted the power according to Law Number 5 of 1999 but such a power cannot be optimally implemented. KPPU often experiences difficulties and obstacles in the process of enforcing business competition law due to a large number of business actors and uncooperative witnesses so that this hinders the process of examining cases. In particular, KPPU has lack of cooperation of involved parties during the inspection process. However, the KPPU in carrying out its authority can include the role of the Indonesian police to assist in the process of enforcing business competition law. This paper shows that the role of the Indonesian police in the enforcement of business competition law can be initiated during the investigation process if the KPPU requests assistance to present the reported party, witnesses, and expert witnesses. Until the decision is issued by the KPPU, investigators can follow up with relevant individuals that may have cases that contain criminal aspects. Abstract

The growing number of Micro, Small and Medium Enterprises (MSMEs) has brought about big potential for the implementation of intellectual property protection. The management and the ability to create is an essential key to develop intellectual property. According to this issue, this study is aimed at investigating and analyzing the contextualization of legal protection of intellectual property in the development of MSMEs in Indonesia. Doctrinal legal research method was applied in this study.  This legal study emphasizes on the conception that law can be seen as a set of laws and regulations which are systematically arranged based on a certain hierarchical order.  The result of the study shows that MSMEs and intellectual property are two inseparable entities. One of the government efforts to develop MSMEs in Indonesia is by simplifying MSME regulation through the implementation of omnibus law in order to avoid overlapping of regulations which may lead to complicated bureaucracy. Another finding of this study is that basically the protection of intellectual property is considered highly important for the vendors of MSMEs. The implementation of legal protection for the vendors of MSMEs and their intellectual properties provides opportunity for the business owners to maximize the economic value of their intellectual property. Intellectual property rights can be collateral to obtain banking credit because intellectual property rights are admitted as property that its ownership can be handed over.

Abstract

Kemajuan teknologi mendorong industri keuangan digital terus mengalami perkembangan yang semakin pesat dan salah satunya adalah financial fechnology (fintech). Indonesia belum memiliki regulasi yang spesifik, menjadikan Indonesia masih lemah secara pondasi hukum dalam mewujudkan suatu kemajuan dalam industri keuangan. Penelitian ini bertujuan untuk memahami dan menganalisa kondisi pengaturan fintech khususnya di Indonesia dan Singapura. Metode penelitian yang digunakan adalah hukum normatif dengan menggunakan data yang diperoleh melalui studi kepustakaan. Hasil penelitian ini menunjukan perkembangan industri fintech Indonesia yang tergolong maju, dapat terus dikembangkan dengan menelaah perkembangan industri  fintech yang ada di Singapura. Hukum fintech Indonesia dan Singapura masih bertumpu pada beberapa aturan yang dikeluarkan Otoritas Jasa Keuangan (OJK) di Indonesia dan Monetary Authority of Singapore  (MAS) di Singapura. Inilah yang masih menjadi titik lemah kedua bangsa ini. Peran hukum yang masih terkesan lemah menjadikan suatu celah besar yang harus segera diperbaiki dalam arus perkembangan industri fintech. Industri Fintech yang melibatkan masyarakat secara luas dan mengandung nominal uang yang sangat banyak, perlunya suatu hadirnyahukum yang dapat menjamin perlindungan kepentingan para stakeholders.

Abstract

A large number of cross-cutting issues in the financial services sector, such as measures of ethical risk, adequate protection of consumers of financial services, and financial stability of the financial services sector, make financial service sector oversight authorities increasingly needed. Therefore, this study aims to describe the regulatory arrangements for the presence of the Financial Services Authority (FSA) which has a regulatory and supervisory function for financial services, then this study aims to describe the FSA's work governance policies in Indonesia. The method used in this study is a normative legal research method with a conceptual approach and legislation approach. This study shows the presence of FSA is one of Indonesia's needs in terms of the formation of regulators for the financial services sector, including banks, insurance companies, pension funds, securities, venture capital and finance companies, and other public companies and their supervision. The legal basis for the implementation of the FSA is Law Number 21 of 2011 concerning the Financial Services Authority which was promulgated on November 22, 2011. FSA as a public sector institution must implement Good Corporate Governance (GCG) which is a fundamental component of FSA's ability to run its function in the long run. GCG is a measure of OJK's performance, which includes 4 parts namely Governance Principles, Governance Structure, Governance Process, and Governance Outcome. Then the Governance Principles are transparency, accountability, responsibility, independence, and fairness.Banyaknya masalah lintas sektoral di sektor jasa keuangan, seperti ukuran risiko etika, perlindungan yang memadai terhadap konsumen jasa keuangan, dan stabilitas keuangan sektor jasa keuangan, membuat otoritas pengawasan sektor jasa keuangan semakin dibutuhkan. Maka dari itu, penelitian ini bertujuan untuk menggambarkan kabijakan pengaturan hadirnya Otoritas Jasa Keuangan (OJK) yang memiliki fungsi pengaturan serta pengawasan terhdap jasa keuangan, kemudian penelitian ini bertujuan untuk menggambarkan kebijakan tata kelola kerja OJK di Indonesia.  Metode yang digunakan pada penelitian ini adalah metode penelitian hukum normative dengan pendekatan konseptual serta pendekatan perundang-undangan. Penelitian ini menunjukan hadirnya OJK merupakan salah satu kebutuhan Indonesia dalamhal pembentukan regulator untuk sektor jasa keuangan, termasuk bank, perusahaan asuransi, dana pensiun, sekuritas, modal ventura dan perusahaan pembiayaan, dan perusahaan publik lainnya serta pengawasannya. Dasar hukum penyelenggaraan OJK adalah Undang-Undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan yang diundangkan pada tanggal 22 November 2011. OJK sebagai lembaga sektor publik, dalam tata kelolanya harus menerapkan Good Corporate Governance (GCG) yang merupakan komponen mendasar dari kemampuan OJK untuk menjalankan fungsinya dalam jangka panjang. GCG adalah ukuran kinerja OJK, yang mencakup 4 bagian yaitu Governanve Principles, Governance Structure, Governance Process, dan Governance Outcome. Kemudain Governanve Principles transparansi, akuntabilitas, tanggung jawab, kemandirian, dan kesetaraan atau kewajaran.

Abstract

The legal protection of cultural diversity within the context of Traditional Cultural Expressions (TCEs) is not governed by specific legislation, which can significantly hinder the protection and validity of cultural expressions. Utilizing normative legal research methods, this study aims to conduct a comprehensive analysis of the urgency of establishing a specialized legal regime that recognizes and safeguards TCEs as a unique form of communal intellectual property. The analysis supported with a statutory approach indicates that there is a strong urgency to form this specialized legal regime, highlighting normative conflicts in existing regulations. The analysis also outlines how the formation of this regime can be accomplished by referring to a comprehensive normative framework and considering the unique elements that constitute TCEs. The research findings show that existing regulations have not been able to provide adequate protection for TCEs, especially in the context of the Industrial Revolution 4.0, which demands more comprehensive protection, particularly in the digital realm. Therefore, the establishment of this specialized legal regime becomes a crucial step in addressing new challenges in the era of Industrial Revolution 4.0.

Abstract

The development of the economy in Indonesia, as in other countries, always goes hand in hand with increasing purchasing power and a culture of consumerism. Especially in the world of fashion, this is very obvious. Coupled with the development of technology and the ease of getting information, various kinds of fashion trends from anywhere in the world can easily spread to other parts of the world. Indonesia's position as one of the countries with the largest number of social media users in the world has made Indonesia one of the most lucrative markets for business actors in the fashion world. Various kinds of well-known fashion brands can be easily found in everyday life, from economical ones to very expensive ones, also known as luxury brands. But in reality, not all groups of people are able to follow fashion trends that change frequently. The people's inability to buy certain fashion products is exploited by MSME business actors who make a living in the convection industry, by selling fake fashion products or better known as counterfeit. The use of fake fashion products has become a public secret, and the prestige and glamor gained from using these fashion products are no longer felt by those who use genuine or authentic products. This study explores the development of a counterfeit culture that is developing in Indonesia, the social impact and impact on the development of convection SMEs, as well as analyzing the legal elements behind this phenomenon, in accordance with the existing intellectual property law in Indonesia.

Abstract

Pariwisata berkelanjutan tidak hanya merupakan perubahan yang diperlukan di sektor pariwisata, namun juga merupakan tren yang dapat merevitalisasi sektor pariwisata yang terbelenggu pandemi dan permasalahan sosio-ekonomi dan lingkungan. Kekayaan intelektual berperan penting, khususnya dalam mendukung industri kreatif sebagai bagian tak terpisahkan dari sektor pariwisata. Penelitian ini dibuat untuk memetakan peran kekayaan intelektual terhadap kemajuan industri kreatif di tengah pengembangan pariwisata berkelanjutan. Dengan metode penelitian hukum normatif dan pendekatan komparatif, penelitian ini membandingkan kerangka hukum Indonesia dengan Filipina, serta kecakapan masing-masing sistem hukum untuk mendukung industri kreatif dalam pariwisata berkelanjutan. Analisis menemukan bahwa Filipina memiliki kerangka hukum pariwisata yang lebih baik, yang sudah sekaligus mengatur secara detail penerapan konsep keberlanjutan, serta dukungan terhadap industri kreatif. Namun, Indonesia memiliki kerangka hukum kekayaan intelektual yang lebih baik, khususnya mengenai kekayaan intelektual komunal, yang secara definitif diatur dan sesuai dengan norma-norma mendasar dari kerangka hukum pariwisata.

Abstract

Introduction: Changes in the industrial revolution have increased the risk of copyright infringement of products, which can be detrimental to the creator. Therefore, better protection is needed to address this high risk.Purposes of the Research:  This research aims to analyze law enforcement related to copyright infringement in the era of the Industrial Revolution through case studies of judges' decisions.Methods of the Research: The research method used is the normative legal method by analyzing legislation and Court Decisions Number 505 K/Pdt.Sus-HKI/2021 and Number 1933 K/Pid.Sus/2021 through literature study, by applying descriptive legal interpretation techniques to reach the right conclusion.Results of the Research: The results showed that law enforcement against copyright infringement involves two main approaches, namely preventive and repressive. The preventive approach is carried out through regulations that provide legal certainty, such as the presence of the Copyright Act. Meanwhile, the repressive approach is realized through legal proceedings in court and out of court to take action against violations that occur. This study highlights several cases of copyright infringement in Indonesia and shows the importance of strong law enforcement to protect the rights of creators in the digital age.

Abstract

The emergence of SPAC has democratized participation in the burgeoning equity market. Capital raised during a SPAC's Initial Public Offering (IPO) is typically held in escrow identifies a suitable acquisition or merger target. This study explores the concept of SPACs, their operational mechanisms, their appeal to tech startups, and their presence in Asia, with a specific focus on the Indonesian jurisdiction. The study also aims to identify the potential risks SPACs may pose to the equity market to inform more effective regulation. Employing normative legal research and prioritizing secondary data, the findings of this paper indicate that SPACs have evolved from a niche option to a significant facilitator for private enterprises seeking to enter public markets through an IPO. The study further reveals that, despite the risks associated with SPACs and their current unpreparedness for IPOs in Indonesia, lessons from foreign experiences could guide the development and implementation of domestic regulations. While SPACs have demonstrated their value and promise to become a significant market force, calls for swift regulatory action should balance the benefits of SPACs against the need for thoughtful regulation, presenting an opportunity to reconsider existing IPO regulations.DOI: https://doi.org/10.22304/pjih.v11n1.a5

Abstract

This research is conducted to examine the problem of legal protection of MSME brands in the digitalization era in the scope of legislation, challenges and law enforcement processes. This research uses normative juridical research and is descriptive qualitative with a statutory approach, concept approach and comparative approach. The results show that first, the laws and regulations that accommodate the protection of MSME brands include Law No.20 of 2016, Law No.20 of 2008, PP No.7 of 2021 and PP No.28 of 2019. The form of MSME brand protection is carried out by constitutive methods and is carried out by means of collective registration, procurement of cooperation, special relief and provision of financing. Unfortunately, in terms of regulation it has weaknesses in the form of potential ownership of the brand not from the original inventor. This is different from the constitutive system in the United States which uses the consideration of use in commerce and intent to use in commerce in determining the rights to the trademark. Second, the challenges of law enforcement of MSME brand protection in the digital era are the lack of public knowledge regarding trademark registration and trademark infringement to the decline in public enthusiasm and awareness in protecting MSME brands. On this basis, DJKI then conducts law enforcement by following up complaints of trademark infringement, optimizing trademark protection programs, conducting socialization and education, holding cooperation to form a special task force. The protection of MSME brands is crucial because it can prevent brand infringement, support the creative industry and maintain brand originality.
