Abstract

This study analyses the dualism of legal responsibility between BPJS Kesehatan and BPJS Ketenagakerjaan in cases of workplace accidents, focusing on the lack of clarity regarding the provision of healthcare services and its implications from the perspectives of criminal and civil law. This issue arises because, in theory, workplace accidents are covered by the Workplace Accident Insurance scheme administered by BPJS Ketenagakerjaan; however, in the practice of healthcare provision, situations frequently arise where the status of a workplace accident is still merely a presumption, meaning that initial coverage may involve BPJS Kesehatan. This study employs a normative legal methodology using a legislative approach, a conceptual approach, and a literature review of relevant legislation, legal doctrine, academic articles, and institutional sources. The findings indicate that this lack of clarity regarding coverage not only gives rise to administrative issues but also has the potential to hinder patients’ access to prompt and appropriate medical care, whilst also giving rise to legal liability for hospitals, insurers and, in certain circumstances, employers. In the civil sphere, such ambiguity may constitute grounds for a claim for tort if it results in material or non-material loss to the patient. In the criminal sphere, liability may arise where gross negligence leads to serious injury or death due to a delay in healthcare provision. This study emphasises that the dualism in legal liability stems from a lack of synchronisation between the norms and procedures of different social security providers. Therefore, regulatory harmonisation, the integration of social security systems, and certainty regarding case-handling mechanisms from the earliest stages of service provision are required to ensure that workers’ rights to health and occupational safety protection are effectively guaranteed.

Abstract

The digital economy is growing rapidly in developing countries but faces complex regulatory challenges across three key pillars: consumer protection, taxation of digital platforms, and legal certainty regarding crypto transactions. This study employs a literature review methodology. The findings indicate that only a few countries have specific consumer protection regulations for digital financial services, Indonesia’s digital economy tax revenue reached Rp31.05 trillion by November 2024, and legal uncertainty surrounding crypto creates a high-risk environment for retail investors. In conclusion, developing countries require a holistic approach that updates consumer protection laws for digital transactions, establishes online dispute resolution (ODR) mechanisms, integrates technology into tax systems, enhances consumer digital literacy, and facilitates regional regulatory harmonisation within ASEAN as well as the OECD’s global digital tax framework. Indonesia emerges as a progressive case study with regulatory reforms treating crypto as an investment commodity and a tax rate increased to 0.21%, yet cross-border implementation challenges and weak digital literacy remain major obstacles to the sustainability of an inclusive and secure digital economy.

Abstract

Indonesia’s digital economy has undergone an accelerated transformation following the enactment of Law No. 27 of 2022 on Personal Data Protection (PDP Law) and the amendment of Law No. 11 of 2008 on Information and Electronic Transactions (ITE Law) via Law No. 1 of 2024. This systematic review analyses the transformation of normative policies and the realities of regulatory implementation using a literature review method. Key findings highlight progressive regulatory synergy that is, however, hampered by a policy-practice gap, low compliance among businesses (35%), weak institutional coordination within the Personal Data Protection Commission (KPDP), and adaptation costs that burden SMEs. The Tokopedia-Akulaku data breach case study illustrates enforcement challenges, whilst private initiatives such as ‘Privacy by Design’ demonstrate the potential for collaboration. This article recommends accelerating the establishment of the Personal Data Protection Agency (KPDP), harmonising implementing regulations, conducting national digital literacy training, and adopting a multi-stakeholder model to bridge the regulatory-practice gap, thereby supporting the target of the digital economy contributing 25% of GDP by 2029.

Abstract

This article examines the structural tension between data sovereignty and open innovation in the regulation of the digital economy in the era of artificial intelligence (AI) and the green economy, using a systematic literature review approach. Data sovereignty, as enshrined in Indonesia’s Personal Data Protection Act (PDP), protects national strategic assets from exploitation by global platforms, yet hinders access to essential datasets for the development of AI models and green technology collaboration. Conversely, the open innovation paradigm, through regulatory sandboxes and open data policies, drives the digital economy target of Rp4,500 trillion (2030), but risks a brain drain of domestic data. A comparative analysis of the EU, US and China reveals a trade-off between protective regulation and market-driven approaches, whilst the Indonesian context demands a hybrid governance model: limited data localisation combined with trusted data-sharing frameworks. Recommendations include the 2026 Presidential Regulation on AI, strengthening cloud sovereignty, and a Digital Sovereignty Index to realise contextual AI that is sovereign, innovative, and sustainable, paving the way for Indonesia Emas 2045.

Abstract

This study systematically examines the evolution of illegal investment schemes and regulatory loopholes in Indonesia following the establishment of the Investment Vigilance Task Force 2.0, using a systematic literature review (SLR) approach. The findings indicate that illegal investment schemes have shifted from conventional schemes to complex digital forms, ranging from money games, trading bots, fake crypto investments, to social media-based platforms and communication groups. On the other hand, regulations still contain serious loopholes, such as fragmentation of authority among agencies, policy delays in response to technological innovation, weak coordination of law enforcement, and limitations in cross-jurisdictional regulation. This study concludes that a holistic approach is needed, integrating cross-sectoral regulatory strengthening, the utilisation of technology-based regulation, and the improvement of public financial literacy to break the chain of evolution of illegal investment schemes in the SWI 2.0 era.

Abstract

Law Number 13 of 2022, which serves as the Second Amendment to Law Number 12 of 2011, strengthens public involvement and participation in all stages of the legislative process, from planning to enactment. However, according to the development of public participation as reflected in the Civic Participation Index from 2019 to 2024 published by the World Justice Project, Indonesia has experienced a downward trend. Several challenges to public participation include the lack of public awareness of their participatory rights, limited access to information, and the absence of effective mechanisms for gathering public input. This study employs a normative juridical method with a statute approach to analyze existing regulations and their implementation (best practices) in accordance with international standards, using a comparative study of countries with higher civic participation index levels. The data were collected from secondary sources, including primary legal materials, secondary legal materials, and tertiary legal materials. This study is of significant urgency as it can provide practical recommendations for the development of more effective technical guidelines on public participation as mandated by Law Number 13 of 2022.

Abstract

This study was motivated by the disharmony between central government regulations and local regulations (perda) in Indonesia. The study aims to analyze the forms and causes of disharmony, as well as to formulate ways to strengthen the harmonization mechanism within the framework of a unitary state. The method used is normative legal research with a legislative and conceptual approach, based on the study of primary and secondary legal materials. The results of the study show that the disharmony of local regulations is influenced by the ambiguity of the harmonization norms in the draft local regulations, the weak capacity of regional legislation, the dominance of local political interests, and the lack of vertical coordination between the central and regional governments. Therefore, it is necessary to affirm the norms and procedures for harmonizing draft local regulations, strengthen harmonization mechanisms (ex ante and ex post), conduct periodic evaluations, and optimize the role of relevant ministries/institutions and the Supreme Court to ensure the harmony of norms, certainty, justice, and the benefits of law.

Abstract

Penelitian ini mengkaji status hukum pohon pepaya yang ditanam tanpa izin di atas tanah milik perusahaan serta konsekuensi hukum dari penebangan pohon-pohon tersebut oleh petugas keamanan pabrik. Dengan menggunakan metode penelitian hukum normatif yang menggabungkan pendekatan yuridis dan konseptual, penelitian ini menganalisis ketentuan-ketentuan yang relevan dalam Kitab Undang-Undang Hukum Perdata (KUH Perdata) dan Undang-Undang Pokok Agraria (UUPA No. 5/1960). Temuan menunjukkan bahwa, berdasarkan prinsip aksesie (accessie) sebagaimana diatur dalam Pasal 500, 571, dan 588 KUH Perdata, benda-benda yang tumbuh secara permanen di atas tanah menjadi milik pemilik tanah secara otomatis berdasarkan ketentuan hukum. Meskipun UUPA mengakui prinsip pemisahan horizontal, penerapannya mensyaratkan adanya dasar hukum yang sah seperti perjanjian tertulis, yang tidak ada dalam kasus ini. Akibatnya, penanam yang tidak berizin tidak memiliki klaim kepemilikan yang dapat ditegakkan secara hukum atas pohon-pohon tersebut. Penebangan yang dilakukan oleh petugas keamanan pabrik tidak termasuk dalam kategori perbuatan melawan hukum berdasarkan Pasal 1365 KUH Perdata, karena hal tersebut merupakan bagian dari pelaksanaan hak perusahaan sebagai pemilik tanah yang sah. Penelitian ini memberikan kontribusi terhadap kejelasan hukum terkait sengketa hak milik dalam kerangka normatif ganda sipil-agri di Indonesia

Abstract

The use of instant messaging applications has led to significant changes in people's communication patterns. The resulting positive impacts include increased efficiency, speed and expansion of social connectedness. These apps facilitate faster and more responsive communication with additional features such as video and voice calls, and enable the formation of more diverse virtual communities and discussion groups. However, there are also emerging challenges, such as the risk of misunderstandings, technology dependency, and a decline in the quality of face-to-face interactions. In addition, the rapid spread of information through these applications may increase the risk of disinformation. Therefore, it is important for people to improve their digital literacy and use instant messaging technology wisely to maximise the benefits while minimising the negative impacts.

Abstract

The important role of e-commerce in improving the local economy in the digital era by focusing on the empowerment of Micro, Small and Medium Enterprises (MSMEs). E- commerce provides wider market access for MSMEs, opening up sales opportunities to the global level without geographical restrictions. Digital literacy and adequate internet infrastructure are key elements that enable local businesses to run online businesses eflectively, thereby improving their operational efficiency and competitive ability. In addition, the optimisation of logistics and the implementation of appropriate digital marketing strategies contribute to the success of e-commerce in supporting the local economy. With efficient logistics infrastructure and modern technology, MSMEs can fulfil consumer expectations for fast and safe delivery. Data-driven digital marketing strategies help MSMEs attract and retain customers. Overall, e-commerce is creating new opportunities for local businesses and driving inclusive and sustainable economic growth.
