Abstract

Pembahasan tentang kewarisan di Indonesia masih menjadi persoalan yang sering menjadi perbedatan. Dimana dalam hukum Islam sebagaimana disinggung dalam Al-Qur’an surat an-Nisa ayat 11 Pembagian waris yakni 1:2, namun hal ini dirasa belum adil, sehingga keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia perlu dikedepankan. Tujuan penelitian ini adalah untuk membahas tentang prinsip-prinsip keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia. Melalui pendekatan teori maslahah Ibnu Qayyim Al-Jauziyah, peneliti memusatkan perhatian pada masalah pembagian waris yang berlaku di Indonesia dan pendistribusianya dilaksanakan secara berkeadilan (maslahah). Penelitian ini menyimpulkan bahwa : 1) prinsip-prinsip keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia adalah konsep berdasarkan prinsip kesepakatan (musyawarah); 2) penerapan prinsip-prinsip keadilan berbasis ramah gender (maslahah) dalam pembagian warisan di Indonesia dapat dilakukan dengan cara menerapkan Prinsip kesetaraan gender secara Islami yakni dengan mengedepankan konsep rahmatan lil’alamin. Discussion of inheritance in Indonesia is still an issue that often becomes a matter of debate. Where in Islamic law as alluded to in the Qur'an letter an-Nisa verse 11 the distribution of inheritance is 1: 2, but this is felt to be unfair, so that gender-friendly based justice (maslahah) in the distribution of inheritance in Indonesia needs to be put forward. The purpose of this study is to discuss the principles of gender-friendly justice (maslahah) in inheritance distribution in Indonesia. Through the maslahah theory approach of Ibn Qayyim Al-Jauziyah, the researcher focuses on the problem of inheritance distribution that applies in Indonesia and its distribution is carried out in a fair manner (maslahah). This study concludes that: 1) the principles of gender-friendly justice (maslahah) in the distribution of inheritance in Indonesia are concepts based on the principle of agreement (deliberation); 2) application of the principles of gender-friendly justice (maslahah) in the distribution of inheritance in Indonesia can be carried out by applying the principle of Islamic gender equality by prioritizing the concept of rahmatan lil'alamin.

Abstract

Purpose - This research aims to analyze the application of Maqāṣid al-Sharīʿah principles according to al-Shatibi in the context of the halal lifestyle in the digital era. The main focus of this research is how digital technology, such as halal e-commerce platforms and digital halal marker applications, can facilitate access and transparency of halal products. In addition, this study examines the relevance of Maqāṣid al-Sharīʿah principles in the contemporary Islamic legal framework in facing the challenges of regulation and validity of halal information. Methods - This research uses a qualitative method with a literature review approach and case analysis. Data is collected through literature studies related to digital halal regulations and studies on technology implementation in supporting halal lifestyles. Findings - The results show that digital technology plays a role in strengthening halal lifestyles through innovations that increase accessibility and transparency. However, challenges such as unverified information, evolving regulations, and potential deviations from Shariah principles must be addressed. Collaboration between government, industry, and society is key to overcoming these challenges. Contribution/Limitation - This research contributes to understanding the relationship between Maqāṣid al-Sharīʿah, digital technology, and contemporary Islamic law in supporting halal lifestyle. However, this research is still limited to literature analysis and does not include empirical research on halal technology users in Indonesia. Originality/Value - This research offers new insights into the integration of technology in the principles of Maqāṣid al-Sharīʿah in contemporary Islamic law.

Abstract

This study examines the impact of budget efficiency policies on labor in the hospitality industry in West Java, focusing on employee reductions in hotels and restaurants. In 2025, the Indonesian government's budget cuts aimed at reducing the fiscal deficit severely impacted the hospitality sector, which relies on government-funded activities like seminars and official travel. Using interviews and secondary data, the study found a sharp decline in hotel occupancy rates, leading to financial difficulties and an estimated 40,000 layoffs. The findings highlight the need for policy adjustments, including financial support for businesses and targeted recovery plans for SMEs, to ensure long-term stability in the region’s hospitality industry.

Abstract

This study aims to analyze the economic impact of the 2025 Los Angeles wildfires through the lens of Islamic law, focusing on its application for disaster management, social justice, and supporting Sustainable Development Goals (SDGs), particularly SDG 13 (Climate Action) and SDG 8 (Decent Work and Economic Growth). Using Islamic legal principles such as maslahah (public interest), adl (justice), tawhid (unity), and takaful (mutual protection), the research explores their role in disaster recovery and economic redistribution. A qualitative approach is adopted, employing a case study of the 2025 wildfires, with an analysis of Islamic legal documents, expert interviews, and post-disaster policy reviews. The study finds that Islamic law offers practical instruments such as zakat (charity), qard al-hasan (interest-free loans), and takaful to aid recovery, while emphasizing collective responsibility in rebuilding after disasters. The research highlights how these Islamic principles can guide disaster recovery, promoting fair and sustainable practices in line with the SDGs. By integrating Islamic law into disaster management, the study offers unique solutions for equitable recovery efforts post-disaster. This research provides valuable insights into using Islamic law to create a more just and sustainable economic recovery framework in the face of natural disasters.

Abstract

Purpose – This study explores the transformation of zakat distribution principles as outlined in Nahdlatul Ulama’s Fatwa Bahtsul Masail and its implications for Indonesia's legal regulations. The goal is to understand how these principles can enhance zakat management by addressing social inequality and poverty alleviation.Methodology – A normative juridical approach was used, with a descriptive analytical study based on a literature review. The research focuses on four main aspects: analyzing zakat distribution principles in the context of Indonesian law, examining the legal reasoning (istinbath hukum) behind these principles, identifying factors driving and hindering the transformation, and assessing the significance of implementing these principles in Indonesian legal frameworks.Findings – This study identifies three main principles—justice, equality, and regionality—that should be integrated into regulatory frameworks. It also highlights challenges, including a lack of public participation in zakat distribution through official institutions, such as NU CARE-LAZISNU.Implications – The findings suggest the need for increased socialization of zakat management principles by the National Amil Zakat Agency (Badan Amil Zakat Nasional, BAZNAS), based on both Sharia and secure legal regulations, to enhance the effectiveness of zakat management in Indonesia.Originality – This research provides valuable insights into the evolving principles of zakat distribution and their integration into legal frameworks, contributing to the adaptation of zakat management practices to contemporary challenges in Indonesia.

Abstract

Penelitian ini bertujuan untuk mengetahui wakaf uang dalam pandangan hukum ekonomi syariah di era revolusi industri 4.0. Latar belakang : pemahaman masyarakat Indonesia terkait Wakaf uang masih minim. Padahal wakaf ini memiliki potensi yang besar guna mensejahterakan masyarakat Indonesia. Kebaruan Penelitian : terkait penelitian perspektif hukum ekonomi syariah tentang wakaf uang di era revolusi industri 4.0 belum ada yang meneliti. Metode Penelitian : Metode yang digunakan adalah penelitian kepustakaan, kualitatif, dengan pendekataan perundang-undangan, sejarah, perbandingan dan konseptual serta penelitian ini bersifat normatif.Hasil Temuan : pandangan Ekonomi Syariāh di Indonesia terkait wakaf uang dilakukan sebagaimana UU No.41/2004 tentang wakaf dimana benda bergerak yakni dalam “Wakaf benda bergerak” yang dimanifestasikan berupa uang. Kesimpulan : Wakaf uang di Indonesia di Era revolusi Industri 4.0 dapat mensejahterahkan perekonomian masyarakat dan juga negara. Wakaf diposisikan sebagai ibadah sosial dimana dengan wakaf dalam UU no.41/2004 tentang wakaf pasal 1 dijelaskan wakaf yaitu perbuatan seorang wakif guna memisahkan atau menyerahkan sebagaian harta bendanya guna dimanfaatkan selamanya utnuk kepentingan peribadatan dan juga untuk keperluan kesejahteraan menurut syariah islam.

Abstract

This study examines the practice of qardhul hasan funded by zakat through the perspective of maqasid sharia, focusing on case studies in Indonesia and Malaysia. Qardhul hasan, defined as an interest-free loan, presents a promising method for effectively utilizing zakat funds; however, its implementation within the framework of Islamic law remains a subject of ongoing debate. A qualitative approach was employed, including content analysis and semi-structured interviews with experts in zakat and Islamic law. The findings indicate that maqasid sharia provides a strong foundation for implementing qardhul hasan, particularly in supporting post-pandemic economic recovery. It is crucial to establish clear parameters and guidelines to ensure that qardhul hasan practices adhere to sharia principles and achieve the goal of social justice. This research advances the current understanding of qardhul hasan by highlighting its potential impact on zakat management and economic recovery. Additionally, it encourages zakat policymakers and practitioners to focus on developing effective systems aligned with maqasid sharia and emphasizes the need for ongoing evaluation and trials to enhance zakat's role in societal welfare.

Abstract

On the one hand, in the 4.0 era, contemporary Islamic education cannot avoid the phenomenon of interrelationships between human beings in the increasingly intensive and pluralistic systems of technology, information and communication. This era demands the practice of Islamic education with a multicultural perspective, democracy and human rights. On the other hand, there is an unpreparedness in the practice of Islamic education to face these challenges, such as teaching staff who do not understand multicultural education, learning materials and resources that are biased by social class, gender, ethnicity, religion, and urban areas. The purpose of this study is to determine the urgency of multicultural Islamic education, democracy and human rights in Indonesia, and to demonstrate the complexity of the challenges. The results show that multicultural Islamic education can be implemented by teachers, leaders, school members and campus communities in the 4.0 era if these stakeholders have a multicultural attitude, which is characterized by the ability to manage challenges of primordialism, ethnicity, religion and social class. The Islamic concept of Rahmatan Lil 'Alamin can be a solution and method of contemporary Islamic education practice that is in accordance with the learning material and the development of the student's soul.

Abstract

The phenomenon of underage marriage by the 5.0 Society has become a necessity, where one of the economic factors and boredom to study online as it is today during the Covid-19 pandemic has made many 5.0 people in Indonesia apply for early marriage. As a result, the phenomenon of Underage Marriage by Society 5.0 today needs special education for the nation's young people in welcoming a brighter and dignified future according to the demands of the times. The results of the study show that the phenomenon of underage marriage that occurred recently by Society 5.0 is a marriage carried out before the child enters the age of 18 years, this is as stated in Law No. 16 / 2019 About Marriage. Factors that support Society 5.0 to carry out underage marriages include Economic Factors and Factors Tired of learning online, this is because today in an all-digital era like today (the era of disruption 4.0), where people called Society 5.0 feel worried about their inability in competing through artificial intelligence technology so that the concerns of today's society's economic fulfillment are threatened. Constraints faced in the practice of underage marriage by Society 5.0 are from the physical aspect, from the cognitive aspect, the language aspect, the social aspect, and the emotional aspect, where these five aspects cause disharmony and the integrity of marriage in early childhood. The solution in responding to the phenomenon of underage marriage in the 5.0 community is that it can be done through various early prevention by parents, religious leaders, and mass organizations in order to socialize about marriage to the community through the integration of technology that is adapted to the demands of the times, such as online class training for young people, especially those under the age of 18.

Abstract

This paper narrates the failure of character education (morals) in Islamic boarding schools. In the midst of globalization and the era of the industrial revolution, students are required to take part in advancing civilization in the changing times. Responding to this challenge, Miftahul Huda Islamic Boarding School (PPMH) has developed an educational model through the application of character-based holistic Islamic educational values. Through this model, students are expected to have personality, master knowledge, and noble character in accordance with religious values. This study uses descriptive research methods and a field approach, where the primary sources are obtained from observation, interviews, and documentation. The results showed: 1) The application of character-based holistic Islamic education values ​​in PPMH was carried out through the inculcation of Holistic Islamic education values ​​from an early age, namely through: a) study of the yellow book, b) Santri independence, c) Santri obedience, d) Santri's respect, e) Santri's responsibility, f) Santri's honesty, g) Santri's tolerance, h) Santri's discipline, i) Santri's mutual cooperation, j) Santri's concern, k) Santri's cooperation, l) Santri's courage, and m) democracy; 2) The relevance of instilling the values ​​of character-based holistic Islamic education in PPMH can be used as a medium in the context of preventing santri radicalism. This application is carried out through the integration of the pesantren curriculum by studying classical books in the context of tafaqquh fiddiin, and trying to realize it in the form of daily practice with habituation and practice accompanied by exemplary examples from teachers, ustadz, or kiai.
