Abstract

On the one hand, in the 4.0 era, contemporary Islamic education cannot avoid the phenomenon of interrelationships between human beings in the increasingly intensive and pluralistic systems of technology, information and communication. This era demands the practice of Islamic education with a multicultural perspective, democracy and human rights. On the other hand, there is an unpreparedness in the practice of Islamic education to face these challenges, such as teaching staff who do not understand multicultural education, learning materials and resources that are biased by social class, gender, ethnicity, religion, and urban areas. The purpose of this study is to determine the urgency of multicultural Islamic education, democracy and human rights in Indonesia, and to demonstrate the complexity of the challenges. The results show that multicultural Islamic education can be implemented by teachers, leaders, school members and campus communities in the 4.0 era if these stakeholders have a multicultural attitude, which is characterized by the ability to manage challenges of primordialism, ethnicity, religion and social class. The Islamic concept of Rahmatan Lil 'Alamin can be a solution and method of contemporary Islamic education practice that is in accordance with the learning material and the development of the student's soul.

Abstract

The phenomenon of underage marriage by the 5.0 Society has become a necessity, where one of the economic factors and boredom to study online as it is today during the Covid-19 pandemic has made many 5.0 people in Indonesia apply for early marriage. As a result, the phenomenon of Underage Marriage by Society 5.0 today needs special education for the nation's young people in welcoming a brighter and dignified future according to the demands of the times. The results of the study show that the phenomenon of underage marriage that occurred recently by Society 5.0 is a marriage carried out before the child enters the age of 18 years, this is as stated in Law No. 16 / 2019 About Marriage. Factors that support Society 5.0 to carry out underage marriages include Economic Factors and Factors Tired of learning online, this is because today in an all-digital era like today (the era of disruption 4.0), where people called Society 5.0 feel worried about their inability in competing through artificial intelligence technology so that the concerns of today's society's economic fulfillment are threatened. Constraints faced in the practice of underage marriage by Society 5.0 are from the physical aspect, from the cognitive aspect, the language aspect, the social aspect, and the emotional aspect, where these five aspects cause disharmony and the integrity of marriage in early childhood. The solution in responding to the phenomenon of underage marriage in the 5.0 community is that it can be done through various early prevention by parents, religious leaders, and mass organizations in order to socialize about marriage to the community through the integration of technology that is adapted to the demands of the times, such as online class training for young people, especially those under the age of 18.

Abstract

Fairness in inheritance distribution between men and women in Indonesia is still an exciting topic to discuss. It is proven that classical Islamic thought says that men's and women's portions in inheritance distribution are final, as stated in the Qur'an Surat an-Nisa verse 11. However, contemporary Islamic thought sees it as a rule that needs to be contextualized to current situations. This progressive thinking about inheritance distribution was pioneered by gender activists who saw that Fiqh Mawaris has a gender bias and discrimination. Therefore, the application of the "gender-friendly justice" concept in the inheritance distribution in Indonesia needs to be put forward. This research analyses the "gender-friendly justice" concept in inheritance law and its application in Indonesia. This study uses Sigmund Freud's gender theory, with an analytic descriptive method focusing on the problem of inheritance distribution in Indonesia. The research results prove that the concept of "gender-friendly justice" in the inheritance distribution refers to the agreement principle and the gender equity principle, where the application is carried out based on the fairness principle. The gender equality principle is implemented by prioritizing the concept of rahmatan lil'alamin, namely equality as servants and caliph of Allah, equality in receiving primordial agreements and cosmic drama events, and reaching achievements.

Abstract

This paper narrates the failure of character education (morals) in Islamic boarding schools. In the midst of globalization and the era of the industrial revolution, students are required to take part in advancing civilization in the changing times. Responding to this challenge, Miftahul Huda Islamic Boarding School (PPMH) has developed an educational model through the application of character-based holistic Islamic educational values. Through this model, students are expected to have personality, master knowledge, and noble character in accordance with religious values. This study uses descriptive research methods and a field approach, where the primary sources are obtained from observation, interviews, and documentation. The results showed: 1) The application of character-based holistic Islamic education values ​​in PPMH was carried out through the inculcation of Holistic Islamic education values ​​from an early age, namely through: a) study of the yellow book, b) Santri independence, c) Santri obedience, d) Santri's respect, e) Santri's responsibility, f) Santri's honesty, g) Santri's tolerance, h) Santri's discipline, i) Santri's mutual cooperation, j) Santri's concern, k) Santri's cooperation, l) Santri's courage, and m) democracy; 2) The relevance of instilling the values ​​of character-based holistic Islamic education in PPMH can be used as a medium in the context of preventing santri radicalism. This application is carried out through the integration of the pesantren curriculum by studying classical books in the context of tafaqquh fiddiin, and trying to realize it in the form of daily practice with habituation and practice accompanied by exemplary examples from teachers, ustadz, or kiai.

Abstract

This research departs from a juridical confusion regarding the ideal of a person going to get married, where the age of marriage with other provisions regarding age, namely in terms of the philosophical Materialism and Idealism of Marriage Age in Indonesia. Whereas in Indonesian Law on Marriage Marriage is only permitted if men and women have reached the age of 19 (nineteen) years. The purpose of this study is to find out the philosophical review of materialism and idealism of marriage age in Indonesia, with the article 7 paragraph (1) for 16 of 2019 jo. u 1 year 1974 regarding marriage). The conclusion of this study is the philosophical value of materialism and idealism of marriage age is the concept of historical materialism of humans who will choose the readiness of themselves in the face of marriage, this is because one's age is not a reference, which is the basis for people to get married including self-readiness to face material livelihood, readiness self and material. Likewise in Indonesia, the ideal age in society in Indonesia if it is connected with Karl Mark's theory, then the readiness of oneself in the material (economic elements) is as a reference for people to get married.

Abstract

This study aims to determine Islamic philanthropy in a modern context. Islamic philanthropy is taken from the religious doctrine of the Qur'an and hadith as a human and religious commitment so that Islamic charity appears as zakat, infaq, alms, and endowments. This type of research is qualitative with a literature study method. Data collection techniques in literature study are through books, articles, journals, and research reports related to the problem being researched. The results of the study found that in Indonesia, practices in zakat, waqf, infaq, and sadaqah (Ziswaf) are seen as economic symbols of justice and democracy, being able to place economic resources in their proper place. In conclusion, Islamic philanthropy in the modern context is a stylish way of managing one's social generosity in the context of carrying out muamalah activities among fellow human beings.

Abstract

Online gambling has become a rapidly growing issue, leading to financial losses and mental health challenges. In Malaysia, online gambling is regulated under progressive Islamic law which focuses on social justice, while Indonesia struggles with weak enforcement despite existing regulations. This study discusses three main parts: first, current online gambling regulation in Indonesia and Malaysia; second, Malaysia’s progressive legal experience as a blueprint for Indonesia; and third, social justice and SDGs-based online gambling regulation for Muslim-majority countries. A qualitative approach, including case studies, in-depth interviews with legal experts, and document analysis in both countries, was employed. The findings show that Malaysia’s implementation of progressive Islamic law has been effective in managing online gambling, promoting social justice, and reducing financial and mental health impacts. In contrast, weak law enforcement in Indonesia exacerbates the social issues related to online gambling. The research concludes that Malaysia’s approach has successfully regulated online gambling and supported SDG achievement. Therefore, Indonesia should consider adopting more progressive Islamic legal principles to enhance law enforcement and reduce the social harms of online gambling.

Abstract

The development of digital technology has opened the door to various forms of digital crime, including schemes involving fictitious job offers, illegal crypto investments and fake refunds that financially harm victims and potentially lead to money laundering offenses. This article examines digital fraud in Indonesia by comparing Islamic criminal law (Fiqh Jinayah) with Indonesian positive law. This normative juridical research employs statutory, conceptual, comparative, and case study approaches. The findings reveal that the “Remote Mining Network” case illustrates how perpetrators exploit digital anonymity to evade legal oversight. Such practices violate Islamic legal norms, including the prohibitions against gharar (uncertainty) and tadlis (deception), which align with the elements of fraud as defined in the Indonesian Penal Code and the Law on Electronic Information and Transactions. The article concludes that both Islamic and national criminal law aim to protect public interests and individual property rights (hifz al-mal). This study contributes to the development of contemporary fiqh jinayah, while also supporting efforts to enhance legal literacy and protect Muslim communities from the risks of digital crime, in accordance with the principle of hifz al-mal within the framework of maqaṣid al-shari‘ah.

Abstract

This study examines the welfare issues of private university lecturers in Indonesia who receive substandard wages, by analyzing them through the perspectives of Islamic law and positive law. The objective of this paper is to explore the alignment between the principles of wage justice in Islamic law and the wage regulations within the national legal framework, especially concerning employment in the private higher education sector. The methodology employed is normative juridical with a qualitative analysis of legal documents and Islamic legal literature. The findings indicate that private lecturers are employed under contractual agreements subject to labor regulations, which often fail to provide adequate welfare guarantees. On the other hand, Islamic law emphasizes justice, fairness, and certainty in wage distribution as part of workers' rights protection. The main novelty of this study lies in identifying the gap between the normative ideals of Islamic law and the practical enforcement of positive law in the higher education context. The impact of this research is to propose an integrative legal approach that incorporates Islamic ethical values into wage regulation policies, aiming to improve the socio-economic well-being of academic professionals in Indonesia. Abstrak: Penelitian ini mengkaji permasalahan kesejahteraan dosen perguruan tinggi swasta (PTS) di Indonesia yang menerima upah di bawah standar, dengan meninjau dari perspektif hukum Islam dan hukum positif. Tujuan dari studi ini adalah untuk menggali kesesuaian prinsip-prinsip keadilan upah dalam hukum Islam dengan pengaturan pengupahan dalam sistem hukum nasional, khususnya terhadap tenaga kerja di sektor pendidikan tinggi swasta. Metodologi yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif dengan analisis kualitatif terhadap dokumen hukum dan literatur keislaman. Hasil kajian menunjukkan bahwa dosen PTS memiliki status hubungan kerja berdasarkan perjanjian kerja yang tunduk pada aturan ketenagakerjaan, yang dalam praktiknya belum memberikan jaminan kesejahteraan yang memadai. Sementara itu, hukum Islam menekankan keadilan, kelayakan, dan kepastian dalam pemberian upah sebagai bagian dari perlindungan hak pekerja. Temuan utama dari penelitian ini menunjukkan adanya kesenjangan antara idealisme hukum Islam dan implementasi hukum positif di sektor pendidikan tinggi. Studi ini memberikan kontribusi dengan menawarkan pendekatan integratif antara hukum Islam dan hukum ketenagakerjaan untuk mendorong formulasi kebijakan pengupahan yang lebih adil dan berorientasi pada kesejahteraan akademisi di Indonesia. Abstract

The largest state income in Indonesia is tax. So it is necessary to study the allocation and distribution of these taxes from the perspective of Islamic economics, this is because Indonesia has the largest Muslim population in the world. Indonesian state income from an Islamic economic perspective is very important, this is because the Islamic economy in Indonesia currently has great opportunities in its development aspect. Especially at this time, it has been recorded in the history of the economy in Indonesia as evidence of the development of the Islamic economy in Indonesia, including the existence of the embodiment of the National Money Waqf Movement and the Islamic Economic Brand. The purpose of this study aims to reveal about: the allocation and distribution of state revenues from the perspective of Islamic Economics on Existence (Sharia Economic Brand and Cash Waqf); and its relevance in Indonesia in the current era (4.0). The method used in this research is library research whose sources are in the form of library data in the form of various books, journals, internet, and also other sources relevant to the theme of allocation and distribution of state income in Islam. The results show that the allocation and distribution of state revenues, when viewed from the perspective of Islamic Economics, has the concept of Rahmatan Lil 'Alamin, meaning equal distribution of ability or income for the community that can be applied in Indonesia, one of which is through the national movement of cash waqf and the Islamic economic brand.
