Abstract

Penelitian ini bertujuan untuk menganalisis implikasi penerapan teori penemuan hukum terhadap tiga tujuan utama hukum, yaitu kepastian hukum, keadilan, dan kemanfaatan dalam praktik peradilan di Indonesia. Teori penemuan hukum (rechtsvinding) menempatkan hakim tidak sekadar sebagai penerap undang-undang, tetapi juga sebagai penafsir dan pembentuk hukum yang berperan penting dalam mengisi kekosongan, mengatasi ambiguitas, dan menyesuaikan hukum dengan dinamika sosial. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan konseptual dan kasus (case approach), melalui analisis terhadap bahan hukum primer seperti putusan Mahkamah Konstitusi dan Mahkamah Agung, serta bahan hukum sekunder dari literatur ilmiah terkait. Hasil penelitian menunjukkan bahwa penerapan teori penemuan hukum berimplikasi positif terhadap sistem peradilan di Indonesia. Dalam aspek kepastian hukum, teori ini membantu memberikan kejelasan dan konsistensi dalam penerapan hukum tanpa mengabaikan asas legalitas. Dalam aspek keadilan, teori penemuan hukum memungkinkan hakim mewujudkan keadilan substantif melalui interpretasi yang sesuai dengan nilai-nilai sosial dan konstitusional. Sementara dalam aspek kemanfaatan, teori ini menjadikan hukum lebih fungsional dan adaptif terhadap perubahan masyarakat. Namun, penerapan teori ini juga menuntut kehati-hatian agar kreativitas hakim tidak melampaui batas kewenangan konstitusional. Dengan demikian, keseimbangan antara kepastian, keadilan, dan kemanfaatan menjadi kunci utama dalam mewujudkan praktik peradilan yang progresif dan berkeadilan di Indonesia.

Abstract

This research focuses on the civil-military supremacy principle within the context of Indonesia’s constitutional democracy, specifically post-2024 political and legal developments. The study examines how the relationship between civilian authorities and the military has evolved, highlighting the institutional resistance within the Indonesian military that challenges civil supremacy. The chosen topic is vital due to the increasing influence of the military in civilian affairs, notably in the political and administrative sectors. Utilizing a normative juridical-critical methodology, this research analyzes primary legal texts, such as the 1945 Constitution, the Indonesian National Army Law (UU TNI), and the Military Court Law, alongside recent amendments. It explores the inconsistency between Indonesia's formal civil supremacy principles and the military’s continued privileges, which hinder the full implementation of democratic governance. The research also highlights the growing political and institutional dynamics, including the controversial expansion of military roles post-2024 and its implications on national security and civilian control. The findings suggest that institutional military resistance to civil supremacy has resulted in legal dualism, undermining the rule of law and democratic consolidation. The study contributes to understanding the challenges of strengthening civilian authority in Indonesia's governance and offers recommendations for legal reforms, including the integration of military and civilian judicial systems, increased civil society oversight, and sustainable policymaking. Ultimately, this research underscores the critical need to preserve civilian supremacy to protect Indonesia's constitutional democracy

Abstract

This research examines the application of progressive legal theory in judicial legal discovery by commercial court judges through a case study of the bankruptcy of PT Sri Rejeki Isman Tbk (Sritex). The study employs a normative juridical method by analyzing legal doctrines and the ratio decidendi of the decision. The results show that (1) legal discovery is required in issues of simple proof, debt verification, stay period, and the rights of secured creditors. (2) judges apply systematic and teleological interpretation to balance certainty, justice, and utility. (3) the absence of adoption of the UNCITRAL Model Law necessitates cross-border legal construction. It concludes that progressive law effectively prevents rigid formalism and promotes substantive justice. Recommendations: reinterpretation of “simple proof,” protection of weaker parties, and cross-border harmonization.

Abstract

Putusan Mahkamah Konstitusi Nomor 3/PUU-XXII/2024 mengukuhkan pembebasan biaya pendidikan dasar dan menengah sebagai hak konstitusional warga negara yang harus dijamin secara cuma-cuma oleh negara. Penelitian hukum normatif ini menelaah norma hukum positif dalam Pasal 31 UUD 1945, Undang-Undang Sisdiknas, serta putusan tersebut untuk menjawab dua rumusan masalah: (1) apakah pembebasan biaya dalam program wajib belajar 12 tahun dapat dikategorikan sebagai hak konstitusional; dan (2) bagaimana peran negara memenuhi program itu pasca putusan. Dengan pendekatan perundang-undangan, kasus, dan konseptual, disimpulkan bahwa MK telah melakukan expansive interpretation terhadap “wajib belajar” sehingga mencakup kewajiban negara membiayai seluruh jenjang dasar-menengah tanpa kecuali. Kewajiban konkuren pemerintah pusat-daerah harus diwujudkan melalui alokasi anggaran, regulasi teknis, dan mekanisme akuntabilitas yang mencegah praktik penarikan biaya ilegal. Putusan ini sekaligus menjadi kompas untuk harmonisasi peraturan turunan agar pendidikan benar-benar gratis, inklusif, dan nondiskriminatif.

Abstract

The red and white flag is one of the national identities that symbolises the sovereignty of the Indonesian state. This research aims to explain the resistance raised by the community. The normative juridical approach method is an approach based on primary legal materials by examining theories, concepts, legal principles and laws and regulations. The results showed that state symbols, such as the red and white flag, have a deep meaning in Indonesia's national identity. Actions that denigrate the dignity of the state and its symbols can have a negative impact on the unity and pride of the community.

Abstract

Recommendations issued by the Ombudsman of the Republic of Indonesia are a crucial instrument for upholding administrative justice and preventing maladministration in public service delivery. This study aims to analyze the Ombudsman’s authority in issuing recommendations and examine its relationship to legal discovery theory, as well as its reflection of justice values in government administration. Using a normative juridical method through a literature-based review of legal scholarship, legislation, and relevant Ombudsman recommendations, the study finds that these recommendations function not merely as administrative decisions but also as a manifestation of the legal discovery process. In interpreting norms and determining appropriate remedies for public reports, the Ombudsman applies principles of legality and good governance while balancing legal certainty, utility, and justice. The study concludes that the Ombudsman’s recommendation authority plays a substantive role in strengthening accountability in public administration and ensuring that government actions remain aligned with citizens’ rights and the broader principles of administrative justice.

Abstract

Indonesia's crypto asset and Non-Fungible Token (NFT) ecosystem has grown at a pace that substantially outstrips its regulatory readiness. By early 2025, the number of domestic crypto users had reached 22.9 million accounts, with total transaction value throughout 2024 amounting to IDR 650.61 trillion — positioning Indonesia as one of Southeast Asia's largest crypto markets. Against this backdrop, cumulative tax revenue from the sector stood at only IDR 1.19 trillion since 2022, falling far short of its actual fiscal potential. This study examines two core issues: first, how the legal construction of crypto asset and NFT taxation stands up to scrutiny under the principle of legal certainty in tax law; and second, whether the current tax collection mechanism adequately satisfies the principles of equity and efficiency as instruments of state revenue. Employing normative legal research with statutory and conceptual approaches, this study finds that Indonesia's crypto tax framework contains significant normative gaps, most notably the absence of any specific legal basis governing NFT taxation. The successive amendments from PMK 68/2022 through PMK 81/2024 to PMK 50/2025 reflect an adaptive effort that remains incomplete. From a fiscal equity perspective, the flat-rate Final Income Tax scheme is inconsistent with the ability-to-pay principle, as it treats small and large investors identically. This study concludes that statutory-level regulation explicitly addressing NFTs is urgently needed, alongside a shift toward a more equitable rate structure.

Abstract

This study examines the legal certainty of administrative appeals against the dismissal of civil servants (PNS) after serving criminal sentences, focusing on the role and authority of the State Civil Apparatus Advisory Board (BPASN). Using a normative juridical method with statutory and conceptual approaches, this research analyzes relevant legislation, legal doctrines, and a concrete case involving the dismissal of a civil servant despite evidence of timely reinstatement efforts. The findings reveal that the application of administrative law in such cases tends to be overly formalistic, often disregarding substantive evidence that reflects compliance with legal obligations. This condition undermines the principle of legal certainty, which requires not only clarity of norms but also consistency and fairness in their application. Furthermore, the study highlights the significant role of BPASN as a quasi-judicial body that ensures legal protection through material examination of facts and correction of administrative errors. From the perspective of proportionality, the imposition of dismissal as a severe sanction is deemed inappropriate when mitigating factors and good faith actions are evident. Therefore, the study concludes that achieving legal certainty in civil servant dismissal cases requires a balanced approach that integrates formal procedures, substantive justice, and careful administrative judgment.

Abstract

This study examines the judicial activism of Indonesia’s Constitutional Court as a form of progressive law discovery, assessing its implications for the doctrine of separation of powers and the risk of the Court functioning as a positive legislator. Rooted in the civil law tradition, Indonesian judges undertake Rechtvinding to bridge gaps in codified law, a mandate that intensifies under constitutional review. Employing a doctrinal legal research method, the analysis synthesizes statutory texts, case law, and scholarly commentary through hermeneutic and comparative techniques. Two landmark decisions illustrate contrasting approaches: Decision No. 46/PUU-VIII/2010, where the Court created new norms concerning the civil status of children born out of wedlock, and Decision No. 168/PUU-XXI/2023, which exercised procedural activism by issuing legislative orders on the Job Creation Law. Findings reveal a normative dilemma between fulfilling substantive justice and preserving legislative sovereignty. Excessive use of extensive interpretation risks normative incoherence and undermines checks and balances, whereas procedural activism offers a calibrated mechanism to guide legislative reform without overstepping constitutional boundaries. The study proposes codifying interpretive limits, promoting judicial self-restraint, and enhancing legislative responsiveness to maintain coherent jurisprudence and uphold constitutional supremacy. These recommendations aim to fortify Indonesia’s constitutional order by balancing judicial innovation with the integrity of democratic lawmaking.

Abstract

Pembangunan Industri Pertahanan merupakan salah satu bagian penting dalam menjaga kepentingan nasional yang diwujud nyatakan dalam berbagai bentuk regulasi sampai dengan implementasinya yang dilakukan oleh Komite Kebijakan Industri Pertahanan. Tujuan dari penulisan artikel ini adalah untuk memberikan penjelasan terkait peran dari Komite Kebijakan Industri pertahanan pasca Undang-Undang No. 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja Menjadi Undang-Undang. Metode Penelitian yang di pergunakan adalah penelitian hukum normatif. Melalui metode kajian penelitian normatif, Peneliti bermaksud untuk melakukan suatu kajian terhadap perubahan peran KKIP (Komite Kebijakan Industri Pertahanan) pasca disahkannya Undang-Undang Nomor 6 Tahun 2023. Sebagai hasil kajian, peneliti menemukan bahwa peran dari Komite Kebijakan Indutri Pertahanan dalam menetapkan kebijakan pemenuhan kebutuhan alat pertahanan dan keamanan negara dipindahkan kepada Kementerian pertahanan
