Abstract

Law Number 20 of 2016 concerning Marks and Geographical Indications in Article 1 Paragraph 1 explains that a mark is a sign that can be displayed graphically in the form of images, logos, names, words, letters, numbers, color arrangements, in 2 (two) dimensions. , sound, hologram, or a combination of two or more of these elements to distinguish goods and/or services produced by persons or legal entities in the activities of trading goods and/or Services. Lyn'z Health & Beauty Care is a business engaged in health and beauty services. The reason for the owner of the brand is notregistering the "Lyn'z Health & Beauty Care" Brand yet is because the ownerof brand is unfamiliar with the trademark registration procedure, which is can conducted online via the DJKI website. Therefore,to do proper mark registration, it is necessary to provide assistance. The purpose of this community service is to register the MSME brand. There are 3 stages that used for implementation method., First stage is to identify problems owned by partner , The second stage is to have a preparation for solving partner problem and the And the third stage is implementation . The result of this community service is the registration of the Lyn'z Health & Beauty Care MSME brand, as provenby the receipt of an online application for the Lyn'z Health & Beauty Care Mark registration

Abstract

Pelanggaran terhadap merek sering terjadi di tengah masyarakat, hal ini juga menjadi penyebab timbulnya korban akibat penggunaan merek tiruan. Kerugian tidak hanya akan dialami oleh konsumen melainkan juga produsen sebagai pemegang hak merek akan merasa sangat dirugikan atas kejahatan pelanggaran merk. Dalam tulisan ini penulis bertujuan untuk menganalisis bagaimana perlindungan merek dagang di Indonesia, bentuk pelanggaran merek dagang dan faktor yang menjadi penghambat dalam pelaksanaan perlindungan hukum terhadap penegakan merek. Penelitian ini menggunakan metode yuridis sosiologis dengan bersumberkan dari data-data primer yaitu UU tentang Merek, dan data-data sekunder lainnya termasuk buku yang berkaitan dengan Hak Kekayaan Intelektual khususnya merek, artikel, jurnal dan lain sebagainya yang memiliki keterkaitan dengan permasalahan ini. Abstract

Good faith in trademark registration is the beginning of the filing of a trademark registration application in Batam, where each brand and its logo has different characteristics and characteristics from each of the services and goods businesses. In this case, the owner of Nasi Bakar Maryam does not understand and does not know how to do Online Mark Registration. It is important for all Traders to Register their Marks so that they can be legally protected against trademark rights and get legal certainty over the trademarks owned by every trade in Goods and Services. Brands in the world of trade in goods and services have a very important role. For that purpose and from this community service is to register the trademark. The implementation method of this activity has 3 stages, namely making an agreement and explaining to partners the purpose of this activity, collecting the required data, and registering a mark and the result of this activity is that the Nasi Maryam Mark will be registered in Intellectual Property Rights.

The pandemic that occurred in Indonesia gave a huge responsibility to the government as stated in the fourth paragraph of the Preamble to the 1945 Constitution of the Republic of Indonesia. Abstract

Hak cipta merupakan hak yang diberikan kepada orang yang menciptakan suatu karya yang menandakan bahwa ciptaan tersebut resmi menjadi kepemilikannya. Penelitian ini bertujuan untuk mengkaji peluang dan tantangan perlindungan hak cipta. Penelitian ini menggunakan metode penelitian hukum normatif. Penelitian ini menunjukan, revolusi industri 4.0 saat ini berpengaruh terhadap hak cipta yang tidak hanya menimbulkan peluang namun juga menimbulkan tantangan. Abstract

The Covid-19 pandemic that occurred in Indonesia indirectly made internet technology even more needed, especially for school children who implemented Online School or commonly called online learning. It is undeniable that internet facilities not only have a positive impact, but also have negative impact on minors, such as hoax, pornographic content, and cyber crimes. This study uses empirical juridical methods, and the data used in this study are primary data obtained from field data and observations from the Prestasi Elementary School. Based on the results of this study, it is found that 75% of the parents/guardians of Prestasi Elementary Students did not understand the substance of Electronic Information and Transaction Law (ITE Law). The result obtained from this study are that knowledge and understanding of the ITE Law plays a crucial role for parents/guardian of Prestasi Elementary Students in supervising their children on social media. Therefore, literacy education is needed for parents/guardians of students so they can supervise their children to avoid any negative impacts on social media. Multimedia facilities can increases awareness and understanding of parents/guardians of Prestasi Elementary School related to the ITE Law.

Abstract

In making a brand, it must have a different characteristic from the other so the product that listed will be easier to recognize. From the results of observation, that LAUNDRY COST is one of the Micro, Small and Medium Enterprises (MSME) in Tanjungpinang city that haven’t registered the brand. So this community services (PkM) is for provide a legal protection of brand rights from the country for the applicant. There are 3 method for this implementation, such as: pre implementation, implementation stage, and the last stage is evaluation. The result of this community services (PkM) is that business owner know about the risk of not registering the brand and the importance of brand protection. MSME actors also get a receipt for the registration brand of LAUNDRY COST from DJKI website.

Abstract

There are so many new brands or products that are popping up at this time. However, with so many new brands and products, it is possible that there will be a dispute, one of which is plagiarism against a particular brand. Therefore, it is very important to maintain the rights to the mark by registering the mark with the Directorate General of Intellectual Property. Registration of a mark aims to ensure that the mark gets legal protection from the state. Shipowner Apparel is one of the businesses engaged in the fashion sector. However, the trademark has not been registered because the business owner is still unfamiliar with the trademark rights. So in this case the aim is to register to avoid disputes related to trademarks that may occur in the future. Community Service (PkM) is carried out with 3 stages of implementation methods, namely pre-implementation, implementation stage and evaluation stage. The result of the implementation of this community service is in the form of education regarding the importance of intellectual property protection. as well as a receipt for an online application for registration of the Shipowner Apparel trademark

Abstract

The brand itself is also included in the type of Intellectual Property that we often encounter in our daily lives. However, although brands are often found in our daily lives, most of these brands are still not registered with the DJKI, one of which is the brand “Teh Tarik Sultan Poenya Anasis”. The reason the owner of the “Teh Tarik Sultan Poenya Anasis” brand has not been registered by the owner to the DJKI is because the owner of the mark still does not understand the procedure for registering the mark online on the DJKI website. Therefore, it is necessary to provide assistance to the registration of the mark. The method of implementing community service is carried out in 3 stages, namely, firstly determining the problems owned by partners, secondly preparing for the resolution of partner problems and the last is implementation. The result of the implementation of this community service is the understanding of partners in the stages and procedures in registering a mark in the DJKI and that the mark has been registered with the DJKI.

Abstract

The e-commerce ecosystem has encompassed various aspects of life, giving rise to legal implications, particularly in the areas of intellectual property and personal data protection, which are now inseparable from Indonesia’s economic system in the digital age. This research aims to elucidate the legal relationship between trade secrets as a crucial form of intellectual property to be safeguarded in the digital era and analyze Indonesia’s legal capability to protect trade secrets amidst the escalating challenges of cybersecurity due to the widespread use of various forms of e-commerce. The research employs a normative legal research method to analyze the protection and legal certainty concerning trade secrets, which can be subject to unauthorized access or theft through cyberattacks. Utilizing a legislative approach, the research relies on secondary data in the form of primary legal sources. The findings of this research reveal political-legal issues and normative shortcomings in regulating e-commerce and trade secrets, often underestimating the digital threats that can harm individuals’ intellectual property rights.
