Abstract

Penelitian ini menganalisis penanganan korupsi dalam konteks sistem Civil Law, dengan fokus komparatif antara Indonesia dan Belanda. Indonesia, yang mengadopsi prinsip Civil Law dari warisan kolonial Belanda melalui KUHP dan UU Tipikor, menghadapi tantangan dalam penerapan hukum tertulis akibat koordinasi antar-lembaga yang terbatas, tekanan politik, dan variabilitas kepatuhan aparat publik. Sebaliknya, Belanda menerapkan mekanisme formal yang sistematis, termasuk KUHP Belanda, Dutch Public Administration Act, audit internal oleh Algemene Rekenkamer, mekanisme transparansi, dan whistleblowing, yang memastikan penegakan hukum dan pencegahan korupsi efektif. Studi ini menggunakan pendekatan yuridis normatif dan komparatif, menelaah dasar hukum, prosedur penyidikan, penuntutan, persidangan, serta mekanisme pencegahan. Hasil penelitian menunjukkan bahwa keberhasilan sistem Civil Law tidak hanya bergantung pada hukum tertulis, tetapi juga pada integritas lembaga, efektivitas prosedur, dan adaptasi terhadap konteks sosial-politik. Penelitian ini memberikan kontribusi pada pengembangan teori hukum positif serta rekomendasi praktis untuk reformasi hukum anti-korupsi di Indonesia.

Abstract

Penelitian ini membahas implementasi prinsip hukum responsive dalam penegakan hukum oleh kepolisian Indonesia sebagai upaya menjembatani sistem Civil Law yang formal dan kaku dengan kebutuhan masyarakat yang dinamis. Dengan menekankan fleksibilitas, adaptasi terhadap konteks sosial, dan keadilan kontekstual, hukum responsive memungkinkan aparat kepolisian menyeimbangkan kepatuhan terhadap KUHAP Pasal 1 ayat (1), KUHPerdata Pasal 1339, dan UU Kepolisian Pasal 13 dengan penyelesaian sengketa yang cepat, efektif, dan diterima masyarakat. Studi ini mengkaji mekanisme mediasi, musyawarah, dan penyelesaian ad hoc, serta dampaknya terhadap efektivitas penegakan hukum, legitimasi institusi, dan reformasi internal kepolisian. Hasil penelitian menunjukkan bahwa penerapan hukum responsive tidak hanya meningkatkan kepercayaan masyarakat, tetapi juga mendukung modernisasi SOP, pelatihan aparat, dan akuntabilitas institusi. Dengan demikian, hukum responsive berperan penting dalam menciptakan sistem penegakan hukum yang adaptif, relevan, dan berkeadilan substantif di Indonesia.

Abstract

This article examines the impact of the common law legal system on the development of law in Indonesia, focusing on how elements of the system have influenced national legal practice and theory. This study uses a qualitative approach through document analysis and literature studies related to the history of Indonesian law and legal practice in common law countries. The results of the study indicate that although Indonesia adheres to a civil law legal system, the influence of common law is visible in certain aspects, such as the principle of precedent, legal interpretation, and the application of customary law. In addition, this study also explores how the integration of common law elements can enrich the dynamics of Indonesian law, especially in the context of legal reform and the achievement of substantive justice. With a better understanding of this influence, it is hoped that recommendations can be produced for the development of a legal system that is more responsive and adaptive to the needs of society.

Abstract

Constitutional Court Decision Number 97/PUU-XI/2013 which in its consideration states that the Constitutional Court cannot add authority that is not contained in the 1945 Constitution, so that the Constitutional Court Decision Number 85/PUU-XX/2022 remains conditional Constitutional authority considering The Lawmakers also did not draft a special law as intended in the Constitutional Court Decision Number 97/PUU-XI/2013. The problems are (1) What are the implications of the Constitutional Court Decision No. 97/PUU-IX/2013 after the enactment of Law no. 10 of 2016 concerning the Election of Regional Heads on the Implementation of Regional Elections in Indonesia?; (2) What is the impact of resolving regional election disputes after the Constitutional Court Decision No. 85/PUU-XX/2022?; (3) What is the ideal institutional model for resolving setbacks in regional head election results? To answer this problem, a comprehensive study is needed, namely examining the 1945 Constitution, Law N0.10 of 2016, Constitutional Court Decision Number 7273/PUU-II/2004, Constitutional Court Decision Number 97/PUU-XI/ 2013, Constitutional Court Decision Number 85/PUU-XX/2022. Research Results: (1) The authority to examine and decide on the voting results of regional head elections is carried out as long as there is no special court, in order to provide legal certainty in resolving disputes over the results of simultaneous regional heads in 2024. (2) Look at the stages of regional head elections that have been advanced and have not yet been brought forward. (3) Model The ideal institution for resolving disputes over regional head election results must be a special ad hoc judicial body.

Abstract

Responsive law in Indonesia is an approach that aims to adapt the legal system to the dynamics and needs of a growing society. This article analyzes how the application of responsive law can improve justice and the effectiveness of law enforcement in Indonesia. The methodology used in this study includes a qualitative analysis of existing legal policies, in-depth interviews with legal practitioners, and case studies from several regions in Indonesia that apply the principles of responsive law. The results of the study indicate that the application of responsive law is not only able to answer emerging social challenges, but also strengthen the legitimacy of law in the eyes of the community. By integrating the values of justice and local needs in the law-making process, it is hoped that the Indonesian legal system will become more inclusive and responsive to community aspirations. This study recommends the development of more flexible and adaptive legal policies to ensure more equitable justice throughout Indonesia.

Abstract

The Job Creation Law and Government Regulation No. 8 of 2021 introduces an individual company owned by one individual. This can confuse personal and corporate interests and obscure responsibilities between directors and shareholders and is vulnerable the risk of bankruptcy. Analyzing the role of directors in the bankruptcy process through legal positivism is important to understand legal responsibilities and protections. Additionally, advances in artificial intelligence (AI) can improve decision-making efficiency and accuracy. The purpose of this study is to identify and analyze the role of directors in the bankruptcy process individual companies through the lens of positivism, as well as to explore the integration of artificial intelligence in improving board decision-making. The research method used is normative juridical, using a legislative approach and an analytical approach. The results of the study show that the board of directors has an important role in managing the bankruptcy process, especially in data-driven decision-making. In the event of bankruptcy, the board of directors faces certain legal consequences in accordance with Articles 16, 69 paragraphs (1), 97, and 104 of Law No. 37 of 2004 concerning Bankruptcy, as well as Article 93 of Law No. 40 of 2007 concerning Limited Liability Companies. Artificial intelligence has been proven help directors in analyzing risks and predicting outcomes, making decisions more informative and strategic. This study concludes that the application of positivism and artificial intelligence in the analysis of the role of directors in the bankruptcy process improves the effectiveness and efficiency of decision-making, especially in complex situations.

Abstract

Legal protection for patients in dental practice is becoming increasingly important with advancements in technology, including artificial intelligence. Positivism provides a framework for analyzing this protection, as outlined in Article 276 of Law Number 17 of 2023 concerning Health, which guarantees patients' right to complete information regarding their health condition and the medical procedures to be performed. However, challenges in implementing regulations often arise, particularly regarding the lack of clarity in the information provided by dentists to patients. The purpose of this study is to analyze the application of artificial intelligence in enhancing legal protection for patients in dental practice, as well as to explore legal protections for patients in dental practice from a positivist perspective. The research method used is normative juridical, using a statutory approach and an analytical approach. The research findings indicate that the application of AI in dentistry enhances legal protection for patients by improving diagnostic accuracy and reducing medical errors. AI also supports better data management and decision-making while increasing transparency and accountability. From a positivist perspective, the emphasis on clear regulations is crucial for protecting patients' rights, ensuring that AI not only improves service quality but also strengthens legal protection. The application of artificial intelligence in dental practice can enhance legal protection for patients by improving service quality and reducing the risk of medical errors. From a positivist perspective, the use of this technology aligns with legal principles aimed at protecting patients' rights and ensuring justice in medical practices.

Abstract

Telemedicine as part of digital health services is officially regulated in Law No. 17 of 2023 concerning Health and implemented through Government Regulation No. 28 of 2024, but has not yet discussed the role of artificial intelligence as a prescription issuing entity. Meanwhile, Law No. 1 of 2024 concerning Electronic Information and Transactions recognizes the validity of electronic documents and digital signatures, opening up legal opportunities for the digitization of medical files. The aim of this study was to evaluate the legal feasibility of automated prescribing by artificial intelligence systems in Telemedicine, in particular reviewing the void of norms governing the "signer" status of prescriptions by artificial intelligence. The research method used is normative legal research; includes the study of national legislative texts, the interpretation of key articles, as well as comparisons with international practices from the FDA (US) and EMA (European Union). The analysis shows that the current national legal regime only recognizes licensed doctors as the authorized parties to sign electronic prescriptions, so artificial intelligence can only function as a "Clinical Decision Support System" without the legal right to issue prescriptions independently. The results of the study also highlight the legal risks for artificial intelligence platform organizers and developers if automatic prescriptions are not verified by medical personnel, including potential malpractice lawsuits and violations of the Consumer Protection Law. In conclusion, to realize the issuance of prescriptions carried out by artificial intelligence, it is necessary to amend the Health Law and/or sectoral regulations that formalize algorithm certification standards, periodic audit mechanisms, and a scheme for the division of legal responsibilities between artificial intelligence developers, platform providers, and supervising doctors.

Abstract

Online Loans (Pinjol) are one form of financial technology development that was born to provide easy access to financing for the community. However, behind that, the growth of Pinjol is not accompanied by the growth of an adequate legal system. So that it has an impact on practices that lead to violations of the law such as violence, intimidation and even have an impact on human rights violations. This study was conducted to examine the urgency of legal reform regarding collection regulations on online loans that have an impact on human rights violations. This study uses a normative legal research method with a legislative approach. Based on the results of the study, it was concluded that the current regulations relating to collection in online loans, namely PJKO No. 10 / PJOK.05 / 2022 concerning Information Technology-Based Joint Funding Services, have not been fully able to provide legal protection for consumers from acts of violence in terms of collection, especially in terms of sanctions and law enforcement. Therefore, legal reform is needed based on the principles of justice, proportionality, and respect for human rights. The reform must include the establishment of more specific legal instruments, strengthening supervisory institutions, and providing harmonization between legal instruments and human rights.

Abstract

Penelitian ini menganalisis efektivitas mekanisme penyelesaian sengketa pajak di Indonesia melalui perspektif perbandingan hukum dengan sistem Common Law. Indonesia, sebagai negara dengan tradisi Civil Law, menekankan prosedur formal dan kepatuhan administratif dalam penyelesaian sengketa pajak, namun menghadapi tantangan berupa birokrasi panjang, lama waktu penyelesaian, dan kompleksitas kasus yang semakin meningkat, termasuk transaksi internasional dan transfer pricing. Sementara itu, sistem Common Law menekankan fleksibilitas hukum melalui preseden, peran hakim yang aktif, dan mekanisme penyelesaian sengketa awal melalui mediasi dan dispute resolution. Penelitian ini membahas perbedaan prinsip dasar hukum, mekanisme administrasi dan peradilan, peran lembaga dan hakim, karakteristik sengketa, serta kelebihan dan kelemahan masing-masing sistem. Hasil penelitian menunjukkan bahwa Indonesia dapat meningkatkan efektivitas penyelesaian sengketa pajak dengan mengadopsi praktik terbaik Common Law, termasuk penerapan preseden, penyederhanaan prosedur administrasi, penguatan kapasitas pengadilan pajak, dan pengembangan mekanisme mediasi, sambil tetap mempertahankan prinsip dasar Civil Law. Pendekatan ini diharapkan dapat mempercepat proses penyelesaian sengketa, meningkatkan kepatuhan wajib pajak, dan memperkuat kepercayaan publik terhadap sistem hukum pajak nasional.
