Abstract

This study aims to analyze the historical of general election postponements in Indonesia, along with the legal basis and constitutional implications of delaying elections without a legitimate emergency. As the primary instrument of popular sovereignty, elections must be held periodically, fairly, and in accordance with the constitution. In this regard, postponing an election without a solid legal foundation could trigger legitimacy crises and constitutional disputes. The method used in this study is normative juridical research with a statute, conceptual approach and historical approach, with the data analyzed qualitatively and descriptively. The novelty of this study lies in its comprehensive review of the historical dynamics and legal framework surrounding election postponements from the era of Parliamentary Democracy to the Reform Era with a specific focus on the legal gap in responding to non-natural disasters such as the COVID-19 pandemic. The findings reveal that election postponements in Indonesia have often been linked to political and security crises, though not always grounded in a democratic legal process. The results of this study show that the postponement of elections in Indonesia has historically been influenced by political instability, legal ambiguity, and emergency situations, such as armed conflict or the COVID-19 pandemic. Despite these challenges, the legal framework in Indonesia lacks specific provisions regarding systematic election postponement, especially in the case of non-natural disasters. The ambiguity in interpreting terms like “other disturbances” under existing electoral laws has led to varying legal opinions and uncertainty in implementation. The conclusion of this study is that the postponement of elections can only be justified in the presence of a real and constitutionally recognized state of emergency. The absence of a clear legal framework poses a risk to democratic integrity and public trust. Therefore, the study emphasizes the urgent need to revise and strengthen electoral regulations by clearly outlining the procedures, legal basis, and conditions under which elections may be postponed, ensuring the protection of citizens’ constitutional rights in all circumstances.

Abstract

This research aims to examine further regulations regarding the provisions of Article 8 paragraph 3 of the 1945 Constitution of the Republic of Indonesia. The Republic of Indonesia declares itself to be a legal state, which means that all aspects of the state must be based on the rule of law. On the other hand, the President of the Republic of Indonesia acts as both head of state and head of government, which indicates the nature of a presidential republic. Therefore, the position of President cannot be vacant because this position is so important and central. The research method used in this research is qualitative method with normative juridical analysis, namely explaining the legal norms that should be fulfilled (das sollen ) compared to the current situation (das sein). This research is also descriptive in nature, namely by describing the existence of a legal vacuum in the field of state administration, especially filling the position of interim president in Indonesia and its relationship with the threat of emergencies. The country's constitution regulates how to fill the vacancy in the presidential position in the event that the President and Vice President are permanently absent at the same time. However, this provision must be further regulated through laws and implementing regulations based on law. Twenty-two years have passed since the last amendment to the constitution but there is no legal regulation regarding this matter even though this situation is a threat and could result in a state of emergency status in the country. To facilitate the consideration and formulation of filling the position of president, the author presents a comparison with several countries so that it can be used which one is most suitable for the conditions of the Republic of Indonesia.

Abstract

In a political system which is interconnected between government departments and elements of society in a nation, there is always social interaction that influences each other. This influence has an impact on the configuration of interests formed in a legal product. Law is a means to achieve political goals, therefore in every stage of its formation and implementation there is a lot of partisanship from political stakeholders. In a democratic country, the supreme power is in the hands of the people which is manifested in a legislative institution with a periodic replacement cycle. However, competition between political groups is an inevitability that requires qualified regulation, including in emergency situations. One country that has a political system similar to Indonesia and has experienced disruptive politics and legal reform is the Philippines. Hopefully this study will create awareness for mitigation in dealing with similar emergency situations.

Abstract

Majelis Permusyawaratan Rakyat sudah menyelenggarakan sidang tahunan untuk memfasilitasi lembaga negara menyampaikan laporan kinerjanya kepada masyarakat. di era reformasi, sidang tahunan MPR pertama kali digelar Majelis Permusyawaratan Rakyat berdasarkan Ketetapan MPR Nomor II/MPR Tahun 1999 tentang Peraturan Tata Tertib Majelis Permusyawaratan Rakyat agar masyarakat mendapatkan informasi tentang lembaga negara selama kurun waktu satu tahun. Perkembangan pelaksanaan tugas ini sebagai bentuk akuntabilitas lembaga negara kepada masyarakat. Sidang Tahunan MPR menempati kedudukan yang tinggi sebagai konvensi ketatanegaraan yang melengkapi kaidah konstitusional dalam praktik penyelenggaraan kehidupan berbangsa dan bernegara, amanat rakyat yang dibawa oleh 8 lembaga negara harus disampaikan dengan transparan dengan mekanisme yang tepat. Penelitian ini merupakan penelitian hukum normatif melalui studi kepustakaan yang dilakukan dengan menggunakan 3 (tiga) pendekatan yaitu pendekatan peraturan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), serta pendekatan kasus (case approach). Penelitian ini mengkaji pengaruh konvensi tersebut sebagai wadah untuk mewujudkan transparansi kinerja lembaga negara dan praktik ketata negaraan-nya sesuai dengan koridor konstitusional negara Republik Indonesia. Terdapat beberapa faktor yang menentukan transparansi negara, salah satunya adalah pencegahan korupsi. Melalui kewenangan presiden, Presiden memiliki peran yang sentral dalam jalan nya konstitusi di Indonesia. Penegakan hukum dalam kasus korupsi harus dijalankan sesuai dengan undang-undang yang berlaku. Diharapkan dengan adanya Transparansi akan menjadi kunci dalam memerangi korupsi. Dengan demikian, peran presiden sangat vital dalam menangani korupsi, dan kemauan serta komitmen presiden dalam memerangi korupsi akan sangat memengaruhi keberhasilan upaya pemberantasan korupsi di suatu negara baik itu melalui pembentukan lembaga negara tertentu misalnya KPK atau melalui konvensi tata negara seperti rapat tahunan MPR.

Abstract

International trademark infringement poses a complex challenge for brand owners due to jurisdictional variations and differing legal systems across countries. This study examines available legal remedies, ranging from non-litigation dispute resolution mechanisms such as Alternative Dispute Resolution (ADR) - encompassing negotiation, mediation, and arbitration - to formal litigation in national courts. ADR offers advantages in time efficiency, cost-effectiveness, and confidentiality, while litigation provides legal certainty through binding court decisions such as injunctions and damages awards. Preventive strategies including international trademark registration through the Madrid System and cooperation with customs authorities serve as crucial proactive protection measures. Furthermore, this research analyzes judicial considerations in cross-industry trademark disputes, including assessment of trademark similarity (visual, phonetic, conceptual), reputation of well-known marks, bad faith of infringers, and potential consumer confusion. Case studies such as Louis Vuitton vs. Louis Vuitton Dak and Zara Food vs. Zara Fashion demonstrate judicial application of the likelihood of confusion principle and anti-dilution doctrine even across different industries. The research employs normative legal methodology with statutory and secondary document analysis approaches. Findings confirm that legal strategy selection must consider infringement scale, jurisdiction, and business objectives, while international trademark protection requires integration of proactive registration, legal enforcement, and comprehensive understanding of global market dynamics.

Abstract

The meaning of defending the country is a manifestation of our love for the Unitary State of the Republic of Indonesia. Defending the State is not the responsibility of the TNI or Police alone, but defending the State is our collective responsibility as citizens of the Indonesian community to protect Indonesia from all kinds of threats both from within and outside in order to maintain the integrity of the Unitary State of the Republic of Indonesia. Along with the development of technology, Indonesia is currently entering the era of digitalization. In the era of digitalization, attacks or threats to the country are not only in the form of physical attacks, but also cyber attacks that attack a country in the economic, political and military fields using attacks due to technological advances. This is the focus of this research. The question of this research is what are the factors that influence the challenges of the digital era in society and how to apply the value of defending the country in facing the challenges of the digital era. To obtain answers, this research uses yuridis normative methods or library research, meaning that this research is based on on library sources to discuss the problems that have been formulated. From the results of this research, it can be concluded that in realizing actions to defend the country, it is necessary to instill a sense of love for Indonesia's air, and by remembering that Indonesia is a country with a lot of diversity, it is necessary to instill a sense of tolerance in the minds of the souls of Indonesian citizens. One of the very important basic elements of the digital era is being critical in responding to content. Indonesian citizens today must be smarter in absorbing content and information and encourage Indonesian citizens and society to always be critical and suspicious, especially regarding content that is too bombarded, meaningless, and full of nuances of hatred To ensure that the unitary Republic of Indonesia remains intact and peaceful.

Abstract

Suatu negara yang memiliki kemandirian dalam sektor industri pertahanan memperoleh keunggulan strategis di tingkat global. Kemandirian ini tidak terlepas dari adopsi teknologi canggih dalam industri pertahanan, yang melibatkan perlindungan Hak Kekayaan Intelektual (HKI). Studi ini menggunakan pendekatan yuridis normatif dengan menganalisis bahan hukum secara deskriptif analitis. Temuan penelitian menunjukkan bahwa Indonesia, sebagai anggota WTO yang telah meratifikasi TRIPs, mengharuskan penyesuaian Undang-Undang terkait HKI di dalam negeri. Ketentuan hukum mencakup aspek-aspek seperti merek dan indikasi geografis, hak cipta, paten, kerahasiaan dagang, desain tata letak sirkuit terpadu, desain industri, dan perlindungan varietas tanaman. Teknologi, terutama dalam konteks industri pertahanan, menjadi fokus perlindungan HKI, termasuk paten yang diatur dalam UU No. 13 Tahun 2016 tentang Paten. Dalam konteks industri pertahanan Indonesia, peran HKI menjadi krusial dalam beberapa aspek, yaitu sebagai alat persaingan dagang, mendorong kemajuan ilmu pengetahuan dan teknologi, meningkatkan kesejahteraan ekonomi masyarakat (terutama para peneliti), dan sebagai sumber pendapatan bagi negara. Kata Kunci: Hak Kekayaan Intelektual, Pertahanan, Teknologi A nation possessing an autonomous defense industry holds a strategic edge on the global stage. The autonomy of the defense sector is closely linked to its sophisticated technology, with the safeguarding of Intellectual Property Rights (IPR) playing a pivotal role. This research adopts a normative juridical approach and conducts a descriptive-analytical analysis of legal materials. The results indicate that Indonesia, being a member of the WTO and a signatory of TRIPs, must adjust various IPR laws to align with TRIPs provisions. Legal provisions cover areas such as trademarks, geographical indications, copyrights, patents, trade secrets, integrated circuit layout designs, industrial designs, and plant variety protection. In the realm of defense technology, IPR protection takes center stage, particularly through patents regulated by Law Number 13 of 2016 concerning Patents. Within the Indonesian defense industry, IPR assumes a critical role, serving as a tool for trade competition, a catalyst for scientific and technological advancement, a means to enhance the economic well-being of the community, especially researchers, and a source of state revenue. Abstract

The production of clothing produced by the textile industry cannot be separated from the use of dyes. The dyes that have been used of course become waste which can have an impact on the damage to the water ecosystem if they do not go through a waste treatment process. This research discusses the extent to which law enforcement has been carried out regarding the behavior of the textile industry which disposes of its clothing dye liquid waste haphazardly when viewed from statutory regulations. In this research the author uses normative legal research methods using legal sources from primary legal materials in the form of environmental law legislation and secondary legal materials in the form of books and articles regarding waste management. The conclusion obtained in this paper is that liquid textile dye waste is a dangerous waste that can damage the condition of water and river environments if its disposal is not based on the provisions of applicable laws and regulations.

Abstract

Used goods are often considered garbage, but waste management is a serious problem in Indonesia, especially with increasing waste consumption and high poverty rates. Bank Sampah is emerging as a solution by managing used goods that have economic value, governed by environmental regulations. Although Bank Sampah is growing, there is no clear regulation on the legal entity used, especially in cooperation with third parties. Waste Bank with a sharia financial system has also emerged, but it is not yet clear in accordance with the applicable sharia banking regulations. The approach method used is normative juridical, analysing laws and regulations through literature study with the main study material in the form of regulations and secondary and tertiary materials. The results showed that the Waste Bank is a government solution with the 3R principle, involving the participation of the community, business entities, and local governments. Islamic Waste Banks such as iqtishadia in Pasong Village, Sumenep, are not only a place for collecting waste, but also conduct community assistance programmes. The Waste Bank helps alleviate poverty and the environmental law approach is key in achieving effective structuring and improving the environment.

Abstract

The development of Solar Photovoltaic Power Plants (SPPVs) as Renewable Energy in Indonesia is increasingly growing. However, SPPVs have a relatively short lifespan, necessitating the proper management of their waste, particularly solar panels. This research aims are, firstly, to analyse the regulations governing the parties responsible for managing waste from SPPVs that have reached the end of their lifespan. And, secondly, to compare waste management regulations for solar panels implemented in Europe and America as best practices for handling end-of-life SPPV waste. This research employs a normative juridical and comparative-descriptive research method, comparing regulations and implementation of SPPV waste management in Indonesia and other countries. The Finding of this research are in line with Law No. 32 of 2009 on Environmental Protection and Management and Government Regulation No. 22 of 2021, which states that any person or business entity generating waste is obligated to handle and restore it, in practice, the Power Purchase Agreement stipulates that waste management of SPPVs is the responsibility of the winning Project Company (in this case, the Consortium). And, in Europe and several US states have issued regulations for managing waste from end-of-life SPPVs. These regulations require solar panel manufacturers to have a recycling program for their own products after their end-of-life. However, managing end-of-life solar panel waste is a complex issue that requires cooperation from various stakeholders, including the government, project companies, and solar panel manufacturers. Adopting waste management policies from Europe and America is recommended to ensure that SPPV waste management is conducted responsibly and environmentally friendly.
