Abstract

The marine pollution caused by the Montara oil spill in Australian waters has created serious challenges to the marine environment in Indonesian waters. This conflict has not been declared terminated until now due to the failure of Australia to exercise its responsibility under the provisions of UNCLOS 1982. The study aims to analyze the firm and concrete efforts that Indonesia can make to hold Australia accountable for the impact of such pollution, as well as the forms of accountability that Australia is supposed to take against Indonesia. This research uses normative legal methods, or library research, through legislative approaches and the study of the rule of law. The findings show that Indonesia can take a diplomatic approach, bring legal claims through international courts, and firmly acknowledge the challenges and economic pressures of withdrawing Australia's accountability. The responsibility of the Australian side should also be insisted on by Indonesia by acting in accordance with the provisions of international law, where there is compensation equal to the territory of Indonesia and the injured parties. Through diplomatic analysis, regional cooperation, and legal approaches, the study contributes to an understanding of the complexity of managing the impact of marine pollution at the international level and the importance of ensuring full accountability in order to preserve the global marine environment.

Abstract

This study focuses on examining the comparison between the principles of general criminal law and military law applied in the justice system, through a comparative method with a normative juridical approach used as a comparative identification process of the two legal systems which includes the process of examination, trial, sentencing and consideration of legal principles. The difference in nature between general criminal law and military law is that general criminal law (Commune delicta) which anyone can carry out, is the opposite of Military Law as a special crime (Delicta proparia) which can only be carried out by certain people, in this case by a military man. Based on a literature study to see the principles of implementing the two laws, this study aims to show how the comparison of the two systems is applied, reviewing aspects of Human Rights, Justice and Legal Certainty in the legal justice system in Indonesia.

Abstract

This study aims to examine how the relevance or legal relationship between the National Resource Management Law and the Indonesian National Army Law. The relationship referred to here wants to examine the aspects of military law and military institutions. We know that after the issuance of the PSDN Law on October 24, 2019 there are several things regulated in it that are closely related to the TNI Law. Especially when talking about the human resources in it (for example the reserve component - komcad). The data collection method is carried out by studying literacy and laws and regulations and conducting qualitative descriptive data analysis to find out how the relationship between the PSDN Law and the TNI Law, especially for the management of human resources - komcad.

Abstract

Hak kesehatan merupakan bagian dari hak asasi manusia yang diakui secara internasional dan nasional, termasuk hak kesehatan gigi bagi anak-anak. Di Indonesia, negara memiliki kewajiban untuk memenuhi hak kesehatan gigi anak sebagaimana tercantum dalam Konstitusi serta berbagai undang-undang dan peraturan yang berlaku. Penelitian ini bertujuan untuk mengeksplorasi peran negara dalam pemenuhan hak kesehatan gigi anak-anak di Indonesia, dengan menitikberatkan pada implementasi kebijakan kesehatan dan kendala yang dihadapi di lapangan. Menggunakan pendekatan yuridis normatif, penelitian ini menganalisis kebijakan, peraturan, serta program-program kesehatan gigi untuk anak, baik di tingkat nasional maupun daerah. Data dikumpulkan melalui studi pustaka, analisis dokumen hukum, serta wawancara dengan tenaga kesehatan dan pakar hukum. Hasil penelitian menunjukkan bahwa meskipun terdapat dukungan kebijakan yang cukup baik di tingkat nasional, implementasinya masih menghadapi berbagai tantangan, seperti ketimpangan akses layanan kesehatan gigi antara wilayah perkotaan dan pedesaan, rendahnya kesadaran masyarakat, serta keterbatasan anggaran dan tenaga kesehatan gigi yang tersebar merata. Oleh karena itu, diperlukan kebijakan yang lebih komprehensif, peningkatan alokasi sumber daya, serta edukasi berkelanjutan kepada masyarakat untuk memastikan pemenuhan hak kesehatan gigi anak secara merata. Penelitian ini memberikan rekomendasi untuk memperkuat peran negara dalam pemenuhan hak kesehatan gigi anak di Indonesia dengan mempertimbangkan aspek distribusi layanan, kesadaran masyarakat, dan dukungan finansial.

Abstract

Jurnal ini membahas perbandingan kebijakan dan dampaknya pada berbagai aspek pembangunan antara era Orde Baru dan Reformasi di Indonesia. Pada era Orde Baru, kebijakan sentralistik berfokus pada stabilitas politik dan pertumbuhan ekonomi melalui pembangunan infrastruktur, meski sering mengorbankan hak asasi manusia. Sebaliknya, era Reformasi ditandai dengan desentralisasi, penguatan demokrasi, dan peningkatan penghormatan terhadap HAM, meskipun dihadapkan pada tantangan seperti fragmentasi politik, konflik sosial, dan ketimpangan pembangunan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan analisis peraturan perundang-undangan serta teori yang relevan. Hasil kajian menunjukkan bahwa meskipun Reformasi membawa kebebasan dan demokrasi yang lebih baik, pelaksanaannya masih menghadapi banyak kendala dalam aspek pemerataan, kualitas pendidikan politik, dan efektivitas tata kelola pemerintahan. Artikel ini menekankan pentingnya kebijakan yang berkelanjutan dan inklusif untuk menjawab tantangan di masa mendatang.

Abstract

This research addressed the resolution of overcrowding as a form of implementing the Convention Against Torture to achieve security stability in prisons and detention centers in Indonesia. Errors in the calculation of prisoner numbers that did not align with the size of detention cells led to the phenomenon of overcrowding. In other words, such conditions could be deemed as torture against inmates. Despite Indonesia's ratification of the Convention Against Torture through Law Number 5 of 1998, torture in sentencing remained a major concern. The aim of this study was to examine the causes and impacts of overcrowding, analyze the phenomenon of overcrowding in Indonesian prisons and detention centers in accordance with the Convention Against Torture, and propose solutions to overcrowding as an implementation of the Convention Against Torture. The research employed a qualitative method with a normative legal approach to comprehend and interpret existing legal provisions and evaluate their implementation, thereby identifying the alignment between applicable law and its implementation. Primary data sources consisted of legislative regulations arranged according to the hierarchy of legal norms. Secondary legal materials included textbooks authored by eminent legal scholars, legal journals, academic opinions, legal cases, jurisprudence, and recent symposium outcomes relevant to the research topic. This study found that the Indonesian government endeavored to expand detention space to minimize torture and suffering that could occur in overcrowded cells, thereby facilitating the achievement of the goals of the Convention Against Torture.

Abstract

This research discusses the Indonesian government's response and foreign policy implications for the formation of AUKUS (Australia, United Kingdom, United States) using a qualitative descriptive approach and constructivism theory. This research using qualitative descriptive method. Through a literature review, this research identifies that the formation of AUKUS has raised concerns among the Indonesian government regarding the potential for conflict escalation and its impact on regional stability, especially in the context of geopolitical competition between AUKUS and China in the Indo-Pacific region. This analysis highlights how constructivist views influence Indonesia's perception of developing regional security dynamics, where large countries compete with each other in global power arrangements. The results of this research provide insight into how Indonesia formulates diplomatic strategies to face new challenges in the regional security sphere, including efforts to maintain the balance of power and strengthen multilateral cooperation in responding to increasingly complex foreign policy dynamics. In conclusion, this research not only describes the Indonesian government's response to AUKUS contextually, but also outlines the foreign policy values ​​that underlie Indonesia's attitudes and policies in facing changing global security dynamics.

Abstract

The application of military law in areas of high security risk presents complex challenges for field commanders. In conditions that are often unstable, such as in border areas or conflict zones, commanders must maintain troop discipline while ensuring the effective implementation of operational tasks. Taking into account the problems in this research, the research method used is a normative legal research method. Normative legal research is an activity that cites aspects originating from positive law. Normative legal research originates from applicable statutory provisions, Jurisprudence or Court Decisions, Legal Theory and Doctrine. This research was mostly carried out on secondary data in libraries. The main challenges faced include the stressed physical and mental condition of soldiers, limited resources, and persistent security threats. Field commanders need to apply military law strictly, but must also be wise in understanding the situations their soldiers face in the field. Additionally, they must make quick and sound decisions under pressure, often without adequate logistical or communications support from central command. Commanders must also consider the geopolitical impact of military actions in border areas, where any breach of discipline could affect the stability of local security as well as diplomatic relations. Therefore, adaptive leadership capabilities, deep contextual understanding, and good risk management are the keys to success in implementing military law in areas with high security risks.

Abstract

The problem of disciplinary violations committed by soldiers is a sensitive issue considering the vital role of the military in maintaining the security and sovereignty of the country, therefore the role of Ankum as a direct superior who provides disciplinary law is very important for soldiers. Abstract

This research examines the dilemma between national security and human rights protection in the context of emergency constitutional law in Indonesia. Through a juridical-normative approach, this study analyzes the balance between state authority in dealing with emergencies and the obligation to protect citizens' human rights. The findings indicate that although the state can restrict human rights during emergencies, such restrictions must comply with the principles of necessity and proportionality and not violate non-derogable rights. Indonesia's experience implementing emergency constitutional law, such as in the cases of DOM Aceh and the COVID-19 pandemic response, demonstrates the importance of regulatory reform to create a more comprehensive legal framework in maintaining a balance between national security and human rights protection. This research recommends updating the State of Emergency Law to align with current developments and strengthen oversight mechanisms to prevent abuse of emergency powers.
