Abstract

Interfaith marriages are marriages between people of different faiths, such as marriages of Muslims and non-Muslims, both polytheists and pagan scholars. As a universal religion, Islam views that humans are one unity of the Ummah Wahidah community between individuals and individuals, and between one ethnic group and another ethnic group, there is no difference in the degree of humanity, the difference is the level of piety Allah. For this reason, in terms of marriage, Islam does not question differences in heredity, nationality and or citizenship, but religious differences are the focus of the problem, so that cases of interfaith marriages appear. This research aims to find out the fatwas of two major institutions in Indonesia namely the Indonesian Ulema Council and Nahdlatul Ulama. This study examines the fatwa and legal basis of the fatwa of the Indonesian Ulema Council and Nahdlatul Ulama on interfaith marriages then analyzes the two fatwas and correlates with the context of Indonesianism and the development of the times. The results showed that the Indonesian Ulema Council as an ulama organization in the country forbade interfaith marriages. This fatwa was issued by basing on the arguments of the Koran, hadith, and using the principles of fiqhiyyah and ushuliyah. The prohibition of interfaith marriages is a form of prudence, given the many mudharat arising from such marriages. Nahdlatul Ulama also stressed the marriage between Muslims and non-Muslims is forbiden and illegitimate. The decision of the Lajnah Bahtsul Masail is based on the understanding of the book of Tuhfah al-Tullab bi Sharh al-Tahrir and Hashiyah al-Sharqawi. Muslim women can only be married to Muslim men because all scholars agree to forbid Muslim women from marrying non-Muslim men. Likewise Muslim men can only marry Muslim women. For a number of reasons, it is unlikely to attract women who are Jewish or Christian to convert to Islam. There are many other ways to get people into Islam. Abstract

Monogami adalah asas yang terkandung dalam Undang-Undang 1 Tahun 1974 tentang Perkawinan di Indonesia, yaitu laki-laki hanya memiliki istri satu, hal ini seirama dengan prinsip mubadahlah agar dapat berbuat adil. Realitanya, upaya pemerintah dalam meminimalisir angka perceraian yang disebabkan oleh poligami dengan cara mewujudkan e-KTP fenomena poligami masih marak kita saksikan. Pertanyaannya adalah, bagaimana telaah mubadalah terhadap poligami pada era digital di Indonesia? Penelitian ini bertujuan untuk menelaah fenomena pologami dalam kacamata mubadalah untuk mewujudkan keadilan. Penelitian ini merupakan jenis penelitian kualitatif dalam bentuk liberary seseach yaitu mengkaji tentang fenomena poligami pada era rad an pasca diwujudkannya e-KTP, yang kemudian telaah dengan teori mubadalah untuk mewujudkan keadilan. Dalam konteks digital, fenomena poligami sebenarnya telah terstruktur, yaitu orang kerap melakukan poligami secara resmi yaitu terdaftar di pegawai pencatat nikah, sedangkan markanya poligami yang terjadi pada era digital ini adalah penipuan ijin nikah pada istri pertama, sehingga akan menimbulkan konflik hingga pada ranah perceraian akibat terkhianati. Dalam telaah mubadalah bahwa fenomena poligami ini bertentangan dengan prinsip-prinsip mubadalah, yaitu rahmah dan akhlakul karimah, yaitu suami tidak memiliki rasa sayang pada istrinya hingga melakukan penipuan surat ijin poligami, dan perilaku penipuan seperti ini adalah bentuk dari suami yang tidak bertanggungjwab dan tidak memiliki akhlakul karimah.

Abstract

This community service activity aims to help ecotourism business actors to increase visits through destination branding strategies. The problem faced by ecotourism business players is that business income has barely developed, especially after the pandemic. One of the Micro, Small and Medium Enterprise sectors affected is hand-written batik. This assistance and training was provided to the Malang Mangrove Batik MSME Group, which consists of 40 members of Batik entrepreneurs throughout Malang City Regency. The lack of visitors and purchasing power which is still only starting to increase after the pandemic also has an impact on the income of MSMEs. Apart from that, several problems with mangrove tourism are caused by not optimal social media branding, lack of cooperation from local communities for branding, lack of information on tourist destinations in mass media, lack of massive campaigns on social media, lack of understanding of the potential and uniqueness of mangrove tourism, etc. have a mangrove tourism promotion strategy plan. This activity seeks to restore income for MSMEs through a destination branding strategy for mangrove batik ecotourism. One of the efforts made is branding mangrove batik. This activity includes 5 stages starting from market analysis, brand identity, brand launch and introduction, brand implementation, and monitoring/evaluation. The results of branding activities show a significant increase in awareness of mangrove batik both in terms of brand, engagement and market segmentation.

Abstract

Penelitian ini bertujuan untuk mengungkap SEMA Nomor 2 Tahun 2023 dalam pencegahan perkawinan beda agama. Persoalan ini menarik untuk diteliti karena perkawinan beda agama sering meninggalkan polemik di masyarakat, termasuk di kalangan praktisi hukum. Penelitian menggunakan metode pustaka, sifatnya deskriptif analitis menggunakan sumber data hukum primer dan sekunder. Riset ini menyimpulkan bahwa SEMA menjadi petunjuk bagi hakim sekaligus untuk memutus polemik di kalangan hakim dan masyarakat. SEMA Nomor 2 Tahun 2023 ini juga berperan dalam pencegahan pernikahan beda agama dan sejalan dengan ajaran agama yang sesungguhnya memerintahkan setiap pemeluknya menikah dengan pria maupun wanita yang seagama. Oleh sebab itu ketika marak terjadinya penetapan pencatatan perkawinan pasangan beda agama dari peradilan sesungguhnya hal itu bisa diakhiri dengan SEMA tersebut. Sudah selayaknya hakim dalam memeriksa perkara perkawinan terlebih dahulu menggunakan asas formal yakni hukum perkawinan, bukan menggunakan hukum lain yakni hukum administrasi kependudukan.

Abstract

This study aims to produce a generalization of a phenomenon found during the research process by collecting various kinds of library source material. The variables used in this study are education, discipline (work ethic), and work (technical) ability to drive employee performance. This study uses a qualitative descriptive method with a literature study approach. The basic postulate (basic assumption) in this study is that higher education/training (as a hard skill competency) and discipline (as a soft skill competency) play a role in improving employee performance. This basic postulate or basic assumption is based on an empirical study of past research. The results of the study show the same symptoms where the level of education, discipline (work ethic as a manifestation of soft skills), and technical abilities (hard skills) can drive employee performance improvement.

Abstract

This research aims to examine and implement a strategy for determining the cost of production using cost plus pricing. The basic assumption of this research is that there are several MSMEs that still use conventional methods to determine the cost of production. The implication is that MSMEs have the potential to lose profits because the prices set are still far from actual profits. The application of the cost-plus pricing method in MSMEs can not only increase profit potential but also be used to promote products with price discounts. The research results show that there is a 640% increase in profits when MSMEs apply the cost-plus pricing method. In addition, at certain moments, MSMEs can provide discounts of up to 20% without losing profits. The limitation of this research lies in the scale of the object which is still small. Thus, this research cannot be generalized to be applied to different objects. However, this research provides recommendations for further research with larger objects, so that the differences can be seen.

Abstract

Recently, being childfree has become a trend in modern Muslim society. Childfree is practiced not only by celebrities but also by common people in Indonesia, particularly in Lampung and West Java provinces. On the one hand, the decision to be childfree is an individual right of each family, but it is considered contrary to the goals of Islamic law, which are to preserve offspring. This study examines the childfree phenomenon in modern Muslim communities in Lampung and West Java through the perspective of maqāṣid al-sharī'ah. This research employed a qualitative method with an ethnographic approach. The research suggested that modern Muslim communities in Lampung and West Java Provinces choose childfree for economic, mental, health, perspective, and environmental reasons. According to maqāṣid al-sharī'ah, being childfree contradicts Sharia's purpose of preserving offspring. Sharia promotes marriage and having healthy offspring. Meanwhile, Sharia cannot justify childfree due to lifestyle or economic factors. Specifically, a fear of not being able to provide for the child's future needs because Allah ensures livelihood for every servant who has faith and works diligently. At the same time, being child-free due to health reasons is permissible.

Abstract

Libraries may be at risk of data security issues. The threat of data loss or data damage is prone to occur in libraries. Information technology embedded in libraries has developed Artificial Intelligence (AI) for information retrieval systems. The application of information technology in the Surabaya City Library has potential risks to data security and force majeure aspects so that need a disaster mitigation plant. This study aimed to implement information system risk management at Surabaya City Libraries as a disaster mitigation plan. The research method was descriptive qualitative. Based on the risk analysis, the recommendations for applying risk to information technology Surabaya City Library were elimination and engineering. The manifestation of these two recommendations made the data access protocol use multiple authentications to avoid data theft attempts due to infiltration, hacking, and cracking. Study results recommended a protocol for each data access. The protocol would save every change, deletion, and system login in the log history. Implementing data authentication twice per login can avoid data theft caused by the intrusion. This activity log is used for activity tracking when the system is infiltrated. The limitation of this study lies in the scope of the research object, namely the library, which has limitations on the system or application used and does not impact the wider community. Conclusion of research, the library can implement risk management strategy with elimination and engineering models through recording system login activities, which mitigate the risk of data breaches originating from insiders.

Abstract

Law No. 7 of 2017 highlights that general elections enable citizens to express their sovereignty; however, the phenomenon of abstention (golput) indicates a decline in voter participation. This trend often results from a lack of trust in elected representatives, who are seen as failing to effect significant change. Rising abstention rates require urgent attention from organizers, especially the General Election Commission (KPU) of Bandar Lampung. From an Islamic legal perspective, abstention is deemed haram according to the Indonesian Ulema Council. This study employs qualitative methods through field research, including observation, interviews, and document collection. The KPU of Bandar Lampung has implemented various strategies to reduce abstention in the upcoming 2024 elections, guided by goal-setting, policy formulation, and plan development theories. This research aims to provide insights for enhancing voter participation.

Abstract

Identity politics in Indonesia is often influenced by social dynamics that are discriminatory towards gender. The concept of Mubadalah, meaning reciprocal or mutual, offers an inclusive approach to addressing gender injustice. This research examines the implementation of Mubadalah in transforming identity politics in Indonesia from 2009 to 2023. This study uses a qualitative approach with literature analysis, in-depth interviews with politicians, activists, and gender experts, as well as policy document analysis and election data. Findings indicate that Mubadalah-based education successfully changes traditional views on gender roles. Public policies adopting Mubadalah principles enhance women's representation in politics. Despite challenges from conservative groups, successes in several regions demonstrate the substantial potential of Mubadalah to achieve gender equality and justice in Indonesia.
