Abstract

This study analyses the dynamics of local and imported goods trade in the Serikin Cross-Border Market as a reflection of economic interaction between Indonesia and Malaysia using a literature review method. This study explains how local and imported goods play a role in cross-border economic activities, while strengthening socio-cultural relations in the border region. Through a synthesis of various academic literature, it was found that local goods trade not only supports the economy of border communities but also preserves cultural identity and strengthens social networks. Meanwhile, the flow of imported goods indicates a high level of economic interdependence between the two countries, but also poses challenges such as intensifying business competition and the risk of illegal goods entering the market. The results of this study emphasise the importance of balanced and adaptive cross-border market management so that trade can take place in a healthy and sustainable manner, thereby contributing positively to regional economic development and bilateral relations between Indonesia and Malaysia.

Abstract

This study aims to analyse the influence of economic inequality, unemployment rates, and poverty on theft crimes in Indonesia through an empirical literature review. Using a thematic synthesis approach to various journals and research reports, this study found that economic inequality and unemployment rates have a significant positive influence on the increase in theft crime rates. Poverty also contributes to the risk of theft, especially when the economic pressure felt by the community is very high. The results of the study indicate that the combination of these three variables strengthens the potential for theft crimes in Indonesia, thus requiring policies that focus on reducing inequality, creating jobs, and implementing poverty alleviation programmes to effectively reduce crime rates.

Abstract

This study aims to examine strategies for combating theft using an analysis of economic inequality and poverty through a literature review. The study examines the complex relationship between social inequality, poverty, and theft, and identifies strategic interventions that have been implemented in a socio-economic context to reduce theft rates. The findings reveal that inequality and poverty are critical factors driving criminal behaviour, necessitating effective interventions that integrate preventive, repressive, and socio-economic empowerment approaches. Strategic recommendations include multi-stakeholder collaboration, improved education, strengthened social systems, and the use of security technology. This approach not only addresses the symptoms but also the root causes of theft crime to create a safe, fair, and inclusive environment.

Abstract

This study examines the relationship between the type of employment contract and the compensation received by employees as service providers, as well as the implications of such compensation on employee performance. The method used is a literature review with a normative legal approach, which analyses various literature, labour regulations, and previous research findings related to compensation and employment contracts. The findings indicate that compensation is significantly influenced by the type of employment contract, with employees under an Indefinite-Term Employment Contract (PKWTT) tending to receive more stable compensation and benefits compared to those under a Fixed-Term Employment Contract (PKWT). Fair and transparent compensation positively impacts motivation, loyalty, and the quality of services provided, thereby enhancing employee performance and the sustainability of service organisations. This study underscores the importance of aligning compensation practices with regulations and the dynamic needs of the workforce to foster employee well-being and corporate competitiveness.

Abstract

The digital age has revolutionised international trade law through the expansion of cross-border e-commerce, which demands a reconfiguration of global regulations, whilst challenges regarding data sovereignty create a fundamental conflict between the free flow of data and national control. This literature review analyses the dynamics of legal harmonisation through the WTO E-commerce Initiative, the UNCITRAL Model Law, the ASEAN Agreement on Electronic Commerce (Law No. 4/2021), as well as a comparison of the European GDPR-DSA regulations, the US sectoral approach, and Indonesia’s Personal Data Protection Law, identifying gaps in consumer protection, electronic contracts, digital taxation, and ODR dispute resolution. Key findings underscore the need for a hybrid approach combining global minimum standards with national flexibility, particularly for developing countries facing big tech dominance and regulatory fragmentation, with recommendations to strengthen the ASEAN Data Adequacy Framework and sovereign cloud infrastructure to safeguard information sovereignty amidst the liberalisation of digital trade.

Abstract

This article examines the dynamics of fragmentation and harmonisation in international trade law in the wake of the COVID-19 pandemic through a literature review, focusing on the impact of Regional Trade Agreements (RTAs) on the multilateral system of the World Trade Organisation (WTO). The process of fragmentation is described in the context of the proliferation of RTAs, which gives rise to overlapping norms, inconsistent rules, and uncertainty for member and non-member states, particularly developing countries. On the other hand, this article asserts that RTAs can serve as “building blocks” for normative integration if designed in a manner compatible and transparent with WTO principles. Through adjustment mechanisms, dispute settlement, and plurilateral initiatives, the WTO demonstrates an adaptive capacity to maintain the coherence of the international trade law system amidst the proliferation of RTAs. Thus, this article concludes that fragmentation and harmonisation are not dichotomous but interrelated; the sustainability of the WTO’s multilateral system depends heavily on the capacity for coordination and harmonisation between regional and multilateral regimes in the post-pandemic era of global trade.

Abstract

Domestic violence is a form of legal and human rights violation that causes physical, psychological, sexual and economic harm to victims within the household. Law No. 23 of 2004 emphasises that the elimination of domestic violence is aimed at preventing violence, prosecuting perpetrators and protecting victims; consequently, its handling cannot be limited solely to private family matters. This study aims to analyse the legal liability of perpetrators of domestic violence through an integrated perspective of criminal and civil law in the protection of victims. The method used is a literature review, examining legislation, legal literature, and relevant academic sources regarding domestic violence, victim protection, restitution, and the restoration of victims’ rights. The findings indicate that criminal legal liability serves to affirm prohibitions, establish the perpetrator’s guilt, and impose sanctions as a form of accountability for acts of domestic violence. However, a criminal approach alone is insufficient, as victims often suffer multiple layers of harm requiring concrete redress through civil mechanisms, including claims for damages and restitution. Perma No. 1 of 2022 strengthens victim recovery by stipulating that restitution may take the form of compensation for loss of wealth or income, material and immaterial losses, medical and psychological care costs, as well as other losses directly related to the criminal offence. Thus, the protection of victims of domestic violence demands an integrated approach between criminal and civil law so that justice does not merely end with the punishment of the perpetrator, but also provides effective redress, ongoing protection, and a guarantee of dignity for the victim.

Abstract

This article aims to analyse the convergence of criminal and civil liability in criminal offences causing loss to the state through a literature review of the duality of sanctions and restitution. This issue is significant because loss to the state resulting from criminal offences, particularly corruption, requires not only the punishment of the perpetrators but also the tangible recovery of state funds through effective legal mechanisms. The findings indicate that the duality of criminal and civil sanctions constitutes a form of convergence of legal instruments, wherein criminal law serves to establish guilt and impose sanctions, whilst civil law serves to recover state losses through claims for damages, asset recovery, and restitution mechanisms. This study also found that restitution in cases of state losses cannot be narrowly interpreted as mere payment of damages, but rather as part of an asset recovery strategy that links the functions of punishment, recovery, and protection of the public interest. However, the effectiveness of this convergence still faces obstacles in the form of regulatory disharmony, limitations in asset tracing, and weak coordination between law enforcement agencies, meaning that the objective of recovering state losses has not always been optimally achieved. Therefore, there is a need to strengthen harmonisation between the criminal and civil regimes, optimise restitution mechanisms, and reformulate asset recovery policies so that law enforcement against criminal acts causing state losses can achieve justice, legal certainty, and public benefit in a balanced manner.

Abstract

This article discusses the harmonisation of criminal liability and civil damages in cases of data breaches in Indonesia as an effort to strengthen victim protection in the digital age. Breaches of personal data cause losses that are not only material but also immaterial, thus requiring a legal approach that goes beyond merely punishing the perpetrators to also restoring the victims’ rights. This study demonstrates that Law No. 27 of 2022 on Personal Data Protection has provided a normative basis for the enforcement of criminal penalties and civil compensation; however, its implementation still faces challenges regarding the burden of proof, compensation mechanisms, and the integration of criminal and civil proceedings. Therefore, harmonisation of regulations and law enforcement is required to ensure that victim protection becomes more effective, fair, and responsive to developments in digital crime.

Abstract

This study aims to analyse the effectiveness of international arbitration in post-ICSID investment dispute resolution, focusing on a comparison between the UNCITRAL and ICSID approaches to the protection of foreign investors. The research method employed is a literature review (library research) using a normative-legal approach and comparative methods to identify the strengths and weaknesses of each arbitration mechanism. The results of the study indicate that ICSID offers greater certainty of enforcement through the self-contained enforcement mechanism under Article 54 of the ICSID Convention, which binds 160 contracting states to enforce awards without the intervention of national courts, whilst also providing a standardised institutional structure and the rarity of forum neutrality. However, ICSID faces serious criticism regarding high costs, lengthy durations, inconsistencies in awards, and potential interference with the host state’s regulatory space. Conversely, UNCITRAL offers greater procedural flexibility, lower costs, and higher transparency through the 2013 UNCITRAL Rules on Transparency; however, its main weakness lies in an enforcement mechanism reliant on the 1958 New York Convention, which requires the intervention of national courts and carries the risk of refusal of enforcement. From the perspective of foreign investors prioritising enforcement certainty, ICSID is superior, whilst from the perspective of transparency and cost efficiency, UNCITRAL is more competitive. Both mechanisms continue to adapt through the reforms of UNCITRAL Working Group III and the revision of the ICSID Rules 2022 to enhance effectiveness in the protection of foreign investors.
