Abstract

Indecency includes all acts related to sexual life that violate morality (propriety), including intercourse outside of marriage. The Criminal Code classifies the crime of indecency as a crime against morality. Currently, there is a rise in the crime of indecency, with children often being the victims. Children are part of the younger generation and a potential human resource; therefore, perpetrators of sexual crimes against children must face appropriate punishment. The position of children as the younger generation who will carry forward the noble ideals of the nation requires that their rights and protection be upheld and respected. This research aims to assess the protection provided to child victims of sexual crimes in the city of Pekanbaru, as well as the forms of protection that have been established and implemented in the jurisdiction of the Pekanbaru Police Department (Polresta Pekanbaru). The research was conducted in Pekanbaru, particularly at Polresta Pekanbaru. In terms of data collection techniques, the author used a normative juridical approach, guided by legislation, legal books or literature, and other materials related to the issues and discussions in this thesis. In this context, the important role of parents and the community or the environment is emphasized to provide attention and supervision, ensuring that acts against children as victims of sexual crimes do not occur. Furthermore, in the implementation of legal protection for child victims of sexual crimes, the involved parties must actively and responsibly carry out their duties to ensure the legal protection of child victims of sexual crimes.

Abstract

The purpose of this community service activities is to provide understanding for village apparatus and the community in terms of identifying and analyzing the organizational arrangements of Village-Owned Enterprises. Each village has the authority to create and develop BUMDes. BUMDes is one of the indicators towards a prosperous village. Forming BUMDes is still a separate problem for villages, because it is not easy to set up a BUMDes. Preparations are needed to carry out the establishment of BUMDes. Corporate governance is also important because good governance will create success for the BUMDes themselves. Tanuharjo Village, Alian District, Kebumen Regency took the initiative to create BUMDes with village potentials, namely in agriculture and tourism. The establishment of BUMDes is not an easy thing to do and must be done with administrative completeness.

Abstract

Arbitration is a mechanism for resolving civil disputes outside traditional courts, governed by a written arbitration agreement between the disputing parties. Limited to commercial and specific disputes like banking, an arbitration tribunal, consisting of arbitrators, hears and decides these matters. In Indonesia, Law Number 30 of 1999 states that the appointment of two arbitrators grants them authority to select a third. Meanwhile, Russian laws, such as Federal Law No. 382-FZ and Law No. 5338-1, empower the Nomination Committee of Permanent Arbitration to appoint a third arbitrator from an approved list. This article employs a normative juridical method with a comparative law approach to scrutinize the selection and appointment of a third arbitrator according to Indonesian and Russian law. Qualitative analysis reveals that, under certain circumstances, all three arbitrators may be appointed by the Nomination Committee or even the general jurisdiction court, as outlined in the Russian International Commercial Arbitration Court's regulations. The article underscores the importance of providing legal certainty to disputing parties, empowering arbitrators, and avoiding conflicts that could impede dispute resolution. By shedding light on the appointment process, this research aims to contribute to the efficacy of arbitration as a judicious alternative for resolving disputes.

Abstract

This study explores the regulatory and institutional framework for relocating Indonesia’s national capital (Ibu Kota Nusantara, IKN) from Jakarta to East Kalimantan, a plan rooted in the integrative ideology articulated by Soepomo in 1945. This ideology emphasizes harmony between macrocosmic and microcosmic forces within the state, suggesting that the government center should be located centrally within the country to symbolize supreme authority. The relocation is also seen as a crucial move toward achieving “Indonesia Emas 2045”. However, the enactment of Law No. 3 of 2022, which serves as the legal basis for the relocation, has faced significant criticism, particularly regarding the regulatory, institutional, and funding aspects. Previous studies have often been opinion-based and lacked scientific rigor, especially in addressing the complexities of policy implementation. This research aims to fill this gap by providing a detailed analysis of the policy from regulatory and institutional perspectives. The study uses a normative legal approach, incorporating both statute and conceptual analyses, to evaluate the regulatory and institutional frameworks guiding the capital relocation. While it does not extensively address funding issues, it focuses on identifying how well the existing rules align with the policy’s implementation goals. Findings suggest that while the relocation offers significant benefits, such as promoting national unity and symbolizing progress, the process faces challenges, including conflicts with existing regulations and institutional inefficiencies. The contribution of this study lies in offering actionable insights for both the government and civil society to assess and improve the policy’s implementation, ensuring its alignment with the broader vision of national development.

Abstract

This study discusses the role of the village government and the role of the surrounding community in implementing an environmental protection system. The purpose of writing this article is to find out data related to security and public order in Kemiri Village. This article is descriptive review supported by qualitative data that aims to reveal the facts or reality of certain social phenomena and provide an objective description of the conditions or problems that may be encountered. Then knowing this, actually, what can the village government do in an effort or at least minimize the crime rate, especially theft in the village of Kemiri? Field data and facts were obtained directly from informants through observation, namely parties who know the information needed regarding environmental safety in the Kemiri Village environment, Kaloran District, Temanggung Regency. As a result authors find out that between the Government, The villagers and The Police cooperate to overcome the situation, but in fact not all problems in society can be solved especially concerning thievery. In conclusion the reason why there is still a crime of theft, especially in the village of Kemiri the security facilities which are inadequate and not as modern as in a big city, also some of villagers careless of their belongings and Lack of police personnel.

Abstract

This paper analyzes the complex and often contradictory dynamics of refugee and migration policy in Indonesia, framed within the political and legal tug-of-war that shapes human rights protections. As one of Southeast Asia’s key transit and destination countries for refugees and migrants, Indonesia's policy approaches are influenced by both international obligations and domestic political considerations. Despite being a signatory to the 1951 Refugee Convention, Indonesia has not adopted comprehensive national legislation to protect refugees, leaving a gap in the legal framework that often results in ad-hoc, inconsistent practices. This study critically examines the tension between political interests—such as national sovereignty, security concerns, and public opinion—and the legal obligations tied to human rights protections under international law. The research analyzes the roles of domestic political actors, including the government, lawmakers, and civil society, in shaping policies related to refugees and migrants. It also explores the legal frameworks that both constrain and enable state actions regarding asylum seekers, detention, and deportation. Through a review of recent case studies and policy shifts, this paper highlights the challenges of balancing humanitarian obligations with domestic priorities. The analysis underscores the need for a more coherent and rights-based approach to migration and refugee policy in Indonesia, suggesting that the existing legal and political landscape often pulls in opposite directions, undermining effective protection for vulnerable populations. Ultimately, this study contributes to the ongoing discourse on global migration governance, offering insights into how national policies can evolve to better protect refugees while navigating political realities.

Abstract

The implementation of patents by the government has become a national policy to control the spread of COVID-19 by helping drug supplies in emergencies and urgent situations. The purpose of this research is to analyse patent regulation by the government (Government Use) for pharmaceutical products in the state of emergency in Indonesia by comparing with Government Use in Malaysia. This research is legal research using secondary data with qualitative analysis. The implementation of patents by the government on the Covid-19 drugs remdesivir and favipiravir, whose application in Indonesia has been based on the provisions regulated by TRIPS and the DOHA Declaration. The implementation of this policy is due to a very urgent need in efforts to tackle the COVID-19 pandemic. Malaysia has also implemented the same policy to address the need to import a generic version of the Hepatitis C drug. It is hoped that the implementation of patents by the Government on the drugs remdesivir and favipiravir can facilitate access for Covid-19 patients who need them and can be an effective strategy to deal with the Covid-19 outbreak.

Abstract

Fenomena aksi anarkis dalam demonstrasi di Indonesia menunjukkan adanya persoalan mendasar dalam sistem penegakan hukum, khususnya dalam relasi antara masyarakat sipil dan aparat kepolisian. Aksi demonstrasi yang secara konstitusional dijamin sebagai hak menyampaikan pendapat kerap berujung pada bentrokan akibat penanganan yang tidak proporsional serta minimnya kepercayaan publik terhadap aparat penegak hukum. Penelitian ini bertujuan untuk menganalisis penanganan aksi anarkis masyarakat sipil terhadap aparat kepolisian melalui perspektif teori sistem hukum Lawrence M. Friedman yang menekankan keterkaitan antara struktur hukum, substansi hukum dan budaya hukum. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan studi literatur dan analisis deskriptif terhadap peraturan perundang-undangan, laporan lembaga swadaya masyarakat, serta studi kasus demonstrasi di Indonesia. Hasil penelitian menunjukkan bahwa aksi anarkis dipicu oleh ketidakseimbangan sistem hukum, yang tercermin dari lemahnya mekanisme pengawasan aparat, ambiguitas regulasi terkait kebebasan berpendapat dan penggunaan kekuatan, serta rendahnya budaya hukum baik di kalangan aparat maupun masyarakat. Kesimpulan penelitian ini menegaskan perlunya reformasi hukum yang komprehensif melalui penguatan akuntabilitas aparat, penegasan regulasi yang berorientasi pada hak asasi manusia dan pembentukan budaya hukum yang mengedepankan dialog serta de-eskalasi konflik. Kontribusi penelitian ini terletak pada penguatan analisis sistemik penanganan aksi anarkis berbasis teori Friedman sebagai pendekatan preventif dalam memperkuat kepercayaan publik terhadap sistem hukum.

Abstract

Penelitian ini mengkaji implementasi kebijakan buku murah dalam pemenuhan hak literasi publik di Kota Semarang dengan menggunakan pendekatan normatif-empiris dan teori utilitarianisme John Stuart Mill sebagai landasan analisis. Melalui survei dan analisis regulasi, ditemukan bahwa keterjangkauan buku masih menjadi hambatan utama bagi mahasiswa dan pelajar, meskipun minat baca masyarakat tergolong tinggi. Kebijakan Indonesia seperti Buku Sekolah Elektronik (BSE) belum mampu menghadirkan pemerataan akses literasi secara berkelanjutan. Sebaliknya, praktik India melalui NCERT, NBT dan mekanisme Low Price Edition menunjukkan model kebijakan yang lebih sistematis dan berdampak luas, termasuk penurunan harga sekitar 20% dan distribusi hingga 150 juta eksemplar. Hasil penelitian menunjukkan bahwa tingginya harga buku menciptakan ketimpangan akses terhadap literatur berkualitas dan mendorong strategi alternatif seperti: pinjam, membeli buku bekas, atau mengakses versi ilegal. Oleh karena itu, penelitian ini menawarkan skema kebijakan "60:40" sebagai solusi, yaitu pemerintah membeli 60% hak ekonomi buku untuk dicetak dalam versi murah, sementara penerbit tetap memproduksi 40% edisi premium. Skema ini dinilai sejalan dengan prinsip utilitarianisme yang menempatkan kebahagiaan intelektual sebagai kesenangan bermutu tinggi, sekaligus mewujudkan amanat UU Sistem Perbukuan untuk menyediakan buku yang bermutu, murah dan merata.

Abstract

Tindak pidana pembunuhan tidak hanya mengakibatkan konsekuensi pidana bagi pelaku, tetapi juga membuka ruang pertanggungjawaban perdata yang memungkinkan keluarga korban untuk menuntut ganti rugi. Tujuan penelitian ini adalah untuk melihat bagaimana Pasal 1370 KUHPerdata berlaku bagi tuntutan ganti rugi keluarga korban pembunuhan. Studi ini menggunakan teori onrechtmatige daad L.C. Hoffman dan teori keadilan Aristoteles sebagai kerangka teoretis. Penelitian ini menerapkan metode kualitatif dan mengklasifikasikan jenis penelitian sebagai hukum normatif dengan melakukan kajian pustaka terhadap sumber hukum primer, sekunder dan tersier. Temuan penelitian mengindikasikan bahwa keluarga pihak yang dirugikan memiliki landasan hukum yang kokoh untuk meminta kompensasi sesuai dengan Pasal 1370 Kitab Undang-Undang Hukum Perdata. Konsep onrechtmatige daad, yang mencakup komponen tindakan melanggar hukum, kesalahan, kerugian dan hubungan kausal, membentuk struktur hukum dari pasal ini. Dalam menentukan proporsionalitas ganti rugi berdasarkan kemampuan ekonomi pelaku dan kebutuhan pemulihan korban, teori keadilan Aristoteles memberikan dimensi filosofis. Studi ini memberikan panduan menyeluruh yang mengintegrasikan aspek hukum formal, konsep tanggung jawab perdata dan prinsip keadilan untuk menawarkan perlindungan hukum yang signifikan kepada keluarga korban pembunuhan di dalam sistem hukum perdata di Indonesia.
