Abstract

There is a lack of maximum realization of sustainable development in the Surakarta City Government’s partnerships. This study proposes a fishbone diagram that seeks the root causes that affect the realization of partnerships that encourage sustainable development in Surakarta. The study aimed to convey ideas on environment-based local government partnership policies (Eco-Partnerships) to achieve sustainable development. It was a descriptive, doctrinal-method legal research. The primary data was sourced from library research, and the author also carried out some field research. The research used several indicators, namely Surakarta City Government’s Partners, Regulations, and Culture as the small bones and the analysis result of the failure to realize eco-friendly partnerships as the big bone. The result of the study showed that the implementation status of 19 out of 52 regional partners and five regional partners with a focus on environmental activities had not yet been followed up by the regional government. The regulation was ineffective because the Surakarta Government lacked adequate policies on eco-partnerships. Therefore, the Surakarta City Government needed to enforce a policy based on regional regulations on partnerships that integrate economic, social, and environmental aspects (Eco-Partnership).

Abstract

Human genetic engineering raises pros and cons. Despite the potential to contribute to the health sector, it can cause several problems. While, in theory, it goes against nature and against other conservative beliefs, human genetic engineering gains important support from Transhumanism—a philosophy promoting the scientific evolution of the human race. This study determines the relevancy regulation of human genetic engineering on a global scope and how it affects the prospects of regulating human genetic engineering in Indonesia. The study aims to provide consideration for Indonesia in determining the legality status of human genetic engineering, through analyses of legal constructions surrounding it. The study used a comparative legal research method, using laws and legislations as the focal point to compare the legal frameworks of Indonesia and other countries. It employed secondary data and applied the qualitative method. The study reveals that some countries have already regulated the issue based on the benefits and risks, laying out the boundaries and restrictions on the issue. Indonesia has not established any regulation or showed specific interest in regulating human genetic engineering. The regulation on human genetic engineering is very important because many institutions are now increasingly carrying out human genetic engineering; and many countries oversee it. This importance is based on the theory of legal progressivity, which states that the law exists for human and not the other way around. Abstract

Big data is the process of collecting, analyzing, and utilizing data, which is necessary for the development of many kinds of technologies that are already highly-integrated into the daily lives of many people. The concept of data ownership is often used to be the basis to support the efforts to regulate big data. This point of view argues that data has a number of elements of ownership that needs to be recognized by intellectual property law but does not clearly explain the conceptual connection of data, big data, and intellectual property. Using the normative legal research method, this article found out that the integration of intellectual property elements into the conceptualization of big data regulation could threaten the antitrust or business competition climate in Indonesia. Additionally, the normative space for big data regulations through the intellectual property rights perspective is still too small to be comprehensively described and still needs more concrete evidence from the actual utilization of big data itself. This research aims at providing points of normative reference for future studies on the potentials and risks of regulating big data under the framework of intellectual property law.Big data merupakan proses pengumpulan, analisis dan pemanfaatan data yang berperan penting dalam perkembangan berbagai macam teknologi yang sudah sangat terintegrasi dalam kehidupan masyarakat. Konsep kepemilikan data merupakan konsep yang kerap dijadikan dasar dalam upaya meregulasi big data. Sudut pandang ini berargumen bahwa data memiliki unsur kepemilikan yang harus dihormati oleh hukum kekayaan intelektual, namun tidak secara jelas menjelaskan konseptualisasi antara data, big data, dan kekayaan intelektual. Dengan menggunakan metode penelitian hukum normatif, penelitian ini menemukan adanya pelekatan nilai kekayaan intelektual ke dalam konseptualisasi pengaturan big data, yang mana dapat mengancam iklim persaingan usaha di Indonesia dan secara normatif pengaturan big data melalui hak kekayaan intelektual masih sangat kecil untuk dijabarkan dan membutuhkan bukti yang lebih konkret dari pemanfaatan big data itu sendiri. Penelitian ini bertujuan untuk memberikan rekomendasi secara normatif untuk penelitian di masa mendatang mengenai peluang dan risiko pengaturan big data dalam kerangka hukum kekayaan intelektual.

Abstract

Intellectual Property (IP) is a right that originates from the creations of human thoughts, which are expressed in various forms and have economic or commercial value. One form of violation currently quite common in IP is counterfeiting or imitating marks. It is caused by developments in technology and transportation facilities which have caused activity in the trade sector, both goods, and services, to experience very rapid development. This study aimed to determine the effectiveness of brand protection for the MSME culinary industry in the city of Batam. This study uses non-doctrinal or empirical legal research methods with data collection techniques using primary and secondary data obtained through interviews and the results of literature studies. This study concludes that the legal protection of trademarks for MSME culinary industry business actors in Batam City is still ineffective. It cannot be applied to society as a whole, where based on culture, there are still quite a several business actors in the culinary industry in Batam City who still need to register their intellectual property. Many people still need to learn about Law Number 20 of 2016 concerning Marks as a law that all Indonesian people must obey as legal subjects.

Abstract

Tidak bisa dipungkiri bahwa penggunaan nama Merek merupakan hal yang penting bagi suatu UMKM, dalam hal ini pemerintah juga memiliki peran penting dalam mensosialisasikan pemahaman tentang Merek. Tujuan Penelitian ini yaitu mengetahui perlindungan atas Merek UMKM yang tidak terdaftar pada Direktorat Jendral Kekayaan Intelektual. Metode penelitian yuridis normatif merupakan metode yang digunakan dalam penelitian kali ini yaitu metode  penelitian  hukum  yang dilakukan  dengan  cara  meneliti  bahan  pustaka  atau  bahan sekunder. Melalui penelitian ini penulis menganalisa pentingnya Merek dalam UMKM. UU Merek dan Indikasi Geografis saat ini menjadi senjata bagi para pelaku kejahatan Merek, dengan segala isi dan manfaatnya telah ditelaah terlebih dahulu yang dilihat dari beberapa landasan. Demi mewujudkan kemajuan bangsa Pemerintah berkewajiban membimbing para pelaku usaha terutama bagi pemilik Merek agar terhindar dari sengketa Merek nantinya.

Abstract

This research explores the forms of intellectual property rights violations and their causes, which are examined using the Indonesian intellectual property rights legal framework, to then generate an overview of the legal reconstruction needed to protect existing intellectual property in Indonesian online marketplaces. This research used normative legal research method with comparative approach by analyzing the existing Indonesian IP legal framework and compare it with other countries that are more advanced in IPR protections. This research puts a great emphasis on legal problems and the criminal elements of the Indonesian intellectual property rights legal framework to explain the position of online marketplaces and their responsibilities to also support the protection of IP and the growth of e-commerce overall. This research finds that Indonesia is facing normative issues in defining the role of online marketplace in many IP infringement cases. This finding is important in the support for continued legal development in Indonesia, to provide better protection of many forms of intellectual property rights in Indonesian online marketplaces.

Abstract

Indonesia's potential has made Indonesia a strategic investment destination, both domestic investment and foreign investment. The enormous number of human resources, abundant natural wealth, and various forms of culture that stretch from Sabang to Merauke, have encouraged many potential investors to continue to monitor the development of the Indonesian economy. All of this potential can even continue to increase, if it is put to good use by the creative economy and the industries within it. The global economic recession caused by the COVID-19 pandemic has increased the urgency for the development of the creative economy sector as a sector that has proven its resilience. Using normative legal research methods, this study analyzes Indonesia's ability to facilitate the interests and development of the creative economy in the context of investment. This research outlines the problems contained in the laws and regulations governing investment in Indonesia, as well as their impact on the creative economy in Indonesia. This research also proves that there is an urgency to renew the regulations contained in the laws and regulations governing investment, in order to attract more investors to invest, especially in creative industries.

Abstract

Strengthening the foundation of national economic resilience through MSMEs is very important, especially after MSMEs are able to prove their adaptability during the COVID-19 pandemic. To encourage the further development of MSMEs, in addition to incentive assistance, the government must also provide assistance by facilitating legal protection of MSMEs, particularly through intellectual property law. This research explores the relationship between trade secret protection and the development of MSMEs in Indonesia in the context of the development of e-commerce in Indonesia and builds important points of legal reconstruction that needs to be carried out as part of the process of protecting MSME Trade Secrets. This study aims to examine the landscape of intellectual property law implementation in Indonesia, the relevance of intellectual property rights in the development of MSMEs and the national economy, and examine the legal lag and its impact on the protection of Trade Secrets for MSMEs. So, this research method uses normative legal research methods. This research shows that Trade Secrets as an important part of intellectual property that supports the development of MSMEs still use arrangements that seem old-fashioned and do not provide space for technical explanations in the regulations. Penguatan fondasi ketahanan ekonomi nasional melalui UMKM sangat penting, terlebih lagi setelah UMKM mampu membuktikan kemampuan adaptasi di masa pandemi COVID-19. Untuk mendorong perkembangan UMKM lebih lanjut, selain bantuan insentif, pemerintah juga harus memberikan bantuan dengan memfasilitasi perlindungan UMKM secara hukum, khususnya melalui hukum kekayaan intelektual. Penelitian ini menelusuri hubungan antara perlindungan rahasia dagang dengan perkembangan UMKM di Indonesia dalam konteks perkembangan e-commerce yang ada di Indonesia serta membangun poin-poin penting rekonstruksi hukum yang perlu dilakukan sebagai bagian dari proses perlindungan Rahasia Dagang UMKM. Penelitian ini bertujuan untuk mengkaji lanskap penerapan hukum kekayaan intelektual di Indonesia, relevansi hak kekayaan intelektual dalam perkembangan UMKM dan ekonomi nasional, dan mengkaji ketertinggalan hukum dan pengaruhnya terhadap perlindungan Rahasia Dagang bagi UMKM. Maka, metode penelitian ini menggunakan metode penelitian hukum normatif. Penelitian ini menunjukan bahwa Rahasia Dagang sebagai bagian penting dari kekayaan intelektual yang mendukung perkembangan UMKM masih menggunakan pengaturan yang sudah berkesan kuno dan tidak memberikan ruang penjelasan teknis dalam pengaturannya.

Abstract

Kondisi Lembaga Pemasyarakatan di Indonesia yang telah melebihi kapasitas (overcrowded) menjadi kekhawatiran pemerintah akan penularan COVID-19 di dalamnya. Penelitian ini bertujuan untuk mengetahui serta mengkaji problematika kebijakan pembebasan narapidana sebagai bentuk upaya penanggulangan COVID-19. Spesifikasi pada penelitian ini bersifat deskriptif analitis dengan jenis penelitian hukum normatif. Penelitian ini menggunakan data sekunder yang diperoleh melalui studi kepustakaan sebagai teknik pengumpulan data, kemudian dianalisis menggunakan metode analisis kualitatif. Hasil penelitian menunjukkan bahwa upaya pemerintah dalam menanggulangi COVID-19 di Lembaga Pemasyarakatan yang telah “overcrowded” adalah dengan mengambil kebijakan pembebasan narapidana melalui jalur asimilasi dan hak integrasi. Namun, kebijakan ini tidak lepas dari adanya problematika yang hadir di tengah-tengah masyarakat, seperti pengulangan kembali tindak pidana yang dilakukan oleh mantan narapidana yang telah dibebaskan berdasarkan kebijakan ini.Kata Kunci: COVID-19; Indonesia; Kebijakan; Pembebasan Narapidana. AbstractThe condition of correctional institutions in Indonesia that has exceeded capacity (overcrowded) is a concern of the government about the transmission of COVID-19 in it. This research aims to identify and examine the problem of prisoner release policies as a form of an effort to tackle COVID-19. The specification in this research is descriptive with the type of normative legal research. This study uses secondary data that obtained through library research as a data collection technique, then analyzed with qualitative method. The results of study indicate that the government's effort to tackle COVID-19 in prisons that have been "overcrowded" is to adopt a policy of releasing prisoners through assimilation and integration rights. However, this policy cannot be separated from the problems that exist amid society, such as the repetition of criminal acts committed by ex-convicts who have been released under this policy.

Abstract

Indonesia memiliki beberapa instrumen hukum perlindungan data pribadi yang tersebar dan hanya menyesuaikan dengan muatan utama dari masing-masing undang-undang, sehingga perlindungan hukum yang diberikan masih belum maksimal. Penelitian ini bertujuan untuk mengkaji penggunaan artificial intelligence (AI) sebagai alat bantu dalam melindungi data pribadi dan mengkaji urgensi sebuah regulasi khusus di Indonesia dalam menciptakan perlindungan terhadap data pribadi. Metode penelitian ini menggunakan pendekatan perundang-undangan dan pendekatan perbandingan hukum. Penelitian menunjukkan bahwa Pemerintah Indonesia perlu untuk segera membentuk dan mengesahkan instrumen hukum khusus dalam mengatur mengenai perlindungan data pribadi. Selain itu, upaya yang dapat dimaksimalkan dalam melindungi data pribadi adalah dengan memanfatkan potensi dari AI. Pemanfaatan AI dalam perlindungan data pribadi akan meminimalisir terjadinya human error sehingga perlindungan data pribadi dapat lebih terjamin.
