Abstract

ABSTRACT Thoughts in Islamic economic theology in the 4.0 era as now in Indonesia adhere to economic freedom, meaning that this freedom is required to always be Muslim-friendly. This research method uses the Library Research method and collects data obtained by means of a literature study from books and journals relevant to the study of the theological conception of Islamic Economics in Indonesia Era 4.0. The findings prove that Islamic Economic Theological Thought Concept of Islamic Economic Theological Thought is a concept formed in order to realize the aspirations of Muslims regarding economic issues in which the concept of Islamic economic theology has a significant effect on its adherents in concrete life. Such as bermu'amalah in terms of Islamic legal politics, Islamic Economic Politics, development strategies in halal tourism, halal food, cash waqf transactions and so on. Regarding independence from lust as a form of effort to escape from the shackles of human (negative) lust, it means that humans as human beings are required to always use their minds. Islamic Economics as a Choice for a Muslim for several reasons, namely the principles adopted by the theological concepts that are adopted by the Islamic economic community itself, especially in Indonesia.

Abstract

Dalam artikel ini penulis mencoba mengekplorasi bagaimana konstruksi epistemologi Islam, melalui satu telaah dalam bidang fiqh dan usul fiqh mengenai Teori Mushawwibah dan Mukhaththiah dalam Ushul Fiqh. Pemahaman terhadap masalah ini sangat penting, mengingat saat ini begitu banyak kalangan yang menyerukan perlunya pambaruan dalam bidang fiqh dan usul fiqh akibat meluapnya serbuan ilmu-ilmu dari sosial Barat. Kita dituntut untuk tidak terburu-buru menolak yang baru dan juga tidak meninggalkan khazanah keilmuan Islam klasik, sebelum memahaminya dengan baik dan benar dengan Teori Mushawwibah dan Mukhaththiah dalam Ushul Fiqh ini. Ushul Fqh lebih mampu memasuki sisi-sisi persoalan hukum yang berkaitan dengan perilaku umat Islam. Sehingga Bagi pengikut teori mushawwibah dijelaskan bahwa semua kesimpulan yang beda-beda itu, yang benar tidaklah satu, bahkan bisa juga semuanya benar. Demikian jika semua mujtahidnya menampilkan kerangka berfikir yang sejalan dengan jalur ushul-fiqh. Sedangkan pengikut mukhaththiah berpendapat bahwa semua kesimpulan yang banyak itu, yang benar cuma satu saja, apalagi jika beberapa kesimpulan tadi ada nilai kontradiktifnya. Metode yang digunakan adalah penelitian kepustakaan, kualitatif, dengan pendekataan perundang-undangan, sejarah, perbandingan dan konseptual serta penelitian ini bersifat normatif. Penelitian ini ditemukan bahwa Islam mengkaji semua teks baik yang tersirat dalam al-Qur’an maupun al-Hadits, baik yang berbentuk zhanni (dugaan), dengan demikian maka makna yang muncul dari teks itu selalu dirumuskan dalam kesimpulan yang berbeda-beda, artinya masih mukhtalaf fih atau perbedaan pendapat. Dalam kajian yang ditawarkan oleh Teori mushawwibah dijelaskan bahwa semua kesimpulan yang beda-beda itu, yang benar tidaklah satu, bahkan bisa juga semuanya benar. Demikian jika para mujtahid dalam menampilkan kerangka berfikir yang sejalan dengan kaidah ushul-fiqh. Berbeda dengan teori mukhaththiah yang berpendapat bahwa semua kesimpulan yang banyak itu tadi, maka yang benar hanyalah satu saja, hal ini dikarenakan jika beberapa kesimpulan ada memiliki nilai kontradiktif. Penilaian semacam itu muncul karena ushul fiqh atau kerangka berfikir fiqh memanfaatkan penalaran subjektif dan paradigma kualitatif. Penalaran jenis ini kurang begiitu memiliki kebenaran pada tingkat tertentu. Kebenaran ushul fiqh dianggap diada-adakan dan sifat kebenarnnya itu bersifat spekulasi.

Abstract

In Indonesia, sharia economic law is implemented through Religious Courts which have an important role in resolving disputes involving sharia financial entities such as banks, microfinance institutions, and insurance. Law Number 3 of 2006 replaces Law Number 7 of 1989 which significantly expands the authority of the Religious Courts in supervising and enforcing sharia economic principles. Sharia economics, which is based on Islamic values ​​such as justice, honesty, and legal certainty, forms an economic and financial system that is different from conventional systems. Religious Court Judges strive to balance ethical and practical considerations in carrying out their judicial duties. This research examines how ethical perspectives and practical considerations contribute to achieving legal certainty and justice in resolving sharia economic disputes, especially in the Surabaya Religious Court. This research uses a normative juridical approach using legal utility theory to analyze the challenges faced and propose strategies to increase the effectiveness of implementing simple, efficient, and cost-effective principles in Sharia economic protection at the Surabaya High Religious Court. The research results consider the principles of maqasid al-syariah to simplify the process, lighten the burden on the parties involved, and uphold justice in every decision-making. This study emphasizes the need for better integration between Islamic Sharia principles and Sharia banking practices in Indonesia, as well as encouraging reforms to ensure that legal outcomes provide fair justice and maximum social benefits, in line with the ethical and utilitarian aims of the law.

Abstract

The purpose of this study is to reveal the sharia compliance of the halal tourism business in Bandung Regency, where halal tourism in its implementation must be carried out by prioritizing the principles of Islamic business ethics (Professional Ethics), meaning that the principles of Islamic business ethics in the context of halal tourism in Bandung Regency must submissive (obedient) in a syar'i, especially in promoting the principles of Islamic business ethics, namely by prioritizing Islamic services with the aim of providing comfort for Muslim tourists in particular. In addition, the principles of Islamic service are expected to be able to realize professional ethics in doing business in an Islamic way, especially in carrying out halal tourism activities, especially for tourism industry players in Bandung Regency. This literature review uses the theory of Islamic business ethics as coined by Hamid Salam and Abdalla Hanafi including: a) Ethics to always convey the truth; b) Ethics to be trusted; c) Ethics to do something sincerely; d) Brotherhood ethics; e) Mastery of science; f) Ethics of Justice. The findings of this study are the principles of Islamic business ethics (professional ethics) in the implementation of the halal tourism business in Bandung Regency referring to the Bandung Regency Regional Regulation (Perda) Number 6 of 2020 concerning Halal Tourism, where there are several principles that must be met in running tourism. Halal in Bandung district which includes: a). set as needed; b). facilitate; c). according to ability; d). gradually; e). priority scale; and f). Inclusive. In addition, there is the concept of the Code of Ethics for Tourism (GCET) or the Global Tourism Code of Ethics as a reference for sustainable tourism development in Bandung Regency which includes economic, social, cultural, and environmental components. This is because Indonesia is not an Islamic country but a country where the majority of the population is Muslim, so it is necessary to prioritize the values of Rahmatan lil 'Alamin in business (muamalah), especially in terms of additional service activities in halal tourism in Bandung Regency. In addition, indicators of sharia compliance in halal tourism in Bandung district are referring to 2 regulations, namely local regulations (perda) Bandung district number 6 of 2020 concerning halal tourism, and DSN-MUI fatwa No: 108/DSN-MUI/2016 concerning guidelines for tourism implementation. based on sharia principles.

Abstract

The concept of ethics from Ghazali's perspective, especially regarding the existence of Islamic ethics, is based on good morals or noble character, so this concept needs to be applied in a pluralistic Indonesian society. Where in this case, within the frame of moderation of religion-based morality in Indonesia in the current era, the application of morality as offered by Ghazali is a must; this is because, in the concept of religious moderation in Indonesia, there are Islamic values that reflect good morals, namely in the form of attitude 1 ) tolerance, 2) non-violence, 3) acceptance of tradition, and 4) high national commitment. This research is a type of library research whose object of study uses library data in the form of books, journals, and other relevant sources of literature as the data source. Besides that, the researcher reads, reviews, and analyzes the existing literature to conclude. This research concludes that Ghazali's relevance regarding Islamic ethics in the framework of moderation of religion-based morality in Indonesia. The present era is relevant; this is proven by prioritizing Islamic ethics will manifest karimah (beginning) morals, then, in the end, will embody Islamic values rahmatan lil natural in all human activities.

Abstract

The development of Islamic law in Indonesia, particularly concerning apostasy as a cause of divorce, is significant in the evolution of Islamic law. The complexity of Indonesia's social and legal system poses challenges in integrating Islamic values with societal diversity. This research aims to understand the development of Islamic law in Indonesia regarding apostasy issues through the analysis of maqasid sharia. Using a descriptive-analytical approach, data from various sources are examined to understand the development of Islamic law in Indonesia, focusing on the implications of maqasid sharia regarding apostasy as a reason for divorce. Findings indicate that progressive Islamic law development in Indonesia emphasizes a balance between religion and individual justice, protecting individual rights in divorce and seeking fair solutions through legal reforms considering the principles of maqasid sharia.

Abstract

The purpose of this study is to analyze the reconstruction of Islamic sharia implementation policies during the Islamic Empire in Indonesia from the perspective of siyasah syar'iyyah and their relevance to Indonesian government policies in regulating Islamic financing instruments in Cash Waqf Linked Retail Sukuk (CWLS Retail). The statutory approach and descriptive analysis are used in this research. Sources of data were obtained from various literary materials both from books, journals and the internet, as well as other relevant sources regarding the politics of Islamic law (siyasah syar'iyyah) during the Islamic period and its relevance to the regulation of Islamic financing instruments in Indonesia, especially with regard to the application of retail sukuk cash waqf (CWLS Retail). The results of the study show that first, the political application of Islamic law during the Islamic empire in Indonesia was carried out through the politics of the king's power (ruler). Second, the application of political Islamic law has relevance to current Indonesian government policies, namely in regulating Islamic financing instruments for Cash Linked Retail Sukuk (CWLS Retail), where the Government through various Islamic policies is embodied through laws, government regulations, MUI Fatwa, and other regulations. However, implementing this policy requires 6 variables of Islamic politics (siyasah syar'iyyah) in the opinion of Ibn Khaldun, namely mutual synergy between law, government, society, economy, development and justice.

Abstract

The Qawa'id fiqhiyyah al-Masyaqqāh Tajlib al-Taysir is a general foundation in social thinking and behavior that provides guidance for all people and nations in Indonesia, especially in the Era of the Industrial Revolution 4.0 as it is today, to carry out various interactions with each other. The guidance given concerns several aspects of life such as legal, economic, social, political and state aspects, as well as culture to human behavior problems when collided with Islamic economics by understanding the principles contained therein. This research focuses on the study of qawa'id Fiqhiyah al-Masyaqqāh Tajlib al-Taysir, which means Difficulty of Giving Birth to Ease, and its implications for economic thought and behavior in society in the current era, namely the era of the Industrial Revolution 4.0. In this case, the understanding of the difficulty of giving birth to ease is that mutlaq is needed to carry out an ijtihad or renewal of thought. The existence of this fiqh principle, in which the difficulty of giving birth to convenience proves that Islam, with all its tools, pays close attention to human behavior in fulfilling the daily needs of both social and economic needs. This can be proven when Allah SWT allows Muslims to interact and transact with non-Muslims at the same time, even Allah SWT gives flexibility to the mukalaf in determining their economic activities according to their ability levels. However, this almost Qath'i rule, namely masyaqqah is limited by the Shari'a in order to maintain the originality of human benefit from the rules made by the creator. Keywords: Ushul Fiqh, Masyaqqāh, Taysir, Islamic Economics, Industrial Revolution Era 4.0 Abstrak Qawa’id fiqhiyyah al-Masyaqqāh Tajlib al-Taysir merupakan landasan umum dalam pemikiran dan perilaku sosial masyarakat yang memberikan panduan bagi segenap masyarakat dan bangsa di Indonesia khususnya di Era Revolusi Industri 4.0 seperti sekarang ini, untuk melakukan berbagai interaksi dengan sesamanya. Panduan yang diberikan menyangkut beberapa aspek kehidupan semisal aspek hukum, ekonomi, sosial, politik dan kenegaraan, serta budaya sampai pada masalah perilaku manusia jika dibenturkan dengan ekonomi syariah dengan memahami kaidah-kaidah yang terkandung didalamnya. Penelitian ini memfokuskan pada kajian qawa’id Fiqhiyah al-Masyaqqāh Tajlib al-Taysir yang bermakna Kesulitan akan Melahirkan Kemudahan, serta implikasinya dalam pemikiran serta perilaku ekonomi dalam masyarakat di Era sekarang yaitu era Revolusi Industri 4.0. Dalam hal ini, pemahaman terhadap kaidah Kesulitan Melahirkan Kemudahan adalah mutlaq diperlukan untuk melakukan suatu ijtihad atau pembaharuan pemikiran. Hadirnya kaidah fiqh ini, dimana Kesulitan Melahirkan Kemudahan membuktikan bahwa agama Islam dengan segala perangkatnya sangat memperhatikan hal-hal perilaku manusia dalam memenuhi kebutuhan hidup sehari-hari, baik kebutuhan sosial maupun ekonomi. Hal ini dapat dibuktikan ketika Alloh Swt membolehkan kaum Muslimin untuk berinteraksi sekaligus bertransaksi dengan kaum yang non-Muslim, bahkan Alloh Swt memberikan keleluasaan kepada para mukalaf dalam menentukan aktifitas ekonominya yang disesuaikan dengan kadar kemampuannya. Akan tetapi dengan demikian kaidah yang hampir Qath’i ini yaitu masyaqqah dibatasi oleh syariat guna menjaga originalitas kemaslahatan manusia dari aturan yang dibuat oleh sang pencipta. . Abstract

This research found that the Norma of Riba in Islamic Economics is a khilafiyah problem as well as the law of Bank Interest, in principle, mutual tolerance and mutual respect and respect for inter-opinions must be put forward. This is because each group of ulama has devoted their energy to seeking the law of the problem, and in the end their opinion remains different. Abstract

This study aims to analyze Islamic education within the socio-cultural and Islamic education dimensions in responding to the challenges of the industrial revolution era 4.0. This study uses a library research method. The results showed that in the scope of the socio-cultural dimension, Islamic education serves as a forum that can instill tolerance, prevent radicalism, and think moderately.
