Abstract

The complexity of the challenges posed by teaching staff who are not ready and do not understand multicultural education today has become a major obstacle, especially in the 4.0 era as it is today. In addition, materials and resources must be free from biases, such as social class, gender, ethnicity, religion, and urban bias. Thus, authors of sources, materials, need to use the perspective of multicultural education, democracy and human rights in Era 4.0 in terms of implementing Islamic education in Indonesia. The purpose of this study is to determine the urgency and reflection of multicultural education, democracy and human rights in Indonesia, where Islamic education today continues to experience its own complexities of challenges. The results of the study show that multicultural education can be implemented for teachers, leaders, school members and campus communities who have a multicultural attitude and have the ability to properly organize Islamic education in the era 4.0 which is full of challenges. This will also be a challenge, because schools in general cannot be separated from stereotypes and prejudices that stem from a sense of primordialism, ethnicity, religion and social class. There is the Islamic concept of Rahmatan Lil 'Alamin as a solution, and also a method of paying attention to the situation in the delivery of subject matter without disturbing the students' souls.

Abstract

This study examines the application of bilateral inheritance law in Indonesia in relation to Islamic inheritance principles and assesses justice in property distribution. Bilateral inheritance grants equal rights to all heirs regardless of gender, while Islamic law provides specific rules for fair distribution. Using a qualitative case study approach, data were collected through interviews with Islamic law experts, legal practitioners, and local community members, as well as analysis of relevant cases. The findings reveal that the application of bilateral inheritance often conflicts with Islamic justice principles, such as excluding deceased parents’ rights or favoring children from second marriages over the first. These inconsistencies reflect tension between local customs seeking equality and Islamic law requiring proportional fairness. The study recommends harmonizing customary and Islamic inheritance laws to improve justice in property distribution. This research contributes new insights into the challenges of integrating customary practices with Islamic legal principles in Indonesia’s inheritance system. The findings can support policymakers, legal practitioners, and communities in developing fairer inheritance practices that respect both traditions and Islamic jurisprudence.

Abstract

Abstract

In Indonesia, sharia economic law is implemented through Religious Courts which have an important role in resolving disputes involving sharia financial entities such as banks, microfinance institutions, and insurance. Law Number 3 of 2006 replaces Law Number 7 of 1989 which significantly expands the authority of the Religious Courts in supervising and enforcing sharia economic principles. Sharia economics, which is based on Islamic values such as justice, honesty, and legal certainty, forms an economic and financial system that is different from conventional systems. Religious Court Judges strive to balance ethical and practical considerations in carrying out their judicial duties. This research examines how ethical perspectives and practical considerations contribute to achieving legal certainty and justice in resolving sharia economic disputes, especially in the Surabaya Religious Court. This research uses a normative juridical approach using legal utility theory to analyze the challenges faced and propose strategies to increase the effectiveness of implementing simple, efficient, and cost-effective principles in Sharia economic protection at the Surabaya High Religious Court. The research results consider the principles of maqasid al-syariah to simplify the process, lighten the burden on the parties involved, and uphold justice in every decision-making. This study emphasizes the need for better integration between Islamic Sharia principles and Sharia banking practices in Indonesia, as well as encouraging reforms to ensure that legal outcomes provide fair justice and maximum social benefits, in line with the ethical and utilitarian aims of the law.
