Abstract

The existence of transgender people in Indonesia cannot be accepted by society because they are considered to deviate from existing cultural values. Their status as transgender also makes it difficult to place them in correctional institutions when someone commits a crime. There is no legal certainty and there is a legal vacuum so that there is a need for criminal law modifications such as alternative punishments outside of prison for transgender inmates. This study has two aims: First to find out criminal modifications in the current punishment of transgender inmates, Second to that describe the concept of ideal criminal modification for transgender inmates. this study uses a normative juridical and empirical juridical approach with data collected through literature studies and field studies. The conclusion is there is a need for modifications in the criminal system, such as the placement of transgender prisoners as seen from their identification cards such as ID cards or passports, as well as court decisions if they have applied for a sex change and it has been legalized. In addition, alternative punishments other than imprisonment for transgender convicts can provide legal certainty for them in order to avoid a legal vacuum. Alternative punishment also serves to protect prisoners from the possibility of bullying and harassment for transgender prisoners.

Abstract

The young generation plays an important role in the sustainability of democracy in Indonesia, but they show a significant apathy towards political participation, which causes a crisis of political citizenship as seen from the decline in awareness and involvement in the democratic process. Studies show that a number of young voters have low interest in elections, doubt political institutions, and are influenced by misinformation on social media. The education system has been less successful in building critical political awareness and a sense of civic responsibility among young people. Factors causing this crisis include a lack of role models, the spread of ethnocentrism, and misunderstandings of democracy, in addition to the external influence of globalization that erodes national identity. The resulting passivity can threaten the integrity of democracy and the progress of society. To solve this problem, strategic interventions involving educational institutions, the media, and the social context are crucial. Improving civic education, encouraging media literacy, and building constructive social discussions can restore political engagement among the young generation. Cooperation between various parties is needed to develop responsible citizenship and empower the young generation to actively participate in the future of the country.

Abstract

Purpose: The Influence of Public Service and Financial Compensation and Professionalism on Employee Performance with Job Satisfaction as an Intervening Variable.Design/methodology/approach: The research method uses quantitative research with analysis tools using path analysis, with 27 respondents, this research sample was obtained using the saturated sampling technique because the population is limited. Abstract

This Community Service Activity aims to assist mothers in making lettuce in order to improve family economy. This community service activity was carried out in Sidolmulyo Barat Village, Tuah Madani District, Pekanbaru City. The method of this community service activity is carried out by providing assistance and training in making lettuce.. The results of this Community Service Activity show that by introducing and holding training in making traditional food, it can improve the family economy. The lettuce-making mentoring program went well and smoothly. The participants were enthusiastic and planned to develop this knowledge for sales ideas and food businesses to improve the family economy in order to meet daily needs.

Abstract

Every teenager should ideally be able to grow and develop well according to their age and as the next generation of the nation, but in reality there are teenagers who commit crimes, one of which is online gambling. Online gambling crimes among teenagers have an impact on other crimes, such as theft, so they must be dealt with optimally. The problem of this research is regarding the criminological analysis of online gambling crimes among teenagers in North Lampung and how the efforts made by the North Lampung Police in dealing with online gambling crimes among teenagers. This research uses a normative and empirical legal approach. The data collection procedure is carried out by means of literature studies and field studies. which are then analyzed qualitatively to obtain conclusions. The results of the research and discussion show that the criminological analysis of online gambling crimes among teenagers in North Lampung in accordance with the Differential Association Theory shows that the cause of teenagers committing online gambling crimes is the interaction, relationship, and communication between teenagers who have never gambled online with other teenagers who have gambled online. In accordance with the Strain Theory, the cause of teenagers committing online gambling crimes is the demands of daily needs. According to Social Control Theory, the cause of teenagers committing online gambling crimes is the lack of supervision from various related parties such as family, schools/educational institutions and law enforcement officers. Efforts to overcome online gambling crimes in teenagers through non-penal means are carried out by socializing child protection and cooperating/coordinating with schools. Penal means are carried out through the process of investigating children who commit online gambling crimes by child investigators based on the Juvenile Justice System Law.

Abstract

 Penelitian ini membahas implementasi ruang bina pekon oleh Kejaksaan Tanggamus dalam menekan kasus korupsi dana desa. Dengan menggunakan pendekatan yuridis normatif dan empiris, penelitian ini melibatkan wawancara dengan narasumber terkait dan analisis data dari berbagai sumber. Hasil penelitian menunjukkan bahwa upaya preventif Kejaksaan Tanggamus melalui ruang bina pekon telah dilakukan dan dapat mengurangi kasus korupsi dana desa di wilayah Tanggamus. Penelitian ini memberikan kontribusi penting dalam pemahaman dan penanganan korupsi dana desa di Indonesia, serta memberikan rekomendasi untuk meningkatkan efektivitas pencegahan korupsi dana desa di masa mendatang.

Abstract

Animal quarantine plays a crucial role in preventing the smuggling of wildlife, particularly protected bird species. Although this is regulated under Law Number 21 of 2019 concerning Animal, Fish, and Plant Quarantine, smuggling practices remain prevalent. This study employs a normative and empirical juridical approach to examine the role of the Agricultural Quarantine Agency Class 1A Bandar Lampung in combating bird smuggling, as well as the factors hindering the enforcement of criminal law. The findings indicate that the quarantine agency carries out three main roles: normative (based on regulations), factual (preventive and repressive actions), and ideal (emphasizing prevention). Obstacles faced include a shortage of field personnel, limited equipment and funding, and low public awareness of the law. It is recommended that the quarantine agency improve community welfare and collaborate with relevant institutions to optimize public outreach and law enforcement efforts.

Abstract

The reform of Indonesian criminal law through the new Criminal Code (Law No. 1 of 2023) introduces the concept of "living law in society," allowing the application of customary norms to balance legal certainty and social justice. Although it aims to accommodate cultural diversity, its implementation faces challenges, such as the definition of living law, difficulties in formulating crimes, and potential conflicts between customary law and formal law. This legal uncertainty can reduce public trust in the justice system. Therefore, intensive socialization and legal education for the community are essential, supported by the participation of academics and legal practitioners to ensure that human rights protection remains a priority. This step is expected to create a fair, effective, and inclusive criminal justice system

Abstract

Criminal money substitution is a very important instrument and has a crucial role in efforts to recover state losses caused by corruption crimes. Through this mechanism, the state seeks to recover losses incurred due to corruption. Although there are provisions that regulate the crime of substitute money, the implementation of the substitute money policy in Indonesia is considered ineffective in restoring state losses due to corruption. The main problem in this study is how the substitute money policy in corruption in Indonesia today and how the construction of the substitute money criminal policy in the perspective of criminal law reform. The methods used in this study are normative juridical and empirical juridical which are research methods that combine normative legal elements with the addition of empirical data. The data sources used in this study are primary data and secondary data. Data was collected through literature studies and field studies. Based on the results of this study, it can be seen that the policy is considered not to clearly explain how the mechanism for recovering state losses through the penalty of substitute money is related. In practice, currently the return of state losses through the imposition of penalty money in lieu has not been effective. This is because there are still many obstacles. Some of the obstacles in the implementation of this substitute money crime are the limitations of law enforcement officials, lack of coordination between institutions, and the inability to trace and confiscate the assets of perpetrators of corruption crimes. In addition, another obstacle faced at the time of execution is the inability of the perpetrator to return state losses caused by corruption crimes. This is what causes the maximum implementation of the substitute money criminal policy. The construction of the substitute money criminal policy in the perspective of criminal law reform, namely the substitute money policy must be able to enforce the law in Total Enforcement or at least in Full Enforcement, namely demanding the return of all state losses caused by corruption crimes as a whole without any legal loopholes that allow convicts to evade.

Abstract

The government’s efforts to provide protection for trademark rights holders have been implemented by enacting and updating laws on trademarks. However, in reality, crimes against trademark rights continue to occur, including in the jurisdiction of the Tanjung Karang District Court. This research addresses the following issues: What are the judges' considerations in cases of unauthorized use of registered trademarks, and how is the criminal analysis of such offenses reflected in Decision Number: 381/Pid.Sus/2023/PN.Tjk? This study uses normative and empirical legal research methods, with statutory and conceptual approaches. The data type used is secondary data obtained through literature study. Data processing involved selection, classification, and organization. The data were analyzed using a descriptive qualitative method. The findings of this research indicate that the judge's legal basis in sentencing the defendant for the unauthorized use of a registered trademark in Decision Number: 381/Pid.Sus/2023/PN.Tjk includes juridical considerations—specifically that the defendant was legally and convincingly proven to have committed a criminal offense as regulated under Article 100 paragraph (1) of Law Number 20 of 2016 concerning Trademarks and Geographical Indications. Philosophically, the judge considered the imposed sentence as a means of rehabilitation and deterrence. Sociologically, the judge weighed both aggravating and mitigating factors in the sentencing. Criminal liability for the offender was based on the fulfillment of criminal responsibility elements, namely that the defendant was an adult and legally capable of committing the act. The element of fault was fulfilled, as the defendant knowingly and intentionally used a registered trademark without authorization, fully aware that such an act constitutes a criminal offense. The element of the absence of justification or excuse was also met, as the defendant committed the offense in a conscious and sound state of mind, without coercion.
