Abstract

The Tax Court has a crucial role in resolving tax disputes and optimizing state revenues. This study aims to analyze the effectiveness of the Tax Court in providing legal certainty for taxpayers and identifying obstacles that hinder its role in the Indonesian taxation system. The method used is a normative legal approach with an analysis of laws and regulations, court decisions, and related empirical data. The results of the study indicate that the dualism of guidance between the Supreme Court and the Ministry of Finance creates the potential for a conflict of interest that can affect the independence of judges in deciding tax disputes. In addition, limited access to the Tax Court, which is only located in Jakarta, causes obstacles for taxpayers in the regions to obtain justice quickly and efficiently. The policy of administrative sanctions in the form of a 100% fine for taxpayers whose appeals are rejected is also considered disproportionate and contrary to the principle of tax justice. To improve the effectiveness of the Tax Court, institutional reform is needed by unifying guidance under the Supreme Court, establishing Tax Court branches in various regions, and revising regulations related to tax sanctions in order to improve taxpayer compliance and trust in the national taxation system.

Abstract

This study aims to analyze the influence of organizing sports events on economic growth in Indonesia during the endemic transition period and legal regulations on sports events during the endemic transition period. Using normative juridical and normative empirical methods with a qualitative approach, this study examines relevant legal norms, such as the Indonesian Sports Law, on the influence of the country's economy in organizing sports events. Data were obtained from documentation of primary and secondary legal sources and interviews to understand the factors of economic growth through the sports industry. The results of this study indicate that the influence on economic growth through organizing sports events in Indonesia during the endemic transition period has not been fully accommodated by existing regulations. During the endemic transition period until now, the government and several sectors that work together to boost economic growth in Indonesia have not maximized the existing opportunities. However, with the weak implementation of regulations even though regulations regarding the sports industry have been written in the law. So that inappropriate implementation can hinder economic growth, as well as the occurrence of individuals who violate and damage existing facilities and the occurrence of budget efficiency in 2025 also affect the implementation of sports events. This study recommends that the government, private sector, and community collaborate to improve infrastructure evenly and maintain and build local and international appeal through the sports industry to become a source of foreign exchange for the country like developed countries.

Abstract

Appreciation of IPR in Indonesia is still relatively low and many people consider IPR to be unimportant and even many lay people do not understand IPR. One of them is the protection of trade secrets which plays an important role for both personal and public interests. The research method is normative legal with prescriptive data analysis. Trade secrets cover aspects of pre-production to post-production, including marketing and sales. The use of trade secrets without permission and approval from other parties is a violation of Law Number 30 of 2000 concerning Trade Secrets. The use of information includes production methods, frying, grinding, to marketing and sales of CV ground coffee. Tiga Putra Berlian resembles CV. Bintang Harapan by recruiting employees, offering coffee products that have been produced to CV customers. Bintang Harapan, causing losses and violating Article 17 of Law Number 30 of 2000.

Abstract

Forced marriage of child victims of rape is a phenomenon that places children in a position of double victimization, both as victims of sexual crimes and as subjects who lose their human rights to determine their future freely and with dignity. This research aims to examine forced marriage in the framework of sexual violence against children from the perspective of criminal law and human rights. In its approach, this research uses a normative juridical method with a statutory approach, conceptual approach, comparative approach, and case approach. The results show that forced marriage not only violates children's rights to protection from sexual violence as stipulated in Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence, but also violates the principles of non-discrimination, the best interests of the child, and the right to physical and psychological integrity as guaranteed in the Convention on the Rights of the Child (CRC) and other international human rights instruments. This research emphasizes the importance of legal recognition of forced marriage as a form of sexual violence and the need for a comprehensive policy in the handling and recovery of child victims.

Abstract

The use of non-cash payments is increasingly becoming a trend among Indonesians, both in urban and rural areas. Non-cash payment instruments are considered more effective in supporting transaction activities and contribute significantly as the main driver of national economic growth. The state, as the organizer of public welfare, is obliged to carry out various activities to achieve the welfare of the people, as mandated in the Preamble of the 1945 Constitution of the Republic of Indonesia. In the beginning, money as a medium of exchange was in concrete form such as coins and banknotes. However, rapid technological developments encourage the birth of innovation in payment systems through electronic methods, to support the optimization of the use of non-cash payment instruments (less cash), so that a society with digital-based financial transactions is formed (less cash society). This research uses a normative juridical approach, relying on secondary data obtained from primary legal materials, secondary legal materials, and tertiary legal materials. The main focus of this research is to analyze the influence of the National Non-Cash Movement (GNNT) on social changes in the economic field. Based on the provisions of Article 1 point 3 of Bank Indonesia Regulation Number 16/8/PBI/2014 concerning Amendments to Bank Indonesia Regulation Number 11/12/PBI/2009 concerning Electronic Money, it is stated that electronic money is a payment instrument that fulfills a number of certain elements related to its use.

Abstract

The Environmental Impact Assessment (AMDAL) licensing process in Indonesia faces significant challenges regarding meaningful public participation, particularly following the implementation of the Job Creation Law (UU Cipta Kerja). Objective: This research analyzes the urgency for reconstructing public participation mechanisms in AMDAL formation and proposes ideal regulatory frameworks for enhanced community involvement in environmental decision-making processes. This normative legal research employs conceptual and statutory approaches, utilizing qualitative descriptive analysis of legal materials including primary sources (legislation and court decisions) and secondary sources (legal literature and scholarly articles). The study reveals that post-Job Creation Law implementation has significantly restricted public participation scope, limiting involvement to only directly affected communities while excluding environmental advocates and civil society organizations from AMDAL processes. The transition from AMDAL Assessment Commission to Environmental Feasibility Assessment Team has further centralized decision-making authority and reduced community representation. Reconstruction of public participation mechanisms is urgently needed to restore meaningful community involvement, implement good environmental governance principles, and ensure transparency, accountability, and inclusive stakeholder engagement in environmental impact assessment processes.

Abstract

Environmental law enforcement provides space for environmental organizations to file lawsuits in the interests of environmental conservation as regulated in Article 92 of Law Number 32 of 2009 concerning Environmental Protection and Management. However, in practice, the right to sue environmental organizations is not always accepted by the courts, especially when it concerns certain areas such as Limited Production Forests. This study aims to analyze the material of environmental organizations' lawsuits based on Decree Number 16/PDT.G/LH/2023/PN.BKN. This study uses a normative juridical method and a case study approach with data sources in the form of court decision documents and related laws and regulations. The results of the study show that in this case, this Decision shows that it recognizes the active role of environmental organizations in supervising and suing permit applications for forest areas. In this case, the plaintiff organization argued that the defendant's actions in carrying out exploitation activities in the Limited Production Forest area had violated the law and harmed the ecological function of the forest, thus fulfilling the elements of an unlawful act as regulated in Article 1365 of the Civil Code. This finding resulted in an understanding of the analysis related to the material of the environmental organization's right to sue as an instrument of social control and supervision of forest area utilization policies.

Abstract

Sengketa Laut China Selatan merupakan salah satu isu paling kompleks dan strategis di kawasan Asia Pasifik, melibatkan berbagai negara dengan klaim tumpang tindih atas wilayah dan sumber daya alam yang melimpah. Konflik ini tidak hanya mencerminkan persaingan klaim teritorial, tetapi juga kepentingan politik, ekonomi, dan keamanan regional yang saling bertautan. China, dengan pendekatan asertif dan strategi “gray zone”, berupaya memperkuat dominasinya di kawasan melalui pembangunan infrastruktur, kehadiran militer, dan diplomasi ekonomi, sementara negara-negara ASEAN serta kekuatan eksternal seperti Amerika Serikat berupaya menyeimbangkan kepentingan keamanan dan ekonomi mereka di tengah tekanan Beijing. Ketergantungan ekonomi negara-negara Asia Tenggara terhadap China menjadi dilema tersendiri, di mana upaya menegakkan kedaulatan harus diimbangi dengan menjaga stabilitas ekonomi nasional. Di sisi lain, keterlibatan Amerika Serikat dan sekutunya menambah dimensi geopolitik yang semakin kompleks, menjadikan Laut China Selatan sebagai arena persaingan pengaruh global dan pengujian efektivitas norma hukum internasional. Dinamika ini menuntut pendekatan multidimensi dan kerja sama regional yang kuat guna mencegah eskalasi konflik dan menjaga stabilitas kawasan.

Abstract

Perkembangan teknologi digital yang sangat pesat telah mengubah wajah inovasi global dan mendorong lahirnya berbagai invensi berbasis perangkat lunak, kecerdasan buatan, Internet of Things (IoT), blockchain, hingga big data. Di perkembangan teknologi digital ini, keberadaan sistem perlindungan hukum terhadap suatu invensi menjadi sangat penting untuk menjaga hak eksklusif para pencipta serta mendorong inovasi keberlanjutan. Namun, pada negara berkembang khususnya Indonesia, sistem hukum paten masih menghadapi berbagai tantangan dalam merespons karakteristik unik dari inovasi digital yang berisfat dinamis, nonkonvensional dan lintas batas. Tantangan tersebut meliputi keterbatasan regulasi, kurangnya literasi hukum paten, biaya administrasi yang tinggi dan belum optimalnya kapasitas institusional yang berpotensi menghambat perkembangan inovasi local dan menurunkan daya saing global yang mana berpotensi untuk melemahkan daya saing nasional di pasar global seta mengurangi insentif bagi para innovator untuk melindungi dan mengkomersialkan hasil karya mereka. Penelitian ini bertujuan untuk mengidentifikasi tantangan utama yang dihadapi negara berkembang dalam melindungi invensi digital melalui sistem paten dan menawarkan solusi untuk menjadikan sistem hukum paten kuat, inkulisif dan adaptif terhadap perkembangan teknologi, dengan solusi tersebut diharapkan negara berkembang dapat lebih maksimal dan memberdayakan potensi innovator local dan berperan aktif dalam ekositem dan inovasi global.

Abstract

Strategic Lawsuit Against Public Participation (SLAPP) has posed a serious challenge to environmental protection in Indonesia. Cases such as Walhi vs PT Jatim Jaya Perkasa and PT Bumi Mekar Hijau vs the Government of South Sumatra Province and Walhi illustrate how SLAPP is used by corporations to intimidate and silence environmental activists. This article analyzes the mechanisms and strategies of SLAPP as well as its psychological and social impacts. The literature study method is employed to gather data from various sources. The conclusion is that SLAPP not only has legal implications but also imposes heavy psychological and social burdens on activists, including fear, isolation, and social polarization within communities. Therefore, strong legal protection, increased civil society capacity, and cross-sectoral collaboration are needed to combat SLAPP practices and ensure a more conducive environment for sustainable and effective environmental advocacy.
