Abstract

The rapid development of artificial intelligence (AI) presents complex challenges in legal theory, particularly regarding the question of AI as a legal subject. As AI becomes increasingly capable of creative work and decision-making, the question arises whether it should be recognized legally as an entity in its own right. This study explores the legal implications of recognizing AI as a legal subject through the lens of Immanuel Kant's philosophy, particularly focusing on human dignity. Kant argues that human dignity is intrinsic, grounded in the capacity for rational thought and moral responsibility, a characteristic AI lacks. Thus, recognizing AI as a legal subject risks undermining human dignity by equating human beings with entities that do not possess autonomy or ethical awareness. The study examines the current legal framework in Indonesia, highlighting the lack of clear regulation for AI, and explores the philosophical, ethical, and practical considerations involved in the legal treatment of AI. It argues that AI should be treated as a tool, not a legal subject, ensuring that human dignity remains the cornerstone of the legal system. The paper concludes by advocating for a fragmented, sector-specific approach to AI regulation in Indonesia, ensuring more focused oversight while protecting human dignity.

Abstract

Indonesia merupakan negara kepulauan terbesar kedua didunia yang mempunyai kekayaan sumber daya perairan yang cukup tinggi serta sumber daya hayati yang beranekaragam. Indonesia juga berada pada posisi yang sangat strategis di antara negara-negara didunia, letaknya yang strategis inilah yang menimbulkan kemungkinan terjadinya berbagai macam kejahatan yang terjadi di laut. Salah satunya adalah tindak pidana illegal fishing. Penelitian yang digunakan adalah yuridis normatif dengan menggunakan pendekatan Undang-Undang (statute approach) serta pendekatan konseptual (conseptual approach). Hasil dari penelitian ini adalah United Nations Convention on the Law of the Sea (UNCLOS 1982) sebagai ketentuan hukum internasional mengatur secara umum tentang penegakan hukum di laut teritorial maupun zona ekonomi ekslusif (ZEE) suatu negara yang diimplementasikan dalam hukum nasional melalui perundang-undangan. Adapun Undang-Undang yang mengatur secara spesifik mengenai illegal fishing yakni Undang-Undang No. 31 Tahun 2004 yang diubah menjadi Undang-Undang No. 45 Tahun 2009 tentang Perikanan dan Undang-Undang No. 5 Tahun 1983 tentang Zona Ekonomi Eksklusif Indonesia (ZEEI).

Abstract

The Indonesian government mandates users of SIM cards to register their National Identification Number (NIK) and Family Card number (KK) correctly to activate their prepaid numbers. However, the prepaid card registration policy invites irresponsible individuals who use that personal data without the owner's permission. Therefore, the main issue in this research is, the legal regulations governing the protection of personal data in Indonesia, the role of telecommunications service providers in maintaining the confidentiality of consumer data, and how government agencies play a role in efforts to protect personal data in Indonesia. Type of research used in this research is normative legal research and used data collection technique through literature research. The findings of this study can be summarized as follows, regarding Law No. 27 of 2022 on Personal Data Protection (PDP Law) that provides a strong legal basis for protecting consumer personal data, regulating individual rights to their personal data, and establishing obligations for personal data managers. As well as telecommunications service providers have the responsibility to provide clear and transparent information to consumers about how their personal data will be used and processed. Along with the government agencies function to enact and supervise personal data protection regulations and educate public about data privacy awareness.

Abstract

The development of technology and digital transformation has led to the growth of industries such as the creative business industry. One of its impacts is the emergence of Non-Fungible Tokens (NFTs). NFTs are digital assets in the form of tokens representing ownership of a digital artwork. In Indonesia, NFTs currently lack specific legislative regulations, and there is no explicit and clear regulatory framework regarding the protection of NFTs in terms of their intellectual property aspects. Therefore, this study examines the development of NFTs in Indonesia, along with the legal position and protection of NFTs based on intellectual property law in Indonesia. In this research, the author employs a normative juridical research method with a legislative approach. Based on the research findings, it is evident that the development of NFTs, both globally and nationally, is quite significant. The public is increasingly becoming acquainted with NFTs, which have substantial prospects and are associated with many high-commercial-value works. Regarding NFTs as creative works, the regulation that accommodates the protection of intellectual property for NFTs in Indonesia is Law No. 28/2014. It is known that NFTs can take the form of images, paintings, videos, and music, which are considered parts of creations protected by copyright.

Abstract

Indonesia's diverse cultural heritage significantly contributes to its economic growth, yet the current intellectual property system, based on Western principles, may not fully align with the country's cultural values. This research aims to enhance the legal framework for Indonesia’s communal intellectual property (CIP), by exploring the potentials brought by of Islamic law, particularly Maqasid al-Shariah. For this purpose, this research utilizes the normative legal research method, analyzing relevant norms within existing laws and Islamic legal doctrines, revealing conceptual correlations between Maqasid al-Shariah and CIP. This research also aims to addresses the common misconceptions regarding Maqasid al-Shariah is crucial for effectively utilizing Islamic law principles in Indonesia's legal system. The analysis demonstrates that communal intellectual property aligns with both Western IP principles and Islamic values, as it recognizes the importance of community welfare and individual benefits. Integrating Maqasid al-Shariah values into Indonesia's CIP legal framework can promote a more inclusive, equitable system that respects collective knowledge and cultural heritage while fostering innovation and creativity.

Abstract

Introduction: Taxes are obligations requiring citizens to pay a specified amount of money to the state. Following the enactment of the Tax Harmonization Law in 2021, tax law enforcement in Indonesia has been directed toward recovering state revenue losses.Purposes of the Research: This study aims to describe and analyze the implementation of criminal fine execution in tax cases as outlined in Decision Number: 249/Pid.Sus/2022/PN.Tpg.Methods of the Research: The study employs a normative legal approach through library research, which includes references such as laws, articles, and journals. Secondary data were collected through literature review and analyzed using a qualitative juridical approach.Results Main Findings of the Research: The findings of the study show that the confiscation of land and buildings belonging to the convicts is not in line with Article 39 Paragraph (1) of the Criminal Procedure Code. In addition, the assets had been used as collateral by Bank Mandiri Tanjungpinang, a State-Owned Enterprise, before the investigation began. This results in a lack of legal certainty and becomes an obstacle in the execution process. To ensure legal certainty, the investigation process must be accompanied by the tracking and blocking of the assets found, in the settlement of tax criminal cases in Decision Number: 249/Pid.Sus/2022/PN.Tpg, deliberation or coordination regarding land and building assets can be carried out, because the ultimate goal is to return the results of the execution to the state.

Abstract

In this era of rapid technological advancement, marked by the emergence of Artificial Intelligence (AI), the legal status surrounding AI-generated works sparks considerable debate. The question arises: do these creations warrant legal protection? This study employs a normative legal research method, drawing upon statutory regulations. Findings indicate that AI cannot be deemed a legal subject with rights and obligations, as it is a product of human-made technology. Consequently, AI-generated works do not meet the criteria for copyright protection, namely fixation, originality, and minimal creativity. Indonesia addresses copyright protection under Law Number 28 of 2014, stipulating that AI-generated works can be protected through registration, provided they meet standards of originality and human creative contribution. This essentially renders AI creations ineligible for legal protection, as they originate from machine intervention. However, legal protection for AI can be circumvented by directing it towards the owner and creator of the AI itself, rather than its resultant works.

Abstract

Abstract The digital economy era has driven the use of technology that relies on data utilization to support various economic activities, such as the use of data analytics. The use of data analytics to provide more relevant features and ads to users of various online platforms has legal implications that must be supported by a legal framework for personal data protection in Indonesia. This study is done to analyze the gap in the development of legal framework in Indonesia in regards to the use of data analytics. Using normative legal research, this study explains the legal implications and outlines the legal issues related to the use of data analytics and the risks faced by online platform users as data owners. The analysis using the statutory approach in this research found that there are several legal issues and normative limitations that make it difficult to implement the concept of transparency and consent in efforts to protect personal data of online platform users, which is the main target of the use of data analytics. The findings of this study also indicate that the use of more complex technical terms is not found in regulations governing the protection of personal data, and hinders further normative exploration related to the use of data analytics that distinguish the types of data used into more complex terms and classifications.

Abstract

The utilization of advanced technologies in the context of digital transformation plays a crucial role in economic progress and growth. However, the use of cutting-edge technologies such as AI and 3D printing must be supported by an adequate legal framework to prevent violations of intellectual property protection principles and avoid harming intellectual property holders. This study aims to explore the issues that may arise from the use of AI and 3D printing technologies. Using a normative legal research method with a comparative approach, this study analyzes the paradox of protection created by these issues, while highlighting the problems found in the legal norms of relevant legal frameworks, such as patent and industrial design regimes. The analysis reveals limitations in the application of the exhaustion doctrine, which could provide balanced protection for the use of these two advanced technologies. Based on these findings, the study offers recommendations for strategic legal development that could be applied by Indonesia and Vietnam, as two ASEAN countries with significant potential in the era of digital transformation.

Abstract

Kebijakan pembatasan sosial akibat dari covid-19 menyebabkan pelaku UMKM mengalami penurunan omzet. UMKM berperan penting dalam peningkatan perekonomian negara terutama dalam hal penyerapan tenaga kerja. Dengan terdampaknya UMKM, perekonomian negara juga ikut menurun. Salah satu upaya yang dapat dilakukan pelaku UMKM untuk mengembangkan usaha mereka adalah dengan melakukan pendaftaran merek. Maka, peneleitian ini bertujuan untuk mengkaji urgensi pendaftaran merek UMKM selama pandemi covid-19. Penelitian ini menggunakan metode penelitian non-doktrinal atau penelitian hukum empiris. Penelitian ini menunjukan bahwa pendaftaran merek memberikan sejumlah keuntungan bagi pelaku UMKM terutama memberikan kesempatan bersaing dengan usaha lain di marketplace dan memberikan perlindungan terhadap barang atau jasa yang diperdagangkannya. Namun banyak pelaku UMKM yang masih enggan untuk melakukan pendaftaran merek dikarenakan alasan seperti pandangan terhadap prosedur pendaftaran merek yang panjang dan memakan waktu serta biaya yang banyak. Pendaftaran merek dapat dilakukan secara online dan terdapat panduan lengkap untuk mempermudah proses pengajuan.
