Abstract

This article discusses the proposed transformation for the Office of Religious Affairs (KUA) towards inclusive marriage registration in Indonesia. This proposal, submitted by the Minister of Religion, raises various questions and challenges regarding the effectiveness and relevance of this policy. Through a qualitative approach with literature studies and document analysis related to marriage registration policies, this article identifies criticisms directed at the Minister of Religion's proposal as well as practical challenges in its implementation. The results of the analysis show that there are various responses from the community and related parties to the transformation of the KUA, with criticism stating the relevance, effectiveness and social impact of the policy. Practical challenges in implementation include regulatory changes, increasing human resource capacity, and integration with other institutions in population administration. However, with a careful approach, the KUA has the opportunity to become an inclusive and effective marriage registration center in Indonesia.

Abstract

This study investigates the integration of QRIS (Quick Response Code Indonesian Standard) in mosque architecture as both a digital innovation and a cultural intervention. Using qualitative case studies of three iconic mosques in Indonesia: Al-Jabbar (Bandung), Sheikh Zayed (Solo), and Hubbul Wathan (Lombok), the research analyzes how QRIS impacts visitor experience, philanthropic participation, and the preservation of architectural and cultural values. Drawing on theories of technology acceptance, vernacular architecture, and experiential learning, the study finds that QRIS can enrich mosque functionality without disrupting sacred spatial aesthetics. It also reveals the importance of inclusive design in ensuring that digital tools benefit diverse visitor groups. While emphasizing the transformative potential of QRIS, the study also notes challenges related to digital literacy and infrastructural disparities. This research contributes to current debates on digital heritage, smart religious spaces, and the adaptive use of technology in sustaining Islamic cultural identity.

Abstract

This study explores the development of waqf-based halal tourism as an innovative and sustainable model within Islamic economic law, using Teras Lembang in West Java as a case study. The primary issue identified is the limited exploration of how Islamic legal principles guide the productive use of waqf in halal tourism. Using a qualitative case study approach with normative juridical analysis, the study applies Ibn Qayyim al-Jawziyyah’s theory of legal change as a middle theory, supported by the concept of maslahah mursalah from al-Ghazālī and al-Shāṭibī, and Yusuf al-Qaradawi’s theory of halal. Data were collected through interviews, field observations, and literature review. Results show that the management of waqf-based halal tourism reflects sharia principles such as justice, transparency, and trustworthiness, while also contributing to local socio-economic empowerment through MSME growth, job creation, and increased community involvement. However, challenges such as regulatory fragmentation and low public literacy on waqf remain. This article concludes that aligning Islamic legal norms with tourism policies can enhance the legitimacy and sustainability of halal tourism. Policy recommendations include strengthening sharia supervisory institutions and integrating halal certification systems into tourism governance.

Abstract

Strengthening the normative foundation and maqāṣid orientation of Indonesia’s religious court system allows it to render fair judgments for the parties while safeguarding the future of children. While Islamic family law is often studied normatively, limited attention is given to its lived application in plural legal settings. Using a descriptive qualitative approach with socio-legal and phenomenological methods, data were collected through purposive sampling of 20 participants, including traditional leaders, religious figures, and village officials. Field observations and the analysis of local documents, including customary manuscripts, sermons, and marriage records, serve to complement the data. The findings reveal that family resilience emerges from a dynamic interplay between Islamic and customary norms, particularly in areas like inheritance, marriage, and gender roles. Integration of maqāṣid al-sharī‘ah occurs through contextual reinterpretation aligned with communal structures and values. Differences between the communities are notable in the role of traditional authority, the interpretation of qiwāmah, and dispute resolution mechanisms. This study contributes to the discourse on Islamic legal pluralism by presenting a contextual model of normative integration. It highlights the potential of a culturally grounded and adaptive Islamic legal framework to strengthen sustainable family systems across diverse local contexts.

Abstract

Retirement preparedness among non-civil servant lecturers in Indonesia has emerged as a critical issue due to the absence of comprehensive institutional pension schemes. This study critically examines the role of fatwas issued by the Dewan Syariah Nasional–Majelis Ulama Indonesia (DSN-MUI) in shaping Islamic retirement financial planning, employing a Maqāṣid al-Sharīʿah framework. It focuses particularly on fatwas related to sharia investment, partnership contracts (muḍārabah and mushārakah), and Islamic capital market practices. Using a qualitative socio-legal approach, this research integrates normative analysis of DSN-MUI fatwas with empirical data from interviews with non-civil servant lecturers across several regions in Indonesia. The findings reveal a normative–practical gap: while DSN-MUI fatwas provide comprehensive ethical and legal guidance for halal financial planning, their application in retirement strategies remains partial and adaptive. Lecturers tend to adopt halal investment, productive assets, and entrepreneurial activities; however, these practices are not always directly grounded in specific fatwa reasoning but are mediated by general Islamic economic ethics. From a maqāṣid perspective, this reflects the realization of ḥifẓ al-māl, yet also indicates limitations in the operationalization of fatwa authority in everyday financial decision-making. This study argues that DSN-MUI fatwas function not only as doctrinal legal products but also as instruments of financial governance whose effectiveness depends on institutional dissemination and socio-economic context. By highlighting the gap between normative fatwa frameworks and lived financial practices, this research contributes to contemporary fatwa discourse, particularly in strengthening the role of fatwa governance in Islamic retirement planning and financial policy development.

Abstract

Marriage in Shawwal among Indonesian Muslim communities reflects a dialectic between normative Islamic guidance and local traditions. Some communities, such as Javanese and Madurese, recommend Shawwal weddings as reinforcement of the Prophet’s sunnah, while others, such as Minangkabau and Javanese primbon traditions, avoid them due to taboos. This study aims to explain these divergent views and clarify how religious texts and customs interact in socio?religious practice. The research employed a qualitative approach through document analysis, semi?structured interviews, participant observation, and administrative data (SIMKAH, Karanganyar Religious Affairs Office). Data were analyzed using Miles & Huberman’s interactive model to identify themes and patterns. Findings reveal that Shawwal marriages are interpreted in two ways: as recommendations reinforcing religious identity or as prohibitions affirming the binding power of custom. This synthesis demonstrates that religious practice is always negotiated between das sollen (normative Islam) and das sein (social reality). The study contributes theoretically by clarifying the interaction between Islamic texts and local traditions in shaping socio?religious practice, and practically by offering a foundation for moderate approaches that respect Islamic principles while accommodating cultural heritage. The novelty lies in its comparative lens, systematically contrasting recommendation and prohibition within the same month and linking the Indonesian case to global Scopus?indexed scholarship. [Pernikahan di bulan Syawal dalam masyarakat Muslim Indonesia memperlihatkan dialektika antara panduan normatif Islam dan tradisi lokal. Sebagian komunitas, seperti Jawa dan Madura, menganjurkan pernikahan di bulan Syawal sebagai penguatan sunnah Nabi Muhammad SAW, sementara komunitas lain, seperti Minangkabau dan tradisi primbon Jawa, menghindarinya karena dianggap tabu. Penelitian ini bertujuan menjelaskan perbedaan pandangan tersebut serta menegaskan bagaimana teks agama dan adat berinteraksi dalam praktik sosial?religius. Metode penelitian menggunakan pendekatan kualitatif dengan analisis dokumen, wawancara semi?terstruktur, observasi partisipan, dan data administratif (SIMKAH, KUA Karanganyar). Analisis dilakukan dengan model interaktif Miles & Huberman untuk mengidentifikasi tema dan pola. Hasil penelitian menunjukkan bahwa pernikahan di bulan Syawal dipahami secara beragam: sebagai anjuran yang memperkuat identitas keagamaan, atau sebagai pantangan yang menegaskan daya ikat adat. Sintesis ini menegaskan bahwa praktik keagamaan selalu dinegosiasikan antara das sollen (normatif Islam) dan das sein (realitas sosial). Kontribusi penelitian ini bersifat teoretis dengan memperjelas interaksi teks Islam dan adat dalam membentuk praktik sosial?religius, serta praktis dengan menawarkan dasar bagi pendekatan moderat yang menghormati prinsip Islam sekaligus mengakomodasi tradisi lokal. Kebaruan penelitian terletak pada lensa komparatif yang secara sistematis mengontraskan anjuran dan pantangan dalam bulan yang sama, serta mengaitkannya dengan literatur global berstandar Scopus.]

Abstract

The rapid growth of halal tourism has generated increasing global attention toward governance models that integrate religious values with sustainable and accountable public policy frameworks. As Muslim-friendly tourism expands across diverse jurisdictions, regulatory implementation often faces structural, institutional, and coordination challenges. In Indonesia, the Central Java Governor Regulation No. 40 of 2023 on Muslim-Friendly Tourism seeks to regulate halal services, worship facilities, and information transparency to accommodate Muslim travelers. This study evaluates the implementation of this regulation in Pekalongan City using a juridical-empirical approach. Data were collected through 12 in-depth interviews with key stakeholders, including tourism actors, religious leaders, and government officials, complemented by field observations. The findings reveal that although the regulation formally reflects Islamic legal values, particularly maq??id al-shar?‘ah, its implementation remains suboptimal due to weak inter-agency coordination, limited public literacy, and the absence of measurable evaluation indicators. This study proposes a Maq??id-based collaborative governance model that integrates Islamic legal objectives, consumer protection principles, and cross-sectoral coordination mechanisms. The model contributes to the broader discourse on halal tourism governance by offering an analytically grounded framework for strengthening accountability, stakeholder collaboration, and policy sustainability in Muslim-friendly tourism regulation.
