Abstract

Hukum adalah seperangkat aturan yang berisi tentang perintah, larangan dan arahan yang bertujuan untuk melindungi hak-hak yang terdapat pada manusia, atau yang lebih sering disebut dengan Hak Asasi Manusia (HAM). Di Indonesia, secara konstitusional mengenai HAM juga telah ditegaskan di dalam UUD 1945 terkhusus di dalam Bab XA UUD 1945. Pada dasarnya, salah satu hal yang penting yang akan diatur dan ditegaskan di dalam konstitusi di semua negara yang ada di dunia adalah mengenai perlindungan HAM terhadap warga negaranya. Sejarah dan gejolak HAM di Indonesia sudah sangat Panjang, terhitung sejak awal Indonesia merdeka hingga reformasi saat ini. Awal mula perhatian serius terhadap penegakan HAM di Indonesia adalah pasca jatuhnya Orde Baru, dimana tidak lama setelah jatuhnya rezim tersebut dibentuklah Undang-Undang Nomor 39 Tahun 1999 Tentang Hak Asasi Manusia. Penelitian ini menggunakan jenis penelitian normatif yuridis dengan mengaitkan pokok pembahasan terhadap topik utama di dalam penelitian ini yakni mengenai Hak Asasi Manusia. Hasil dari penelitian ini akan mengkaji keberadaan hukum yang ada di tengah-tengah masyarakat dalam konteks Hak Asasi Manusia.

Abstract

This study aims to analyze freedom of association and assembly from a human rights perspective, and explore the challenges faced in its implementation in various countries. The scope of the study includes a review of various cases of violations of the right to freedom of association and assembly, both in countries with democratic and authoritarian systems. In addition, this study will also discuss the role of international organizations and civil society in promoting and protecting these rights. This study will not only discuss the theory and basic principles of freedom of association and assembly, but will also dig deeper into how these rights are implemented in practice, the challenges faced, and steps that can be taken to strengthen the protection of these freedoms throughout the world. This study is expected to make a significant contribution to understanding the complexity of freedom of association and assembly and its impact on human rights as a whole. This study uses a qualitative approach with a case study design. The qualitative approach was chosen because it allows researchers to dig deeper into freedom of association and assembly in the context of Human Rights (HAM).

Abstract

Perbedaan perlakuan di depan hukum masih terjadi, misalnya pada dua kasus pembelaan diri yang dialami oleh MIB dan ZA. Satu kasus dihentikan oleh kepolisian, sedangkan pada kasus lainnya tidak dijadikan sebagai pertimbangan hukum. Pada Putusan Nomor 1/Pid.Sus-Anak/2020/PN.Kpn, persoalan tindakan pembelaan diri dalam perspektif persamaan di hadapan hukum, serta proses penyelesaiannya melalui keadilan restoratif menjadi bermasalah. Metode penelitian yang digunakan merupakan jenis penelitian normatif dengan pendekatan perundang-undang dan kasus. Hasil analisis menunjukkan bahwa perbedaan proses hukum dalam kasus pembelaan diri yang dialami oleh MIB dan ZA tidak mencerminkan adanya persamaan di hadapan hukum. Intervensi terhadap salah satu kasus, yakni kasus MIB dan adanya klasifikasi tertentu yang ditetapkan dalam Surat Edaran Kapolri Nomor SE/8/VII/2018 dan Peraturan Kejaksaan Republik Indonesia Nomor 15 Tahun 2020 menyebabkan upaya keadilan restoratif tidak dapat dijalankan pada proses penyidikan dan penuntutan di kasus ZA. Hal ini juga ditambah dengan penafsiran hakim yang keliru terhadap unsur pembelaan diri ZA, yang tidak mempertimbangkan ancaman pelecehan dan pemerkosaan terhadap kekasih ZA. Upaya mengakomodir keadilan restoratif melalui Putusan Nomor 1/Pid.SusAnak/2020/PN.Kpn merupakan upaya terakhir yang dapat dilakukan oleh pengadilan dalam proses peradilan. Tindakan pembelaan diri yang dilakukan oleh seseorang seharusnya dapat menerapkan konsepsi keadilan restoratif. Namun, hal tersebut masih belum dapat diterapkan sepenuhnya dan secara komprehensif.

Abstract

This study aims to examine the dilemma faced by judges in determining bankruptcy decisions, especially in the context of conflict between Supreme Court Circular Letter Number 3 of 2023 and Law 37 of 2004 concerning Bankruptcy-PKPU. The research method used is a normative research method that focuses on analyzing laws and regulations, court decisions, and related legal documents. This approach allows researchers to understand and analyze relevant legal aspects to obtain a comprehensive understanding of the judge's dilemma in determining bankruptcy decisions. In the context of normative research, the researcher conducted an in-depth study of the conflict between Supreme Court Circular Letter Number 3 Year 2023 and Law 37 Year 2004 on Bankruptcy-PKPU. This research explores how judges face the challenge of applying different regulations and their potential impact on their decisions. The analysis is conducted with reference to applicable legal principles, legal interpretations, as well as relevant cases in court practice. The results of this study are expected to contribute to clarifying the framework of thought and legal solutions to the problem of judges' dilemma in the context of bankruptcy in Indonesia. In addition, this research can also serve as a basis for stakeholders, both legal practitioners and policy makers, to consider the necessary steps to minimize legal conflicts and improve consistency and fairness in handling bankruptcy cases.

Abstract

Indonesia continues to experience persistent territorial disparities as a result of the long-standing application of symmetric decentralization, under which uniform administrative standards are imposed on regions with fundamentally different structural capacities. This approach has contributed to chronic governance underperformance and spatial injustice. The resulting mismatch between regional heterogeneity and policy uniformity underscores the need for a conceptual reorientation grounded in normative theories of justice and constitutional principles. This article aims to develop a coherent framework for asymmetric regional development capable of addressing structural inequalities while remaining consistent with the constitutional architecture of the Unitary State. Using a normative legal research approach that combines statutory analysis with case studies of Aceh, Papua, and Yogyakarta, this study investigates how asymmetric arrangements can be operationalized as both legally legitimate and philosophically justified governance models.The article presents four key contributions: first, it reconceptualizes asymmetric regional development as an ethical and constitutional imperative, grounded in Rawlsian distributive justice, Sen’s capability approach, and contemporary spatial justice theory; second, it highlights the policy pitfalls of symmetric decentralization through a critical assessment of historical and empirical evidence, including failures in regions such as Malaka; third, it introduces the Regional Inclusion Feasibility Index (IKPD) as a juridical and technocratic innovation, providing objective, multidimensional criteria for regional expansion; and fourth, it situates Indonesia’s asymmetric model within global comparative practices, demonstrating its alignment with principles of proportional autonomy and contextual justice. Collectively, these contributions position asymmetric regional development as a viable pathway toward equitable and sustainable territorial governance in Indonesia.

Abstract

This condition gives rise to various problems, particularly in resolving criminal conflicts involving vulnerable groups and local communities. This study aims to analyze the role of progressive law in resolving community criminal conflicts, as well as to identify the challenges and equitable legal solutions offered through this approach. The research employs a qualitative library-based methodology by analyzing scholarly literature, statutory regulations, and academic works relevant to progressive law and criminal conflict resolution. The findings indicate that progressive law is capable of providing more humane and contextual solutions through the application of restorative justice, penal mediation, and community-based approaches. Nevertheless, its implementation still faces structural, cultural, and institutional obstacles. Therefore, a paradigm shift in law enforcement and strengthened commitment from all stakeholders are required so that progressive law can function optimally in realizing sustainable justice.

Abstract

This study aims to analyze the dynamics of agrarian conflicts in Indonesia using a sociological perspective on law, particularly in the context of land dispute resolution. This study uses a socio-legal approach by combining normative analysis of agrarian legislation and conceptual studies of legal sociology to understand the interaction between law, social structures, and power relations in the practice of land dispute resolution. The results show that the existence of agrarian regulations has not been fully able to realize substantive justice because their implementation is often influenced by social inequality, the dominance of economic interests, and the weak bargaining position of the community, especially farmers and marginalized groups. In practice, the law not only functions as a normative instrument but also reflects the configuration of power at work in society. Therefore, the resolution of agrarian conflicts requires an approach that is not merely legal-formal, but also sensitive to the social context, distributive justice, and the protection of land rights in a sustainable manner. Keywords: Agrarian Conflict; Sociology of Law; Land Disputes; Social Justice

Abstract

Abstract

Fenomena overcriminalization dalam sistem hukum pidana Indonesia semakin menonjol seiring dengan berkembangnya regulasi yang cenderung menempatkan hukum pidana sebagai instrumen utama penyelesaian masalah sosial. Kondisi ini menimbulkan problematika serius karena melahirkan inflasi kriminalisasi, mempersempit ruang kebebasan individu, serta berpotensi bertentangan dengan prinsip-prinsip konstitusional yang dijamin dalam UUD 1945, terutama mengenai hak asasi manusia dan asas legalitas. Selain itu, penggunaan hukum pidana yang berlebihan kerap mengabaikan nilai-nilai dasar Pancasila sebagai ideologi bangsa yang menekankan keseimbangan antara keadilan, kemanusiaan, dan kemaslahatan sosial. Kajian ini bertujuan untuk mengkaji secara kritis implikasi overcriminalization terhadap prinsip konstitusionalitas dan Pancasila, serta menawarkan alternatif pendekatan dalam perumusan kebijakan pidana yang lebih proporsional. Metodologi yang digunakan adalah penelitian hukum normatif dengan pendekatan konseptual, perundang-undangan, dan komparatif, melalui analisis literatur, doktrin hukum, serta putusan pengadilan relevan. Hasil penelitian menunjukkan bahwa overcriminalization berpotensi mengikis jaminan konstitusional warga negara, melemahkan legitimasi hukum, dan bertentangan dengan semangat keadilan sosial yang menjadi pilar utama Pancasila. Oleh karena itu, diperlukan pembatasan yang tegas dalam penggunaan instrumen pidana dengan mengedepankan prinsip ultimum remedium, rasionalisasi peraturan perundang-undangan, serta penguatan nilai-nilai Pancasila dalam kebijakan kriminal agar hukum pidana tetap selaras dengan cita hukum Indonesia.

Abstract

Urban green-space conflicts have emerged as a significant challenge for marginalized communities, exacerbating existing social and environmental inequalities in cities undergoing rapid urbanization and environmental transitions. This study explores the dynamics of access to justice for marginalized groups in the context of urban green-space conflicts, focusing on the barriers they face and the enabling factors that improve their ability to access legal remedies. Through a socio-legal research design, data was collected using surveys, case reviews, and stakeholder interviews, which were analyzed to identify key physical, socio-economic, and institutional barriers that hinder equitable access to green spaces. Findings revealed that marginalized communities often experience physical barriers such as limited proximity to green spaces, socio-economic disparities that prevent them from accessing legal resources, and institutional constraints, including discriminatory urban planning policies. Despite these challenges, enabling factors such as legal aid networks, participatory forums, and inclusive urban planning policies emerged as crucial elements in improving access to justice for these communities. Moreover, the study examined the impact of social and environmental transitions, such as urbanization and climate change, on justice outcomes, showing that these transitions can either exacerbate or alleviate barriers depending on how policies are implemented. The study emphasizes the need for policy reforms that promote equity in urban planning and legal aid systems, ensuring that marginalized communities are included in decision-making processes. Future research should explore the impact of environmental justice policies in global contexts and investigate new legal frameworks to address the specific needs of vulnerable populations.
